program</header><subsection id="idDB9D620E88F84FD4A9E2476D8421E9EB"><enum>(a)</enum><header>Purposes</header><text>Section 1240(3) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa">16 U.S.C. 3839aa(3)</external-xref>) is amended—</text><paragraph id="id52CD5D9E8DBB443E9C479ED24020C934"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="idDF035E06FB654CAB812D34A13CC10C75"><enum>(2)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end; id="idC40209745B0D4714805F445E7727893A"><enum>(D)</enum><text>$5,000,000,000 for each of fiscal years 2024 through 2030.</text></subparagraph></paragraph><paragraph id="id5FB7F14BEC944DA58FA265B0A8185C2B"><enum>(3)</enum><header>Set-asides for socially disadvantaged and beginning farmers and ranchers</header><text>Of the funds set aside under each of paragraphs id="id2E55DF9FEA0E4CF4A501B7D5D927D9C6"><enum>(1)</enum><header>In general</header><text>Of the funds of the Commodity Credit Corporation, the Secretary of Agriculture shall use $100,000,000 for each of fiscal years 2021 through 2030 to carry out, through the Administrator of the Agricultural Research Service, the research mission of the Department of Agriculture with respect to the issues described in clauses (i) through (iv) of subparagraph (G) of subsection (b)(2) of the Competitive, Special, and Facilities Research Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/7/3157">7 U.S.C. 3157(b)(2)</external-xref>).</text></paragraph><paragraph commented="no" id="id09DA14E4607A4DF9803034D2841E0DE9"><enum>(2)</enum><header>Set-aside</header><text>The Secretary of Agriculture shall set aside 25 percent of the amounts made available by paragraph (1) for research relating to pulse crops, other legumes, and high-biomass crops.</text></paragraph></subsection><subsection id="idBF99FEE164EB4505A66DC2137E823FE6"><enum>(c)</enum><header>Foundation for Food and Agriculture Research</header><text>Section 7601 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/5939">7 U.S.C. 5939</external-xref>) is amended—</text><paragraph id="id57F4793F674D4604B90770C886E5FABC"><enum>(1)</enum><text>in subsection (c)(1)(D), by inserting after <quote>environment</quote> the following:</text><quoted-block style="OLC" id="idC68BAA2379D045F9B6B77D86B462596F"><enum>(iv)</enum><text>increasing soil carbon levels</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id1A258BED63384601AB91940A77C87A3E"><enum>(2)</enum><text>in subsection (g)(1)(A), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8E5AAA6CCD48407A998D071809647A38"><clause id="id45E5FBA6A12A47F9A515B63E1AEB2288"><enum>(iii)</enum><header>Climate stewardship funding</header><text>On the date of enactment of the <short-title>Climate Stewardship Act of 2021</short-title>, and each fiscal year thereafter through fiscal year 2030, of the funds of the Commodity Credit Corporation, the Secretary shall transfer to the Foundation $40,000,000 to advance the research mission of the Department with respect to the issues described in clauses (i) through (iv) of subsection (c)(1)(D), to remain available until expended.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idE9DC06FC84E24C15841B6DA9FB60867F"><enum>(d)</enum><header>Sustainable agriculture research and extension projects</header><text>Section 1621 of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5811">7 U.S.C. 5811</external-xref>) is amended—</text><paragraph id="id09637D60297C40EDBC215F25AE3EF79E"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id371866BFE29749428640BC861B39DA76"><enum>(A)</enum><text>in paragraph (1)(C), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph and</text></subparagraph><subparagraph id="id0E574ADDF64F46AEB2C83611B158EE80"><enum>(B)</enum><text>5 percent to provide assistance under this section to beginning farmers and ranchers (as defined in that section (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>)).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section commented="no" id="id76A69E991CC0415C9767AFDC418A1948"><enum>109.</enum><header>Local Agriculture Market Program</header><text display-inline="no-display-inline">Section 210A(i)(1) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1627c">7 U.S.C. 1627c(i)(1)</external-xref>) is amended by striking <quote>$50,000,000 for fiscal year 2019</quote> and inserting <quote>$500,000,000 for fiscal year 2021</quote>.</text></section><section id="ida97686f4d5a549a3a5c92c5fb00283f8"><enum>110.</enum><header>Soil health equipment grant program</header><subsection id="id84217798efbc428eaf61ad976ade5cf2"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ida471d8bb71734b508da8575df0ec38d6"><enum>(1)</enum><header>Eligible land</header><text>The term <term>eligible land</term> means land on which agricultural commodities, livestock, or forest-related products are produced.</text></paragraph><paragraph id="iddf1d9bebaad74710ab152c8b73238f55"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="id1a812f82694b4c74be62e452a4ff6ba6"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a program under which the Secretary shall award grants to agricultural producers to acquire equipment for the purpose of implementing climate stewardship practices (as defined in section 1240A of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-1">16 U.S.C. 3839aa–1</external-xref>)) on eligible land to increase soil health.</text></subsection><subsection id="idfe11dabf0e6841d3a9e9e9c5838b601c"><enum>(c)</enum><header>Priority</header><text>In providing grants under subsection (b), the Secretary shall give priority to equipment for—</text><paragraph id="id945390DB6DE94BBCBE38851464E2FF83"><enum>(1)</enum><text>projects to carry out nonchemical termination of cover crops; and</text></paragraph><paragraph id="id971DBDC08CC142B79B8EB0FCA3CCAF14"><enum>(2)</enum><text>on-farm composting facilities.</text></paragraph></subsection><subsection id="id87ef996fa85e4053adb45e96413851dd"><enum>(d)</enum><header>Funding</header><paragraph id="id81B1369ED17547D09D20A13612EA209B"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $100,000,000 for each of fiscal years 2021 through 2030.</text></paragraph><paragraph id="idA7C90BA4231445278174C2A579549917"><enum>(2)</enum><header>Set-asides for socially disadvantaged and beginning farmers and ranchers</header><text>Of the amount made available under paragraph (1), the Secretary shall set aside—</text><subparagraph id="id026BA2455F58424D8193670A887D8EBF"><enum>(A)</enum><text>5 percent to provide assistance to socially disadvantaged farmers and ranchers (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>)); and</text></subparagraph><subparagraph id="idF6ABB205A2CB40FE84FFA97711D74CA0"><enum>(B)</enum><text>5 percent to provide assistance to beginning farmers and ranchers (as defined in that section (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>)). </text></subparagraph></paragraph></subsection></section><section id="idf423795e69c241e8831cb9485754a094"><enum>111.</enum><header>Farm and ranch stress assistance network</header><text display-inline="no-display-inline">Section 7522 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/5936">7 U.S.C. 5936</external-xref>) is amended by striking subsection (d) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9D31422C6B994434ACD6ACAB2D14412E"><subsection id="id938717EAF6944BBEA35855EC388C03EA"><enum>(d)</enum><header>Mandatory funding</header><text display-inline="yes-display-inline">Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $10,000,000 for each of fiscal years 2021 through 2030.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id92f881c6905840ffb61317472cb739fe"><enum>112.</enum><header>Assistance for community food projects</header><text display-inline="no-display-inline">Section 25 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2034">7 U.S.C. 2034</external-xref>) is amended—</text><paragraph id="id4772D2B20CC34FE3AAB60A7434518224"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph id="id9A83014836544BC5B22401D11DAB9A64"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>including amounts made available under subsection (i) to carry out this section,</quote> after <quote>Act,</quote>; and</text></clause></subparagraph><subparagraph id="id029FB2BB61664C7AA27E5AD982A8824A"><enum>(B)</enum><text>that is determined to be in need of active reforestation based on field surveys assessing regeneration potential;</text></subparagraph></paragraph><paragraph id="id4CA948FF92064BE4A153797FBC342922"><enum>(3)</enum><text>to carry out the Reforest America Grant Program established under section 6 of the Cooperative Forestry Assistance Act of 1978;</text></paragraph><paragraph id="id190E7773DFC54AEF8D5FE1499DBA80C1"><enum>(4)</enum><text>to carry out the Forest Stewardship Practice Program established under section 7B of the Cooperative Forestry Assistance Act of 1978;</text></paragraph><paragraph commented="no" id="id0fc5b1845ba34b2388b41210ebebd27f"><enum>(5)</enum><text>to carry out the urban wood programs established under section 21 of the Cooperative Forestry Assistance Act of 1978;</text></paragraph><paragraph commented="no" id="id149DC149D9F84093A3E87F57D212C54D"><enum>(6)</enum><text>to operate the Stewardship Corps established under section 206 of the <short-title>Climate Stewardship Act of 2021</short-title>; or </text></clause><clause id="idF08629CFB2814F1991352FED1BF64993" indent="up1"><enum>(ii)</enum><text>to reclaim abandoned mine land, an orphaned oil or gas well, or a decommissioned logging road or landing; and </text></clause></subparagraph><subparagraph id="id5FA45B2A129648EBBD808FADB0151AF5"><enum>(B)</enum><text>that is determined to be in need of active reforestation based on field surveys assessing regeneration potential and is managed by the Bureau of Land Management; and</text></subparagraph></paragraph><paragraph id="id96510916737944698db526c00155485a"><enum>(2)</enum><text>land that is determined to be in need of active reforestation and is managed by the Bureau of Indian Affairs, by planting—</text><subparagraph id="id6628EE12D68A4BA294BF06233E1F972A"><enum>(A)</enum><text>to the maximum extent practicable, 12,500,000 trees in each of calendar years 2021 and 2022;</text></subparagraph><subparagraph id="id3AF6F96F6F9B4294BB1D8261D7FB4AFB"><enum>(B)</enum><text>to the maximum extent practicable, 25,000,000 trees in each of calendar years 2023 and 2024;</text></subparagraph><subparagraph id="id66AFC24E2C4749469A8BBD7A74A14156"><enum>(C)</enum><text>to the maximum extent practicable, 37,500,000 trees in each of calendar years 2025 and 2026; and</text></subparagraph><subparagraph id="id41FBB1E684C446748D1D1F7084DBC0DF"><enum>(D)</enum><text>to the maximum extent practicable, 50,000,000 trees in—</text><clause id="idE70E3A1C4D2845D3A645C6EC65169126"><enum>(i)</enum><text>each of calendar years 2027 through 2029; and</text></clause><clause id="idA5605215445D40E6A229E8F403CC6FD0"><enum>(ii)</enum><text>the period beginning on January 1, 2030, and ending on September 30, 2030.</text></clause></subparagraph></paragraph></subsection><subsection id="id60585DD8D17C46618D89E76C55C578EE"><enum>(f)</enum><header>Reforestation</header><paragraph commented="no" display-inline="no-display-inline" id="id2651B3D6F3C74497B53F2199189E43D0"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of connectivity</header><text>In this subsection, the term <quote>connectivity</quote> means the degree to which the landscape facilitates native species movement.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34D637D601004AABBA97993F1157688F"><enum>(2)</enum><header>Reforestation</header><subparagraph commented="no" display-inline="no-display-inline" id="id00776456942A4604A1F62EADDA5EB689"><enum>(A)</enum><header>In general</header><text>Reforestation under subsections (d)(2) and (e) shall consist of ecologically based site preparation, tree planting, and subsequent management using practices that—</text><clause commented="no" display-inline="no-display-inline" id="id50B8131513094A439EF77C07F9F3B030"><enum>(i)</enum><text>are informed by climate change science and the importance of spatial pattern;</text></clause><clause commented="no" display-inline="no-display-inline" id="idCA5F999748CF4A6F9367B4F304D3D8BF"><enum>(ii)</enum><text>enhance forest health, resilience, and biodiversity; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id05B0892CB1624B62BDC1BB705D0BD778"><enum>(iii)</enum><text>reduce vulnerability to future forest mortality and catastrophic wildfire.</text></clause></subparagraph><subparagraph id="idd183a42c9fca4bb2aee53b31af3c45be"><enum>(B)</enum><header>Post-wildfire reforestation</header><text>In the case of reforestation under subsections (d)(2) and (e), sums available in the Trust Fund shall not be used for post-wildfire salvage logging.</text></subparagraph></paragraph><paragraph id="idB514BC1F0B04486BA85D8CFB0A2F62B5"><enum>(3)</enum><header>Priority</header><text>In carrying out reforestation under subsections (d)(2) and (e), the Chief of the Forest Service and the Secretary of the Interior, as applicable, shall give priority to planting—</text><subparagraph id="id5874cbe90c8149b1941ace6eb4dd8574"><enum>(A)</enum><text>that will restore and maintain resilient landscapes;</text></subparagraph><subparagraph id="id96B51E6612994CDC90521A149E3EBC5E"><enum>(B)</enum><text>on land on which the planting provides increased habitat connectivity for wildlife; and</text></subparagraph><subparagraph id="idea9abce963f542338aea4242b57a49e8"><enum>(C)</enum><text>that will provide the largest potential long-term increase in carbon sequestration.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id40180F8333084944A8BA5062DBF31921"><enum>(g)</enum><header>Mandatory funding</header><text>To carry out paragraphs (2) through (6) of subsection (d) and subsection (e), the Secretary of the Treasury shall transfer from the general fund of the Treasury into the Trust Fund $5,500,000,000 for each of fiscal years 2021 through 2030.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ide1b7296bb5484d4abf1ea5f8bf7880c9"><enum>(b)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture and the Secretary of the Interior shall issue regulations necessary to carry out the amendments made by this section.</text></subsection></section><section id="id27ece5b671ce4660a8c42df51283ff35"><enum>202.</enum><header>Reforest America Grant Program</header><text display-inline="no-display-inline">The Cooperative Forestry Assistance Act of 1978 is amended by inserting after section 5 (<external-xref legal-doc="usc" parsable-cite="usc/16/2103a">16 U.S.C. 2103a</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb1854e83382d4a07a351c418ed2581e2"><section id="id80bf9eb7d73f4a43ae831550ec5941a7"><enum>6.</enum><header>Reforest America Grant Program</header><subsection id="id51f7bfd0e4b048eca814ddcae62e0e92"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id7bd3844de68743ce9246a953f8cb4274"><enum>(1)</enum><header>Community of color</header><text>The term <term>community of color</term> means, in a State, a census block group in an urban area for which the aggregate percentage of residents who identify as Black, African-American, Asian, Pacific Islander, Hispanic, Latino, other nonwhite race, or linguistically isolated is—</text><subparagraph id="id2EA598DC89D64A9093B718441D9C0AD3"><enum>(A)</enum><text>not less than 50 percent; or</text></subparagraph><subparagraph id="idBA8D90867CA6462D877858DC9C5F9BFA"><enum>(B)</enum><text>is significantly higher than the State average.</text></subparagraph></paragraph><paragraph id="id9a6d550322a64a679ab10a8f42d312f3"><enum>(2)</enum><header>Eligible cost</header><text>The term <quote>eligible cost</quote> means, with respect to a project of an eligible entity under the Program—</text><subparagraph id="id67efc0a338824e459e599c13417a7f73"><enum>(A)</enum><text>the cost of implementing a reforestation project, including by—</text><clause id="id058e5152926147a5b3abb5bc9721419e"><enum>(i)</enum><text>planning and designing the reforestation activity, including considering relevant science;</text></clause><clause id="idd7673ece7fa246818043ca2d2852b8b9"><enum>(ii)</enum><text>establishing tree nurseries;</text></clause><clause id="id87d1f2ae634549d5955b84364a2e7312"><enum>(iii)</enum><text>purchasing trees; and</text></clause><clause id="id6320562fe3fc48e087f7be68f8e6ac8a"><enum>(iv)</enum><text>ecologically based site preparation, including the labor and cost associated with the use of machinery;</text></clause></subparagraph><subparagraph id="idaf861454b105460aa461f4a2b9811840"><enum>(B)</enum><text>the cost of maintaining and monitoring planted trees for a period of up to 3 years to ensure successful establishment of the trees;</text></subparagraph><subparagraph id="id3051a1b9e5f64dc5b07a29f51fc5cf52"><enum>(C)</enum><text>with respect to reforestation in an urban area under subsection (e) in a low income community that has an existing tree canopy cover of not more than 20 percent, not more than 50 percent of the cost of the maintenance of any nearby tree canopy; and</text></subparagraph><subparagraph id="id076BAAFDAB774161ADF5A093F92D4830"><enum>(D)</enum><text>any other relevant cost, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="idefb8661bdde3491eb21e23add99540aa"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id767C1C55FEBF4CFAB691F16F39EA9070"><enum>(A)</enum><text>a State agency;</text></subparagraph><subparagraph id="id6D7EEEF7E88B4049B65578A558E53826"><enum>(B)</enum><text>a local governmental entity;</text></subparagraph><subparagraph id="id613CDA0141CF451885BA0F4F7DF9FA79"><enum>(C)</enum><text>an Indian Tribe; and</text></subparagraph><subparagraph id="idBA88B754291F415DBB12EC6E9FFF80BC"><enum>(D)</enum><text>a nonprofit organization.</text></subparagraph></paragraph><paragraph id="id5c16e736c1344b1b837f6e0f4d98e9f7"><enum>(4)</enum><header>Eligible land</header><subparagraph id="idC028A869CD274E74AF23B4EAC612B699"><enum>(A)</enum><header>In general</header><text>The term <quote>eligible land</quote> means—</text><clause id="idD4E6889D1E33416591698D798F8F2127"><enum>(i)</enum><text>land owned in fee simple by an eligible entity—</text><subclause id="idec9d062922c94a6cb42e7eb30ad4d9a8"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="id9E7B8026C21D47DD89E25009199EC4C8"><enum>(aa)</enum><text>for which, at the time of application to the Program under subsection (c), the forest stocking level of the land is less than 25 percent of regional norms for forest properties with comparable tree species and soil characteristics; and</text></item><item id="id0080018492A9466D9687A2F99C46A1C9" indent="up1"><enum>(bb)</enum><text>that is in need of active reforestation due to events such as—</text><subitem id="idDD7D8E24045147A0A1DA7B92014108A3"><enum>(AA)</enum><text>high-intensity wildfire;</text></subitem><subitem id="idF7762D468F284AF4ACFAC3FF6FAB2B19"><enum>(BB)</enum><text>pest infestation;</text></subitem><subitem id="id1BF3B00246F94B5EAA2A623EC7EDAD27"><enum>(CC)</enum><text>invasive species; and</text></subitem><subitem id="id66D5BF860C934457BB5385F7945330ED"><enum>(DD)</enum><text>drought and other extreme weather; or</text></subitem></item></subclause><subclause id="id59deb68ab3734f2eb135d2d5a15753cd"><enum>(II)</enum><text>that was formerly forest land and has been abandoned or incompletely reclaimed from mining, commercial development, clearing for agriculture, or other nonforest use; and</text></subclause></clause><clause id="id0A6563439245421287FA7B11AD51A28F"><enum>(ii)</enum><text>with respect to reforestation in an urban area under subsection (e), land in that urban area that is owned in fee simple by an eligible entity.</text></clause></subparagraph><subparagraph id="id3016626395d54a83a89d0a414abfe9e6"><enum>(B)</enum><header>Exclusion</header><text>The term <quote>eligible land</quote> does not include land on which the eligible entity conducted a timber harvest—</text><clause id="id2286F34131044FC3A1BFC528D117DC16"><enum>(i)</enum><text>not later than 5 years before the date on which the eligible entity submits an application under subsection (c); and</text></clause><clause id="idF2E1C0B767324F45B9EFE813CF7643E9"><enum>(ii)</enum><text>that resulted in a forest stocking level described in subparagraph (A)(i)(I)(aa).</text></clause></subparagraph></paragraph><paragraph id="id45b89934a3ee489cac6116eebc4c6bd7"><enum>(5)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id184c4bf9467146cebbce04def03c3f6e"><enum>(6)</enum><header>Local governmental entity</header><text>The term <term>local governmental entity</term> means any municipal government or county government with jurisdiction over local land use decisions.</text></paragraph><paragraph id="id02e31ae933a646b29be90df8701edbb0"><enum>(7)</enum><header>Low income community</header><text>The term <term>low income community</term> means any census block group in an urban area in which not less than 30 percent of the population lives below the poverty line (as defined in section 673 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902</external-xref>)).</text></paragraph><paragraph id="id06201de174774db882853e32787f1474"><enum>(8)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization that—</text><subparagraph id="idffb34d39d1294bfdad02d05a802cbab6"><enum>(A)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(h)(3)</external-xref> of the Internal Revenue Code of 1986; and</text></subparagraph><subparagraph id="idf275fdcc6a9b45fe9e2a2cff95a1eb8c"><enum>(B)</enum><text>operates in accordance with 1 or more of the purposes described in section 170(h)(4)(A) of that Code.</text></subparagraph></paragraph><paragraph id="idf65064d19eca4e2f9dc5024b34239a22"><enum>(9)</enum><header>Program</header><text>The term <term>Program</term> means the Reforest America Grant Program established under subsection (b)(1).</text></paragraph><paragraph id="id66199921cf174bf4b1309933408bdab6"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph><paragraph id="idaae45c66118e40c3825eb6fa13623c1c"><enum>(11)</enum><header>Urban area</header><text>The term <term>urban area</term> means an area identified by the Bureau of the Census as an <quote>urban area</quote> in the most recent census.</text></paragraph></subsection><subsection id="id1fa5dc70c862456dbf4aecf18b6a58fd"><enum>(b)</enum><header>Establishment</header><paragraph id="id040AB3E9CF5E447A88DB5477CCC96441"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a program, to be known as the <quote>Reforest America Grant Program</quote>, under which the Secretary shall award grants to eligible entities to conduct projects to reforest eligible land in accordance with this section.</text></paragraph><paragraph id="idEBD4075FF16346CD9B08409D6C9F079A"><enum>(2)</enum><header>Reforestation</header><text>In carrying out the Program, the Secretary shall, to the maximum extent practicable, award sufficient grants each year to plant—</text><subparagraph id="id770FC510EF204E51BF665FE4DC334386"><enum>(A)</enum><text>50,000,000 trees in each of calendar years 2021 and 2022;</text></subparagraph><subparagraph id="id16F48AED9FFF447288505AA26897D499"><enum>(B)</enum><text>100,000,000 trees in each of calendar years 2023 and 2024;</text></subparagraph><subparagraph id="id0A0FEF0FA8C84FF79CEB2D4FC941C59F"><enum>(C)</enum><text>150,000,000 trees in each of calendar years 2025 and 2026; and</text></subparagraph><subparagraph id="id6B96E455DFEA42898D5F5D2D358A7213"><enum>(D)</enum><text>250,000,000 trees in—</text><clause id="id7CE40563537844F1A98A9928D9255FE6"><enum>(i)</enum><text>each of calendar years 2027 through 2029; and </text></clause><clause id="idC1B66B04704F47EDB4D15E5CC3A7E89C"><enum>(ii)</enum><text>the period beginning on January 1, 2030, and ending on September 30, 2030.</text></clause></subparagraph></paragraph></subsection><subsection id="id23ea9f31739449819589d1f4ba4a0251"><enum>(c)</enum><header>Applications</header><paragraph id="idB251F0FAF9A244D4B8BFEB3EBD928E89"><enum>(1)</enum><header>In general</header><text>An eligible entity that seeks to receive a grant under the Program shall submit an application at such time, in such form, and containing such information as the Secretary may require, including the information described in paragraph (2), to—</text><subparagraph id="id7fef7f76bea94c239c0a5c497015f470"><enum>(A)</enum><text>the State forester or equivalent official of the State in which the eligible entity is located; or</text></subparagraph><subparagraph id="id540EE7520BAE4C2E80355D1DEBE66854"><enum>(B)</enum><text>in the case of an eligible entity that is an Indian Tribe, an official of the governing body of the Indian Tribe.</text></subparagraph></paragraph><paragraph id="id188390F6041044B0A0862CDF0AB708AF"><enum>(2)</enum><header>Contents</header><text>An application submitted under paragraph (1) shall include—</text><subparagraph id="id2ab7d00d496d41269561bd8547d6ede4"><enum>(A)</enum><text>the reason that the forest stocking level of the land is less than 25 percent of regional norms for forest properties with comparable tree species and soil characteristics, if applicable;</text></subparagraph><subparagraph id="id607cff684d5b474f9c04af1c204505d7"><enum>(B)</enum><text>the natural, economic, and environmental benefits of returning the eligible land to forested condition;</text></subparagraph><subparagraph id="id87ee9dd87011404dbc214826fdcb7ef6"><enum>(C)</enum><text>an estimate of the annual carbon sequestration that will be achieved by the replanted forests, using processes determined by the Secretary;</text></subparagraph><subparagraph id="id857f9a7405444acf959a3312397a8197"><enum>(D)</enum><text>a reforestation plan that includes—</text><clause id="ide11026fc43bd42fc9b239c8229e29995"><enum>(i)</enum><text>a list of expected eligible costs;</text></clause><clause id="id1d951669909a480f87bca7afa2a7cb6e"><enum>(ii)</enum><text>a description of the site preparation and the tree species to be planted;</text></clause><clause id="id2C81B7707B6A400CBBBB1F1C9DCD8C1E"><enum>(iii)</enum><text>a description of the manner in which the design of the project is informed by climate change science and will enhance forest health, resilience, and biodiversity;</text></clause><clause id="id08cf29c08b854c308f2d72113a5f582e"><enum>(iv)</enum><text>an explanation of the manner in which the land will be maintained for 36 months after planting to ensure successful establishment; and</text></clause><clause id="id6cf7ab51516a41249a370f9d320b5e16"><enum>(v)</enum><text>an explanation of the manner in which the land will be managed later than 36 months after planting, including whether that management shall include a timber harvest;</text></clause></subparagraph><subparagraph id="idD53445BDC23B47CA98C97CF1510EF0E1"><enum>(E)</enum><text>in the case of an application for an urban reforestation project under subsection (e)—</text><clause commented="no" id="idA8A867873E20497493684EE86491986D"><enum>(i)</enum><text>a description of the manner in which the tree planting shall address disparities in local environmental quality, such as lower tree canopy cover; and</text></clause><clause id="idf37ba9a67035422995fe64587aafdc13"><enum>(ii)</enum><text>a description of the anticipated community and stakeholder engagement in the project; and</text></clause></subparagraph><subparagraph id="id109eb2c7d7f1403fb3c2b2ffbfc8d870"><enum>(F)</enum><text>any other relevant information required by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" id="idabfb2512c19e4881b52da82dfc840b5a"><enum>(3)</enum><header>Applications to Secretary</header><text>Each official that receives an application under paragraph (1) shall submit the application to the Secretary with a description of the application and any other relevant information that the Secretary may require.</text></paragraph></subsection><subsection id="id6B954E3B8EC14506908EC3EDE0611538"><enum>(d)</enum><header>Priority</header><paragraph id="id7A403625578C4D728D06BC2D39F80785"><enum>(1)</enum><header>Definition of connectivity</header><text>In this subsection, the term <quote>connectivity</quote> means the degree to which the landscape facilitates native species movement.</text></paragraph><paragraph id="idE2CD76D2384F4D898A7E9907D2481B4D"><enum>(2)</enum><header>Priority</header><text>In awarding grants under the Program, the Secretary shall give priority—</text><subparagraph id="idb396fc4eebbf42c698731655d4678f9b"><enum>(A)</enum><text>to projects that provide the largest potential increase in carbon sequestration per dollar;</text></subparagraph><subparagraph id="id6E51CF0748344063B28AE780DD31A684"><enum>(B)</enum><text>to projects that provide increased habitat connectivity for wildlife;</text></subparagraph><subparagraph id="idfa581047affc41fc8763f5d8e6e6910b"><enum>(C)</enum><text>to projects under which an eligible entity will enter into a contract or cooperative agreement with 1 or more qualified youth or conservation corps (as the term is defined in section 203 of <external-xref legal-doc="public-law" parsable-cite="pl/91/378">Public Law 91–378</external-xref> (commonly known as the <quote>Youth Conservation Corps Act of 1970</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/1722">16 U.S.C. 1722</external-xref>)); and</text></subparagraph><subparagraph id="id4DA32D9B7A364080A28806002130B329"><enum>(D)</enum><text>in the case of urban reforestation projects under subsection (e), to projects that—</text><clause id="ida6dae602116942f3ab5fd79e5d42d174"><enum>(i)</enum><text>are located in a community of color or a low-income community;</text></clause><clause id="idE3219F33F67141269AD5E5CFF7941B6B"><enum>(ii)</enum><text>are located in a neighborhood with poor local environmental quality, including lower tree canopy cover and higher maximum daytime summer temperatures;</text></clause><clause id="id99b2816929284bc7b605ad0704c2d124"><enum>(iii)</enum><text>are located in a neighborhood with high amounts of senior citizens or children;</text></clause><clause id="id919cce9e2d7d4b68a1588008080d5809"><enum>(iv)</enum><text>are located immediately adjacent to large numbers of residents;</text></clause><clause id="idbed6c3f07e7546b0ad5ce087983218de"><enum>(v)</enum><text>will collaboratively engage neighbors and community members that will be closely affected by the tree planting in as many aspects of project development and implementation as possible; and</text></clause><clause id="id9c5ef7424b064c8cb1c310b4916476fc"><enum>(vi)</enum><text>will employ a substantial percentage of the workforce locally, with a focus on engaging unemployed and underemployed persons in communities of color and low-income communities.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="id292b58249aa7443daf70f499020d1f2b"><enum>(e)</enum><header>Urban reforestation</header><paragraph commented="no" id="idBDDCAA4665F14F3993D37BD1F056B2FF"><enum>(1)</enum><header>In general</header><text>In carrying out the Program, the Secretary shall award sufficient grants each year to projects carried out in urban areas to plant, to the maximum extent practicable—</text><subparagraph id="ida672cd3822294617b6557c440e702f71"><enum>(A)</enum><text>5,000,000 trees in each of calendar years 2021 through 2023;</text></subparagraph><subparagraph id="idf563234241dd47149f440b435fa5da40"><enum>(B)</enum><text>10,000,000 trees in each of calendar years 2024 through 2027; and</text></subparagraph><subparagraph id="id959de039fd2e455e96c6f2531b2a6ca3"><enum>(C)</enum><text>15,000,000 trees in each of calendar years 2028 through 2030.</text></subparagraph></paragraph><paragraph commented="no" id="idCC750C02189F439A94C0D78DB331F9D6"><enum>(2)</enum><header>Federal share</header><text>The Secretary shall award a grant to an eligible entity under the Program to conduct a reforestation project in an urban area in an amount equal to not more than 90 percent of the cost of reforesting the eligible land, as determined by the Secretary.</text></paragraph><paragraph commented="no" id="idCF9B3A39C28F46C7ACE7AF8B30A2B4B6"><enum>(3)</enum><header>Matching requirement</header><text>As a condition of receiving a grant described in paragraph (2), an eligible entity shall provide, in cash or through in-kind contributions from non-Federal sources, matching funds in an amount equal to not less than 10 percent of the cost of reforesting the eligible land, as determined by the Secretary.</text></paragraph></subsection><subsection id="id6317f2471b8c400580dd8f799ef56979"><enum>(f)</enum><header>Prohibited conversion to nonforest use</header><paragraph id="id9682C41B71E540078893F73F943CFA06"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), an eligible entity that receives a grant under the Program shall not sell or convert land that was reforested under the Program to nonforest use.</text></paragraph><paragraph id="id8c412c124fc84eb2a4810211ef1c3d95"><enum>(2)</enum><header>Reimbursement of funds</header><text>An eligible entity that receives a grant under this Program and sells or converts land that was reforested under the Program to nonforest use shall pay to the Federal Government an amount equal to the greater of—</text><subparagraph id="id89AB1FCA82C84E13AA340A687B8E9F4E"><enum>(A)</enum><text>the amount of the grant; and</text></subparagraph><subparagraph id="id5F37B3CAD4734820BF7E67E43FB77CF5"><enum>(B)</enum><text>the current appraised value of timber stocks on that land.</text></subparagraph></paragraph><paragraph id="id489c0297eb8b418d814b870e0afe0408"><enum>(3)</enum><header>Loss of eligibility</header><text>An eligible entity that receives a grant under this Program and sells or converts land that was reforested under the Program to nonforest use shall not be eligible for additional grants under the Program.</text></paragraph></subsection><subsection commented="no" id="id65A452B49FD74840B4B46DA3FAA0EEDD"><enum>(g)</enum><header>Costs</header><paragraph id="ide0cb918b4e404e4b9e9e01d2d035ebd1"><enum>(1)</enum><header>Federal share</header><text>Unless otherwise provided under this section, the Secretary shall award a grant to an eligible entity under the Program in an amount equal to not more than 75 percent of the cost of reforesting the eligible land, as determined by the Secretary.</text></paragraph><paragraph id="idbc9616709bfb44a0aaeda0a30d22ca74"><enum>(2)</enum><header>Matching requirement</header><text>Unless otherwise provided under this section, as a condition of receiving a grant under the Program, an eligible entity shall provide, in cash or through in-kind contributions from non-Federal sources, matching funds in an amount equal to not less than 25 percent of the cost of reforesting the eligible land, as determined by the Secretary.</text></paragraph></subsection><subsection id="ida3c8ecd84be6433f8e0b2b89205b1bd6"><enum>(h)</enum><header>Planting survival</header><text>An eligible entity that receives a grant under the Program shall—</text><paragraph id="idededfcd0bcb54b6296939df2ee801488"><enum>(1)</enum><text>not later than 36 months after planting has been completed using the grant funds, submit to the responsible State or Tribal official, as applicable, a monitoring report that describes project implementation, including the survival rate of all plantings made under the grant; and</text></paragraph><paragraph id="id7ffdefd7bf0f41c7941b2220317cb73f"><enum>(2)</enum><text>if the survival rate reported in the monitoring report under paragraph (1) is, after 36 months, less than the required minimum survival rate for the geographic area in which the planting is located, as determined by a State forester or equivalent State or Tribal official, as applicable, replant tree seedlings in a quantity equivalent to half of the original planting, using comparable means to the original planting.</text></paragraph></subsection><subsection commented="no" id="idbdfd65e0cf704d1ebe4fd2a43063806b"><enum>(i)</enum><header>Prevailing wage requirement</header><text>Any contractor or subcontractor entering into a service contract in connection with a project under the Program shall—</text><paragraph commented="no" id="id5EAC9AEAE7E24C30A1A214B17C8F210B"><enum>(1)</enum><text>be treated as a Federal contractor or subcontractor for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/67">chapter 67</external-xref> of title 41, United States Code (commonly known as the <quote>McNamara-O'Hara Service Contract Act of 1965</quote>); and</text></paragraph><paragraph id="id6b980bc7081549fea604156e5b6844d9"><enum>(2)</enum><text>pay each class of employee employed by the contractor or subcontractor wages and fringe benefits at rates in accordance with prevailing rates for the class in the locality, or, where a collective-bargaining agreement covers the employee, in accordance with the rates provided for in the agreement, including prospective wage increases provided for in the agreement.</text></paragraph></subsection><subsection commented="no" id="id6C6D3738A787458783451E4E16F83941"><enum>(j)</enum><header>Report</header><text>The Secretary shall annually submit to the relevant committees of Congress a report that describes the activities of the Program, including the total amount of carbon sequestered by replanted forests during the year covered by the report.</text></subsection><subsection id="idcce21c8828724ee8a23092e21deb6288"><enum>(k)</enum><header>Funding</header><paragraph id="id701A92716A91499D9BE179982C29E642"><enum>(1)</enum><header>In general</header><text>Of the funds of the Reforestation Trust Fund established under section 303 of <external-xref legal-doc="public-law" parsable-cite="pl/96/451">Public Law 96–451</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1606a">16 U.S.C. 1606a</external-xref>), the Secretary shall use such sums as are necessary to carry out the Program.</text></paragraph><paragraph id="id293338566576406ca2e7e10b0bff2d87"><enum>(2)</enum><header>Administrative costs and technical assistance</header><text>Of the funds used under paragraph (1), the Secretary shall allocate not more than 10 percent for each fiscal year to State foresters or equivalent officials, including equivalent officials of Indian Tribes, for administrative costs and technical assistance under the Program.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id4EBC05706E63465AB6BC66C46C572C73"><enum>203.</enum><header>Funding for the community forest and open space conservation program</header><text display-inline="no-display-inline">In addition to amounts otherwise made available, of the funds of the Reforestation Trust Fund established under section 303 of <external-xref legal-doc="public-law" parsable-cite="pl/96/451">Public Law 96–451</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1606a">16 U.S.C. 1606a</external-xref>), the Secretary of Agriculture shall use $100,000,000 for each of fiscal years 2021 through 2030 to carry out the community forest and open space conservation program established under section 7A of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2103d">16 U.S.C. 2103d</external-xref>).</text></section><section id="id2DA0BCB14AA1436CAE113BFDBF10B3D5"><enum>204.</enum><header>Forest Stewardship Practice Program</header><text display-inline="no-display-inline">The Cooperative Forestry Assistance Act of 1978 is amended by inserting after section 7A (<external-xref legal-doc="usc" parsable-cite="usc/16/2103d">16 U.S.C. 2103d</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5081D78A46D44A2F8EBA4401514FC680"><section id="id4F83DAD54A5A432B94CA871002F0D3BE"><enum>7B.</enum><header>Forest Stewardship Practice Program</header><subsection id="ide72713e8438f4219bc5a478d8df367cb"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a Forest Stewardship Practice Program (referred to in this section as the <term>program</term>) to provide funding to carry out forest practices determined by the Secretary to increase carbon sequestration and storage on private forest land, including extended timber harvest rotations.</text></subsection><subsection id="id07cf0b0a317b482383a55788c022e86e"><enum>(b)</enum><header>Practices and payment rates</header><text>The Secretary shall—</text><paragraph id="idAD37010118DF4D4B9CD03D35633E1F37"><enum>(1)</enum><text>establish a schedule of eligible forest practices and payment rates under the program, calibrated to forest type and other relevant considerations; and </text></paragraph><paragraph id="id4783C1A3FBCD4CFD95AA11C5A49CC03A"><enum>(2)</enum><text>update the schedule established under paragraph (1) annually with statistical sampling of projects funded under the program.</text></paragraph></subsection><subsection id="idaaf9fa2ca3ff4221b644ff3cee1da4c2"><enum>(c)</enum><header>Priority</header><text>In awarding funding under the program, the Secretary shall give priority to projects that incentivize the largest quantity of carbon sequestration and storage by—</text><paragraph id="idB40536C2DE78458F9CDD34520901659C"><enum>(1)</enum><text>increasing timber harvest intervals; and</text></paragraph><paragraph id="id9C77744B13F64E0BA8011165CB314B35"><enum>(2)</enum><text>removing less carbon during timber harvest operations.</text></paragraph></subsection><subsection id="id7cdcb00a00d34d3b9cbd08c53ecadc21"><enum>(d)</enum><header>Funding</header><text>Of the funds of the Reforestation Trust Fund established under section 303 of <external-xref legal-doc="public-law" parsable-cite="pl/96/451">Public Law 96–451</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1606a">16 U.S.C. 1606a</external-xref>), the Secretary shall use not more than $1,000,000,000 for each fiscal year to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id76dbd8906e064999b0bfc69868cf1bb8"><enum>205.</enum><header>Urban wood programs</header><subsection id="id6BFE1678DC974B14A9D782BE32584FA5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2101">16 U.S.C. 2101</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE23C48F89EED4682A586A5C4F89EAFD1"><section id="idf5db6d4c726143b2ae2a3058356215ba"><enum>21.</enum><header>Urban wood programs</header><subsection id="idce8338303d6044e7865fc40c33a535d9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idd65452b8ea6b4bc198bf4d9961afe38b"><enum>(1)</enum><header>Innovative urban wood product</header><text>The term <term>innovative urban wood product</term> means a wood product that uses wood residues and byproducts from urban forest management, building deconstruction, and other related sources of wood generated in urban areas.</text></paragraph><paragraph id="idf02161ac89f2494cae0888b04765ac9f"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary, acting through the Research and Development Deputy Area and the State and Private Forestry Deputy Area of the Forest Service.</text></paragraph><paragraph id="id78a4bec8b83340a08169ae0c2083ebb6"><enum>(3)</enum><header>Wood product</header><text>The term <term>wood product</term> includes—</text><subparagraph id="id71cb5e6207474082bf866764fdba58e0"><enum>(A)</enum><text>building material made of wood;</text></subparagraph><subparagraph id="idac9f385cc7cf485785d39ddb2a8112fd"><enum>(B)</enum><text>a durable home product made of wood; and</text></subparagraph><subparagraph id="idf9bcccf63081495f8f63d5863714eab9"><enum>(C)</enum><text>a woody residue used for bioenergy.</text></subparagraph></paragraph></subsection><subsection id="id2d6588ed54e24292a39bd0c52c791a8c"><enum>(b)</enum><header>Urban wood research and development program</header><paragraph id="id6C332786B0C64BEE823030A2E9EC14D6"><enum>(1)</enum><header>Definition of eligible entity</header><text>In this subsection, the term <quote>eligible entity</quote> means—</text><subparagraph id="id9b3aaf1d1d8c46808a920e4f20085526"><enum>(A)</enum><text>a unit of State, Tribal, or local government;</text></subparagraph><subparagraph id="idf8421899e29149708a66b26cbf3b041c"><enum>(B)</enum><text>a land-grant college or university (as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>)) or other institution of higher education;</text></subparagraph><subparagraph id="id409310ef91cf4c9aa7a2bb0188d0008c"><enum>(C)</enum><text>a nonprofit organization; and</text></subparagraph><subparagraph id="id066F180FC5BD433A9FEAE667FA595EFF"><enum>(D)</enum><text>any other entity, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id671c5e2c097243718c77d2868cbb3c59"><enum>(2)</enum><header>Establishment</header><text>The Secretary shall establish a program to facilitate the use of innovative urban wood products in incorporated cities and towns in the United States by—</text><subparagraph id="id763A652F1EF142ECB6946CB24AF31B7D"><enum>(A)</enum><text>conducting performance-driven research and development relating to the potential sources and uses of urban wood products;</text></subparagraph><subparagraph id="id248971D0B8F14B1EB0CF87A5954BEFB9"><enum>(B)</enum><text>providing education and technical assistance to eligible entities relating to the potential sources and uses of urban wood products; and</text></subparagraph><subparagraph id="id649E72E1555C4C5784E8E4AF2F75DC96"><enum>(C)</enum><text>awarding grants under paragraph (5).</text></subparagraph></paragraph><paragraph id="id78cf990d59bf4f8f9275ca90775e1dfd"><enum>(3)</enum><header>Collaboration</header><text>In carrying out the program established under paragraph (2), the Secretary shall obtain input and guidance from, and collaborate with—</text><subparagraph id="id276580EDA6BF4E6286F84B58CEBE9114"><enum>(A)</enum><text>the wood products industry;</text></subparagraph><subparagraph id="idFF6513C0D4444453B0359A7C338DCF8B"><enum>(B)</enum><text>conservation organizations;</text></subparagraph><subparagraph id="id00910D5EEB9E45DDA1BBB8095DAA7AA5"><enum>(C)</enum><text>community organizations; and</text></subparagraph><subparagraph id="id576072E26A964A799CE65D9A85006505"><enum>(D)</enum><text>institutions of higher education.</text></subparagraph></paragraph><paragraph id="id2EA4A3397E6B44D4A556C05CFAB53CC1"><enum>(4)</enum><header>Research and development, education, and technical assistance</header><text>The Secretary shall carry out subparagraphs (A) and (B) of paragraph (2) at the Forest Products Laboratory of the Department of Agriculture or through the State and Private Forestry Deputy Area in a manner that meets the needs of municipalities, private companies, trade and technical schools, and other entities that work with urban wood.</text></paragraph><paragraph id="ide9f8e42dd9ef4567ba58bfcca5913326"><enum>(5)</enum><header>Grants</header><text>After obtaining input and guidance from the entities described in paragraph (3), the Secretary shall award grants on a competitive basis to eligible entities to conduct research and development and provide education and technical assistance that—</text><subparagraph id="id6091BE07AE7A4B4386AE7CB051FD7455"><enum>(A)</enum><text>increases the use of urban wood; and</text></subparagraph><subparagraph id="id40F5BF0FEF7F48B59759E41A0A940FA4"><enum>(B)</enum><text>provides increased employment opportunities in the urban wood industry and related fields.</text></subparagraph></paragraph><paragraph id="iddc2469aa7ee94ebbb7a7d46a549022da"><enum>(6)</enum><header>Priorities</header><text>In carrying out the program established under paragraph (2), the Secretary shall give priority to projects and activities that—</text><subparagraph id="id742c74fb900d42c48f962991fc2187f2"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idAA928B8187C2434F86190C244946AEDB"><enum>(i)</enum><text>identify new products that can be created from urban wood; or</text></clause><clause id="idEAB207C5B83F48929A578CC3F9323E90" indent="up1"><enum>(ii)</enum><text>improve on existing processes to produce innovative urban wood products with greater efficiency and quality;</text></clause></subparagraph><subparagraph id="id13573949f5784695af1da88d5250b580"><enum>(B)</enum><text>facilitate improved commercialization of innovative urban wood products;</text></subparagraph><subparagraph id="idf807c3fb942848f2ab2ce3deb5248753"><enum>(C)</enum><text>engage unemployed and underemployed persons in disadvantaged communities in worker training, full-time employment, and incubation of new commercial enterprises; and</text></subparagraph><subparagraph id="id4cc06a79984045f1a16cc6f05fe87c04"><enum>(D)</enum><text>increase the carbon mitigation benefit of the management of urban wood, as measured by the lifecycle environmental footprint of a wood product or production process, beginning with the collection of raw urban wood materials and ending with the manufacturing process.</text></subparagraph></paragraph><paragraph id="id50cc435b106846fabe14c2573d2ce97a"><enum>(7)</enum><header>Timeframe</header><text>To the maximum extent practicable, the measurable performance goals for the research and development, education, and technical assistance conducted under the program established under paragraph (2) shall be achievable within a 10-year timeframe beginning on the date of establishment of the program.</text></paragraph></subsection><subsection id="idb6fc0190d19a449f85331d8f1324ddc7"><enum>(c)</enum><header>Urban wood building competition</header><text>Beginning in fiscal year 2021, the Secretary shall carry out an annual competition, in accordance with section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>), for—</text><paragraph id="id6125014AA28542C6953B22630F8555AF"><enum>(1)</enum><text>innovative urban wood products and manufacturing processes; or</text></paragraph><paragraph id="id9A1B601240C34C6CA5CECC23EBA7E185"><enum>(2)</enum><text>other innovative wood product demonstrations.</text></paragraph></subsection><subsection id="id50a4b5bb315a495cb03ddc3763701c24"><enum>(d)</enum><header>Funding</header><text>Of the funds of the Reforestation Trust Fund established under section 303 of <external-xref legal-doc="public-law" parsable-cite="pl/96/451">Public Law 96–451</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1606a">16 U.S.C. 1606a</external-xref>), the Secretary shall use $35,000,000 each fiscal year to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idF5E6F3A32DBF4E84A9EFDCD7A11CE1F2"><enum>(b)</enum><header>Urban wood innovation grants</header><text>Section 8643 of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/7/7655d">7 U.S.C. 7655d</external-xref>) is amended—</text><paragraph id="idF37C0F5F387F42C9AD6F6B42F8C8BD67"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id485A75835B39407C8FE28BA7C0601E86"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></subparagraph><subparagraph id="idE708C3868D464CE9B30840F447156A78"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD4CD08E77614476187EA002B6A04D91D"><paragraph id="id3025279F67D24F51977FC42F66A4ACEE"><enum>(2)</enum><header>Innovative urban wood product</header><text>The term <term>innovative urban wood product</term> means a wood product that uses wood residues and byproducts from urban forest management, building deconstruction, and other related sources of wood generated in urban areas.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id36C61580B1164764A5DC86EA7645C29E"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id692B86CBB36445F0B09FB6E7E95FE20B"><enum>(A)</enum><text>in paragraph (1), by striking <quote>(October 20, 2015)), may</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id29D2EE68953F48B78FD6C099784BE377"><text>(October 20, 2015))—</text><subparagraph id="id85AA51659C5848C785565F8E47AD3BD3"><enum>(A)</enum><text>may</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id2C8E94631223472389C19FC76BC4D9CA"><enum>(B)</enum><text>in subparagraph (A) (as so designated), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id2AE73D3E7C8945B98F981529A950EA79"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4EC3D63D0B5F4CF4A189F51FAEE7AF60"><subparagraph id="id71C9A30551EF4BC281F4AF2CEDE9E2C3"><enum>(B)</enum><text>shall, to the maximum extent practicable, award 1 or more wood innovation grants each year to eligible entities for the purpose of advancing the use of innovative urban wood products.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id7EE3294D8EE44328894F8453F31C4E13"><enum>(3)</enum><text>in subsection (c), by striking <quote>under subsection (b)(2)</quote> and inserting <quote>for grants under subsection (b)(1)(A)</quote>.</text></paragraph></subsection></section><section id="id65385aefab0645318a1ceed943eef790"><enum>206.</enum><header>Stewardship Corps</header><subsection id="idb0801f50b9de43718485618352def80d"><enum>(a)</enum><header>In general</header><text>The Secretary of Agriculture (referred to in this section as the <quote>Secretary</quote>), in consultation with the Secretary of the Interior, shall establish a civilian conservation corps, to be known as the <quote>Stewardship Corps</quote> (referred to in this section as the <quote>Stewardship Corps</quote>), to provide youth with the academic, vocational, and social skills necessary to pursue long term, productive careers in the forest sector and the wetland restoration sector.</text></subsection><subsection id="id21D936F9EECF46C6A65FCF5B47871603"><enum>(b)</enum><header>Priority requirement</header><text>To the maximum extent practicable, the Secretary shall prioritize recruitment for the Stewardship Corps of youth from—</text><paragraph id="id1DFEFB3864E5423FBA5B2E404B2B8831"><enum>(1)</enum><text>low-income communities;</text></paragraph><paragraph id="id6B74DA17739B47A6A084DE9F9E8C6AEA"><enum>(2)</enum><text>indigenous communities; and</text></paragraph><paragraph id="idADCC8DA473E8433E9325326785EFB3B4"><enum>(3)</enum><text>communities of color.</text></paragraph></subsection><subsection id="id2f2a230b38604c57b545dbcf289def93"><enum>(c)</enum><header>Reforestation and restoration on Federal land</header><text>To the maximum extent practicable, members of the Stewardship Corps shall perform—</text><paragraph id="idCE6C238960B942B5A2C802013E649963"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idA5AC54BAD8BC44B3916D2A5AB5DBB3AD"><enum>(A)</enum><text>in each of calendar years 2021 through 2025, not less than 20 percent of the reforestation required under subsections (d)(2) and (e) of section 303 of <external-xref legal-doc="public-law" parsable-cite="pl/96/451">Public Law 96–451</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1606a">16 U.S.C. 1606a</external-xref>); and</text></subparagraph><subparagraph id="id73D0BD3599A041DF83452F0009398C10" indent="up1"><enum>(B)</enum><text>in calendar years 2026 and each calendar year thereafter, not less than 40 percent of the reforestation described in subparagraph (A); and</text></subparagraph></paragraph><paragraph id="idA272AD1BA7AA4ED981E1CFED501DF9AE"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3150FA1781F844A5BE6909B39EC476B6"><enum>(A)</enum><text>in each of calendar years 2021 through 2025, not less than 20 percent of the wetlands restoration required under section 307; and</text></subparagraph><subparagraph id="id7F5538D3021844F4B07883D8D53D7601" indent="up1"><enum>(B)</enum><text>in calendar year 2026 and each calendar year thereafter, not less than 40 percent of the wetlands restoration described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id2ad001b9b8c6404dbbc0e20f92689f27"><enum>(d)</enum><header>Duration of participation</header><text>An individual shall serve in the Stewardship Corps for not more than 2 years.</text></subsection><subsection id="id5be69b17af024046a7ea36d3d2decba2"><enum>(e)</enum><header>Housing and care</header><text>The Secretary shall provide to each member of the Stewardship Corps housing, subsistence, clothing, medical attention (including hospitalization), transportation, and a cash allowance, as determined necessary by the Secretary.</text></subsection><subsection id="id5bd381cfeebe4247885e3ee87c124edc"><enum>(f)</enum><header>Compensation</header><text>Members of the Stewardship Corps shall be paid at a rate in accordance with the prevailing rate for a similar class of Federal employees in the locality.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idF06AF4F4E5A34F5CBF59840E6801B6EC"><enum>(g)</enum><header>Job placement</header><text>The Secretary shall assist members of the Stewardship Corps with obtaining employment in the forest sector and the wetlands restoration sector on the completion of service under the Stewardship Corps.</text></subsection></section></title><title id="id03EED0D9F1EF432D8CE93876DC962CAD" style="OLC"><enum>III</enum><header>Coastal wetland</header><section id="ida8d3673fa05349279cd9e5e7352ffe19"><enum>301.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="ide4d16cb406464f33a39814fda73a75bb"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Under Secretary of Commerce for Oceans and Atmosphere and Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="idabb471111e83453491bca4468546baf3"><enum>(2)</enum><header>Coastal wetland</header><text>The term <term>coastal wetland</term> means estuarine vegetated coastal habitat, including salt marsh, seagrass, mangrove, and other vegetated marine habitats.</text></paragraph><paragraph id="id95877ae8231841e1841e3a0912d0b552"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id02ed2a0705304d11b0b11824c62a5545"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given that term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph commented="no" id="id501ab61ea18b43019c9147207c59bac7"><enum>(5)</enum><header>Natural infrastructure</header><text>The term <term>natural infrastructure</term> means infrastructure that—</text><subparagraph commented="no" id="id2864A3A1DDC147668DD8F4E6658D39C5"><enum>(A)</enum><text>uses, restores, or emulates natural ecological processes; and</text></subparagraph><subparagraph commented="no" id="id86B4E47ABC78487B97369C64E0A6C6E7"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id5F0B0A8178594E77A855E839BC51FB5D"><enum>(i)</enum><text>is created through the action of natural physical, geological, biological, and chemical processes over time;</text></clause><clause commented="no" id="idBC44606DBB1B47C7AA028AFD45C8B5D8" indent="up1"><enum>(ii)</enum><text>is created by human design, engineering, and construction to emulate or act in concert with natural processes; or</text></clause><clause commented="no" id="id65C5A2CB8D6A4CCC9D2B923EA2D795F3" indent="up1"><enum>(iii)</enum><text>involves the use of plants, soils, and other natural features, including through the creation, restoration, or preservation of vegetated areas using materials appropriate to the area.</text></clause></subparagraph></paragraph><paragraph id="idcdf52acb197d44b7be48fa4a9a35c6e5"><enum>(6)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code.</text></paragraph><paragraph id="idfbbe2aee872541bf9b548d650076355a"><enum>(7)</enum><header>Program</header><text>The term <term>Program</term> means the Coastal and Estuary Resilience Grant Program as established by section 302.</text></paragraph><paragraph id="id8eab1e3e9a3e478aba769f8a78423bb3"><enum>(8)</enum><header>Restoration</header><text>The term <term>restoration</term> means renewing, enhancing, or replacing degraded, damaged, vulnerable, or destroyed wetlands to improve the ecosystem function and resilience through active human intervention and action, such as—</text><subparagraph id="idfabbe5a7fa774bd5913cac84767f0b45"><enum>(A)</enum><text>improving hydrological conditions (such as by removing tidal barriers, improving connectivity, or changing water levels);</text></subparagraph><subparagraph id="idc80fd3d5bf244ca19e015140b324f130"><enum>(B)</enum><text>altering sediment supply (such as through the beneficial use of dredge material, thin-layer spraying, or reconnecting river sediment);</text></subparagraph><subparagraph id="idf6539a5307e14ddc9e9082737b6dab14"><enum>(C)</enum><text>changing salinity characteristics;</text></subparagraph><subparagraph id="ide00ae349f3094df0827758c03c723493"><enum>(D)</enum><text>improving water quality (such as by reducing excess nutrients, sedimentation, or contaminants);</text></subparagraph><subparagraph id="id4db2228cd1a0471e990c41febd569c47"><enum>(E)</enum><text>planting of native plants, removal of invasive species, and other improved management practices;</text></subparagraph><subparagraph id="id2b56e17e1111462ea985f317043a1c10"><enum>(F)</enum><text>controlling erosion of wetland edges; and</text></subparagraph><subparagraph id="idcda94b1f6eca4533a9bba6722fc0e9d8"><enum>(G)</enum><text>enabling future inland migration as sea levels rise, including through the enhancement of adjacent fresh water wetlands.</text></subparagraph></paragraph><paragraph id="id40A431C814A743F695B144AFB56607D8"><enum>(9)</enum><header>State</header><text>The term <term>State</term> means a State, the District of Columbia, or any territory or possession of the United States.</text></paragraph></section><section id="id3137b3d6e4504b20b75199bcccea6056"><enum>302.</enum><header>Coastal and Estuary Resilience Grant Program</header><subsection id="id7cf88af496a0477bbd70c935a616e76b"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Commerce shall establish a program, to be known as the <quote>Coastal and Estuary Resilience Grant Program</quote>, under which the Secretary awards grants to entities that eligible under subsection (b) to fund coastal wetland restoration projects that are eligible under subsection (c).</text></subsection><subsection id="idF154CCDDB1484590B0FCDB60164C17CB"><enum>(b)</enum><header>Eligible entities</header><text>An entity is eligible to apply for a grant under the Program if the entity is an institution of higher education, a nonprofit organization, a State or local government, or an Indian Tribe.</text></subsection><subsection id="id7ca5eeee6adb4de88bbd2fc7d9b4f604"><enum>(c)</enum><header>Eligible projects</header><text display-inline="yes-display-inline">A project is eligible for a grant under the Program if the project is designed to reduce net greenhouse gases through one of the following:</text><paragraph id="id90DDC3AA1C124542B28884D3459474E9"><enum>(1)</enum><text>The sequestration of additional carbon dioxide through—</text><subparagraph id="id426E454FE7E6470EA3FEC05CFA884E69"><enum>(A)</enum><text>the active restoration of degraded coastal wetland; and</text></subparagraph><subparagraph id="id38D5CE9F9EF241A19BB5FD1C1657FBD7"><enum>(B)</enum><text>the protection of threatened coastal wetland.</text></subparagraph></paragraph><paragraph id="id8A473580897441B291B7AFC4DE65DFB7"><enum>(2)</enum><text>The halting of ongoing carbon dioxide emissions, and the resumption of the natural rate of carbon capture, through the restoration of drained coastal wetland.</text></paragraph><paragraph id="idDB7222989F684C0DA3C1D0A30FFCE864"><enum>(3)</enum><text>The halting of ongoing methane emissions, and the resumption of the natural rate of carbon storage, through the restoration of formerly tidal wetland that has lost tidal connectivity and become fresh wetland (commonly known as <term>impounded wetland</term>).</text></paragraph></subsection><subsection id="id88b4b78f6fb44cdb9be13de6f9b181e0"><enum>(d)</enum><header>Grant evaluation criteria</header><text>In reviewing applications for grants under the Program, the Secretary shall give priority to projects that exhibit the highest potential to—</text><paragraph id="id259465aadb3049869251fc6fabf95b43"><enum>(1)</enum><text>mitigate greenhouse gas emissions by—</text><subparagraph id="id0ce3f5a11ea54113b87766ec8b4d52e8"><enum>(A)</enum><text>reducing greenhouse gas emissions; or</text></subparagraph><subparagraph id="id07772a79e7c34fbf97df14b3616d21dc"><enum>(B)</enum><text>capturing and storing greenhouse gases;</text></subparagraph></paragraph><paragraph id="idf0572a308d6d4e43b77e1f65b516a5c0"><enum>(2)</enum><text>reinforce ecosystem resilience and adaptation by—</text><subparagraph id="id94ca59ea2977415da3b77855950471f5"><enum>(A)</enum><text>preparing for sea level rise in order to reduce vulnerability to sea level rise and erosion;</text></subparagraph><subparagraph id="idf1941af164c44c1394e58393ab639722"><enum>(B)</enum><text>supporting resilience against flooding and sea level rise; or</text></subparagraph><subparagraph id="id8b5722303c694bc3bcc287243608d2f3"><enum>(C)</enum><text>restoring or enhancing ecosystem function; or</text></subparagraph></paragraph><paragraph id="idffc56c17b4034d3899345f90dedea822"><enum>(3)</enum><text>provide economic and social co-benefits by—</text><subparagraph id="idcf2c1471d1744992b26d1cab385f7d97"><enum>(A)</enum><text>reducing the potential impact and damage of storms on the built environment;</text></subparagraph><subparagraph id="id5216a8b34b6a44ea92434b73bf6a5d4e"><enum>(B)</enum><text>advancing environmental justice by reducing the disproportionate impacts of environmental hazards on communities of color, indigenous communities, and low-income communities;</text></subparagraph><subparagraph id="idf3bd34a9c707461bb61e00093b0e9616"><enum>(C)</enum><text>providing jobs in coastal communities;</text></subparagraph><subparagraph id="id0dc644788fe641048eade989a83aac40"><enum>(D)</enum><text>including elements of natural infrastructure;</text></subparagraph><subparagraph id="id93a38380639b418d8907f0a83b3593f0"><enum>(E)</enum><text>incorporating collaborative partnerships; or</text></subparagraph><subparagraph id="idd3e94f822df34b54a6732224cfffad36"><enum>(F)</enum><text>involving local communities in project planning and implementation.</text></subparagraph></paragraph></subsection><subsection id="idf7bd0482cd8a4c7c814db4b8907c6273"><enum>(e)</enum><header>Matching funds</header><paragraph id="idD43EBBDB0F2E4DB8AC9DBE77D6B64CA2"><enum>(1)</enum><header>Inclusion in applications</header><text>An eligible entity under subsection (b) may include in an application for a grant under the Program a commitment to provide non-Federal resources (including in-kind contributions and volunteer hours) to match the amount of grant.</text></paragraph><paragraph id="id5D4CE4456C254295A3F86BA751B08F56"><enum>(2)</enum><header>Consideration</header><text>In reviewing an application for a grant under the Program, the Secretary may consider the inclusion of a commitment under paragraph (1) but may not require such a commitment as a condition of receiving a grant.</text></paragraph></subsection><subsection id="id5c62e0900880464099472010ec97b034"><enum>(f)</enum><header>Eligible costs</header><text display-inline="yes-display-inline">A grant awarded under the Program shall be available for all phases of the development, implementation, and monitoring of projects that are eligible under subsection (c), including—</text><paragraph id="id37d898d670a74974b836779b5065d2d4"><enum>(1)</enum><text>preliminary community engagement, planning, and prioritization;</text></paragraph><paragraph id="id32821982dc1047db98c9c58b0d1e7201"><enum>(2)</enum><text>preliminary design and site assessment, including—</text><subparagraph id="ida0f5899f8425403f8490ebe9cb33cc94"><enum>(A)</enum><text>assessments of feasibility;</text></subparagraph><subparagraph id="id8b9e2c47b61b452296d05edeff7c21bb"><enum>(B)</enum><text>planning; and</text></subparagraph><subparagraph id="idb003fa4237694e90a8e12dfad5544ead"><enum>(C)</enum><text>community engagement;</text></subparagraph></paragraph><paragraph id="id559b4b299de846b2b5382d681edb0976"><enum>(3)</enum><text>final design and permitting;</text></paragraph><paragraph id="idce7c39e7809e4dd08b8cef3abe55171e"><enum>(4)</enum><text>restoration and project implementation; and</text></paragraph><paragraph id="idbd9d3202451d42758379a64c2ae891ba"><enum>(5)</enum><text>monitoring, reporting, and stewardship.</text></paragraph></subsection><subsection id="idee77a9f6dc484570b0391393727bfa71"><enum>(g)</enum><header>Reporting</header><paragraph id="idf5243851dfee4019bb10d3b55995c9cd"><enum>(1)</enum><header>In general</header><text>An entity that receives a grant under the Program for a project shall—</text><subparagraph id="id9148DD23797E4F95ADA78B87C3B518BB"><enum>(A)</enum><text>collect data on the development and implementation of the project and stewardship following completion of the project; and</text></subparagraph><subparagraph id="idD0A79A7BAABA4A36804A208EE9857303"><enum>(B)</enum><text>submit that data to the Administrator for inclusion in the database required by section 303(a).</text></subparagraph></paragraph><paragraph id="id9604925d9c9f4626a1e91cebbaed117c"><enum>(2)</enum><header>Report after project completion</header><text>Not later than 1 year after the completion of a project for which a grant is provided under the Program, the entity that received the grant shall submit to the Administrator a report on the outputs, outcomes, and impacts of the project, including with respect to—</text><subparagraph id="id444dedaf5b39481b82b372939c94b773"><enum>(A)</enum><text>the amount of area restored;</text></subparagraph><subparagraph id="id1555c4d4e0a44f0182546a854952e671"><enum>(B)</enum><text>the estimated net climate benefit;</text></subparagraph><subparagraph id="id5902ce1f273346e083fc260adb25b099"><enum>(C)</enum><text>benefits to nearby communities; and</text></subparagraph><subparagraph id="id1353c76538f0422ba72a51da956c45e1"><enum>(D)</enum><text>involvement of partners and communities.</text></subparagraph></paragraph></subsection><subsection id="idd0b73fa7772e456eae2463d7bc3fe8ba"><enum>(h)</enum><header>Monitoring</header><text display-inline="yes-display-inline">The Secretary shall establish guidelines providing for monitoring a project for which a grant is provided under the Program for the 10-year period after the grant is awarded.</text></subsection><subsection id="id0584c37155ff4073ac77c10f21fbd933"><enum>(i)</enum><header>Role of National Fish and Wildlife Foundation</header><text>In carrying out the Program, the Secretary may consult, partner, or otherwise coordinate with the National Fish and Wildlife Foundation established by section 2(a) of the National Fish and Wildlife Foundation Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3701">16 U.S.C. 3701(a)</external-xref>).</text></subsection></section><section id="ide53e9a6309de497497277a8c64a351a7"><enum>303.</enum><header>Data collection</header><subsection id="id28A7B9040B474EF5A0167653AC15193A"><enum>(a)</enum><header>Database</header><paragraph id="idB929065616A840B5A142DE273F75F0EC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall maintain a coastal wetland restoration database to collect information about projects that receive grants under the Program.</text></paragraph><paragraph id="idAF132242A37B48E1812D1BB8701193AF"><enum>(2)</enum><header>Design</header><text display-inline="yes-display-inline">The Administrator shall design the database required by paragraph (1) to collect performance metrics on the development and implementation of projects that receive grants under the Program and stewardship following completion of such projects to evaluate the success of those projects and inform the design of future projects in an adaptive manner.</text></paragraph><paragraph id="id0C210A5C67A847DD98FD493AF4D93332"><enum>(3)</enum><header>Included metrics</header><text display-inline="yes-display-inline">The database required by paragraph (1) shall include standardized metrics for reporting such as—</text><subparagraph id="idcfc0fc215a564ca893755e81fa26b9d3"><enum>(A)</enum><text>acres restored, protected, or created;</text></subparagraph><subparagraph id="id527b6b846e2e4622b3cf371d02008181"><enum>(B)</enum><text>habitat type;</text></subparagraph><subparagraph id="id4b11c98649c94b9aab34acb2b4551c26"><enum>(C)</enum><text>restoration technique;</text></subparagraph><subparagraph id="idf37f1cad66f94c65a6c0eb6a96481920"><enum>(D)</enum><text>estimated net greenhouse gas reduction effect;</text></subparagraph><subparagraph id="ide49730ce4cd54d3cbbd0bee834e38714"><enum>(E)</enum><text>jobs created;</text></subparagraph><subparagraph id="id9c42e71702db46d4a5929f46803f88e5"><enum>(F)</enum><text>quantified ecosystem services; and</text></subparagraph><subparagraph id="id5bb832df7eaf4fd09345ee4fc53b1554"><enum>(G)</enum><text>other metrics selected by the Administrator.</text></subparagraph></paragraph><paragraph id="id9A62956E234949F6AA1219B473C8C9E7"><enum>(4)</enum><header>Public availability</header><text display-inline="yes-display-inline">The Administrator shall make products of the database publicly available and disseminate important findings to the public.</text></paragraph><paragraph id="id0190e57c700b422993753bc6a2d7b21c"><enum>(5)</enum><header>Privacy</header><text>To protect the privacy of private landowners, the Administrator shall ensure that any data collected from private landowners under this section are anonymized before the data are made publicly available. </text></paragraph></subsection><subsection commented="no" id="id2c997b0fbb1e418ca07acc783fc780c0"><enum>(b)</enum><header>Inventory of coastal wetland</header><text>The Administrator shall compile an inventory of coastal wetland.</text></subsection></section><section id="id28273859034d41fb859fa43c38775eb1"><enum>304.</enum><header>Outreach and technical assistance</header><text display-inline="no-display-inline">The Administrator shall establish a technical assistance program to help entities outside of the National Oceanic and Atmospheric Administration in all phases of coastal wetland restoration project work, including outreach to potential applicants for grants under section 302.</text></section><section id="id2280aed1150041cc83edd974e170d3df"><enum>305.</enum><header>Annual restoration and funding</header><subsection commented="no" display-inline="no-display-inline" id="id7199DE452FC54352AF0A750BE19AAA40"><enum>(a)</enum><header display-inline="yes-display-inline">Acreage requirements</header><text display-inline="yes-display-inline">To the maximum extent practicable, the Secretary of Commerce shall award grants under the Program to conduct coastal wetland restoration on 1,500,000 acres over 10 years, as follows:</text><paragraph id="idAC75CEF9173E40A1972FDD358F08ACFA"><enum>(1)</enum><text>On 50,000 acres in each of fiscal years 2021 and 2022.</text></paragraph><paragraph id="idEF03F5B09A5F46F4B6725D49DD5D2118"><enum>(2)</enum><text>On 100,000 acres in each of fiscal years 2023 and 2024.</text></paragraph><paragraph id="idAFA07238DCAD4D32A5CC980C037F16D2"><enum>(3)</enum><text>On 150,000 acres in each of fiscal years 2025 and 2026.</text></paragraph><paragraph id="id8FD82EC4EAF442A9A94F1770D3CE9484"><enum>(4)</enum><text>On 225,000 acres in each of fiscal years 2027 through 2030.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA4961FC23710441EA8443CAE3FD4A188"><enum>(b)</enum><header display-inline="yes-display-inline">Funding</header><paragraph commented="no" display-inline="no-display-inline" id="id53D2A6B58A814B4E814D302D260E3360"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On October 1 of each fiscal year, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary of Commerce to provide grants under the Program, to remain available until expended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0171B04A48ED4AC7ABB95DC688E3E49B"><enum>(A)</enum><text>$1,250,000,000 for each of fiscal years 2021 and 2022;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF81589E6745847E3B516C3C0378EFAAA"><enum>(B)</enum><text>$2,500,000,000 for each of fiscal years 2023 and 2024;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA28EBF842F5044FB9CF5B47266F20E2B"><enum>(C)</enum><text>$3,750,000,000 for each of fiscal years 2025 and 2026; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFA27E9C4160E4156B388ADF4ED20C66A"><enum>(D)</enum><text>$5,625,000,000 for each of fiscal years 2027 through 2030.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id97A69F91550B433382A39DD4924331F8"><enum>(2)</enum><header display-inline="yes-display-inline">Receipt and acceptance</header><text display-inline="yes-display-inline">The Secretary of Commerce shall be entitled to receive, shall accept, and shall use to provide grants under the Program in accordance with paragraph (1) the funds transferred under that paragraph, without further appropriation. <added-phrase reported-display-style="italic"></added-phrase></text></paragraph></subsection><subsection commented="no" id="idBA5203778928430688E36FB73F3E8E76"><enum>(c)</enum><header>Supplement not supplant</header><text>The amount authorized to be appropriated by subsection (a) shall supplement and not supplant other amounts available to the Secretary of Commerce.</text></subsection></section><section id="ideb8893e389f94d59b4ec641d3fde58e3"><enum>306.</enum><header>Prevailing wage requirement</header><text display-inline="no-display-inline">Any contractor or subcontractor entering into a service contract in connection with a project under the Program shall—</text><paragraph id="id5bc24f1088df4383be2ce26fbcb01047"><enum>(1)</enum><text>be treated as a Federal contractor or subcontractor for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/67">chapter 67</external-xref> of title 41, United States Code (commonly known as the <quote>McNamara-O'Hara Service Contract Act of 1965</quote>); and</text></paragraph><paragraph id="id0af7a1eef45f489c8e8b1733897f6c21"><enum>(2)</enum><text>pay each class of employee employed by the contractor or subcontractor wages and fringe benefits at rates in accordance with prevailing rates for the class in the locality, or, where a collective-bargaining agreement covers the employee, in accordance with the rates provided for in the agreement, including prospective wage increases provided for in the agreement.</text></paragraph></section><section id="idaa9af287251b4347bbe2bacb2e677760"><enum>307.</enum><header>Department of the Interior coastal wetland restoration; funding</header><subsection id="id66fbc1c028814530a0394720cd3a2522"><enum>(a)</enum><header>In general</header><text>The Secretary of the Interior shall conduct coastal wetland restoration on land managed by the Secretary of the Interior to achieve at least 1 of the following:</text><paragraph id="idff19b13756b44bcba9856a52f4645890"><enum>(1)</enum><text>The sequestration of additional carbon dioxide through—</text><subparagraph id="id816c5525b94a41c1a33fe4cc4607c96b"><enum>(A)</enum><text>the active restoration of degraded coastal wetland; and</text></subparagraph><subparagraph id="idb05650c59c104c0abbeb075d3136831c"><enum>(B)</enum><text>the protection of threatened coastal wetland.</text></subparagraph></paragraph><paragraph id="id0458a40a481b4c16b278dee21898cbb0"><enum>(2)</enum><text>The halting of ongoing carbon dioxide emissions, and the resumption of the natural rate of carbon capture, through the restoration of drained coastal wetland.</text></paragraph><paragraph id="ide8254972009f498fbfab0f945d5fcae8"><enum>(3)</enum><text>The halting of ongoing methane emissions, and the resumption of the natural rate of carbon storage, through the restoration of formerly tidal wetland that has lost tidal connectivity and become fresh wetland (commonly known as <term>impounded wetland</term>).</text></paragraph></subsection><subsection id="idAACD9D88B277482398DEDA391D77EFE9"><enum>(b)</enum><header>Acreage requirements</header><text>To the maximum extent practicable, the Secretary of the Interior shall conduct coastal wetland restoration under subsection (a)—</text><paragraph id="ide41b661c9622471d80128c2f8893dd20"><enum>(1)</enum><text>on land managed by the Director of the United States Fish and Wildlife Service—</text><subparagraph id="id1fa13e8cbe9d44c2a3ec7894c180c821"><enum>(A)</enum><text>on 10,000 acres in each of fiscal years 2021 and 2022;</text></subparagraph><subparagraph id="id84a7a4633a9747569024cbff8a362bb2"><enum>(B)</enum><text>on 20,000 acres in each of fiscal years 2023 and 2024; and</text></subparagraph><subparagraph id="id7c0fc01e67c041de9f5f637344c623b2"><enum>(C)</enum><text>on 30,000 acres in fiscal year 2025 and each fiscal year thereafter; and</text></subparagraph></paragraph><paragraph id="idc9760ff2f69641e6a70f0ca7f2c851ed"><enum>(2)</enum><text>on land managed by the Director of the National Park Service—</text><subparagraph id="id34ce30a32698458cb69757c34fb38a3c"><enum>(A)</enum><text>on 10,000 acres in each of fiscal years 2021 and 2022;</text></subparagraph><subparagraph id="id753d003e5e774bc5a9c4870568f2e6af"><enum>(B)</enum><text>on 20,000 acres in each of fiscal years 2023 and 2024;</text></subparagraph><subparagraph id="idb56f2ba667644e08bc89d13f63f1d863"><enum>(C)</enum><text>on 40,000 acres in each of fiscal years 2025 and 2026;</text></subparagraph><subparagraph id="id8d57db687c104c56b4d8d0228b42238e"><enum>(D)</enum><text>on 80,000 acres in each of fiscal years 2027 and 2028; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2f3e7231ecd849c5a6df7aaf12da5d64"><enum>(E)</enum><text>on 160,000 acres in each of fiscal years 2029 and 2030.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1C094F2172614741B8F76AD113AAFE80"><enum>(c)</enum><header display-inline="yes-display-inline">Funding</header><paragraph commented="no" display-inline="no-display-inline" id="id6D9BB34B5289445F8F987120B46516A3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On October 1 of each fiscal year, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary of the Interior to carry out this section, to remain available until expended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id93660340BAE44AD8A1A95474110F1B16"><enum>(A)</enum><text>for coastal wetland restoration on land managed by the Director of the United States Fish and Wildlife Service—</text><clause commented="no" display-inline="no-display-inline" id="id1F54A7E66A664A039271A8DABBD16159"><enum>(i)</enum><text>$250,000,000 for each of fiscal years 2021 and 2022;</text></clause><clause commented="no" display-inline="no-display-inline" id="idC3718FCF3D5A4D19B311DB0DEB04F692"><enum>(ii)</enum><text>$500,000,000 for each of fiscal years 2023 and 2024; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id4B5B6E6461174A89A5073093215A95A5"><enum>(iii)</enum><text>$750,000,000 for each of fiscal years 2025 through 2030; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1BA5F1081C8B47718BDAEEDE8945640F"><enum>(B)</enum><text>for coastal wetland restoration on land managed by the Director of the National Park Service—</text><clause commented="no" display-inline="no-display-inline" id="id7EEA44AB17994F9FA4C815D086DCA4C4"><enum>(i)</enum><text>$250,000,000 for each of fiscal years 2021 and 2022;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2C0CBD3C452E4873827009C646900D75"><enum>(ii)</enum><text>$500,000,000 for each of fiscal years 2023 and 2024;</text></clause><clause commented="no" display-inline="no-display-inline" id="id28F3658C58ED43CC96A9B1F07E2C7EE5"><enum>(iii)</enum><text>$1,000,000,000 for each of fiscal years 2025 and 2026;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4DC9FFAF3F41406AB26418701153C94A"><enum>(iv)</enum><text>$2,000,000,000 for each of fiscal years 2027 and 2028; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idCE9CEB3F77CF450E951DE75E10E6FF05"><enum>(v)</enum><text>$4,000,000,000 for each of fiscal years 2029 and 2030.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C40161AADFB456DA9BA8C48423E1DB3"><enum>(2)</enum><header display-inline="yes-display-inline">Receipt and acceptance</header><text display-inline="yes-display-inline">The Secretary of the Interior shall be entitled to receive, shall accept, and shall use to carry out this section in accordance with paragraph (1) the funds transferred under that paragraph, without further appropriation. <added-phrase reported-display-style="italic"></added-phrase></text></paragraph></subsection></section></title></legis-body></bill>
