<section id="H76ABC9F966D947C888E74B97FEAD3BF8" section-type="section-one"><enum>1.</enum><header>Adoption of the rules of the One Hundred Sixteenth Congress</header><text display-inline="no-display-inline">The Rules of the House of Representatives of the One Hundred Sixteenth Congress, including applicable provisions of law or concurrent resolution that constituted rules of the House at the end of the One Hundred Sixteenth Congress, are adopted as the Rules of the House of Representatives of the One Hundred Seventeenth Congress, with amendments to the standing rules as provided in section 2, and with other orders as provided in this resolution.</text></section> <section id="HAC39B98F9F4949919EDCB6D336330FD0"><enum>2.</enum><header>Changes to the standing rules</header> <subsection id="H8D59536D56B34F4A8C28C46960DAE663"><enum>(a)</enum><header>Conforming change</header><text>In clause 2(i) of rule II—</text> 
<paragraph id="H6A02FB5269474B88B8CAA66F4EE56C92"><enum>(1)</enum><text>strike the designation of subparagraph (1); and</text></paragraph> <paragraph id="H00F82395C3AE4443A3796847ACCFD8B9"><enum>(2)</enum><text>strike subparagraph (2).</text></paragraph></subsection> 
<subsection id="HB25A40B71EC44EA593F9644D5AD2B186"><enum>(b)</enum><header>Office of Diversity and Inclusion and Office of the Whistleblower Ombuds</header> 
<paragraph id="H4AD313DB3A0448EA85FB2133D990DD90"><enum>(1)</enum><header>Establishment</header><text>In rule II, add at the end the following new clauses:</text> <quoted-block style="OLC" id="HDF3A8A2A8A544BB4AAB295D364F52B59" display-inline="no-display-inline"> <rules-clause id="H19AD96CF435748FD947F0B7F4D256B15"> <rules-clause-header>Office of Diversity and Inclusion</rules-clause-header><enum>9.</enum> <rules-paragraph id="H3C43399E76FF4BE9B45D148CDCBC9D30" display-inline="yes-display-inline"><enum>(a)</enum><text display-inline="yes-display-inline">There is established an Office of Diversity and Inclusion. The Speaker, in consultation with the Minority Leader, shall appoint a Director of the Office from recommendations provided by the chair of the Committee on House Administration in consultation with the ranking minority member of such committee.</text></rules-paragraph> 
<rules-paragraph id="H72574AE62FDD4029915AE299842DCB8F" indent="up1"><enum>(b)</enum><text display-inline="yes-display-inline">Subject to the policy direction and oversight of the Committee on House Administration, the Office of Diversity and Inclusion shall—</text> <rules-subparagraph id="H4743342BE8EE4908A2103F72FC1C5B8F"><enum>(1)</enum><text display-inline="yes-display-inline">direct and guide House employing offices to recruit, hire, train, develop, advance, promote, and retain a diverse workforce; </text></rules-subparagraph> 
<rules-subparagraph id="HEB4CF1BC5B47447C9B3E783E48DBDF23"><enum>(2)</enum><text display-inline="yes-display-inline">survey and evaluate diversity in House employing offices;</text></rules-subparagraph> <rules-subparagraph id="H085036FFFC38442A94B2F89631B867B9"><enum>(3)</enum><text display-inline="yes-display-inline">through the Director of the Office at the end of each session of Congress, submit a House of Representatives diversity report to the Speaker, the Majority Leader, the Minority Leader, the chair and ranking minority member of the Committee on House Administration, and the chair and ranking minority member of the Subcommittee on the Legislative Branch of the Committee on Appropriations; and</text></rules-subparagraph> 
<rules-subparagraph id="HD76B4A6BED474CB78CF0F300C6A8E727"><enum>(4)</enum><text>provide consultation and guidance in furtherance of increasing diversity and inclusion in the House.</text></rules-subparagraph> </rules-paragraph> </rules-clause> <rules-clause id="HF49C654C6B024A1D9D8AE3BB7A5F96EC"> <rules-clause-header>Office of the Whistleblower Ombuds</rules-clause-header><enum>10.</enum> <rules-paragraph id="H9605A04CFCD444D78E8DB347CF0ED97E" display-inline="yes-display-inline"><enum>(a)</enum><text display-inline="yes-display-inline">There is established an Office of the Whistleblower Ombuds. The Speaker, in consultation with the chairs and ranking minority members of the Committee on House Administration and the Committee on Oversight and Reform, shall appoint a Director of the Office.</text></rules-paragraph> 
<rules-paragraph id="HFB872C241D44487FAD09BF6332FBA6AB" indent="up1"><enum>(b)</enum><text display-inline="yes-display-inline">Subject to the policy direction and oversight of the Committee on House Administration, and in consultation with any other committee (at the request of the chair or ranking minority member of such other committee), the Office of the Whistleblower Ombuds shall—</text> <rules-subparagraph id="HB3D137B01FD3402683F174D7747A8872"><enum>(1)</enum><text display-inline="yes-display-inline">promulgate best practices for whistleblower intake for offices of the House; and</text></rules-subparagraph> 
<rules-subparagraph id="H7B1F8EEA3E2E43D4AA9C5B2F1CDC2E43"><enum>(2)</enum><text>provide training for offices of the House on whistleblower intake, including establishing an effective reporting system for whistleblowers, maintaining whistleblower confidentiality, advising staff of relevant laws and policies, and protecting information provided by whistleblowers.</text></rules-subparagraph> </rules-paragraph></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HE56584962C174724BF0BE399821A109E"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">In clause 4(d)(1)(A) of rule X—</text>

<rules-paragraph id="HAFB43ACA510D4E10A5AEAEE0BF211B0A" indent="up1"><enum>(b)</enum><text display-inline="yes-display-inline">The limitation in paragraph (a) shall not apply to any disclosure of an individual’s identity or personally identifiable information if—</text> <rules-subparagraph id="H2CF0782310964F6D9E757DC9560EB8B1"><enum>(1)</enum><text display-inline="yes-display-inline">the individual has provided express written consent prior to such disclosure;</text></rules-subparagraph> 
<rules-subparagraph id="HF14A27B6D71D44E2A066CF82E8817491"><enum>(2)</enum><text display-inline="yes-display-inline">the individual has already voluntarily and publicly disclosed their identity; or</text></rules-subparagraph> <rules-subparagraph id="H2034D3B5AAB649B28E7E54910D8444E0"><enum>(3)</enum><text display-inline="yes-display-inline">the disclosure is by the chair of a committee after an affirmative vote by two-thirds of the members of the committee that such disclosure is in the public interest.</text></rules-subparagraph></rules-paragraph>

When providing such notice to the individual the committee chair shall send the individual a written explanation of the reasons for the disclosure.</text> </rules-paragraph></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subsection id="HEDF7BBDA45584AAF94D09DA05AF38F79"><enum>(b)</enum><header>Deposition authority</header> 
<paragraph id="H49F5F5A23CBA42D9B98E5B7F1497A49E"><enum>(1)</enum><text>During the One Hundred Seventeenth Congress, the chair of a standing committee (other than the Committee on Rules), and the chair of the Permanent Select Committee on Intelligence, upon consultation with the ranking minority member of such committee, may order the taking of depositions, including pursuant to subpoena, by a member or counsel of such committee.</text></paragraph> <paragraph id="H9F9F332387C84D82A9299985893C6FFD"><enum>(2)</enum><text>Depositions taken under the authority prescribed in this subsection shall be subject to regulations issued by the chair of the Committee on Rules and printed in the Congressional Record.</text></paragraph></subsection> 
<subsection id="HEE93CB066B3A472BB3A91E8F636E9398"><enum>(c)</enum><header>War Powers resolution</header><text display-inline="yes-display-inline">During the One Hundred Seventeenth Congress, a motion to discharge a measure introduced pursuant to section 6 or section 7 of the War Powers Resolution (<external-xref legal-doc="usc" parsable-cite="usc/50/1545-46">50 U.S.C. 1545–46</external-xref>) shall not be subject to a motion to table.</text></subsection> <subsection id="H13A236E0B4E04FA5ACF4590FC35ED7E2"><enum>(d)</enum><header>Exercise facilities for former members</header><text>During the One Hundred Seventeenth Congress—</text> 
<paragraph id="H96C46E1FD4BC4D9495A7A705A2AF90C7"><enum>(1)</enum><text>The House of Representatives may not provide access to any exercise facility which is made available exclusively to Members and former Members, officers and former officers of the House of Representatives, and their spouses to any former Member, former officer, or spouse who is a lobbyist registered under the Lobbying Disclosure Act of 1995 or any successor statute or who is an agent of a foreign principal as defined in clause 5 of rule XXV. For purposes of this subsection, the term <term>Member</term> includes a Delegate or Resident Commissioner to the Congress.</text></paragraph> <paragraph id="HB62545E9C82A4506B5BE74C183628D29"><enum>(2)</enum><text>The Committee on House Administration shall promulgate regulations to carry out this subsection.</text></paragraph></subsection> 
<subsection id="H58DB12D092884E1FAE3D96EA688304BB"><enum>(e)</enum><header>Empaneling investigative subcommittee of the Committee on Ethics</header><text>The text of House Resolution 451, One Hundred Tenth Congress, shall apply in the One Hundred Seventeenth Congress in the same manner as such provision applied in the One Hundred Tenth Congress, except that references to the Committee on Standards of Official Conduct shall be construed as references to the Committee on Ethics.</text></subsection> <subsection id="H59665612ABB445C9B22D3D5A1E182904"><enum>(f)</enum><header>Non-Disclosure agreements</header><text>Any non-disclosure agreement imposed by any employing or contracting authority in the House of Representatives to which a paid or unpaid employee or contractor is or was required to agree as a term of employment shall—</text> 
<paragraph id="H146B5ECEC56C4955B45ACF2C72B50FDD"><enum>(1)</enum><text>provide clear guidance that the employee or contractor may communicate concerning any matter with the Committee on Ethics, the Office of Congressional Workplace Rights, or any other office or entity designated by the Committee on House Administration without prior, concurrent, or subsequent notice or approval; and</text></paragraph> <paragraph id="H1FF76D6F64D0438BA8943308F8FFCBCF"><enum>(2)</enum><text>not be binding and shall have no legal effect to the extent to which it requires prior, concurrent, or subsequent notice or approval from anyone on any matter with respect to communications from an employee or contractor to any of the committees, offices, or entities described in paragraph (1).</text></paragraph></subsection> 
<subsection id="H060AEF52298C4CA5A6D9E2E7F351DB90"><enum>(g)</enum><header>Requiring Members to pay for discrimination settlements</header> 
<paragraph id="H5546F44E3CC248E69485676D19747F47"><enum>(1)</enum><header>In general</header><text>In the case of a settlement of a complaint under the Congressional Accountability Act of 1995 in connection with a claim alleging a violation described in paragraph (2) which is committed personally by a Member, Delegate, or Resident Commissioner, if the Member, Delegate, or Resident Commissioner is not required under law to reimburse the Treasury for the amount of the settlement, the chair and ranking minority member of the Committee on House Administration may not approve the settlement pursuant to clause 4(d)(2) of rule X unless, under the terms and conditions of the settlement, the Member, Delegate, or Resident Commissioner is required to reimburse the Treasury for the amount of the settlement.</text></paragraph> <paragraph id="H63AA6C5276184E90B86B30B441896267"><enum>(2)</enum><header>Violations described</header><text>A violation described in this paragraph is—</text> 
<subparagraph id="H4B0601FC823644EA8DBC1BD3071B13B8"><enum>(A)</enum><text>a violation of section 201(a) or section 206(a) of the Congressional Accountability Act of 1995; or</text></subparagraph> <subparagraph id="H61C88E52C6C44AB8BBF395765D60E5E8"><enum>(B)</enum><text>a violation of section 207 of such Act which consists of intimidating, taking reprisal against, or otherwise discriminating against any covered employee under such Act because of a claim alleging a violation described in subparagraph (A).</text></subparagraph></paragraph></subsection> 
<subsection id="H906BA23F79074BF3BBDEF5F5D81989F5"><enum>(h)</enum><header>Mandatory anti-Harassment and anti-Discrimination policies for House offices</header> 
<paragraph id="H829580122A444B1AB78C597140F110C4"><enum>(1)</enum><header>Requiring offices to adopt policy</header><text display-inline="yes-display-inline">Each employing office of the House of Representatives under the Congressional Accountability Act of 1995 shall adopt an anti-harassment and anti-discrimination policy for the office's workplace.</text></paragraph> <paragraph id="HA6A340B54D524F6290CD64AD94AB65D8"><enum>(2)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than April 1, 2021, the Committee on House Administration shall promulgate regulations to carry out this subsection, and shall ensure that such regulations are consistent with the requirements of the Congressional Accountability Act of 1995, rule XXIII, and other relevant laws, rules, and regulations.</text></paragraph></subsection> 
<subsection id="H290B29EF568948B380A309BBD8FE311F"><enum>(i)</enum><header>Displaying statement of rights and protections provided to House employees</header><text display-inline="yes-display-inline">The Committee on House Administration shall issue regulations to provide that each employing office of the House of Representatives shall post in a prominent location in the office (including, in the case of the office of a Member, Delegate, or the Resident Commissioner, a prominent location in each district office) a statement of the rights and protections provided to employees of the House of Representatives under the Congressional Accountability Act of 1995, including the procedures available to employees of the House under such Act for responding to and adjudicating allegations of violations of such rights and protections.</text></subsection> <subsection id="HB9A5116ED60D43D78CF8B87FC59FA424"><enum>(j)</enum><header>Broadening availability and utility of legislative documents in machine-Readable formats</header><text>The Committee on House Administration, the Clerk, and other officers and officials of the House shall continue efforts to broaden the availability and utility of legislative documents in machine readable formats in the One Hundred Seventeenth Congress in furtherance of the institutional priorities of—</text> 
<paragraph id="HE5A8B94FA3474860A8EF48A821429A4A"><enum>(1)</enum><text>improving public availability and use of legislative information produced by the House and its committees; and</text></paragraph> <paragraph id="H1916BB69BB3F46AEB1812E7903F6B570"><enum>(2)</enum><text display-inline="yes-display-inline">enabling all House staff to produce comparative prints showing the differences between versions of legislation, how proposed legislation will amend existing law, and how an amendment may change proposed legislation.</text></paragraph></subsection> 
<subsection id="HD199BB7CB2A948ADA60AE31D1F39B09C"><enum>(k)</enum><header>Improving the Committee electronic document repository</header><text display-inline="yes-display-inline">The Clerk, the Committee on House Administration, and other officers and officials of the House shall undertake efforts to improve the electronic document repository operated by the Clerk for use by committees of the House in the One Hundred Seventeenth Congress, in furtherance of the institutional priority of increasing public availability and identification of legislative information produced and held by House committees, including votes, amendments, and witness disclosure forms.</text></subsection> <subsection id="H7E086B0755CF490D897A34B06AEBA1E4"><enum>(l)</enum><header>Inclusion of citations for proposed repeals and amendments</header><text>To the maximum extent practicable and consistent with established drafting conventions, an instruction in a bill or joint resolution proposing to repeal or amend any law or part thereof not contained in a codified title of the United States Code shall include, in parentheses immediately following the designation of the matter proposed to be repealed or amended, the applicable United States Code citation (which may be a note in the United States Code), or, if no such citation is available, an appropriate alternative citation to the applicable law or part.</text></subsection> 
<subsection id="HDA9D0DFFC6764BF0A6DB69DC131BE692"><enum>(m)</enum><header>Providing for transparency with respect to memorials submitted pursuant to Article V of the Constitution of the United States</header><text>With respect to any memorial presented under clause 3 of rule XII purporting to be an application of the legislature of a State calling for a convention for proposing amendments to the Constitution of the United States pursuant to Article V, or a rescission of any such prior application—</text> <paragraph id="H64261389BAEB402EBB1801B1683FC0A4"><enum>(1)</enum><text display-inline="yes-display-inline">the chair of the Committee on the Judiciary shall, in the case of a memorial presented in the One Hundred Fourteenth Congress or succeeding Congresses, and may, in the case of such a memorial presented prior to the One Hundred Fourteenth Congress, designate any such memorial for public availability by the Clerk; and</text></paragraph> 
<paragraph id="HCF5E59C8EFC14F1997C669DE2530B682"><enum>(2)</enum><text>the Clerk shall make such memorials as are designated pursuant to paragraph (1) publicly available in electronic form, organized by State of origin and year of receipt, and shall indicate whether the memorial was designated as an application or a rescission.</text></paragraph></subsection> <subsection id="H531F4D6378FF431AB811FFDBC160A357"><enum>(n)</enum><header>Subcommittees</header><text display-inline="yes-display-inline">Notwithstanding clause 5(d) of rule X, during the One Hundred Seventeenth Congress the Committee on Agriculture may have not more than six subcommittees.</text> </subsection> 
<subsection id="H67681C620C2A4EF7A6FFD415A5030E1F"><enum>(o)</enum><header>Congressional Member Organization transparency reform</header> 
<paragraph id="HA2F2801715C7458585E46C3213CB00E6"><enum>(1)</enum><header>Payment of salaries and expenses through account of organization</header><text>A Member of the House of Representatives and an eligible Congressional Member Organization may enter into an agreement under which—</text> <subparagraph id="H3DDA17A46CB1495286ADE3EDAAC6B087"><enum>(A)</enum><text>an employee of the Member’s office may carry out official and representational duties of the Member by assignment to the Organization; and</text></subparagraph> 
<subparagraph id="H971E720B798345AFB480C249A7542638"><enum>(B)</enum><text>to the extent that the employee carries out such duties under the agreement, the Member shall transfer the portion of the Members’ Representational Allowance (MRA) of the Member which would otherwise be used for the salary and related expenses of the employee to a dedicated account in the House of Representatives which is administered by the Organization, in accordance with the regulations promulgated by the Committee on House Administration under paragraph (2).</text></subparagraph></paragraph> <paragraph id="HEB3C3F0648F24C18910B7FC4DC11F96E"><enum>(2)</enum><header>Regulations</header><text>The Committee on House Administration (hereafter referred to in this subsection as the <quote>Committee</quote>) shall promulgate regulations as follows:</text> 
<subparagraph id="HD74C60C795204C0EB84DCCDD002CEA51"><enum>(A)</enum><header>Use of MRA</header><text>Pursuant to the authority of section 101(d) of the House of Representatives Administrative Reform Technical Corrections Act (<external-xref legal-doc="usc" parsable-cite="usc/2/5341">2 U.S.C. 5341(d)</external-xref>), the Committee shall prescribe regulations to provide that an eligible Congressional Member Organization may use the amounts transferred to the Organization’s dedicated account under paragraph (1)(B) for the same purposes for which a Member of the House of Representatives may use the Members’ Representational Allowance, except that the Organization may not use such amounts for franked mail, official travel, or leases of space or vehicles.</text></subparagraph> <subparagraph id="H8EE71A49907B4C199CAD9F62EF61FA09"><enum>(B)</enum><header>Maintenance of limitations on number of shared employees</header><text>Pursuant to the authority of section 104(d) of the House of Representatives Administrative Reform Technical Corrections Act (<external-xref legal-doc="usc" parsable-cite="usc/2/5321">2 U.S.C. 5321(d)</external-xref>), the Committee shall prescribe regulations to provide that an employee of the office of a Member of the House of Representatives who is covered by an agreement entered into under paragraph (1) between the Member and an eligible Congressional Member Organization shall be considered a shared employee of the Member’s office and the Organization for purposes of such section, and shall include in such regulations appropriate accounting standards to ensure that a Member of the House of Representatives who enters into an agreement with such an Organization under paragraph (1) does not employ more employees than the Member is authorized to employ under such section.</text></subparagraph> 
<subparagraph id="HF0F0CFE43FD742CFB1B17C17A36BB241"><enum>(C)</enum><header>Participation in student loan repayment program</header><text>Pursuant to the authority of section 105(b) of the Legislative Branch Appropriations Act, 2003 (<external-xref legal-doc="usc" parsable-cite="usc/2/4536">2 U.S.C. 4536(b)</external-xref>), relating to the student loan repayment program for employees of the House, the Committee shall promulgate regulations to provide that, in the case of an employee who is covered by an agreement entered into under paragraph (1) between a Member of the House of Representatives and an eligible Congressional Member Organization and who participates in such program while carrying out duties under the agreement—</text> <clause id="HD205A1D636EC4B4AA5D276BA16316D6C"><enum>(i)</enum><text>any funds made available for making payments under the program with respect to the employee shall be transferred to the Organization’s dedicated account under paragraph (1)(B); and</text></clause> 
<clause id="HD3ECAE14B8014306835DC17699EDE25E"><enum>(ii)</enum><text>the Organization shall use the funds to repay a student loan taken out by the employee, under the same terms and conditions which would apply under the program if the Organization were the employing office of the employee.</text></clause></subparagraph> <subparagraph id="HDB6E0C725ABF47E1BBE1D0CFC6E21018"><enum>(D)</enum><header>Access to House services</header><text>The Committee shall prescribe regulations to ensure that an eligible Congressional Member Organization has appropriate access to services of the House.</text></subparagraph> 
<subparagraph id="HD33B9C0D6D484665ACE5037B40D64477"><enum>(E)</enum><header>Other regulations</header><text>The Committee shall promulgate such other regulations as may be appropriate to carry out this subsection.</text></subparagraph></paragraph> <paragraph id="HFFCA6C6C72E344A2819FA91A535D3746"><enum>(3)</enum><header>Eligible congressional member organization defined</header><text>In this subsection, the term <term>eligible Congressional Member Organization</term> means, with respect to the One Hundred Seventeenth Congress, an organization meeting each of the following requirements:</text> 
<subparagraph id="H95272B0F83114CAAA9B3F65F7E24BD99"><enum>(A)</enum><text>The organization is registered as a Congressional Member Organization with the Committee on House Administration.</text></subparagraph> <subparagraph id="H09FC85572C2A4D798B818EEEF7A92BFA"><enum>(B)</enum><text>The organization designates a single Member of the House of Representatives to be responsible for the administration of the organization, including the administration of the account administered under paragraph (1)(B), and includes the identification of such Member with the statement of organization that the organization files and maintains with the Committee on House Administration.</text></subparagraph> 
<subparagraph id="HB36BCF877A9541DFB45A2BF55E12C462"><enum>(C)</enum><text>At least 3 employees of the House are assigned to perform some work for the organization.</text></subparagraph> <subparagraph id="HDF0D9E7996E849AD9E831DB32F68123F"><enum>(D)</enum><text>During the One Hundred Sixteenth Congress, at least 15 Members of the House of Representatives used a portion of the Members’ Representational Allowance of the Member for the salary and related expenses of an employee who was a shared employee of the Member’s office and the organization.</text></subparagraph> 
<subparagraph id="H56BDB7B06E9149C8A36394B00A8D26DC"><enum>(E)</enum><text>The organization files a statement with the Committee on House Administration and the Chief Administrative Officer of the House of Representatives certifying that it will administer an account in accordance with paragraph (1)(B).</text></subparagraph></paragraph></subsection> <subsection id="HA27D0D8C593A404AA70ED6A2D5BE0D3E"><enum>(p)</enum><header>Budget matters</header><text display-inline="yes-display-inline">During the first session of the One Hundred Seventeenth Congress, pending the adoption of a concurrent resolution on the budget for fiscal year 2021, the allocations, aggregates, and other appropriate levels as contained in the statement of the chair of the Committee on the Budget of the House of Representatives in the Congressional Record of May 1, 2020, as adjusted in the One Hundred Sixteenth Congress, shall be considered for all purposes in the House to be the allocations, aggregates, and other appropriate levels under titles III and IV of the Congressional Budget Act of 1974.</text></subsection> 
<subsection id="H428007D153E64F9D9BAED2D932B35612"><enum>(q)</enum><header>Reissuance of subpoenas prior to committee organization</header> 
<paragraph id="H78D76E1FF20B4EA0BA4E2479B7F879E8" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The House authorizes the chair of the Committee on Oversight and Reform (when elected), on behalf of the Committee on Oversight and Reform and until such committee has adopted rules pursuant to clause 2(a) of rule XI, to issue subpoenas related to the investigation into the accuracy and timing of the 2020 decennial census and related matters.</text></paragraph> <paragraph id="HA3CC07F6D3534B0DA7A4FEEE32A0FDE0" indent="up1"><enum>(2)</enum><text>The House authorizes the chair of the Select Subcommittee on the Coronavirus Crisis (when designated), on behalf of the Select Subcommittee on the Coronavirus Crisis and until the Committee on Oversight and Reform has adopted rules pursuant to clause 2(a) of rule XI, to issue subpoenas related to the investigation into political interference in the response to the coronavirus pandemic at the Department of Health and Human Services and Centers for Disease Control and Prevention and related matters.</text></paragraph> </subsection> 
<subsection id="HA4BADC183EDF4ACAB5C900BF832B45C0"><enum>(r)</enum><header>Numbering of bills</header><text>In the One Hundred Seventeenth Congress, the first 10 numbers for bills (H.R. 1 through H.R. 10) shall be reserved for assignment by the Speaker and the second 10 numbers for bills (H.R. 11 through H.R. 20) shall be reserved for assignment by the Minority Leader.</text></subsection> <subsection id="H47120B48CEF648BDA43299D577D66B95"><enum>(s)</enum><header>Remote voting by proxy and remote committee activity</header><text display-inline="yes-display-inline">House Resolution 965, One Hundred Sixteenth Congress, shall apply in the One Hundred Seventeenth Congress in the same manner as such resolution applied in the One Hundred Sixteenth Congress, except that—</text> 
<paragraph id="H321AA014DF7649558C7D0BB2B8E1BFAF"><enum>(1)</enum><text>the notification and availability requirements of section 2 do not apply to revocation letters submitted to the Clerk after an automatic revocation pursuant to section 2(a)(2)(B);</text></paragraph> <paragraph id="HCB3FA2BFFF754176A5B7537633660E6C"><enum>(2)</enum><text>section 4(b) shall not apply; and</text></paragraph> 
<paragraph id="H1686553C050E41D1B7DCD0D00618B511"><enum>(3)</enum><text>the chair of the Committee on House Administration, in consultation with the ranking minority member, shall identify and submit to the Speaker and to the chair and ranking minority member of the Committee on Rules specific operable and secure technology that may be used to conduct remote voting in the House and shall provide certification of such submission to the House as though pursuant to section 5(a).</text></paragraph></subsection> <subsection id="HB2BF7FD56123447E943F8697FC7E2AFA"><enum>(t)</enum><header>Witness diversity</header><text display-inline="yes-display-inline">Not later than July 1, 2021, the Office of Diversity and Inclusion shall submit a report to the Committee on House Administration and the Committee on Rules recommending a method to survey the diversity of witness panels at committee hearings. Not later than July 31, 2021, the Committee on House Administration and the Committee on Rules shall take such steps as may be necessary to ensure the implementation of such method.</text></subsection> 
<subsection id="HABE387D7730C48E7B91BC58A0633A9BE"><enum>(u)</enum><header>Requirements for Committee hearing and markup</header><text display-inline="yes-display-inline">During the One Hundred Seventeenth Congress, notwithstanding clause 12(c) of rule XXI (as added by section 2(r)), clause 12(a) of rule XXI shall not apply before April 1, 2021.</text></subsection> <subsection id="H0F489E4F2A9F4162B275004F688D4716" commented="no"><enum>(v)</enum><header>Exemptions</header><text display-inline="yes-display-inline">The chair of the Committee on the Budget may adjust an estimate under clause 4 of rule XXIX to—</text> 
<paragraph id="H3E004B5F8F1D40668BF9DE6B632A92B1"><enum>(1)</enum><text>exempt the budgetary effects of measures to prevent, prepare for, or respond to economic or public health consequences resulting from the COVID–19 pandemic; and</text></paragraph> <paragraph id="H076BEE972DB246279D45F3CB3FCE9897"><enum>(2)</enum><text>exempt the budgetary effects of measures to prevent, prepare for, or respond to economic, environmental, or public health consequences resulting from climate change.</text></paragraph></subsection> 
<subsection id="H5D242AB81BCF419687E21C6D40FA217C"><enum>(w)</enum><header>Further expenses for resolving contested elections</header> 
<paragraph id="HE865A01067A74319961589F15EEB6EEF"><enum>(1)</enum><header>Amounts for expenses of Committee on House Administration</header><text display-inline="yes-display-inline">There shall be paid out of the applicable accounts of the House of Representatives such sums as may be necessary for further expenses of the Committee on House Administration for the One Hundred Seventeenth Congress for resolving contested elections.</text></paragraph> <paragraph id="H3482A03300E5443CAE4A09955B41B235"><enum>(2)</enum><header>Session limitation</header><text>The amount specified in paragraph (1) shall be available for expenses incurred during the period beginning at noon on January 3, 2021, and ending immediately before noon on January 3, 2022.</text></paragraph> 
<paragraph id="HAE69E46DE88143F481033C0190064C46"><enum>(3)</enum><header>Vouchers</header><text>Payments under this subsection shall be made on vouchers authorized by the Committee on House Administration, signed by the chair of the Committee, and approved in the manner directed by the Committee.</text></paragraph> <paragraph id="H64649994E2C14ED6B9D3D6BEC0675B19"><enum>(4)</enum><header>Regulations</header><text>Amounts made available under this subsection shall be expended in accordance with regulations prescribed by the Committee on House Administration.</text></paragraph></subsection> 
<subsection id="H9C12E55E29B7461E86CA04C72F351A46"><enum>(x)</enum><header>Support for Senate measures</header><text display-inline="yes-display-inline">Not later than February 1, 2021, the Clerk shall submit to the chair of the Committee on Rules regulations establishing a process for Members to indicate their support for Senate measures that have been received by the House. Such process shall include the maintenance of a publicly available list of Members supporting each such Senate measure. Upon receipt of such regulations, the chair of the Committee on Rules shall cause them to be printed in the Congressional Record, and Members shall be permitted to indicate their support for Senate measures accordingly.</text></subsection> <subsection id="HBCED741733854F21AF5DE6A8FAA6D731"><enum>(y)</enum><header>Dissemination of manipulated media</header><text display-inline="yes-display-inline">The Committee on Ethics is directed to report to the House, not later than December 31, 2021, any recommended amendments to the Code of Official Conduct, as well as any accompanying regulations, intended to address the circumstances and instances, if any, for which a Member, Delegate, Resident Commissioner, officer, or employee of the House may be subject to discipline for the dissemination by electronic means, including by social media, of any image, video, or audio file that has been distorted or manipulated with the intent to mislead the public.</text></subsection> </section> 
<section id="H85872AC40EA24B07831EC9D027B6A30C"><enum>4.</enum><header>Committees, commissions, and House offices</header> 
<subsection id="H4F266EC526014E12A47C3A1BA0124BA2"><enum>(a)</enum><header>House Democracy Partnership</header><text display-inline="yes-display-inline">House Resolution 24, One Hundred Tenth Congress, shall apply in the One Hundred Seventeenth Congress in the same manner as such resolution applied in the One Hundred Tenth Congress, except that the commission concerned shall be known as the House Democracy Partnership.</text></subsection> <subsection id="H5AD81EF7DCC8416AAE71BC9C8CE99FBE"><enum>(b)</enum><header>Tom Lantos Human Rights Commission</header><text display-inline="yes-display-inline">Sections 1 through 7 of House Resolution 1451, One Hundred Tenth Congress, shall apply in the One Hundred Seventeenth Congress in the same manner as such provisions applied in the One Hundred Tenth Congress, except that—</text> 
<paragraph id="HA2383CFEEA484A51AF2BF9FF8D6A9071"><enum>(1)</enum><text>the Tom Lantos Human Rights Commission may, in addition to collaborating closely with other professional staff members of the Committee on Foreign Affairs, collaborate closely with professional staff members of other relevant committees;</text></paragraph> <paragraph id="H05F1933EA560463FB507A27EEA3F9629"><enum>(2)</enum><text>the resources of the Committee on Foreign Affairs which the Commission may use shall include all resources which the Committee is authorized to obtain from other offices of the House of Representatives; and</text></paragraph> 
<paragraph id="HB902EA78B203404CB02C64B2E06EF503"><enum>(3)</enum><text>any amounts authorized to provide full-time professional staff and resources to the Tom Lantos Human Rights Commission shall be in addition to and separate from the amounts authorized for salaries and expenses of the Committee on Foreign Affairs as provided by resolution of the House, shall be administered by the Committee on Foreign Affairs, and shall be distributed equally between the co-chairs of the Commission.</text></paragraph></subsection> <subsection id="HB1B1A59D2209468F879857E740DABDE5"><enum>(c)</enum><header>Office of Congressional Ethics</header><text display-inline="yes-display-inline">Section 1 of House Resolution 895, One Hundred Tenth Congress, shall apply in the One Hundred Seventeenth Congress in the same manner as such provision applied in the One Hundred Tenth Congress, except that—</text> 
<paragraph id="H0AA598EB482745959AA4952302B98E3E"><enum>(1)</enum><text>the Office of Congressional Ethics shall be treated as a standing committee of the House for purposes of section 202(i) of the Legislative Reorganization Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/4301">2 U.S.C. 4301(i)</external-xref>);</text></paragraph> <paragraph id="HFB28EE8214E64A5DA8AE153504EF1590"><enum>(2)</enum><text>references to the Committee on Standards of Official Conduct shall be construed as references to the Committee on Ethics;</text></paragraph> 
<paragraph id="H3242B7A207414B2EA49DCBA6D570D71C"><enum>(3)</enum><text>any requirement for concurrence in section 1(b)(1) shall be construed as a requirement for consultation;</text></paragraph> <paragraph id="H3576BDD518CF4C4DBFE13CF28BACAE0B"><enum>(4)</enum><text>the second sentence of section 1(b)(6)(A) shall not apply;</text></paragraph> 
<paragraph id="H5928A68E012943CEADC79D2E545CB956"><enum>(5)</enum><text>members subject to section 1(b)(6)(B) may be reappointed for a fourth additional term;</text></paragraph> <paragraph id="HF95568205AC6453199FC995BBC191EA3"><enum>(6)</enum><text>any individual who is the subject of a preliminary review or second-phase review by the board shall be informed of the right to be represented by counsel and invoking that right should not be held negatively against such individual; and</text></paragraph> 
<paragraph id="H5B245DD7A6FB470AAF039CB8405F739C"><enum>(7)</enum><text>the Office may not take any action that would deny any person any right or protection provided under the Constitution of the United States.</text></paragraph></subsection> <subsection id="H00E77E95B53D40628BD5C6A135788B5B"><enum>(d)</enum><header>Select Committee on the Climate Crisis</header><text display-inline="yes-display-inline">Section 104(f) of House Resolution 6, One Hundred Sixteenth Congress, shall apply in the One Hundred Seventeenth Congress in the same manner as such section applied in the One Hundred Sixteenth Congress, except that—</text> 
<paragraph id="H5A7DC3BCEFCB407981E3B6DEF8F99C46"><enum>(1)</enum><text display-inline="yes-display-inline">the investigative jurisdiction of the Select Committee on the Climate Crisis shall consist of policies, strategies, and innovations to achieve substantial and permanent reductions in pollution and other activities that contribute to the climate crisis which will honor our responsibility to be good stewards of the planet for future generations and advance environmental justice;</text></paragraph> <paragraph id="H22B707D75EF74C77B7DB896E4F589F26"><enum>(2)</enum><text>the Select Committee shall coordinate with and advise standing committees with relevant jurisdiction with respect to such policies, strategies, and innovations;</text></paragraph> 
<paragraph id="HD7597E38EB7E4F6C983C677A508E5766"><enum>(3)</enum><text>any records obtained by a standing committee pursuant to a subpoena or deposition recommended by the Select Committee pursuant to section 104(f)(3)(B)(iii) may be transferred to the Select Committee; and</text></paragraph> <paragraph id="H80C5645FC54F47059EB61918A99CB86A"><enum>(4)</enum><text>the Select Committee shall submit all policy recommendations referenced in section 104(f)(5) by December 31, 2021, and all reports referenced in section 104(f)(5) by December 31, 2022.</text></paragraph></subsection> 
<subsection id="H591B9F2AA2134A41B3EDB54C8E00F320"><enum>(e)</enum><header>Select Committee on the Modernization of Congress</header><text>Section 201 of House Resolution 6, One Hundred Sixteenth Congress, shall apply in the One Hundred Seventeenth Congress in the same manner as such section applied in the One Hundred Sixteenth Congress, except that—</text> <paragraph id="H8B9D5309EC9145039478ED1422615428"><enum>(1)</enum><text>the Select Committee shall submit the final report under section 201(f)(3) not later than December 31, 2022; and</text></paragraph> 
<paragraph id="H4C74E3784D2B428AB37D907E0BD81405"><enum>(2)</enum><text>section 201(g)(1) shall not apply.</text></paragraph> </subsection> <subsection id="H92166EEE09C2441DAD94C813E0B3114F"><enum>(f)</enum><header>Select Subcommittee on the Coronavirus Crisis</header><text display-inline="yes-display-inline">Sections 1 through 7 of House Resolution 935, One Hundred Sixteenth Congress, shall apply in the One Hundred Seventeenth Congress in the same manner as such provisions applied in the One Hundred Sixteenth Congress.</text></subsection> 
<subsection id="HEF8F4BC9D09D487C9BE3BED2184334D3"><enum>(g)</enum><header>Select Committee on Economic Disparity and Fairness in Growth</header> 
<paragraph id="H6E1BA82BCA234DD7B66F37F8FA113C37"><enum>(1)</enum><header>Establishment; composition</header> 
<subparagraph id="HD0941BF729DB448FA0591D516CA97839"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is hereby established a Select Committee on Economic Disparity and Fairness in Growth (hereafter in this subsection referred to as the <quote>Select Committee</quote>).</text></subparagraph> <subparagraph id="HA54ED71A86464CC1879E7DFE478C90BA"><enum>(B)</enum><header>Composition</header><text>The Select Committee shall be composed of 15 Members, Delegates, or the Resident Commissioner appointed by the Speaker, of whom 6 shall be appointed on the recommendation of the Minority Leader. The Speaker shall designate one member of the Select Committee as its chair. A vacancy in the membership of the Select Committee shall be filled in the same manner as the original appointment.</text></subparagraph></paragraph> 
<paragraph id="H679807674ADF4591BF81CCEC71DA7A7F"><enum>(2)</enum><header>Jurisdiction; functions</header> 
<subparagraph id="H4FC82A2324F042C4BA92D3E7F03339F9"><enum>(A)</enum><header>Legislative jurisdiction</header><text>The Select Committee shall not have legislative jurisdiction and shall have no authority to take legislative action on any bill or resolution.</text></subparagraph> <subparagraph id="H14FD0810208046C7908409B55A2861CC"><enum>(B)</enum><header>Investigative jurisdiction</header><text display-inline="yes-display-inline">The sole authority of the Select Committee shall be to investigate, study, make findings, and develop recommendations on policies, strategies, and innovations to make our economy work for everyone, empowering American economic growth while ensuring that no one is left out or behind in the 21st Century Economy. The Select Committee shall coordinate with and advise standing committees with relevant jurisdiction with respect to policy related to economic fairness, access to education, and workforce development. The Select Committee may, at its discretion, hold public hearings in connection with any aspect of its investigative functions.</text></subparagraph></paragraph> 
<paragraph id="HE3D4AEE50534452D8B3BAE5E286A8FB3"><enum>(3)</enum><header>Procedure</header> 
<subparagraph id="HC3C414C2FBC240D8A4970000D6BFA783" display-inline="yes-display-inline"><enum>(A)</enum><text>Except as specified in subparagraph (B), the Select Committee shall have the authorities and responsibilities of, and shall be subject to the same limitations and restrictions as, a standing committee of the House, and shall be deemed a committee of the House for all purposes of law or rule.</text></subparagraph> <subparagraph id="HF7382AD381784BF09CEA19175F7B8D84" indent="up1"><enum>(B)</enum> <clause id="HAFE82DD1050346058CF5131D6C62F700" display-inline="yes-display-inline" indent="up1"><enum>(i)</enum><text>Rules X and XI shall apply to the Select Committee where not inconsistent with this subsection.</text></clause> 
<clause id="HF167477DB1AD42FF8C658A8E81CE10C2" indent="up1"><enum>(ii)</enum><text>Service on the Select Committee shall not count against the limitations in clause 5(b)(2) of rule X.</text></clause> <clause id="H83A7513FF6AC44CEBE1BF4720AC2371A" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">Clause 2(m)(1)(B) of rule XI, clause 2(m)(3) of rule XI, and section 3(b) of this resolution shall not apply to the Select Committee, but the Select Committee may recommend subpoenas and depositions and submit such recommendations to the relevant standing committee. Any records obtained by a standing committee pursuant to a subpoena or deposition recommended by the Select Committee pursuant to this clause may be transferred to the Select Committee.</text></clause> 
<clause id="H9B1E6C040166479BA9CD7CDEEAA3C43F" indent="up1"><enum>(iv)</enum><text>Clause 2(d) of rule X shall not apply to the Select Committee.</text></clause></subparagraph></paragraph> <paragraph id="H9E262EC8B17D406E8CE641CD88FA43A8"><enum>(4)</enum><header>Amounts for initial expenses</header> <subparagraph id="H90753A247ACF4A70BC59B1415BB815A4"><enum>(A)</enum><header>Payment of expenses</header><text display-inline="yes-display-inline">There shall be paid out of the applicable accounts of the House of Representatives not more than $500,000 for the expenses of the Select Committee, to be available during the period beginning at noon on January 3, 2021, and ending on March 31, 2021.</text></subparagraph> 
<subparagraph id="H399D1AEBED4E4ACF84A841D6A1574395"><enum>(B)</enum><header>Vouchers</header><text>Payments under this paragraph shall be made on vouchers authorized by the Select Committee, signed by the chair of the Select Committee, and approved in the manner directed by the Committee on House Administration.</text></subparagraph> <subparagraph id="H50B370426B1746488A383832E4F46ADD"><enum>(C)</enum><header>Regulations</header><text>Amounts made available under this paragraph shall be expended in accordance with regulations prescribed by the Committee on House Administration.</text></subparagraph></paragraph> 
<paragraph id="HB7892A23C8344035AE47514A4BDDE6ED"><enum>(5)</enum><header>Use of staff</header><text display-inline="yes-display-inline">To enable the Select Committee to carry out the purposes of this subsection, the Select Committee may use the services of staff of the House.</text> </paragraph> <paragraph id="HAB39D8E8415349398C00B02999EE789D"><enum>(6)</enum><header>Reporting</header><text display-inline="yes-display-inline">The Select Committee may report to the House or any committee of the House from time to time the results of its investigations and studies, together with such detailed findings and policy recommendations as it may deem advisable. All such reports shall be submitted to the House by December 31, 2022. All such policy recommendations shall be submitted to the relevant standing committees not later than December 31, 2021.</text></paragraph> 
<paragraph id="H094AEE715498433B8F92E91152F83DA5"><enum>(7)</enum><header>Publication</header><text>The Select Committee shall ensure that reports and proposals prepared in accordance with this subsection shall, upon completion, be made available to the general public in widely accessible formats not later than 30 calendar days following the respective dates for completion set forth in paragraph (6).</text></paragraph></subsection></section> <section id="HAB84E43DD4234EDE8E48158C3744EE3F"><enum>5.</enum><header>Orders of business<editorial></editorial></header> <subsection id="HFBA63F9BBB2B46D085C4A94A98AC5FDD"><enum>(a)</enum> <paragraph id="HD16B3AF50AED4330AD1DDC159A75E000" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">On any legislative day during the period from January 3, 2021 through January 28, 2021—</text> 
<subparagraph id="HF0E4AA8BF1F84369A96EA2DD84C96A07" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the Journal of the proceedings of the previous day shall be considered as approved; and</text></subparagraph> <subparagraph id="HC9290BE246234E7C8A87104FF85278EA" indent="up1"><enum>(B)</enum><text>the Chair may at any time declare the House adjourned to meet at a date and time, within the limits of clause 4, section 5, article I of the Constitution, to be announced by the Chair in declaring the adjournment.</text></subparagraph></paragraph> 
<paragraph id="HFCA6925D118A4B00B4CD0B5A898AF43B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Speaker may appoint Members to perform the duties of the Chair for the duration of the period addressed by paragraph (1) as though under clause 8(a) of rule I.</text></paragraph> <paragraph id="H25E12BA2F7FC489B88E7E13FD4B94B76" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Each day during the period addressed by paragraph (1) shall not constitute a calendar day for purposes of section 7 of the War Powers Resolution (<external-xref legal-doc="usc" parsable-cite="usc/50/1546">50 U.S.C. 1546</external-xref>).</text></paragraph> 
<paragraph id="H9DDC8370EA7C4B43A15E5CB5C92C17AA" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Each day during the period addressed by paragraph (1) shall not constitute a legislative day for purposes of clause 7 of rule XIII.</text></paragraph> <paragraph id="H017B4C07A3014128AFD59A6D9341C3EB" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">Each day during the period addressed by paragraph (1) shall not constitute a calendar or legislative day for purposes of clause 7(c)(1) of rule XXII.</text></paragraph> 
<paragraph id="HA46573106C24455EB8337ED2D483CE65" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">Each day during the period addressed by paragraph (1) shall not constitute a legislative day for purposes of clause 7 of rule XV.</text></paragraph></subsection> <subsection id="H219B61ACBD4F47AC82A99963773AB693"><enum>(b)</enum><text display-inline="yes-display-inline">It shall be in order at any time through the legislative day of January 28, 2021, for the Speaker to entertain motions that the House suspend the rules as though under clause 1 of rule XV. The Speaker or her designee shall consult with the Minority Leader or his designee on the designation of any matter for consideration pursuant to this subsection.</text></subsection> 
<subsection id="H9DD70D5E6F214EE9B831AB9DB78A5E95"><enum>(c)</enum><text display-inline="yes-display-inline">The requirement of clause 6(a) of rule XIII for a two-thirds vote to consider a report from the Committee on Rules on the same day it is presented to the House is waived with respect to any resolution reported through the legislative day of January 28, 2021.</text></subsection> </section> </resolution-body> <attestation><attestation-group><attestor display="no">Cheryl L.
