BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to increase the deduction allowed for student loan interest and to exclude from gross income discharges of income contingent or income-based student loan indebtedness.</official-title></form><legis-body id="HBEE07DE24F524F5698305AA0A2D9B307" style="OLC"><section id="HB7CC3E15188C4BB899EAAF6E9B770AB8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Students and Families Empowerment Act</short-title></quote>.</text></section><section id="H110D17AD32924998B66BBB6AAE6F7083"><enum>2.</enum><header>Increase in deduction for student loan interest</header><subsection id="HB7ED0B51ADDA4E52A82F39E2C29B9E61"><enum>(a)</enum><header>Dollar limitation and limitation based on income replaced with limitation on aggregate education indebtedness that may be taken into account</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/221">Section 221(b)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H331F441455734F81B556782ECF6A0CC4" style="OLC"><subsection id="H742D55AF97D94395AAF338617159F340"><enum>(b)</enum><header>Limitation on aggregate education indebtedness that may be taken into account</header><text display-inline="yes-display-inline">The aggregate amount taken into account under subsection (a) as qualified education loans for any period shall not exceed $750,000 (twice such amount in the case of a joint return).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H870D59511C57418F8B480DD0D485DDAC"><enum>(b)</enum><header>Conforming amendments</header><text>Section 221 of such Code is amended by striking subsections (e) and (f) (relating to special rules and inflation adjustments, respectively) and inserting the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H9DF5CBD744E84FCCB9324EEF0DBA2C1F" style="OLC"><subsection id="HB923D6BEDA6D4112800B4ECEFD3C303B"><enum>(e)</enum><header>Denial of double benefit</header><text display-inline="yes-display-inline">No deduction shall be allowed under this section for any amount for which a deduction is allowable under any other provision of this chapter.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0352890BD9884516911DF0E6DEDEA62C"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section><section id="H4366AF9FF5BA4514BE2F22A0AF72D858" section-type="subsequent-section"><enum>3.</enum><header>Exclusion from gross income for discharge of income contingent and income-based student loan indebtedness</header><subsection id="H8408BD5CDDC6478C932E6425B0698C65"><enum>(a)</enum><header>In general</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/108">section 108(f)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H4F90708B4B5546DDB3F740284195CE12" style="OLC"><paragraph id="H2F84F550631940288E9D914C9E76223A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of an individual, gross income does not include any amount which (but for this subsection) would be includible in gross income by reason of the discharge (in whole or in part) of any student loan if such discharge was pursuant to—</text><subparagraph commented="no" id="HBBCE45DC942941BC8A29358282E81233"><enum>(A)</enum><text display-inline="yes-display-inline">a provision of such loan under which all or part of the indebtedness of the individual would be discharged if the individual worked for a certain period of time in certain professions for any of a broad class of employers, or</text></subparagraph><subparagraph id="HE7F836932D834D52BE1CCF09EBBB9586"><enum>(B)</enum><text display-inline="yes-display-inline">subsections (d)(1)(D) and (e)(7) of section 455 or section 493C(b)(7) of the Higher Education Act of 1965 (relating to income contingent and income-based repayment, respectively).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7C0F57CEA5F1421D94A4770ED9CEB956"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to discharges of indebtedness after the date of the enactment of this Act.</text></subsection></section><section id="H3EEB158E33AE45279E707E311D7D5BAD" section-type="subsequent-section"><enum>4.</enum><header>Grace period extension</header><subsection id="HA8485D3927D3437E80DE609F884F443A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 455 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HB4FF1877051A4A9392CD4590ACEDB78B" style="OLC"><subsection id="HD990B9A172674579B4770234049109BF"><enum>(r)</enum><header>Grace period extension</header><paragraph id="H7262E28C65434BD985D6F0BD5A3DDD89"><enum>(1)</enum><header>In general</header><text>With respect to the Federal Direct Stafford Loans and Federal Direct Unsubsidized Stafford Loans, section 487(b)(7) shall be applied—</text><subparagraph id="H194F638BFD054D8A9885A3BAFCC89567"><enum>(A)</enum><text>in subparagraph (A), by substituting <quote>12 months</quote> for <quote>6 months</quote>; and</text></subparagraph><subparagraph id="HA7256CC89E0B4D3FB6F211A1EB820073"><enum>(B)</enum><text>in subparagraph (D), by substituting <quote>12-month period</quote> for <quote>6-month period</quote>.</text></subparagraph></paragraph><paragraph id="H4E514C48FF6B4609A18D689907674707"><enum>(2)</enum><header>No accrual of interest</header><text>Notwithstanding any other provision of this part, interest shall not accrue on a Federal Direct Unsubsidized Stafford Loan during the 12-month period described in paragraph (1).</text></paragraph></subsection><subsection id="H7976218FC43E4E388E0FAA5EDCDA991E"><enum>(s)</enum><header>Extension of certain deferment period for Federal Direct PLUS Loans</header><paragraph id="H6FAFE4719B3E44379644F4009AB0EAA8"><enum>(1)</enum><header>In general</header><text>With respect to Federal Direct PLUS Loans, section 428B(d)(1)(B) shall be applied—</text><subparagraph id="HC0343DB9F7E64BAABE3CBABC57E8E6CC"><enum>(A)</enum><text>in the case of a parent borrower, in clause (i), by substituting <quote>12-month period</quote> for <quote>6-month period</quote>; and</text></subparagraph><subparagraph id="H16B1F1B0BD6949E49F2E562DF4ADD407"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a graduate or professional student borrower, in clause (ii), by substituting <quote>12-month period</quote> for <quote>6-month period</quote>.</text></subparagraph></paragraph><paragraph id="H04AD75FF0D3A491A8AD3948AFAD80E84"><enum>(2)</enum><header>No accrual of interest</header><text>Notwithstanding any other provision of this part, interest shall not accrue on a Federal Direct PLUS Loan during the 12-month period described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA43946D4CE464AE6A3C58083654830FD"><enum>(b)</enum><header>Effective date and application</header><text>The amendments made by this section shall take effect on the date of enactment of this Act, and shall apply with respect to—</text><paragraph id="H8145A2D1DD104220AC810EA08E77F776"><enum>(1)</enum><text display-inline="yes-display-inline">Federal Direct Stafford Loans, Federal Direct Unsubsidized Stafford Loans, and Federal Direct PLUS Loans made on or after the date of enactment of this Act; and</text></paragraph><paragraph id="H91D3F5D806114DBBA326A1306128C1FD"><enum>(2)</enum><text display-inline="yes-display-inline">Federal Direct Stafford Loans, Federal Direct Unsubsidized Stafford Loans, and Federal Direct PLUS Loans made before such date of enactment to borrowers who have not yet entered repayment on such loans on such date of enactment.</text></paragraph></subsection></section></legis-body></bill>
