which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to prohibit abortion in cases where a fetal heartbeat is detectable.</official-title></form><legis-body id="HC715EDA8D53A4C5DB052641A385FEA30" style="OLC"><section id="H1E4423CC3547440DA324FD984D121BA8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Heartbeat Protection Act of 2021</short-title></quote>.</text></section><section id="H30CD64EC47B844E7AD18197B6AC86135"><enum>2.</enum><header>Abortions prohibited without a check for fetal heartbeat, or if a fetal heartbeat is detectable</header><subsection id="HA2B4B8A9CD68485DA625F265B327C048"><enum>(a)</enum><header>Abortions prohibited without a check for fetal heartbeat, or if a fetal heartbeat is detectable</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/74">Chapter 74</external-xref> of title 18, United States Code, is amended—</text><paragraph id="H9B25F3A2EF2749098A1C954B055BA87E"><enum>(1)</enum><text>in the chapter heading, by striking <quote><header-in-text level="chapter" style="USC">Partial-Birth</header-in-text></quote>;</text></paragraph><paragraph id="HCAEDFAC4B82C46678BC5FDE22AB19A94"><enum>(2)</enum><text>by inserting after section 1531 the following:</text><quoted-block display-inline="no-display-inline" id="H40BA481FB07A4C75BB4B06938857A8D6" style="USC"><section id="H353F0CA8C3A44488A1C854318D6E2262"><enum>1532.</enum><header>Abortions prohibited without a check for fetal heartbeat, or if a fetal heartbeat is detectable</header><subsection id="H56A929D2DB9A47D8B8995F79901BB88E"><enum>(a)</enum><header>Offense</header><text>Any physician who knowingly performs an abortion and thereby kills a human fetus—</text><paragraph id="H6DDB89CFBAB94BCD93E50933AE9B07E5"><enum>(1)</enum><text display-inline="yes-display-inline">without determining, according to standard medical practice, whether the fetus has a detectable heartbeat;</text></paragraph><paragraph id="H56840515D3D04734AB6C730406AF6B63"><enum>(2)</enum><text>without informing the mother of the results of that determination; or</text></paragraph><paragraph id="HBFEB05092F7349A6B5C9A21AD4D29ACB"><enum>(3)</enum><text display-inline="yes-display-inline">after determining, according to standard medical practice, that the fetus has a detectable heartbeat,</text></paragraph><continuation-text continuation-text-level="subsection">shall be fined under this title or imprisoned not more than 5 years, or both. This subsection does not apply to an abortion that is necessary to save the life of a mother whose life is endangered by a physical disorder, physical illness, or physical injury, including a life-endangering physical condition caused by or arising from the pregnancy itself, but not including psychological or emotional conditions. </continuation-text></subsection><subsection id="H43B5559B758C4D189DD5848C2E16757F"><enum>(b)</enum><header>Defendant may seek hearing</header><text display-inline="yes-display-inline">A defendant indicted for an offense under this section may seek a hearing before the State Medical Board on whether the physician's conduct was necessary to save the life of the mother whose life was endangered by a physical disorder, physical illness, or physical injury, including a life-endangering physical condition caused by or arising from the pregnancy itself, but not including psychological or emotional conditions. The findings on that issue are admissible on that issue at the trial of the defendant. Upon a motion of the defendant, the court shall delay the beginning of the trial for not more than 30 days to permit such a hearing to take place.</text></subsection><subsection id="H0ED0C0EBBC4A402F82F763F882C796AA"><enum>(c)</enum><header>No liability for the mother on whom abortion is performed</header><text display-inline="yes-display-inline">A mother upon whom an abortion is performed may not be prosecuted under this section, for a conspiracy to violate this section, or for an offense under section 2, 3, or 4 of this title based on a violation of this section.</text></subsection><subsection id="H41D277134D774FDBADDE8E178B62A138"><enum>(d)</enum><header>Requirement for data retention</header><text display-inline="yes-display-inline">The physician shall include in the medical file of the mother documentation of the determination, according to standard medical practice, of whether the fetus has a detectable heartbeat, the results of that determination, notification of the mother of those results, and any information entered into evidence in any proceedings under subsection (b). Paragraph (j)(2) of section 164.530 of title 45, Code of Federal Regulations, shall apply to such documentation.</text></subsection><subsection id="H431FF845751B45CF95492FC2EDD11ABF"><enum>(e)</enum><header>Severability</header><text display-inline="yes-display-inline">If any provision of this section or the application of such provision to any person or circumstance is held to be invalid, the remainder of this section and the application of the provisions of the remainder to any person or circumstance shall not be affected thereby.</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H588E96341DFE44D2B21A87F8F558EBC2"><enum>(3)</enum><text>in the table of sections, by inserting after the item pertaining to section 1841 the following:</text><quoted-block display-inline="no-display-inline" id="H1FCC5B1AF4904419854220B20DA27927" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1532.
