Act</short-title></quote>.</text></subsection><subsection id="HCACAED1AEA30483A88445ABD990034F9"><enum>(b)</enum><header>National Use-of-Force Data Collection</header><text>Section 501 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10152">34 U.S.C. 10152</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7B140F15D7E643B3B7EA9FFEFACBEA15"><subsection id="HD13CAF0B761444108415BD64165D58D0"><enum>(h)</enum><header>National Use-of-Force Data Collection</header><paragraph id="H580998FE31CB451CBF963C558285496A"><enum>(1)</enum><header>Definitions</header><text>In this section—</text><subparagraph id="H4A2165932287421FB3F4DEB7D0930C32"><enum>(A)</enum><text> the term <term>law enforcement officer</term>—</text><clause id="H47A8142F1FA14BFDBD5C6A3388065DAB"><enum>(i)</enum><text>means any officer, agent, or employee of a State, unit of local government, or an Indian tribe authorized by law or by a government agency to engage in or supervise the prevention detection, or investigation of any violation of criminal law, or authorized by law to supervise sentenced criminal offenders; and</text></clause><clause id="HC113C4DB1D564CA1A3EEEEB54F06887A"><enum>(ii)</enum><text> includes an individual described in clause (i) who is employed or volunteers in a full-time, part-time, or auxiliary capacity; </text></clause></subparagraph><subparagraph id="H74DF3679B72C403AA321D3C30F720375"><enum>(B)</enum><text>the term <term>National Use-of-Force Data Collection</term> means the National Use-of-Force Data Collection of the Federal Bureau of Investigation; and</text></subparagraph><subparagraph id="H718935D779F643D7972C5C91AB33A8FA"><enum>(C)</enum><text>the term <term>serious bodily injury</term> means bodily injury that involves a substantial risk of death, unconsciousness, extreme physical pain, protracted and obvious disfigurement, or protracted loss or impairment of the function of a bodily member, organ, or mental faculty. </text></subparagraph></paragraph><paragraph id="HD7F167AED3F94767BE08A6FC88273F43"><enum>(2)</enum><header>Reporting requirement</header><text>For each fiscal year in which a State or unit of local government receives funds under subsection (a), the State or unit of local government shall report to the National Use-of-Force Data Collection on an annual basis and pursuant to guidelines established by the Federal Bureau of Investigation, information regarding—</text><subparagraph id="HD5A56B030A0C4DD2BD3219C979142F68"><enum>(A)</enum><text>a use-of-force event by a law enforcement officer in the State or unit of local government that involves—</text><clause id="H0643FCB694E2420AAA44838E239C9AA2"><enum>(i)</enum><text> the fatality of an individual that is connected to use of force by a law enforcement officer; </text></clause><clause id="H17008A23C5CC41EDBC5394F1B7606BF5"><enum>(ii)</enum><text>the serious bodily injury of an individual that is connected to use of force by a law enforcement officer; and</text></clause><clause id="H7334A11C3A0844679ACE4F66BA9E309F"><enum>(iii)</enum><text>in the absence of either death or serious bodily injury, when a firearm is discharged by a law enforcement officer at or in the direction of an individual; </text></clause></subparagraph><subparagraph id="H9F32610DCA2D4D048DCC84BB2AC3EE42"><enum>(B)</enum><text>any event in which a firearm is discharged by a civilian at or in the direction of a law enforcement officer; and </text></subparagraph><subparagraph id="HFC38ABE2329B4E5885D987A88B28E5CF"><enum>(C)</enum><text>the death or serious bodily injury of a law enforcement officer that results from any discharge of a firearm by a civilian, or any other means, including whether the law enforcement officer was killed or suffered serious bodily injury as part of an ambush or calculated attack. </text></subparagraph></paragraph><paragraph id="H2AEB8E34B8F44199B042D7E4DCBF688F"><enum>(3)</enum><header>Information required</header><text>For each use-of-force event required to be reported under paragraph (2), the following information shall be provided, as required by the Federal Bureau of Investigation:</text><subparagraph id="HCC21C0AEFD4740DCB0A4FD7BB63AB066"><enum>(A)</enum><text>Incident information.</text></subparagraph><subparagraph id="H47281E88A9F04887912C7088ADE0CC96"><enum>(B)</enum><text>Subject information.</text></subparagraph><subparagraph id="H29B826EE5AF7420EA7186BE281C55B52"><enum>(C)</enum><text>Officer information.</text></subparagraph></paragraph><paragraph id="H812D5C93C55642B5945C631205EF3555"><enum>(4)</enum><header>Compliance</header><subparagraph id="H74A01F43F7DE468981040D8E76096129"><enum>(A)</enum><header>Ineligibility for funds</header><clause id="H2542D3EA2DD04AA48715E560F13DC969"><enum>(i)</enum><header>First fiscal year</header><subclause id="H5082CAB0C7A54533A640D5B9694E8529"><enum>(I)</enum><header>States</header><text>For the first fiscal year beginning after the date of enactment of the <short-title>George Floyd and Walter Scott Notification Act</short-title> in which a State fails to comply with paragraph (2) with respect to a State law enforcement agency, the State shall be subject to a 20-percent reduction of the funds that would otherwise be allocated for retention by the State under section 505(c) for that fiscal year, and if any unit of local government within the State fails to comply with paragraph (2), the State shall be subject to a reduction of the funds allocated for retention by the State under section 505(c) that is equal to the percentage of the population of the State represented by the unit of local government, not to exceed 20 percent. </text></subclause><subclause id="H475C2CD4A58B4584BCA75DAA65E60243"><enum>(II)</enum><header>Local governments</header><text>For the first fiscal year beginning after the date of enactment of the <short-title>George Floyd and Walter Scott Notification Act</short-title> in which a unit of local government fails to comply with paragraph (2), the unit of local government shall be subject to a 20-percent reduction of the funds that would otherwise be allocated to the unit of local government for that fiscal year under this subpart.</text></subclause></clause><clause id="H08D5A4936CBD4A9A8CD425E8FB6D0B0F"><enum>(ii)</enum><header>Subsequent fiscal years</header><subclause id="H900AD89A26E5473D9B4586126D5913F2"><enum>(I)</enum><header>States</header><text>Beginning in the first fiscal year beginning after the first fiscal year described in clause (i)(I) in which a State fails to comply with paragraph (2) with respect to a State law enforcement agency, the percentage by which the funds described in clause (i)(I) are reduced shall be increased by 5 percent each fiscal year the State fails to comply with paragraph (2), except that such reduction shall not exceed 25 percent in any fiscal year.</text></subclause><subclause id="H73BBD43A1DDC4A86857AA77320C5BB75"><enum>(II)</enum><header>Local governments</header><text>Beginning in the first fiscal year beginning after the first fiscal year described in clause (i)(II) in which a unit of local government fails to comply with paragraph (2), the percentage by which the funds described in clause (i)(II) are reduced shall be increased by 5 percent each fiscal year the unit of local government fails to comply with paragraph (2), except that such reduction shall not exceed 25 percent in any fiscal year.</text></subclause></clause></subparagraph><subparagraph id="H754AB6E514B648AAB30C8FD7F938194D"><enum>(B)</enum><header>Reallocation</header><text>Amounts not allocated under a program referred to in subparagraph (A) to a State or unit of local government for failure to comply with paragraph (2) shall be reallocated under the program to States or units of local government that have complied with paragraph (2). </text></subparagraph></paragraph><paragraph id="HD4A5FAFE68B541389AECE76015D459D2"><enum>(5)</enum><header>Public availability of data</header><text>Not later than 1 year after the date of enactment of this Act, and each year thereafter, the Director of the Federal Bureau of Investigation shall publish, and make available to the public, the National Use-of-Force Data Collection.</text></paragraph><paragraph id="HC88A0D1D63C14E59B08D56317EF1CA74"><enum>(6)</enum><header>FBI outreach and technical assistance</header><text>The Director of the Federal Bureau of Investigation shall provide to a State or unit of local government technical assistance and training for the collection and submission of data in accordance with this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H49FBA34DADE74DEF84A8BA815AEC4017"><enum>102.</enum><header>Breonna Taylor Notification Act</header><subsection id="HC02D98312A364F6AA6FAE99AE3B70E91"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>Breonna Taylor Notification Act of 2021</short-title></quote>.</text></subsection><subsection id="H4C35D52DBEF34534AA46A6FD13662E72"><enum>(b)</enum><header>No-Knock warrant reports</header><text>Section 501 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10152">34 U.S.C. 10152</external-xref>), as amended by section 101 of this Act, is amended by adding at the end the following:</text><quoted-block id="HAC959549FBF64D468CFD5D03CBAF13EE" display-inline="no-display-inline" style="OLC"><subsection id="H410FF56E7C254FB2AA859878E165742E"><enum>(i)</enum><header>No-knock warrant reports</header><paragraph id="H236A3F3FFB2649DF902583DA813B2E79"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HD99A1F9C4D2F48759B6E0A3ABF5A47FF"><enum>(A)</enum><header>Federal law enforcement agency</header><text>The term <term>Federal law enforcement agency</term> means any agency of the United States authorized to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of Federal criminal law.</text></subparagraph><subparagraph id="H0023FD7041AF424D99D2A511755516C5"><enum>(B)</enum><header>No-knock warrant</header><text>The term <term>no-knock warrant</term> means a warrant that authorizes a law enforcement officer to enter a certain premises to execute a warrant without first knocking or otherwise announcing the presence of the law enforcement officer if a court of competent jurisdiction finds reasonable suspicion that knocking and announcing the presence of law enforcement would—</text><clause id="H5968771151A648AD819FD9FC9BB90627"><enum>(i)</enum><text>pose a danger to the officer, a suspect, or a third party on the premises;</text></clause><clause id="HF79D226301A441C5969EEAC7ACFCC0D6"><enum>(ii)</enum><text>inhibit the investigation; or</text></clause><clause id="HD54FE8EE20964E0881CBC0186F0E693E"><enum>(iii)</enum><text>allow the destruction of evidence.</text></clause></subparagraph><subparagraph id="HD711A33B697449B28186C8304F4A5B0E"><enum>(C)</enum><header>State law enforcement agency; local law enforcement agency</header><text>The terms <term>State law enforcement agency</term> and <term>local law enforcement agency</term> mean an agency of a State or unit of local government, respectively, that is authorized to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal law.</text></subparagraph></paragraph><paragraph id="H962158D5377945438B0D891BFA60030A"><enum>(2)</enum><header>Report to Attorney General</header><subparagraph id="HF421EB2880924AFE86CFBD8E93DD8C53"><enum>(A)</enum><header>Requirement</header><clause id="H07C574F0C9AD40E1A1A251078CECBE82"><enum>(i)</enum><header>In general</header><text>Subject to clause (iii), not later than January 31 <italic></italic>of the first calendar year beginning after the date of enactment of the <short-title>Breonna Taylor Notification Act of 2021</short-title>, and annually thereafter—</text><subclause id="HFFE4D5002AE14A5C9C175703A8E6491D"><enum>(I)</enum><text>a State that receives funds under subsection (a) shall submit to the Attorney General a report that includes, for each no-knock warrant carried out by a State law enforcement agency of the State during the preceding calendar year, the information described in subclauses (I) through (V) of paragraph (3)(A)(i); and</text></subclause><subclause id="H4255BBB0B18649E182C6AB5137BEDE7D"><enum>(II)</enum><text>a unit of local government that receives funds under subsection (a) shall submit to the Attorney General a report that includes—</text><item id="H5A07B8469822464F8C2D66EB964ECC77"><enum>(aa)</enum><text>for each no-knock warrant carried out by a local law enforcement agency of the unit of local government during the preceding calendar year, the information described in subclauses (I) through (V) of paragraph (3)(A)(i); and</text></item><item id="H8BD72CE5E48F44B08272D720532A27F5"><enum>(bb)</enum><text>the crime rate data for the unit of local government for the preceding calendar year.</text></item></subclause></clause><clause id="HD768FCB9272645FBB4E4FF72597AD7CA"><enum>(ii)</enum><header>State oversight of local governments</header><text>A State that receives funds under subsection (a) shall ensure that each unit of local government within the State submits to the Attorney General a report that includes, in accordance with clause (i)(II) of this subparagraph—</text><subclause id="H09137C628A1D4054A3008A6B1243EE3E"><enum>(I)</enum><text>for each no-knock warrant carried out by a local law enforcement agency of the unit of local government during the preceding calendar year, the information described in subclauses (I) through (V) of paragraph (3)(A)(i); and</text></subclause><subclause id="HE0AF81E4E23D4BADBC730C2FAAF40338"><enum>(II)</enum><text>the crime rate data for the unit of local government for the preceding calendar year.</text></subclause></clause><clause id="H2645874F1A414D4187EE28B9F54D3E33"><enum>(iii)</enum><header>Open investigations</header><text>A State or unit of local government—</text><subclause id="H82ACFDA1D8B44E0AA979A4930F448F92"><enum>(I)</enum><text>may not submit the information described in subclauses (I) through (V) of paragraph (3)(A)(i) for a no-knock warrant relating to an investigation that has not been closed as of the date on which the applicable report is due under clause (i) of this subparagraph; and</text></subclause><subclause id="HEF4466782A344E1D8299BDA13E796265"><enum>(II)</enum><text>shall include any information withheld under subclause (I) in the earliest subsequent report submitted under clause (i) after the investigation has been closed.</text></subclause></clause></subparagraph><subparagraph id="HB224BB546543465A8E5D9AA4B78B2B04"><enum>(B)</enum><header>Penalty</header><clause id="H8B7B854C72974EC39D5B01224DB1FD8A"><enum>(i)</enum><header>In general</header><subclause id="HF9C34E9ED8F44B6AA3C37D43571105D6"><enum>(I)</enum><header>First fiscal year</header><item id="H3C62E7D9F75549039306C3E2DD6FEBB5"><enum>(aa)</enum><header>States</header><subitem id="H996253E1BBC640C689BC00ECFEDAFF16"><enum>(AA)</enum><header>Failure to comply by State</header><text>For the first fiscal year that follows a fiscal year in which a State failed to comply with subparagraph (A) with respect to a State law enforcement agency, the State shall be subject to a 20-percent reduction of the funds that would otherwise be allocated for retention by the State under section 505(c) for that fiscal year.</text></subitem><subitem id="HFABB1A5773F04E2D836572C6CF532A66"><enum>(BB)</enum><header>Failure to comply by local government</header><text>For the first fiscal year that follows a fiscal year in which a unit of local government within a State failed to comply with subparagraph (A), the State shall be subject to a reduction of the funds that would otherwise be allocated for retention by the State under section 505(c) for that fiscal year by a percentage that is equal to the percentage of the population of the State that lives in the unit of local government, which may not exceed 20 percent.</text></subitem></item><item id="HDA90F54FA16C4A0F989C24B960AB04E6"><enum>(bb)</enum><header>Units of local government</header><text>For the first fiscal year that follows a fiscal year in which a unit of local government failed to comply with subparagraph (A), the unit of local government shall be subject to a 20-percent reduction of the funds that would otherwise be allocated to the unit of local government under this subpart for that fiscal year.</text></item></subclause><subclause id="HDCA3CB42AB364452A0640DFB90BE5551"><enum>(II)</enum><header>Subsequent fiscal years</header><item id="H17C0BB8BB1DA42A4B9254C7D24927783"><enum>(aa)</enum><header>States</header><text>Beginning in the first fiscal year beginning after the first fiscal year described in subclause (I)(aa)(AA) in which a State fails to comply with subparagraph (A) with respect to a State law enforcement agency, the percentage by which the funds described in subclause (I)(aa)(AA) are reduced shall be increased by 5 percent each fiscal year the State fails to comply with subparagraph (A) with respect to a State law enforcement agency, except that such reduction shall not exceed 25 percent in any fiscal year.</text></item><item id="HBDA6AB2453EC4C419C8BA4BA79405D67"><enum>(bb)</enum><header>Local governments</header><text>Beginning in the first fiscal year beginning after the first fiscal year described in subclause (I)(bb) in which a unit of local government fails to comply with subparagraph (A), the percentage by which the funds described in subclause (I)(bb) are reduced shall be increased by 5 percent each fiscal year the unit of local government fails to comply with subparagraph (A), except that such reduction shall not exceed 25 percent in any fiscal year. </text></item></subclause></clause><clause id="H9B697BD2E8A54CCF822AC89DE27CCEEB"><enum>(ii)</enum><header>Reallocation</header><text>Amounts not allocated by reason of clause (i) to a State or unit of local government for failure to comply with subparagraph (A) shall be reallocated to States or units of local government, respectively, that have complied with subparagraph (A).</text></clause><clause id="H11D63C34354E405B89610F5211645B5F"><enum>(iii)</enum><header>Effective date</header><text>Clause (i) shall take effect with respect to the third annual report due under subparagraph (A) after the date of enactment of the <short-title>Breonna Taylor Notification Act of 2021</short-title>.</text></clause></subparagraph></paragraph><paragraph id="HA26CCE7910D64F26977C3859FE09B5AD"><enum>(3)</enum><header>Attorney General Report</header><subparagraph id="H3F5DE675448948AA9AB331B53C20AFCC"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), not later than March 31 <italic></italic>of the first calendar year beginning after the date of enactment of the <short-title>Breonna Taylor Notification Act of 2021</short-title>, and annually thereafter, the Attorney General shall publish a report that includes—</text><clause id="H5B5A05B3AA0F4BBC9016783D3F7ABF46"><enum>(i)</enum><text>for each no-knock warrant carried out by a Federal law enforcement agency, State law enforcement agency, or local law enforcement agency during the preceding calendar year—</text><subclause id="H58CEF181874C4CDFA8B8614C90ACA54F"><enum>(I)</enum><text>the reason for which the warrant was issued, including each violation of law listed on the warrant;</text></subclause><subclause id="H3AEE5C77F9FF49C69914FC9A454CAE4A"><enum>(II)</enum><text>whether, in the course of carrying out the warrant—</text><item id="H81CA8135082C4EE9BE7A4C5DFAED1449"><enum>(aa)</enum><text>force resulting in property damage, serious bodily injury, or death was used; or</text></item><item id="H4C30632CD7D2456085B34C144C26E44E"><enum>(bb)</enum><text>any law enforcement officer, suspect, or bystander was injured or killed;</text></item></subclause><subclause id="HDFB80A1BD5EE4E40BB45A6A3A22C32EB"><enum>(III)</enum><text>the sex, race, ethnicity, and age of each person found at the location for which the no-knock warrant was issued;</text></subclause><subclause id="H1497CD4DF6A940D5A5667A40F159F519" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text>whether the location searched matched the location described in the warrant; and</text></subclause><subclause display-inline="no-display-inline" commented="no" id="HCFB5F3EBBE72459D8B24B902607A958C"><enum>(V)</enum><text>whether the warrant included the particularized information required under the Fourth Amendment to the Constitution of the United States, as interpreted by the Supreme Court of the United States, and any other applicable Federal, State, or local law related to the use of no-knock warrants; and</text></subclause></clause><clause display-inline="no-display-inline" commented="no" id="HD01177A88B014FB0BC70534C40887685"><enum>(ii)</enum><text>for each local law enforcement agency for which information is submitted under clause (i) for a calendar year, the crime rate data for the applicable unit of local government for that calendar year.</text></clause></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="H07C673C2DEC94EF4BD591DA146942D7A"><enum>(B)</enum><header>Open investigations</header><text>The Attorney General—</text><clause display-inline="no-display-inline" commented="no" id="H9A8C47A8D66A465A90B006F6888A6B16"><enum>(i)</enum><text>may not publish any information described in subparagraph (A) for a no-knock warrant relating to an investigation that has not been closed as of the date on which the applicable report is due under that paragraph; and</text></clause><clause id="HE40AB459560B476687223A9FE14CB6EA" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>shall include any information withheld under clause (i) in the earliest subsequent report published under subparagraph (A) after the investigation has been closed.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HAAA879D63388498BB5461A201042A917"><enum>103.</enum><header>Guidance</header><subsection id="H1C8C08B277AB4281A93A903017CD6073"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Attorney General, in coordination with the Director of the Federal Bureau of Investigation and State and local law enforcement agencies, shall issue guidance on best practices relating to establishing standard data collection systems that capture the information required to be reported under subsections (h) and (i) of section 501 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10152">34 U.S.C. 10152</external-xref>), as added by sections 101 and 102 of this Act, respectively, and that ensure the reporting under such subsections (h) and (i) is consistent with data reported under the Death in Custody Reporting Act of 2013 (<external-xref legal-doc="usc" parsable-cite="usc/34/60105">34 U.S.C. 60105</external-xref> et seq.), section 20104(a)(2) of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12104">34 U.S.C. 12104(a)(2)</external-xref>), which shall include standard and consistent definitions for terms, including the term <term>use of force</term>. </text></subsection><subsection id="H6B22AE27932141FD83A9A0F5C13F07AC"><enum>(b)</enum><header>Privacy protections</header><text>Nothing in section 101 or 102 shall be construed to supersede the requirements or limitations under section 552a of title 5, United States Code (commonly known as the <quote>Privacy Act of 1974</quote>). </text></subsection></section><section id="HD6E7597B0C1943EF94E0407261ED0897"><enum>104.</enum><header>Compliance assistance grants</header><subsection id="H2526CDB040ED4B7CB2A63231A6A2BAF6"><enum>(a)</enum><header>In general</header><text>The Attorney General may award grants to States and units of local government to assist in the collection of the information required to be reported under subsections (h) and (i) of section 501 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10152">34 U.S.C. 10152</external-xref>), as added by sections 101 and 102 of this Act, respectively. </text></subsection><subsection id="H7F9BE4A5ABA746D687BFE08455A3D0C5"><enum>(b)</enum><header>Application</header><text>A State or unit of local government seeking a grant under this section shall submit an application at such time, in such manner, and containing such information as the Attorney General may require.</text></subsection><subsection id="HDC28218424F945FC8BE988F2CDBF9D8E"><enum>(c)</enum><header>Amount of grant</header><text>Each grant awarded under this section shall be not more than $1,000,000.</text></subsection><subsection id="HE09D2C028C78414892C2C226DFEF0F69"><enum>(d)</enum><header>Direct appropriations</header><text display-inline="yes-display-inline">For the purpose of making grants under this section, there is authorized to be appropriated, and there is appropriated, out of any money in the Treasury not otherwise appropriated for the fiscal year ending September 30, 2021, $112,000,000, to remain available until expended.</text></subsection></section><section id="H25DC6C5FC7684B8C88F77BB6CB29A651"><enum>105.</enum><header>Incentivizing banning of chokeholds</header><subsection id="H0FD9735E06794CBDAE29355DB1F871A0"><enum>(a)</enum><header>Sense of congress</header><text>It is the sense of Congress that—</text><paragraph id="H5DD325970B8740D19B6F641741821B43"><enum>(1)</enum><text>chokeholds are extremely dangerous maneuvers that can easily result in serious bodily injury or death;</text></paragraph><paragraph id="H5D07B66A8F0B4946AED8833CE655B59B"><enum>(2)</enum><text>George Floyd’s death has become a flashpoint to compel the need to address the use of chokeholds by law enforcement officers across the United States;</text></paragraph><paragraph id="H7DD82F7E145D48358093D0ACAEE15EAC"><enum>(3)</enum><text>the National Consensus Policy on Use of Force, a collaborative effort among 11 of the most significant law enforcement leadership and labor organizations in the United States, concluded in a discussion paper on the use of force that chokeholds are extremely dangerous and recommended restricting their use, consistent with this section; and</text></paragraph><paragraph id="H9012E8B74F0145A09E697C0F1EC8F1D2"><enum>(4)</enum><text>law enforcement agencies throughout the United States must create policies that guard against the use of this maneuver to help prevent the death of civilians whom they encounter, and engender more trust and faith among law enforcement officers and the communities they serve.</text></paragraph></subsection><subsection id="HE58E7BE9DC884D719C421BD80E473EFF"><enum>(b)</enum><header>Incentivizing banning of chokeholds</header><paragraph id="H3EB8D9628BA743C29E6F131BA4576BA6"><enum>(1)</enum><header>COPS grant program eligibility</header><text>Section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>), as amended by section 501 of this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA3E29FDA0FD64EA0A0BADD5E243E04F4"><subsection id="HD5A84AAB4EDA4486963B74F204239CA3"><enum>(o)</enum><header>Banning of chokeholds</header><paragraph id="HB54D3282B5904B368123AA9AE53E5333"><enum>(1)</enum><header>Chokehold defined</header><text>In this subsection, the term <term>chokehold</term> means a physical maneuver that restricts an individual’s ability to breathe for the purposes of incapacitation.</text></paragraph><paragraph id="H529DD734D74A4580B5B40885B5A7D125"><enum>(2)</enum><header>Limitation on eligibility for funds</header><text>Beginning in the first fiscal year beginning after the date of enactment of the <short-title>JUSTICE Act</short-title>, a State or unit of local government may not receive funds under this section for a fiscal year if, on the day before the first day of the fiscal year, the State or unit of local government does not have an agency-wide policy in place for each law enforcement agency of the State or unit of local government that prohibits the use of chokeholds except when deadly force is authorized.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H65AEE5AF4DAD4DBCB6EEA5688CAB5F93"><enum>(2)</enum><header>Byrne grant program eligibility</header><text>Section 501 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10152">34 U.S.C. 10152</external-xref>), as amended by section 102 of this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE9AD4D9994EF49E7B970FC6DE68B22C2"><subsection id="HA1C15AC6A89D4204B64E2C2649DB8B6C"><enum>(j)</enum><header>Banning of chokeholds</header><paragraph id="H0D37877C9EA94E5BB3CDBCE0EA6DDEDA"><enum>(1)</enum><header>Chokehold defined</header><text>In this subsection, the term <term>chokehold</term> means a physical maneuver that restricts an individual’s ability to breathe for the purposes of incapacitation.</text></paragraph><paragraph id="H616DB004B4364172851EF30E1D69F825"><enum>(2)</enum><header>Limitation on eligibility for funds</header><text>Beginning in the first fiscal year beginning after the date of enactment of the <short-title>JUSTICE Act</short-title>, a State or unit of local government may not receive funds under this part for a fiscal year if, on the day before the first day of the fiscal year, the State or unit of local government does not have an agency-wide policy in place for each law enforcement agency of the State or unit of local government that prohibits the use of chokeholds except when deadly force is authorized.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H52C7AA36F0BE426484F9C00E2560164A"><enum>(c)</enum><header>Federal law enforcement agencies</header><paragraph id="H8607690EF0364C2A9397C5AC2BBBB5DE"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>chokehold</term> means a physical maneuver that restricts an individual’s ability to breathe for the purposes of incapacitation.</text></paragraph><paragraph id="H00A01E4FC0184558ABBC60C7584F3152"><enum>(2)</enum><header>Federal policy</header><text>The Attorney General shall develop a policy for Federal law enforcement agencies that bans the use of chokeholds except when deadly force is authorized.</text></paragraph><paragraph id="HB558CAD4D26246328BAF88AF277ACBF8"><enum>(3)</enum><header>Requirement</header><text>The head of each Federal law enforcement agency shall implement the policy developed under paragraph (2). </text></paragraph></subsection></section><section id="H5ECD42D850424E4B924C430962BF41FD"><enum>106.</enum><header>Falsifying police incident reports</header><subsection id="H42FDBFFB70E641B0A262292F5EB5A5AE"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text><paragraph id="H906C9D4160AB494BB20C7A8AC2F98FD8"><enum>(1)</enum><text>when a law enforcement officer commits an offense that deprives a citizen of their rights, privileges, and immunities protected under the Constitution and laws of the United States, that behavior is penalized to punish those involved and to deter future conduct;</text></paragraph><paragraph id="H08C229012BD24ECFB912126F2207649F"><enum>(2)</enum><text>where serious bodily injury or death results from the acts described in paragraph (1), punishment must be severe;</text></paragraph><paragraph id="H6E3A68BFCCA44A0D8BA6AED88A830EFC"><enum>(3)</enum><text>a law enforcement officer who intentionally submits a false police report in connection with an act described in paragraph (1) should also be punished severely;</text></paragraph><paragraph id="H1A25BFF4CB064C0DB595C37707E747EB"><enum>(4)</enum><text>false reporting described in paragraph (3) not only serves to conceal potential criminal conduct and obstruct the administration of justice, false reporting also undermines the trust and confidence that communities place in law enforcement agencies;</text></paragraph><paragraph id="H92B14CCDF70B4205BF37FF6575974E1E"><enum>(5)</enum><text>obstruction of justice is intolerable in any form, particularly in the form described in this subsection;</text></paragraph><paragraph id="H37053A25230940B0983541719E362B62"><enum>(6)</enum><text>the deterioration of trust and confidence between law enforcement agencies and communities must be abated; and</text></paragraph><paragraph id="H966D48A425A6453D902A512B05632201"><enum>(7)</enum><text>severe penalties must be imposed for individuals who create false police reports in connection with criminal civil rights violations resulting in serious bodily injury or death. </text></paragraph></subsection><subsection id="H8D4D09AD01854BC4A147069107019FD1"><enum>(b)</enum><header>Offense</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE278D1E4B4144EFF934059257946F8C6"><section id="H49318D8809CD4C5EAA98B1E8B7299BFA"><enum>1041.</enum><header>False reporting</header><subsection id="HCEE6E20B835343B894F6EF5129605F6F"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">It shall be unlawful for any person to knowingly and willfully falsify a police report in a material way with the intent to falsify, conceal, or cover up a material fact, in furtherance of the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States where death or serious bodily injury (as defined in section 1365) occurs.</text></subsection><subsection id="HF0D6E218B37A4C629EEC4D49BF3DCCB5"><enum>(b)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall be fined under this title, imprisoned for not more than 20 years, or both.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H73570EBA0E554C8F8AC68D5BE14C4609"><enum>(c)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">chapter 47</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/1040">section 1040</external-xref> the following:</text><quoted-block style="USC" id="H4E426866F1F746218C370949731241F1"><toc><toc-entry level="section" idref="H49318D8809CD4C5EAA98B1E8B7299BFA">1041. False reporting.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA6B0D2F9F2864FB180192E37F2349D5A"><enum>(d)</enum><header>Sentencing enhancement for falsification of police reports</header><text>Pursuant to its authority under section 994 of title 28, United States Code, the United States Sentencing Commission shall review and amend the Federal sentencing guidelines to ensure that the guidelines provide an additional penalty increase of not fewer than 4 offense levels if the defendant knowingly and willfully falsifies a report in a material way with the intent to falsify, conceal, or cover up a material fact, in furtherance of the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States where death or serious bodily injury occurs. </text></subsection></section></title><title id="HBF029174B311481D8D4026CA63324851" style="OLC"><enum>II</enum><header>Body-worn cameras</header><section id="H1BA6F44420F6442D952559866D88101F"><enum>201.</enum><header>Body-Worn Camera Partnership Grant Program</header><text display-inline="no-display-inline"> Subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEAE46015AD31495C831F7138CE3E351B"><section id="HB0A5FF1BFB3F4785A07FCA71BB4371B3"><enum>509.</enum><header>Body-Worn Camera Partnership Grant Program</header><subsection id="H420C95FF06FA41769A64980F42185016"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section— </text><paragraph id="H41AD8D87433149B9BD53A469AEAB9A56"><enum>(1)</enum><text>the term <term>covered government</term> means a State, unit of local government, or Indian Tribe;</text></paragraph><paragraph id="HE6B47F40F0E34523B2BC315F12AA9C2E"><enum>(2)</enum><text>the term <term>Director</term> means the Director of the Bureau of Justice Assistance; and</text></paragraph><paragraph id="H469167E4050F48E9B931CF0EBD6AC6C9"><enum>(3)</enum><text>the term <term>unit of local government</term>, notwithstanding section 901, does not include an Indian Tribe.</text></paragraph></subsection><subsection id="H94694B5F2F4B4D65A54D79D803BCB7BF"><enum>(b)</enum><header>Authorization of grants</header><text display-inline="yes-display-inline">The Director may make grants to eligible covered governments for use by the covered government for—</text><paragraph id="HFCDD3AE0611840C0873624566F46DD17"><enum>(1)</enum><text>the purchase of body-worn cameras;</text></paragraph><paragraph id="HEB4DBE80275B4783B84B94582988B6A3"><enum>(2)</enum><text>necessary initial supportive technological infrastructure for body-worn cameras for law enforcement officers in the jurisdiction of the grantee;</text></paragraph><paragraph id="H6174A3280B5F4C358FA739A32E94FD16"><enum>(3)</enum><text>the development of policies and procedures relating to the use of body-worn cameras;</text></paragraph><paragraph id="HEF3D81109E6942A7B35CE431DFE6A3F2"><enum>(4)</enum><text>training on the use of body-worn cameras;</text></paragraph><paragraph id="HB330A86B7695456AAA681929A2D4C18C"><enum>(5)</enum><text>the storage, retention, viewing, auditing, and release of footage from body-worn cameras; and</text></paragraph><paragraph id="H61962DB2B93B4841A8A74A55DC4B953B"><enum>(6)</enum><text>personnel, including law enforcement, prosecution, and criminal defense personnel, to support the administration of the body-worn camera program of the covered government.</text></paragraph></subsection><subsection id="HCD0DDAA319E64B92A6E759F1C21DCE1B"><enum>(c)</enum><header>Eligibility</header><paragraph id="H12C48839D45149BFA0C90372E1ABD49C"><enum>(1)</enum><header>Application</header><text>For a covered government to be eligible to receive a grant under this section, the chief executive officer of the covered government shall submit to the Director an application in such form and containing such information as the Director may require.</text></paragraph><paragraph id="H1C6F8536F5054355BCCCEC2E24D1F857"><enum>(2)</enum><header>Policies and procedures assurances</header><text>The application under paragraph (1) shall, as required by the Director, provide assurances that the covered government will establish policies and procedures in accordance with subsection (d).</text></paragraph></subsection><subsection id="H0ABACAB47BF440F78C8D99EAA1CAEFDD"><enum>(d)</enum><header>Required policies and procedures</header><paragraph id="HE9340E42C3FD467692E3E65469D6A060"><enum>(1)</enum><header>In general</header><text>A covered government receiving a grant under this section shall develop policies and procedures related to the use of body-worn cameras that—</text><subparagraph id="HAF5D0ACE960E4D708F859B0AD39BD506"><enum>(A)</enum><text>are developed with community input, including from prosecutors and organizations representing crime victims, in accordance with recognized best practices;</text></subparagraph><subparagraph id="H060826AF26B34EDEB1BECFAEF4887427"><enum>(B)</enum><text>require that a body-worn camera be activated when a law enforcement officer arrests or detains any person in the course of the official duties of the officer, with consideration to sensitive cases;</text></subparagraph><subparagraph id="H503F5DCD321F4C1A90B7FB95FC73745D"><enum>(C)</enum><text>apply discipline to any law enforcement officer who intentionally fails to ensure that a body-worn camera is engaged, functional, and properly secured at all times during which the camera is required to be worn;</text></subparagraph><subparagraph id="H45C4EB1A495B4090A5E754C67950CBBF"><enum>(D)</enum><text>require training for—</text><clause id="H38C30943D8AA4A11863B69096A11D385"><enum>(i)</enum><text>the proper use of body-worn cameras; and</text></clause><clause id="HF7B0A1BB465B49169AE268F0EF4E0C77"><enum>(ii)</enum><text>the handling and use of the obtained video and audio recordings;</text></clause></subparagraph><subparagraph id="H5D4DD1F886344FD8BCEDF7791055793E"><enum>(E)</enum><text>provide clear standards for privacy, data retention, and use for evidentiary purposes in a criminal proceeding, including in the case of an assault on a law enforcement officer; and </text></subparagraph><subparagraph id="H9DA1317B89174A0F908EDB66F53CF223"><enum>(F)</enum><text>make footage available to the public in response to a valid request under an applicable freedom of information law if the footage can be made available—</text><clause id="HD51204822386473CBC93CAF8F6F5A289"><enum>(i)</enum><text>without compromising an ongoing investigation or revealing the identity of third parties, including victims, informants, or witnesses; and</text></clause><clause id="HC36E5AFE8C2D449580CF6426774AA6E1"><enum>(ii)</enum><text>with consideration given to the rights of victims and surviving family members.</text></clause></subparagraph></paragraph><paragraph id="H1ADEDFEAF17E49679649AF926B34D7C6"><enum>(2)</enum><header>Publication</header><text>A covered government receiving a grant under this section shall make all policies and procedures regarding body-worn cameras available on a public website.</text></paragraph><paragraph id="H1601758A02C949749E8EE6F9B4F545A0"><enum>(3)</enum><header>Guidance</header><text>The Director shall issue guidance to covered governments related to the requirements under paragraph (1).</text></paragraph></subsection><subsection id="HFE0F20A1E28D43558191FC9DE25F9379"><enum>(e)</enum><header>Grant amounts</header><paragraph id="H369380AFB4F94AC9B8A55E7B98E5D3AA"><enum>(1)</enum><header>Minimum amount</header><subparagraph id="HFD494059487D4D4DA6852A4E744F0FB4"><enum>(A)</enum><header>In general</header><text>Each fiscal year, unless the Director has awarded a fully funded grant for each eligible application submitted by a State and any units of local government within the State under this section for the fiscal year, the Director shall allocate to the State and units of local government within the State for grants under this section an aggregate amount that is not less than 0.5 percent of the total amount appropriated for the fiscal year for grants under this section.</text></subparagraph><subparagraph id="HEC135A9C7EB64549AC2161439EF84BDF"><enum>(B)</enum><header>Certain territories</header><text>For purposes of the Virgin Islands, American Samoa, Guam, and the Northern Mariana Islands, subparagraph (A) shall be applied by substituting <quote>0.25 percent</quote> for <quote>0.5 percent</quote>.</text></subparagraph></paragraph><paragraph id="HEE5C7510B2264749A0B8BBB93A3B2801"><enum>(2)</enum><header>Maximum amount</header><subparagraph id="H6195C518F9B748D2B1F3FA34225DE83D"><enum>(A)</enum><header>Amount per covered government</header><text>A covered government may not receive a grant under this section for a fiscal year in an amount that is greater than 5 percent of the total amount appropriated for grants under this section for the fiscal year.</text></subparagraph><subparagraph id="H8BD7E78EE15A4C92928C4604CB3283E7"><enum>(B)</enum><header>Aggregate amount per State</header><text>A State and each covered government within the State may not receive grants under this section for a fiscal year in an aggregate amount that is more than 20 percent of the total amount appropriated for grants under this section for the fiscal year.</text></subparagraph></paragraph></subsection><subsection id="H39F90EDA2A3048B093339F49ACA7775D"><enum>(f)</enum><header>Matching funds</header><text>The portion of the costs of a body-worn camera program provided by a grant under this section—</text><paragraph id="HADFB09F987EB459C853524DDFDD2828A"><enum>(1)</enum><text>may not exceed 50 percent; and</text></paragraph><paragraph id="HC42396FCA6CF4971880A7973F26A7189"><enum>(2)</enum><text>subject to subsection (e)(2), shall equal 50 percent if the grant is to a unit of local government with fewer than 100,000 residents.</text></paragraph></subsection><subsection id="H69C73D526ABF4079A4BB1143FB97418E"><enum>(g)</enum><header>Supplement, not supplant</header><text>Funds made available under this section shall not be used to supplant covered government funds, but shall be used to increase the amount of funds that would, in the absence of Federal funds, be made available from covered government sources for the purposes of this section.</text></subsection><subsection id="HF33B4C0A1060493A82E2B40BCBCC068A"><enum>(h)</enum><header>Reports to the Director</header><text>A covered government that receives a grant under this section shall submit to the Director, for each year in which funds from a grant received under this section are expended, a report at such time and in such manner as the Director may reasonably require, that contains—</text><paragraph id="H8E5971ABB319482983E649854E2EFE44"><enum>(1)</enum><text>a summary of the activities carried out under the grant and an assessment of whether the activities are meeting the needs identified in the grant application; and</text></paragraph><paragraph id="H0CEE813E5F3642A296A07357179A4364"><enum>(2)</enum><text>such other information as the Director may require.</text></paragraph></subsection><subsection id="H787D8C6B430B48CDB26F3A12590F9068"><enum>(i)</enum><header>Reports to Congress</header><text>Not later than 90 days after the end of a fiscal year for which grants are made under this section, the Director shall submit to Congress a report that includes—</text><paragraph id="H3BB6B4D9F4CD482799658180E1D45F7B"><enum>(1)</enum><text>the aggregate amount of grants made under this section to each covered government for the fiscal year;</text></paragraph><paragraph id="H9DDD254610444B37B239B2D988FA3B93"><enum>(2)</enum><text>a summary of the information provided by covered governments receiving grants under this section; and</text></paragraph><paragraph id="HC7BB8748CABD4837BCF16260524BAB05"><enum>(3)</enum><text>a description of the priorities and plan for awarding grants among eligible covered governments, and how the plan will ensure the effective use of body-worn cameras to protect public safety.</text></paragraph></subsection><subsection id="H99DD6625685642BDB81E557D96376793"><enum>(j)</enum><header>Direct appropriations</header><text display-inline="yes-display-inline">For the purpose of making grants under this section there is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2021, $500,000,000, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section section-type="subsequent-section" id="H50CE001BC3B441FCB9A1A6A493F040D7"><enum>202.</enum><header>Penalties for failure to use body-worn cameras</header><subsection id="H957E632A7A4246008709F2E500ED8889"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>covered provision</term> means—</text><paragraph id="H2F87C4BD843043F5AA78324CFCF98902"><enum>(1)</enum><text>section 509 of title I of the Omnibus Crime Control and Safe Streets Act of 1968, as added by section 201; and</text></paragraph><paragraph id="HB2895BE92B57424AA896CDA914AB01CC"><enum>(2)</enum><text>any other provision of law that makes funds available for the purchase of body-worn cameras.</text></paragraph></subsection><subsection id="H9A98E87F12514E28B119DF39BB6A9B0F" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Requirement</header><paragraph commented="no" display-inline="no-display-inline" id="H233DE05559694031B53B9F504B6A4B08"><enum>(1)</enum><header>States</header><text>A State that receives funds under a covered provision shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB91CF1AEED2E4833A293BA9A0F39843B"><enum>(A)</enum><text>have a policy in place to apply discipline to any law enforcement officer who intentionally fails to ensure that a body-worn camera purchased using those funds is engaged, functional, and properly secured at all times during which the camera is required to be worn; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="HCDE208C591DA4A3F89F386EF3DC146F0"><enum>(B)</enum><text>ensure that any entity to which the State awards a subgrant under the covered provision has a policy in place to apply discipline to any law enforcement officer who intentionally fails to ensure that a body-worn camera purchased using those funds is engaged, functional, and properly secured at all times during which the camera is required to be worn.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9D25418350544BE5B33DA6AF4930C4A5"><enum>(2)</enum><header>Other entities</header><text>An entity other than a State that receives funds under a covered provision shall have a policy in place to apply discipline to any law enforcement officer who intentionally fails to ensure that a body-worn camera purchased using those funds is engaged, functional, and properly secured at all times during which the camera is required to be worn.</text></paragraph></subsection><subsection id="H78C50790CD8E443A85FD747BE7F5607E"><enum>(c)</enum><header>Compliance</header><paragraph id="H74B61A1F19164D7E8C9A0A811E83303A"><enum>(1)</enum><header>Ineligibility for funds</header><subparagraph id="H715BD5CC3D9D48B5B736FC25456085D3"><enum>(A)</enum><header>First fiscal year</header><clause id="H529F8104323045FCAAA7509099F32536"><enum>(i)</enum><header>States</header><text>For the first fiscal year beginning after the date of enactment of this Act in which a State fails to comply with subsection (b)(1), the State shall be subject to a 20-percent reduction of the funds that would otherwise be provided to the State under the applicable covered provision for that fiscal year.</text></clause><clause id="H3BB98A77D3E94AD4A3E1EE0521EC41AA"><enum>(ii)</enum><header>Other entities</header><text>For the first fiscal year beginning after the date of enactment of this Act in which an entity other than a State fails to comply with subsection (b)(2), the entity shall be subject to a 20-percent reduction of the funds that would otherwise be allocated to the entity under the applicable covered provision for that fiscal year.</text></clause></subparagraph><subparagraph id="H22EDAA55A32F43D5BA77E6A9CE734E94"><enum>(B)</enum><header>Subsequent fiscal years</header><clause id="H002595A74C6E471FBC77C09696907799"><enum>(i)</enum><header>States</header><text>Beginning in the first fiscal year beginning after the first fiscal year described in subparagraph (A)(i) in which a State fails to comply with subsection (b), the percentage by which the funds described in subparagraph (A)(i) are reduced shall be increased by 5 percent each fiscal year the State fails to comply with subsection (b), except that such reduction shall not exceed 25 percent in any fiscal year.</text></clause><clause id="HEF4D89DF70EB4E2DA6D67F6D1EB2A910"><enum>(ii)</enum><header>Other entities</header><text>Beginning in the first fiscal year beginning after the first fiscal year described in subparagraph (A)(i) in which a an entity other than a State fails to comply with subsection (b), the percentage by which the funds described in subparagraph (A)(ii) are reduced shall be increased by 5 percent each fiscal year the entity fails to comply with subsection (b), except that such reduction shall not exceed 25 percent in any fiscal year.</text></clause></subparagraph></paragraph><paragraph id="H1D6F3C6A564D49C398FAD6B9FB760F5A"><enum>(2)</enum><header>Reallocation</header><text>Amounts not allocated under covered provision to a State or other entity for failure to comply with subsection (b) shall be reallocated under the covered provision to States or other entities that have complied with subsection (b).</text></paragraph></subsection></section></title><title style="OLC" id="H5FB20ED8982E446B85A96FF1F821AA3E"><enum>III</enum><header>Law enforcement records retention</header><section id="H91CCABC51DC544528D7ACBFCA4C0F48E"><enum>301.</enum><header>Law enforcement records retention</header><subsection id="H85E5FBE88B2F404F822EDB517625A0CF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"> Part E of title I of the Omnibus Crime Control and Safe Streets Acts of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H574EAEA29610426193113235203FBEEA"><subpart id="H1FDC37D33F63400BB370EECD59801BD6" style="OLC"><enum>4</enum><header>Law enforcement records retention</header><section id="H39A94BCBB53E4EF3917805E65E5DA906"><enum>531.</enum><header>Law enforcement records retention</header><subsection id="H77E8E8977F784E98B121D594321FBF58" commented="no"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph commented="no" id="HA72EC3483F6646C099B6AC64D6F0651B"><enum>(1)</enum><text>the term <term>applicable covered system</term>, with respect to a law enforcement agency, means the covered system of the covered government of which the law enforcement agency is part;</text></paragraph><paragraph commented="no" id="HA7E3EEE635ED460E98B579F732897E68"><enum>(2)</enum><text>the term <term>covered government</term> means a State or unit of local government;</text></paragraph><paragraph commented="no" id="HB21C8C49ABE449E388582A0F9208459A"><enum>(3)</enum><text>the term <term>covered system</term> means a system maintained by a covered government under subsection (b); and</text></paragraph><paragraph commented="no" id="HE4CB65E01C0A454D8B4F1964398269B2"><enum>(4)</enum><text>the term <term>disciplinary record</term>—</text><subparagraph commented="no" id="HADDE1DC0E8654E53A23A4DDF91908325"><enum>(A)</enum><text>means any written document regarding an allegation of misconduct by a law enforcement officer that—</text><clause commented="no" id="H1B51AE2F36C64C388F7F868118BBBEDC"><enum>(i)</enum><text>is substantiated and is adjudicated by a government agency or court; and</text></clause><clause commented="no" id="HF47215F5C99A4A6C926F560F13B089B4"><enum>(ii)</enum><text>results in—</text><subclause id="HF821C06824F04DC196F7B9B3E32D0BD2"><enum>(I)</enum><text>adverse action by the employing law enforcement agency; or</text></subclause><subclause id="H3571CE29D9C74845BCCBF27DB42AEDA2"><enum>(II)</enum><text>criminal charges; and</text></subclause></clause></subparagraph><subparagraph id="H5A594A378A104256A8BB399BAF51B31D"><enum>(B)</enum><text>does not include a written document regarding an allegation described in subparagraph (A) if the adjudication described in clause (i) of that subparagraph has been overturned on appeal.</text></subparagraph></paragraph></subsection><subsection id="H54DC7D6BA9CE4DE3BC785FA318DF2748"><enum>(b)</enum><header>Records retention requirements</header><paragraph id="H2596F404404542CDAB813DCF0CDBE4AB"><enum>(1)</enum><header>Records retention system</header><text>A covered government that receives funds under this part shall maintain a system for sharing disciplinary records of law enforcement officers that meets the requirements under paragraph (2).</text></paragraph><paragraph id="HA62483A407DD43F692D01B015CD5EB84"><enum>(2)</enum><header>Requirements</header><text>In administering a covered system, a covered government shall—</text><subparagraph id="HDD99E4BDCCB54E4BACE7755F2AEA9693"><enum>(A)</enum><text>retain each disciplinary record or internal investigation record regarding a law enforcement officer that is prepared by a law enforcement agency of the covered government;</text></subparagraph><subparagraph id="HAF59620B2D824AC680EF6C18C15942B8"><enum>(B)</enum><text>retain a record of each award or commendation regarding a law enforcement officer that is prepared by a law enforcement agency of the covered government;</text></subparagraph><subparagraph id="H42F1C9C86F0F4A9BBC9B3622AC83C227"><enum>(C)</enum><text>establish a policy that ensures that each record included in the covered system is retained and accessible for not less than 30 years;</text></subparagraph><subparagraph id="HC4C07C4726044D7D92FD74E9EE842722"><enum>(D)</enum><text>allow a law enforcement officer, counsel for a law enforcement officer, or the representative organization of a law enforcement officer to—</text><clause id="H40FDF280A90D4DBEB6D2CF6635AFE140"><enum>(i)</enum><text>submit information to the covered system relating to a disciplinary record or internal investigation record regarding the law enforcement officer that is retained under subparagraph (A); or</text></clause><clause id="H6E7CE7ABCD6543D89F4356CEB39C97DF"><enum>(ii)</enum><text>obtain access to the covered system in order to review a disciplinary record or internal investigation record described in clause (i);</text></clause></subparagraph><subparagraph id="H304B6035ECE349E7ACB64C30A2A9F970"><enum>(E)</enum><text>allow any Federal, State, or local law enforcement agency to access any record included in the covered system for the purpose of making a decision to hire a law enforcement officer;</text></subparagraph><subparagraph id="H5E270B4BE5184FD68F8CE403DDDBBB1B"><enum>(F)</enum><text>require that, before hiring a law enforcement officer, a representative of a law enforcement agency of the covered government with hiring authority—</text><clause id="HD04E4F8E119443E58E3044477C1E5738"><enum>(i)</enum><text>search the applicable covered system of each law enforcement agency that has employed the applicant as a law enforcement officer in order to determine whether the applicant has a disciplinary record, internal investigation record, or record of an award or commendation on file; and</text></clause><clause id="H2E407683BCB3402CB8B63770A92FE781"><enum>(ii)</enum><text>if a record described in clause (i) exists, review the record in full before hiring the law enforcement officer; and</text></clause></subparagraph><subparagraph id="HCBD627BF35F74C7F882397A876E764C5"><enum>(G)</enum><text>prohibit access to the covered system by any individual other than an individual who is authorized to access the covered system for purposes of—</text><clause id="HC8FC447AE0E845098370887D525BDBB0"><enum>(i)</enum><text>submitting records or other information to the covered system as described in subparagraphs (A), (B), and (D); or</text></clause><clause id="H0638C4985DEC48A2899ECB2F64F84078"><enum>(ii)</enum><text>reviewing records or other information in the covered system as described in subparagraphs (E) and (F).</text></clause></subparagraph></paragraph></subsection><subsection id="HF85BF912861E45658CB0BFD730BA166B"><enum>(c)</enum><header>Ineligibility for funds</header><paragraph id="H5EAE14C7496F46F68A0884DF3D9F6F44"><enum>(1)</enum><header>In general</header><text>A covered government may not receive funds under section 505, 506, 515, or 516 unless the covered government is in compliance with subsection (b) of this section. </text></paragraph><paragraph id="H0D0DF18856B7411F9A4356533E0AD360"><enum>(2)</enum><header>Reallocation</header><text>Amounts not allocated under a section referred to in paragraph (1) to a covered government for failure to comply with subsection (b) shall be reallocated under that section to covered governments that have complied with subsection (b).</text></paragraph></subsection><subsection id="H07AC3B9B182B435286C367A1289377E4"><enum>(d)</enum><header>One-Time grant</header><paragraph id="H6FE09E9F055F488FAC8A480F543891C0"><enum>(1)</enum><header>In general</header><text>The Attorney General shall award a grant to each State, using an apportionment formula that reflects the differences between each State, to be used by the State and units of local government within the State to establish covered systems.</text></paragraph><paragraph id="HAA2C861C3B1C4FE891F180C136B84FDB"><enum>(2)</enum><header>Amount</header><text>The amount of a grant awarded to a State under paragraph (1) shall be not less than $1,000,000.</text></paragraph><paragraph id="H9445AC62C44F4F93B783E53B8F4D5BDE"><enum>(3)</enum><header>Direct appropriations</header><text>For the purpose of making grants under this subsection, there is authorized to be appropriated, and there is appropriated, out of any money in the Treasury not otherwise appropriated, $100,000,000, to remain available until expended. </text></paragraph></subsection><subsection id="HC0D22F4676EF45028CDECC7AEB36AB2C"><enum>(e)</enum><header>Indemnification</header><paragraph id="H552D26574434424F9B456229DAD7FCA0"><enum>(1)</enum><header>In general</header><text>The United States shall indemnify and hold harmless a covered government, and any law enforcement agency thereof, against any claim (including reasonable expenses of litigation or settlement) by any person or entity related to—</text><subparagraph id="H8AC4A4C6385E46A09FCC880F427C5BA3"><enum>(A)</enum><text>the retention of records in a covered system as required under subsection (b); or</text></subparagraph><subparagraph id="H2FA0C0B9D5F146819B8ECE55ABB4D210"><enum>(B)</enum><text>the review of records included in a covered system as required under subsection (b).</text></subparagraph></paragraph><paragraph id="HA70950A4531A4CBC816B789365DE6928"><enum>(2)</enum><header>Limitation</header><text>Paragraph (1) shall not apply to the release of a record—</text><subparagraph id="H6DA21C1251D74C8FA766821A9901F390"><enum>(A)</enum><text>to a non-law enforcement entity or individual; or</text></subparagraph><subparagraph id="H6782FBC197664139BEAAA8251F587F50"><enum>(B)</enum><text>for a purpose other than making a decision to hire a law enforcement officer.</text></subparagraph></paragraph></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H33A766E96D094F54B27F1F28B7B09E34" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Effective date</header><text>Section 531(c) of title I of the Omnibus Crime Control and Safe Streets Acts of 1968, as added by subsection (a), shall take effect on October 1 of the first fiscal year beginning after the date of enactment of this Act. </text></subsection></section></title><title id="H74BD29913062439DB7E54839150C07F2" style="OLC"><enum>IV</enum><header>Justice for Victims of Lynching</header><section commented="no" display-inline="no-display-inline" id="HF6793CF18F164E3087849CAB126DA956"><enum>401.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Justice for Victims of Lynching Act of 2021</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H801872A212AB418F9F476D41888C6952"><enum>402.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph commented="no" display-inline="no-display-inline" id="H2AFA41769B484981886CEC1EC85E0F22"><enum>(1)</enum><text display-inline="yes-display-inline">The crime of lynching succeeded slavery as the ultimate expression of racism in the United States following Reconstruction.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9A52A89191F34EC1B03FBECF28BB6F8D"><enum>(2)</enum><text display-inline="yes-display-inline">Lynching was a widely acknowledged practice in the United States until the middle of the 20th century.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAC2A5E442BCB4208B32CB10578B61C33"><enum>(3)</enum><text display-inline="yes-display-inline">Lynching was a crime that occurred throughout the United States, with documented incidents in all but 4 States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5AFADA51126C48D5906B523A035AF326"><enum>(4)</enum><text display-inline="yes-display-inline">At least 4,742 people, predominantly African Americans, were reported lynched in the United States between 1882 and 1968.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9AA0966D20384912BFC4155EA13E81BD"><enum>(5)</enum><text display-inline="yes-display-inline">Ninety-nine percent of all perpetrators of lynching escaped from punishment by State or local officials.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE338168C43074281A6431A5F6FC13815"><enum>(6)</enum><text display-inline="yes-display-inline">Lynching prompted African Americans to form the National Association for the Advancement of Colored People (referred to in this section as the <quote>NAACP</quote>) and prompted members of B'nai B'rith to found the Anti-Defamation League.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7775D664B86B42DEADEFED18C210BE2B"><enum>(7)</enum><text display-inline="yes-display-inline">Mr. Walter White, as a member of the NAACP and later as the executive secretary of the NAACP from 1931 to 1955, meticulously investigated lynchings in the United States and worked tirelessly to end segregation and racialized terror.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H634B0F8553684100AD546EBD0B0A406D"><enum>(8)</enum><text display-inline="yes-display-inline">Nearly 200 anti-lynching bills were introduced in Congress during the first half of the 20th century.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0EC250B361BA4BF6B3C2058E6AF50FFE"><enum>(9)</enum><text display-inline="yes-display-inline">Between 1890 and 1952, 7 Presidents petitioned Congress to end lynching.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3909E23AC3994F9FB55123401D5888B0"><enum>(10)</enum><text display-inline="yes-display-inline">Between 1920 and 1940, the House of Representatives passed 3 strong anti-lynching measures.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H82C523717C0244939D3B81E4E29A4054"><enum>(11)</enum><text display-inline="yes-display-inline">Protection against lynching was the minimum and most basic of Federal responsibilities, and the Senate considered but failed to enact anti-lynching legislation despite repeated requests by civil rights groups, Presidents, and the House of Representatives to do so.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8664F894CECC4B90B3013F81EE4DD0F2"><enum>(12)</enum><text display-inline="yes-display-inline">The publication of <quote>Without Sanctuary: Lynching Photography in America</quote> helped bring greater awareness and proper recognition of the victims of lynching.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3FB855AC83CD4A2F828EFC46CBB418B4"><enum>(13)</enum><text display-inline="yes-display-inline">Only by coming to terms with history can the United States effectively champion human rights abroad.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8A89A66140AA4D50BE48C34A1D6CFF54"><enum>(14)</enum><text display-inline="yes-display-inline">An apology offered in the spirit of true repentance moves the United States toward reconciliation and may become central to a new understanding, on which improved racial relations can be forged.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6C133B29AE4C482E80F3D069DA9F52CC"><enum>(15)</enum><text display-inline="yes-display-inline">Having concluded that a reckoning with our own history is the only way the country can effectively champion human rights abroad, 90 Members of the United States Senate agreed to Senate Resolution 39, 109th Congress, on June 13, 2005, to apologize to the victims of lynching and the descendants of those victims for the failure of the Senate to enact anti-lynching legislation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H63E2682BB7764107B50A21C7ED46E9B3"><enum>(16)</enum><text display-inline="yes-display-inline">The National Memorial for Peace and Justice, which opened to the public in Montgomery, Alabama, on April 26, 2018, is the Nation’s first memorial dedicated to the legacy of enslaved Black people, people terrorized by lynching, African Americans humiliated by racial segregation and Jim Crow, and people of color burdened with contemporary presumptions of guilt and police violence.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H888FB66C0BDF483D8292E6901B4A4739"><enum>(17)</enum><text display-inline="yes-display-inline">Notwithstanding the Senate’s apology and the heightened awareness and education about the Nation’s legacy with lynching, it is wholly necessary and appropriate for the Congress to enact legislation, after 100 years of unsuccessful legislative efforts, finally to make lynching a Federal crime.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFAFB5AC31E444280BA56F62548FA08B2"><enum>(18)</enum><text display-inline="yes-display-inline">Further, it is the sense of Congress that criminal action by a group increases the likelihood that the criminal object of that group will be successfully attained and decreases the probability that the individuals involved will depart from their path of criminality. Therefore, it is appropriate to specify criminal penalties for the crime of lynching, or any attempt or conspiracy to commit lynching.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9C4BE64055244C7FA80C0D46CACBA71D"><enum>(19)</enum><text display-inline="yes-display-inline">The United States Senate agreed to unanimously Senate Resolution 118, 115th Congress, on April 5, 2017, <quote>[c]ondemning hate crime and any other form of racism, religious or ethnic bias, discrimination, incitement to violence, or animus targeting a minority in the United States</quote> and taking notice specifically of Federal Bureau of Investigation statistics demonstrating that <quote>among single-bias hate crime incidents in the United States, 59.2 percent of victims were targeted due to racial, ethnic, or ancestral bias, and among those victims, 52.2 percent were victims of crimes motivated by the offenders’ anti-Black or anti-African American bias</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE97F042327DB4177924D7AE2A2CEBD5E"><enum>(20)</enum><text display-inline="yes-display-inline">On September 14, 2017, President Donald J. Trump signed into law Senate Joint Resolution 49 (<external-xref legal-doc="public-law" parsable-cite="pl/115/58">Public Law 115–58</external-xref>; 131 Stat. 1149), wherein Congress <quote>condemn[ed] the racist violence and domestic terrorist attack that took place between August 11 and August 12, 2017, in Charlottesville, Virginia</quote> and <quote>urg[ed] the President and his administration to speak out against hate groups that espouse racism, extremism, xenophobia, anti-Semitism, and White supremacy; and use all resources available to the President and the President’s Cabinet to address the growing prevalence of those hate groups in the United States</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCB598D33D0BF459287A2AE4CCBF06BE3"><enum>(21)</enum><text display-inline="yes-display-inline">Senate Joint Resolution 49 (<external-xref legal-doc="public-law" parsable-cite="pl/115/58">Public Law 115–58</external-xref>; 131 Stat. 1149) specifically took notice of <quote>hundreds of torch-bearing White nationalists, White supremacists, Klansmen, and neo-Nazis [who] chanted racist, anti-Semitic, and anti-immigrant slogans and violently engaged with counter-demonstrators on and around the grounds of the University of Virginia in Charlottesville</quote> and that these groups <quote>reportedly are organizing similar events in other cities in the United States and communities everywhere are concerned about the growing and open display of hate and violence being perpetrated by those groups</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6E390D6154D249799C035ACA4832A46F"><enum>(22)</enum><text display-inline="yes-display-inline">Lynching was a pernicious and pervasive tool that was used to interfere with multiple aspects of life—including the exercise of Federally protected rights, as enumerated in section 245 of title 18, United States Code, housing rights, as enumerated in section 901 of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3631">42 U.S.C. 3631</external-xref>), and the free exercise of religion, as enumerated in section 247 of title 18, United States Code. Interference with these rights was often effectuated by multiple offenders and groups, rather than isolated individuals. Therefore, prohibiting conspiracies to violate each of these rights recognizes the history of lynching in the United States and serves to prohibit its use in the future.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="HD4328A76B8F840AF8B012F803C8E4AB9"><enum>403.</enum><header display-inline="yes-display-inline">Lynching</header><subsection commented="no" display-inline="no-display-inline" id="H026C35A55CD34C6A8BB5CA8426564135"><enum>(a)</enum><header display-inline="yes-display-inline">Offense</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/13">Chapter 13</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H2AB16F9EA842444D857753F515535B83" style="USC"><section commented="no" display-inline="no-display-inline" id="H63E89F64AF95478BBA50EC15F6797128" section-type="subsequent-section"><enum>250.</enum><header display-inline="yes-display-inline">Lynching</header><text display-inline="no-display-inline">Whoever conspires with another person to violate section 245, 247, or 249 of this title or section 901 of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3631">42 U.S.C. 3631</external-xref>) shall be punished in the same manner as a completed violation of such section, except that if the maximum term of imprisonment for such completed violation is less than 10 years, the person may be imprisoned for not more than 10 years.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="HDE9C3C2FD76245C2A110D8E9DE5FC1E5"><enum>(b)</enum><header display-inline="yes-display-inline">Table of sections amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/13">chapter 13</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/249">section 249</external-xref> the following:</text><quoted-block display-inline="no-display-inline" id="H404512F789BF4B16855A4BCD49CD7948" style="OLC"><toc><toc-entry bold="off" idref="H63E89F64AF95478BBA50EC15F6797128" level="section">250. Lynching.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title><title id="H933D42FE5C2C475486C8C8D20B3A755B" style="OLC"><enum>V</enum><header>Alternatives to the use of force, de-escalation, behavioral health crises and duty to intervene training</header><section id="HA50E86128B3E41E1958F03D84DFEC435" section-type="subsequent-section"><enum>501.</enum><header>Training on alternatives to use of force, de-escalation, and behavioral health crises</header><subsection id="H43025FB6AFFF44938C6A7B6EE5E216D9"><enum>(a)</enum><header>Definitions</header><text>Section 901(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251(a)</external-xref>) is amended—</text><paragraph id="HE68463D51DCA42B498687E25FB9F486D"><enum>(1)</enum><text>in paragraph (27), by striking <quote>and</quote> at the end; and</text></paragraph><paragraph id="HB4689B1790144912A247FE1150CFE175"><enum>(30)</enum><text>the term <term>behavioral health crisis</term> means a situation in which the behavior of a person puts the person at risk of hurting himself or herself or others or prevents the person from being able to care for himself or herself or function effectively in the community, including a situation in which a person is under the influence of a drug or alcohol, is suicidal, or experiences symptoms of a mental illness.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC38C1C1E3BBC41B9A5C028D16DE145AD"><enum>(b)</enum><header>COPS program</header><text display-inline="yes-display-inline">Section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC16ECF4118F742E2BF616A4E320BD80E"><subsection id="H089D45204A204A01AC864F60C3E88A35"><enum>(n)</enum><header>Training in alternatives to use of force, de-Escalation techniques, and behavioral health crises</header><paragraph id="H4C398B708C13400DBA5E3BB08B782F05"><enum>(1)</enum><header>Training curricula</header><text>The Attorney General, in consultation with relevant law enforcement agencies of States and units of local government, labor organizations, professional law enforcement organizations, and mental health organizations, shall develop training curricula in—</text><subparagraph id="H3995F6E85C66486C92244F4382A01F21"><enum>(A)</enum><text>alternatives to use of force and de-escalation tactics; and</text></subparagraph><subparagraph id="H6AF6C2AC20FF4701B2E81AF3996C1FFD"><enum>(B)</enum><text>safely responding to a person experiencing a behavioral health crisis, including techniques and strategies that are designed to protect the safety of the person experiencing the behavioral health crisis, law enforcement officers, and the public.</text></subparagraph></paragraph><paragraph id="H0CE0DF2925B241409A461BEA33381C26"><enum>(2)</enum><header>Certified programs</header><text>The Attorney General shall establish a process to certify public and private entities that offer courses in alternatives to use of force, de-escalation tactics, and techniques and strategies for responding to a behavioral health crisis using the training curricula established under paragraph (1) or equivalents to the training curricula established under paragraph (1).</text></paragraph><paragraph id="HC21FCF89EE2444F890439608E6208685"><enum>(3)</enum><header>Transitional regional training programs for State and local agency personnel</header><text>Until the end of fiscal year 2023, the Attorney General shall, and thereafter may, provide regional training to equip and certify personnel from law enforcement agencies of States and units of local government in a State to conduct training using the training curricula established under paragraph (1).</text></paragraph><paragraph id="H375148B968224DFCA9A462BAAFDC2FBD"><enum>(4)</enum><header>List</header><text>The Attorney General shall publish a list of law enforcement agencies of States and units of local government that employ officers who have successfully completed a course described under paragraph (2) or (3), which shall include— </text><subparagraph id="H0167450E0CF74C09BD836FD5F5EB234D"><enum>(A)</enum><text>the total number of law enforcement officers employed by the agency; </text></subparagraph><subparagraph id="HC54B2444561B48D8A44CE4A03B3C5558"><enum>(B)</enum><text>the number of officers who have completed the course; and</text></subparagraph><subparagraph id="HA85734E764944E5493FD44F7E9B72D80"><enum>(C)</enum><text>whether personnel from the law enforcement agency are certified to conduct training. </text></subparagraph></paragraph><paragraph id="HFE4DF2E300854D90AD7ABCBC51722181"><enum>(5)</enum><header>Direct appropriations</header><text display-inline="yes-display-inline">For the purpose of making grants under this subsection there is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2021, $100,000,000, to remain available until expended.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H57FB63C95A66485491A68A541B9DCA88"><enum>(c)</enum><header>Byrne JAG program</header><text>Subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151</external-xref> et seq.) is amended—</text><paragraph id="HA5173019AFF34BB6ABEF290DE0A9093C"><enum>(1)</enum><text>by redesignating section 508 as section 511; and</text></paragraph><paragraph id="H9A600934BC9A498EA628ED12B5645292"><enum>(2)</enum><text>by inserting after section 507 the following: </text><quoted-block id="HF58A5E8289994D18B4D4D564607E72E6" display-inline="no-display-inline" style="OLC"><section id="H2FBC6D4D8A2742A685E323B6F72E0EC7"><enum>508.</enum><header>Law enforcement training programs</header><subsection id="HE09F88E3EFED40738AFEF9F2983E5CDC"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="H4860D671C83A44B9B136E1B4021F7367"><enum>(1)</enum><text>the term <term>approved course in alternatives to use of force, de-escalation tactics, or techniques and strategies for responding to a behavioral health crisis</term> means a course using the training curricula established under section 1701(n)(1) or equivalents to such training curricula—</text><subparagraph id="H21F420373C804A4F92A8006E10790736"><enum>(A)</enum><text>provided by the Attorney General under section 1701(n)(3); or</text></subparagraph><subparagraph id="HA03935164AA14291A40B20C0EADE67F1"><enum>(B)</enum><text>provided by a certified entity; and </text></subparagraph></paragraph><paragraph id="H7A031DE934974E3792A2F636E08AAEB8"><enum>(2)</enum><text>the term <term>certified entity</term> means a public or private entity that has been certified by the Attorney General under section 1701(n)(2).</text></paragraph></subsection><subsection id="HF3FBCCB194B74134B77DAA3AB6E571D1"><enum>(b)</enum><header>Authority</header><text>The Attorney General shall, from amounts made available for this purpose under subsection (e), make grants to States for use by the State or a unit of government located in the State to—</text><paragraph id="H71DB8549E907424493B09165D4271446"><enum>(1)</enum><text>pay for costs associated with conducting the training and for attendance by law enforcement personnel at an approved course in alternatives to use of force, de-escalation tactics, or techniques and strategies for responding to a behavioral health crisis; and</text></paragraph><paragraph id="HC5D0A9F846874E62908207CF8248B432"><enum>(2)</enum><text>procure training in alternatives to use of force, de-escalation tactics, or techniques and strategies for responding to a behavioral health crisis from a certified entity.</text></paragraph></subsection><subsection id="HA670515070E14E8C861A1FC5FF95969B"><enum>(c)</enum><header>Allocation of funds</header><paragraph id="HC848367D6469478E8B59CF4D24456ECB"><enum>(1)</enum><header>In general</header><text>Of the total amount appropriated to carry out this section for a fiscal year, the Attorney General shall allocate funds to each State in proportion to the total number of law enforcement officers in the State as compared to the total number of law enforcement officers in the United States.</text></paragraph><paragraph id="H2A1C605FFE364234ACCFCF64D1745678"><enum>(2)</enum><header>Training for State law enforcement officers</header><text>Each State may retain from the total amount of funds provided to the State for the purposes described in this section an amount that is not more than the amount that bears the same ratio to the total amount of funds as the ratio of—</text><subparagraph id="H17716041496D42439BAFEE2B0A486B83"><enum>(A)</enum><text>the total number of law enforcement officers employed by the State; to</text></subparagraph><subparagraph id="HCB2D7200532B458694EFB09B3AF4E119"><enum>(B)</enum><text>the total number of law enforcement officers employed by the State and units of local government within the State. </text></subparagraph></paragraph><paragraph id="H9181DDF765DD489A88FF5566AFD785F3"><enum>(3)</enum><header>Training for local law enforcement officers</header><text>A State shall make available to units of local government in the State for the purposes described in this section the amounts remaining after a State retains funds under paragraph (2). At the request of a unit of local government, the State may use an amount of the funds allocated to the unit of local government under this paragraph to facilitate training in alternatives to use of force, de-escalation tactics, or techniques and strategies for responding to a behavioral health crisis to law enforcement officers employed by the unit of local government. </text></paragraph></subsection><subsection id="HAFB41E42D1964EB3B24C916856A4555A"><enum>(d)</enum><header>Reporting</header><paragraph id="HD62D4D53B8D8499095CEA4635B9CA235"><enum>(1)</enum><header>Units of local government</header><text>Any unit of local government that receives funds from a State under subsection (c)(3) shall submit to the State a report indicating— </text><subparagraph id="H8C8D9A12A0AD43D09BD354B3A8B61CA0"><enum>(A)</enum><text>the number of law enforcement officers that have completed training described in this section; </text></subparagraph><subparagraph id="H236F4723BEAC40AA99816C7C72AB9725"><enum>(B)</enum><text>the total number of law enforcement officers employed by the unit of local government; and </text></subparagraph><subparagraph id="HFA3C0472176042CE935ECA4F733EA770"><enum>(C)</enum><text>any barriers to providing the training.</text></subparagraph></paragraph><paragraph id="H4B93975574AE4E2B873C7F712045C0BF"><enum>(2)</enum><header>States</header><text>Any State that receives funds under subsection (c)(2) shall, after receiving the reports described in paragraph (1), submit to the Attorney General— </text><subparagraph id="H9539AC0A8F8941B3B4F82858A84DBBEE"><enum>(A)</enum><text>such reports; and </text></subparagraph><subparagraph id="H4BFAA15F31864ADD95B6ED019C82DA81"><enum>(B)</enum><text>a report by the State indicating— </text><clause id="HCFC65A7C941745258D1BFB4514602E02"><enum>(i)</enum><text>the number of law enforcement officers employed by the State that have completed training described in this section; </text></clause><clause id="H8B257B64F73345ADAF5A1E21D40D7360"><enum>(ii)</enum><text>the total number of law enforcement officers employed by the State; and </text></clause><clause id="HFF657575D8014CBF9514223CC3318877"><enum>(iii)</enum><text>any barriers to providing the training. </text></clause></subparagraph></paragraph></subsection><subsection id="H5C445994768B4419877F663B211C6ED3"><enum>(e)</enum><header>Direct appropriations</header><text display-inline="yes-display-inline">For the purpose of making grants under this section there is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2021, $250,000,000, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H7D0972C35A8144F1B941071CC613DF4B" commented="no"><enum>502.</enum><header>Training on duty to intervene</header><text display-inline="no-display-inline">Subpart 1 of part E of Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151</external-xref> et seq.), as amended by section 201, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA208A5A8B3AD41899E39B40AE33E2F6B"><section id="H35164E6E16B445888CEB0CAA088328F5"><enum>510.</enum><header>Training on duty to intervene</header><subsection id="H78792011BD3C47EDADF253B9D6B4249B"><enum>(a)</enum><header>Training program</header><paragraph id="HDB9A96D481114D819B13A2C958FC39DE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General, in consultation with relevant law enforcement agencies of States and units of local governments and organizations representing rank and file law enforcement officers, shall develop a training curriculum for law enforcement agencies and officers on the development, implementation, fulfillment, and enforcement of a duty of a law enforcement officer to intervene when another law enforcement officer is engaged in excessive use of force. </text></paragraph><paragraph id="H736F554A5ADD467C91DC5C82C9085CE1"><enum>(2)</enum><header>Certified programs</header><text>The Attorney General shall establish a process to certify public and private entities that offer courses on the duty to intervene that are equivalent to the training curriculum established under paragraph (1). </text></paragraph><paragraph id="H24E7A84709E94431901F17090AFA47ED"><enum>(3)</enum><header>Transitional regional training programs</header><text>Until the end of fiscal year 2023, the Attorney General shall provide regional training workshops for law enforcement officers of States and units of local government, using the training curriculum established under paragraph (1).</text></paragraph><paragraph id="HC350EA8A823F441684ABF547E307259E"><enum>(4)</enum><header>List</header><text>The Attorney General shall publish a list of law enforcement agencies of States and units of local government that employ officers who have successfully completed a course described under paragraph (2) or (3), which shall include the total number of law enforcement officers employed by the agency and the number of officers who have completed the course. </text></paragraph></subsection><subsection id="H63B18EFACFDB4963A52C68D894AE349A"><enum>(b)</enum><header>Grant program</header><paragraph id="H965C05AD760D479E868F62925267CC47"><enum>(1)</enum><header>Authorization</header><text>The Attorney General may make grants to State and local law enforcement agencies to—</text><subparagraph id="H3E31D9CB0A2D4352A81E49F6FFC8C808"><enum>(A)</enum><text>pay for costs associated with attendance by law enforcement personnel at a training course approved by the Attorney General under paragraph (2) or (3) of subsection (a); and</text></subparagraph><subparagraph id="H2312A12F599C4729B91AD0ADC890DD3B"><enum>(B)</enum><text>procure training in the duty to intervene from a public or private entity certified under subsection (a)(2).</text></subparagraph></paragraph><paragraph id="H3ADA11F5D9CF4FE2B20943ABDD2651CF"><enum>(2)</enum><header>Application</header><text>Each State or local law enforcement agency seeking a grant under this subsection shall submit an application to the Attorney General at such time, in such manner, and containing such information as the Attorney General may require. </text></paragraph></subsection><subsection id="H3DF1B00B38E94ACCA997B506E67FDBE5"><enum>(c)</enum><header>Direct appropriations</header><text display-inline="yes-display-inline">For the purpose of making grants under this section, there is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2021, $500,000,000, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="HA826FB15F9D940D6BAFE10216A9E1AB7" style="OLC"><enum>VI</enum><header>National Criminal Justice Commission Act</header><section id="H509EB9EE5370485BB93C41605980D1A3" section-type="subsequent-section"><enum>601.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>National Criminal Justice Commission Act of 2021</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HAD9066C8F5D24B23A70D966DDBBE423B" section-type="subsequent-section"><enum>602.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="HBA88AA406D614558B9CA2BF5B45CC0BD"><enum>(1)</enum><text display-inline="yes-display-inline">it is in the interest of the United States to establish a commission to undertake a comprehensive review of the criminal justice system;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3BFB1E4BC79540A2B2BBF17E49CB2577"><enum>(2)</enum><text display-inline="yes-display-inline">there has not been a comprehensive study since the President’s Commission on Law Enforcement and Administration of Justice was established in 1965;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE1B02F70298A43A19B72E79027728D9B"><enum>(3)</enum><text display-inline="yes-display-inline">in a span of 18 months, the President’s Commission on Law Enforcement and Administration of Justice produced a comprehensive report entitled <quote>The Challenge of Crime in a Free Society</quote>, which contained 200 specific recommendations on all aspects of the criminal justice system involving—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB5920B1D17F9456EAC1BEE5BC3A6F4CC"><enum>(A)</enum><text display-inline="yes-display-inline">Federal, State, Tribal, and local governments;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF32D79EA02A445869BC44C4CA39EADD1"><enum>(B)</enum><text display-inline="yes-display-inline">civic organizations;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFBA04CF64C5D478E98B8AC51A2843E99"><enum>(C)</enum><text display-inline="yes-display-inline">religious institutions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBE35223FC8AA43D6841B1BBAABA6318D"><enum>(D)</enum><text display-inline="yes-display-inline">business groups; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H087F549875AB4DA2A41E863F71C34807"><enum>(E)</enum><text display-inline="yes-display-inline">individual citizens; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1734D37DC1E74C41ABAD6CA3B64005DC"><enum>(4)</enum><text display-inline="yes-display-inline">developments over the intervening 50 years require once again that Federal, State, Tribal, and local governments, law enforcement agencies, including rank and file officers, civil rights organizations, community-based organization leaders, civic organizations, religious institutions, business groups, and individual citizens come together to review evidence and consider how to improve the criminal justice system.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="H5B6C17810EF7498996648C42A1C8D18A" section-type="subsequent-section"><enum>603.</enum><header display-inline="yes-display-inline">Establishment of Commission</header><text display-inline="no-display-inline">There is established a commission to be known as the <quote>National Criminal Justice Commission</quote> (referred to in this title as the <quote>Commission</quote>).</text></section><section commented="no" display-inline="no-display-inline" id="H1661A1592F894E62AAFA5DCC42432C2E" section-type="subsequent-section"><enum>604.</enum><header display-inline="yes-display-inline">Purpose of the Commission</header><text display-inline="no-display-inline">The Commission shall—</text><paragraph commented="no" display-inline="no-display-inline" id="HC9B0BDA23E9749EEA2091F5EFD287A6C"><enum>(1)</enum><text display-inline="yes-display-inline">undertake a comprehensive review of the criminal justice system;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD8FFE3467A041C589AEF7E21F8AEC19"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the President and Congress recommendations for Federal criminal justice reform; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H31B701EBAA5048CB89B1B6BF09A48F3C"><enum>(3)</enum><text display-inline="yes-display-inline">disseminate findings and supplemental guidance to the Federal Government, as well as to State, local, and Tribal governments.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="H346FD8C80B274810BD46108E4AFE65DB" section-type="subsequent-section"><enum>605.</enum><header display-inline="yes-display-inline">Review, recommendations, and report</header><subsection commented="no" display-inline="no-display-inline" id="HA9BDD1E177A0459CB363C4ACE08E66CD"><enum>(a)</enum><header display-inline="yes-display-inline">General review</header><text display-inline="yes-display-inline">The Commission shall undertake a comprehensive review of all areas of the criminal justice system, including the criminal justice costs, practices, and policies of the Federal, State, local, and Tribal governments.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HD1209F20C1E94021AB247747BD6BBCC6"><enum>(b)</enum><header display-inline="yes-display-inline">Recommendations</header><paragraph commented="no" display-inline="no-display-inline" id="HED1CABED13624D19AD10F1F024885A09"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the first meeting of the Commission, the Commission shall submit to the President and Congress recommendations for changes in Federal oversight, policies, practices, and laws designed to prevent, deter, and reduce crime and violence, reduce recidivism, improve cost-effectiveness, and ensure the interests of justice at every step of the criminal justice system.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H42279864050E4260B1F8729F218549EA"><enum>(2)</enum><header display-inline="yes-display-inline">Unanimous consent</header><text display-inline="yes-display-inline">If a unanimous vote of the members of the Commission at a meeting where a quorum is present pursuant to section 606(d) approves a recommendation of the Commission, the Commission may adopt and submit the recommendation under paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDADB86213AE24F68BDFA40C48E9903B9"><enum>(3)</enum><header display-inline="yes-display-inline">Public access</header><text display-inline="yes-display-inline">The recommendations submitted under this subsection shall be made available to the public.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H571007CCBA4A4AB1A65DA83E9EB4B406"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><paragraph commented="no" display-inline="no-display-inline" id="H116655538E3A4A75AF92C443DCA99B3D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the first meeting of the Commission, the Commission shall disseminate to the Federal Government, as well as to State, local, and Tribal governments, a report that details the findings and supplemental guidance of the Commission regarding the criminal justice system at all levels of government.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9672F1710AF04E5C8B7C8F38F97EAA2D"><enum>(2)</enum><header display-inline="yes-display-inline">Majority vote</header><text display-inline="yes-display-inline">If a majority vote of the members of the Commission approves a finding or supplemental guidance at a meeting where a quorum is present pursuant to section 606(d), the finding or supplemental guidance may be adopted and included in the report required under paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H34C832C0DF404FA093A75AE910D3BA56"><enum>(3)</enum><header>Dissents</header><text display-inline="yes-display-inline">In the case of a member of the Commission who dissents from a finding or supplemental guidance approved by a majority vote under paragraph (2), the member may state the reason for the dissent in writing and the report described in paragraph (1) shall include the dissent.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H360B2704C1804E0C8A9ADE1F841667BE"><enum>(4)</enum><header display-inline="yes-display-inline">Public access</header><text display-inline="yes-display-inline">The report submitted under this subsection shall be made available to the public.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H69DC505BA6EC4BDDAED30F2EED779F0F"><enum>(d)</enum><header display-inline="yes-display-inline">Prior commissions</header><text display-inline="yes-display-inline">The Commission shall take into consideration the work of prior relevant commissions in conducting the review of the Commission.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H345B0E78541A45B49EDB572C952DDE25"><enum>(e)</enum><header display-inline="yes-display-inline">State and local governments</header><text display-inline="yes-display-inline">In issuing the recommendations and report of the Commission under this section, the Commission shall not infringe on the legitimate rights of the States to determine the criminal laws of the States or the enforcement of such laws.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HC9EF028FEC6A48DF8E7CD7E1A6EB49A3"><enum>(f)</enum><header display-inline="yes-display-inline">Public hearings</header><text display-inline="yes-display-inline">The Commission shall conduct public hearings in various locations around the United States.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H9AB6C4375EDD459884A113FB980BD7D1"><enum>(g)</enum><header display-inline="yes-display-inline">Consultation with government and nongovernment representatives</header><paragraph commented="no" display-inline="no-display-inline" id="HF98593CC5B9B49B18D6F7EF9E00B859D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="H9B755C0DB8B34317BBC089E8D5E2C9CB"><enum>(A)</enum><text display-inline="yes-display-inline">closely consult with Federal, State, local, and Tribal governments and nongovernment leaders, including—</text><clause commented="no" display-inline="no-display-inline" id="H7BE3C41FD2684F7192A587983CA1BDB7"><enum>(i)</enum><text display-inline="yes-display-inline">State, local, and Tribal law enforcement officials, including rank and file officers;</text></clause><clause commented="no" display-inline="no-display-inline" id="H396F710FEE7E4F58A245E85294B4F5DF"><enum>(ii)</enum><text display-inline="yes-display-inline">legislators;</text></clause><clause commented="no" display-inline="no-display-inline" id="H52E6D85F2639450F8D469F1A08E6768A"><enum>(iii)</enum><text display-inline="yes-display-inline">public health officials;</text></clause><clause commented="no" display-inline="no-display-inline" id="H0FB3CEFA0E5148D281C5CEECA67A0D0C"><enum>(iv)</enum><text display-inline="yes-display-inline">judges;</text></clause><clause commented="no" display-inline="no-display-inline" id="H6AA7AFE9F13D45A3A05494A60471D0C6"><enum>(v)</enum><text display-inline="yes-display-inline">court administrators;</text></clause><clause commented="no" display-inline="no-display-inline" id="H9BF21A1F71F348959F12A407A6B08567"><enum>(vi)</enum><text display-inline="yes-display-inline">prosecutors;</text></clause><clause commented="no" display-inline="no-display-inline" id="H3E5CF269B36F4915994DDF4D0D84A1E2"><enum>(vii)</enum><text display-inline="yes-display-inline">defense counsel;</text></clause><clause commented="no" display-inline="no-display-inline" id="HD7C4A3B1C08A4A08AF7E136084C3C97B"><enum>(viii)</enum><text display-inline="yes-display-inline">victims’ rights organizations;</text></clause><clause commented="no" display-inline="no-display-inline" id="HDC5045FACA9B40DE92AEBADE9996C3DA"><enum>(ix)</enum><text display-inline="yes-display-inline">probation and parole officials;</text></clause><clause commented="no" display-inline="no-display-inline" id="H0F42300F1F1B4EE784901D563F62EB94"><enum>(x)</enum><text display-inline="yes-display-inline">criminal justice planners;</text></clause><clause commented="no" display-inline="no-display-inline" id="HA4DBAF78FF36463EB8B7FF4F79702769"><enum>(xi)</enum><text display-inline="yes-display-inline">criminologists;</text></clause><clause commented="no" display-inline="no-display-inline" id="HAA6F7035D24343A1A94687A761F7785C"><enum>(xii)</enum><text display-inline="yes-display-inline">civil rights and liberties organizations;</text></clause><clause commented="no" display-inline="no-display-inline" id="H2C8C8515EEB0466D91ECD698BDF4FE05"><enum>(xiii)</enum><text display-inline="yes-display-inline">community-based organization leaders;</text></clause><clause commented="no" display-inline="no-display-inline" id="H768BC2A192634BD0833FEDA1F1BE9935"><enum>(xiv)</enum><text display-inline="yes-display-inline">formerly incarcerated individuals;</text></clause><clause commented="no" display-inline="no-display-inline" id="H6D06C23D5C034DF89644A389AB29BA07"><enum>(xv)</enum><text display-inline="yes-display-inline">professional organizations; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H6FA816D5CFA94DC0A75F30E0E441BE22"><enum>(xvi)</enum><text display-inline="yes-display-inline">corrections officials; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H40A074A7E8314F60A8805CE63963A11B"><enum>(B)</enum><text display-inline="yes-display-inline">include in the final report required under subsection (c) summaries of the input and recommendations of the leaders consulted under subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC5DD0A41AC30484490F57BEB6F5EA737"><enum>(2)</enum><header display-inline="yes-display-inline">United States sentencing commission</header><text display-inline="yes-display-inline">To the extent the review and recommendations required by this section relate to sentencing policies and practices for the Federal criminal justice system, the Commission shall conduct the review in consultation with the United States Sentencing Commission.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H710250D349814B839947E5B5E8AAAE42"><enum>(h)</enum><header display-inline="yes-display-inline">Sense of Congress on unanimity</header><text display-inline="yes-display-inline">It is the sense of Congress that, given the national importance of the matters before the Commission—</text><paragraph commented="no" display-inline="no-display-inline" id="H1FECC7AD3BEE42BBB0E82F545DEC6E72"><enum>(1)</enum><text display-inline="yes-display-inline">the Commission should work toward developing findings and supplemental guidance that are unanimously supported by the members of the Commission; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB28A20401E7F4445B08A347BB47A04BC"><enum>(2)</enum><text display-inline="yes-display-inline">a finding or supplemental guidance unanimously supported by the members of the Commission should take precedence over a finding or supplemental guidance that is not unanimously supported.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HE60ECA603EFB440F8E8433B2935FC6E8" section-type="subsequent-section"><enum>606.</enum><header display-inline="yes-display-inline">Membership</header><subsection commented="no" display-inline="no-display-inline" id="HEECEE522804D4CCFB145FA5D38CB53F3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall be composed of 14 members, as follows:</text><paragraph commented="no" display-inline="no-display-inline" id="HCBBBFFDF2B374751B3F8A1A38505B1F8"><enum>(1)</enum><text display-inline="yes-display-inline">The President shall appoint 1 member, who shall serve as a co-chairperson of the Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA133F9BFD36640A089BF1162BF170FE0"><enum>(2)</enum><text display-inline="yes-display-inline">The co-chairperson described in paragraph (1) shall appoint 6 members in consultation with the leadership of—</text><subparagraph commented="no" display-inline="no-display-inline" id="H66429E1276CB4A14AE63A4E6E758F7C3"><enum>(A)</enum><text display-inline="yes-display-inline">the Senate and House of Representatives of the same political party as the President;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2D7549793FEF4C9AA6049C1561978CDB"><enum>(B)</enum><text>the Committee on the Judiciary of the House of Representatives of the same political party as the President; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB800C996A8B540CEB5DBE68B303BB355"><enum>(C)</enum><text>the Committee on the Judiciary of the Senate of the same political party as the President.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6082208CA6564A2292EF78C3A73D8AC2"><enum>(3)</enum><text display-inline="yes-display-inline">The leader of the Senate, in consultation with the leader of the House of Representatives who is a member of the opposite party of the President, shall appoint 1 member, who shall serve as a co-chairperson of the Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFCD43D0199B640ACA6AA1813D63F0332"><enum>(4)</enum><text>The co-chairperson described in paragraph (3) shall appoint 6 members in consultation with the leadership of—</text><subparagraph commented="no" display-inline="no-display-inline" id="HFE07369309694ED483061549B058C072"><enum>(A)</enum><text>the Senate and House of Representatives of the opposite political party as the President;</text></subparagraph><subparagraph id="HB97E081B3BEE462F9AD1D75A1756AD36"><enum>(B)</enum><text>the Committee on the Judiciary of the House of Representatives of the opposite political party as the President; and</text></subparagraph><subparagraph id="H114A804EA8D641CEADB0496A3C3CF51D"><enum>(C)</enum><text>the Committee on the Judiciary of the Senate of the opposite political party as the President.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5C7CB00C752D4CE7908B67D72D315125"><enum>(b)</enum><header display-inline="yes-display-inline">Membership</header><paragraph commented="no" display-inline="no-display-inline" id="H6E43DFDB6EDA48F0AAF89455ABF088DE"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A member shall be appointed based upon knowledge or experience in a relevant area, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="HEF9AAA3D77124525A023794CD3264410"><enum>(A)</enum><text display-inline="yes-display-inline">law enforcement;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H96263AE8519F4BD88B04AD3C1787A24D"><enum>(B)</enum><text display-inline="yes-display-inline">criminal justice;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB204C288FABA4E96AFEC2F7B2AAB3A3E"><enum>(C)</enum><text id="HF97C647780BF4181A2BC1E07EACCEF4E"><enum>(F)</enum><text display-inline="yes-display-inline">public health, including—</text><clause commented="no" display-inline="no-display-inline" id="HF921BB97AE7141E0B0F1F6462DD300ED"><enum>(i)</enum><text display-inline="yes-display-inline">physical and sexual victimization;</text></clause><clause commented="no" display-inline="no-display-inline" id="H305501ACC16B4CABA7E04EAA3DF41BB9"><enum>(ii)</enum><text display-inline="yes-display-inline">drug addiction; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HA3A04757F16241C08DA325B1F8C907BC"><enum>(iii)</enum><text display-inline="yes-display-inline">mental health;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0DB7F9785FEA4170AE259BE8480AE859"><enum>(G)</enum><text display-inline="yes-display-inline">the rights of victims;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCD6AD92818ED43EB8718523FF53DF29A"><enum>(H)</enum><text display-inline="yes-display-inline">civil rights;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFD46418A17DA4CB691693851C59769E0"><enum>(I)</enum><text display-inline="yes-display-inline">civil liberties;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H841832FFF43944FB815B35B5C992A8DA"><enum>(J)</enum><text display-inline="yes-display-inline">court administration;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H10C768BF7E684E249D58F43AAB26C942"><enum>(K)</enum><text display-inline="yes-display-inline">social services; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H662ED2C0CE434CF4917F1A7DF31C3632"><enum>(L)</enum><text display-inline="yes-display-inline">State, local, or Tribal government.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H263C0068392B4C25B122F2A91F2C389B"><enum>(2)</enum><header display-inline="yes-display-inline">Law enforcement representation</header><subparagraph commented="no" display-inline="no-display-inline" id="H0319EDF6A3E04EDAA3A77F5265DAE225"><enum>(A)</enum><header display-inline="yes-display-inline">Members appointed by the co-chairpersons</header><text display-inline="yes-display-inline">Of the 6 members appointed by the co-chairperson under subsection (a)(2)—</text><clause commented="no" display-inline="no-display-inline" id="H4AED1C27960642548F684BE1DFD3B6AB"><enum>(i)</enum><text display-inline="yes-display-inline">not fewer than 2 shall be representatives from Federal, State, or local law enforcement agencies, including not less than 1 representative from a rank and file organization; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HAC5DD8F347EC47A3A58550E6A5FEF004"><enum>(ii)</enum><text display-inline="yes-display-inline">not fewer than 1 shall be a representative from a Tribal law enforcement agency.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H23E7A96E1C964EE8846E4CB9BBF1A8CC"><enum>(B)</enum><header display-inline="yes-display-inline">Other members</header><text display-inline="yes-display-inline">Of the 6 members appointed under subsection (a)(4)—</text><clause commented="no" display-inline="no-display-inline" id="H07F109398699415C8682CF2723A63AF2"><enum>(i)</enum><text display-inline="yes-display-inline">not fewer than 2 shall be representatives of Federal, State, or local law enforcement agencies, including not less than 1 representative from a rank and file organization; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HE99FA4002499482B82D285FA68C574E8"><enum>(ii)</enum><text display-inline="yes-display-inline">not fewer than 1 shall be a representative from a Tribal law enforcement agency.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCAA78B3FA2724AA981373E3223DE7D79"><enum>(3)</enum><header display-inline="yes-display-inline">Disqualification</header><text display-inline="yes-display-inline">If an individual possesses a personal financial interest in the discharge of a duty of the Commission, the individual may not be appointed as a member of the Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H51550C78BAD04520823DC15E96A566AA"><enum>(4)</enum><header display-inline="yes-display-inline">Terms</header><text display-inline="yes-display-inline">A member shall be appointed for the duration of the Commission.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCEF51AD2FDC9409AA76F8171FC3A3A80"><enum>(c)</enum><header display-inline="yes-display-inline">Appointments and first meeting</header><paragraph commented="no" display-inline="no-display-inline" id="HE048160F2332446CA28D84CDDC687EFD"><enum>(1)</enum><header display-inline="yes-display-inline">Appointments</header><text display-inline="yes-display-inline">Each member of the Commission shall be appointed not later than 45 days after the date of enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H636790CD7B9948689B8AEA0BCA1CE983"><enum>(2)</enum><header display-inline="yes-display-inline">First meeting</header><text display-inline="yes-display-inline">The Commission shall hold the first meeting of the Commission on the date, whichever is later, that is not later than—</text><subparagraph commented="no" display-inline="no-display-inline" id="H2164BDFF4F454171AA593D1F2AD533C4"><enum>(A)</enum><text display-inline="yes-display-inline">60 days after the date of enactment of this Act; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H57EB0B09555543FFA9E3B029322B284D"><enum>(B)</enum><text display-inline="yes-display-inline">30 days after the date on which funds are made available for the Commission.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6CE686621D9341668636FAE7823C1EEF"><enum>(3)</enum><header display-inline="yes-display-inline">Ethics</header><text display-inline="yes-display-inline">At the first meeting of the Commission, the Commission shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3FC58038F2BA49DE9C737DCB0B90727B"><enum>(A)</enum><text display-inline="yes-display-inline">draft appropriate ethics guidelines for members and staff of the Commission, including guidelines relating to—</text><clause commented="no" display-inline="no-display-inline" id="H0EA0736F758D451984FC27B491E1763D"><enum>(i)</enum><text display-inline="yes-display-inline">conflict of interest; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HC4EEC0CF33CD4990A345157676361510"><enum>(ii)</enum><text display-inline="yes-display-inline">financial disclosure;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE92140DCF8B64E5CAFA4BCDD2C971266"><enum>(B)</enum><text display-inline="yes-display-inline">consult with the Committees on the Judiciary of the Senate and the House of Representatives as a part of drafting the guidelines; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2B18B90777A04B58B7242B0BC23DC609"><enum>(C)</enum><text display-inline="yes-display-inline">provide each Committee described in subparagraph (B) with a copy of the guidelines completed under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2CB64EBD6B5644DB99C912FE2E611F3D"><enum>(d)</enum><header display-inline="yes-display-inline">Meetings, quorum, and vacancies</header><paragraph commented="no" display-inline="no-display-inline" id="H36E2FF1FDBD84EB892EFD913C5EC5A08"><enum>(1)</enum><header display-inline="yes-display-inline">Meetings</header><text display-inline="yes-display-inline">The Commission shall meet at the call of—</text><subparagraph commented="no" display-inline="no-display-inline" id="H40E1B5AFCD7C4CB88C902EEC7D2EE7D0"><enum>(A)</enum><text display-inline="yes-display-inline">the co-chairpersons; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H67E9ED6BC3A14F6A833C93C8FEF6AB99"><enum>(B)</enum><text display-inline="yes-display-inline">a majority of the members of the Commission.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEDDE76F115B94EAFB9D0510585AE198E"><enum>(2)</enum><header display-inline="yes-display-inline">Quorum</header><text display-inline="yes-display-inline">Except as provided in paragraph (3)(B), a majority of the members of the Commission shall constitute a quorum for purposes of conducting business, except that 2 members of the Commission shall constitute a quorum for purposes of receiving testimony.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD367C3BFCB1941E39892BC8F76BDB291"><enum>(3)</enum><header display-inline="yes-display-inline">Vacancies</header><subparagraph commented="no" display-inline="no-display-inline" id="H2862AFD60EE94D42BFFB1011F4258091"><enum>(A)</enum><header>In general</header><text>A vacancy in the Commission shall not affect a power of the Commission, and the vacancy shall be filled in the same manner in which the original appointment was made.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD5860B7E4CCC42D898C823B55558202C"><enum>(B)</enum><header>Quorum</header><text display-inline="yes-display-inline">In the case of a vacancy occurring after the date that is 45 days after the date of enactment of this Act, until the date on which the vacancy is filled, a majority of the members of the Commission shall constitute a quorum if—</text><clause id="HEE3FDB1890AC4A8E978DC4FC7833637C"><enum>(i)</enum><text>not fewer than 1 member of the Commission appointed under paragraph (1) or (2) of subsection (a) is present; and</text></clause><clause id="HA325008206BB40FF9C917268FE9361ED"><enum>(ii)</enum><text>not fewer than 1 member of the Commission appointed under paragraph (3) or (4) of subsection (a) is present.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDE51C1748D264506B10029D320A18D4E"><enum>(e)</enum><header display-inline="yes-display-inline">Actions of the Commission</header><paragraph commented="no" display-inline="no-display-inline" id="H3F012131A8D0478EB99BCAA9468E8BA0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission—</text><subparagraph commented="no" display-inline="no-display-inline" id="H9519FC896B6D424C80F0F153FAA41290"><enum>(A)</enum><text display-inline="yes-display-inline">shall, subject to section 605, act by a resolution agreed to by a majority of the members of the Commission voting and present; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H766B3852E1DE473B8015C5A7558594E0"><enum>(B)</enum><text display-inline="yes-display-inline">may establish a panel composed of less than the full membership of the Commission for purposes of carrying out a duty of the Commission under this title, which—</text><clause commented="no" display-inline="no-display-inline" id="H65D0B3A2663F4582B3E20B15EEF1DACA"><enum>(i)</enum><text display-inline="yes-display-inline">shall be subject to the review and control of the Commission; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H6D963CFE81DA4D67A254FB923184F965"><enum>(ii)</enum><text display-inline="yes-display-inline">may make a finding or determination that may be considered a finding or determination of the Commission if the finding or determination is approved by the Commission.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HABD6FF042C654176B0F182752C37FBA8"><enum>(2)</enum><header display-inline="yes-display-inline">Delegation</header><text display-inline="yes-display-inline">If authorized by the co-chairpersons of the Commission, a member, agent, or staff member of the Commission may take an action that the Commission may take under this title.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H3DE176AC54E747098ED27A6C81D47595" section-type="subsequent-section"><enum>607.</enum><header display-inline="yes-display-inline">Administration</header><subsection commented="no" display-inline="no-display-inline" id="H871C6C0D3C1545F1ABD8203F48717F67"><enum>(a)</enum><header display-inline="yes-display-inline">Staff</header><paragraph commented="no" display-inline="no-display-inline" id="H4A94104878FF47A7B2376841894F9F2B"><enum>(1)</enum><header display-inline="yes-display-inline">Executive Director</header><text display-inline="yes-display-inline">The Commission shall have a staff headed by an Executive Director, who shall be paid at a rate established for the Certified Plan pay level for the Senior Executive Service under section 5382 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4C1B457ECCDD45089E4A4984C197D405"><enum>(2)</enum><header display-inline="yes-display-inline">Appointments and compensation</header><text display-inline="yes-display-inline">The co-chairpersons of the Commission shall designate and fix the compensation of the Executive Director and, in accordance with rules agreed upon by the Commission, may appoint and fix the compensation of such other personnel as may be necessary to enable the Commission to carry out its functions, without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and without regard to the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates, except that no rate of pay fixed under this subsection may exceed the equivalent of that payable for a position at level V of the Executive Schedule under section 5316 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H95A285EEB4124A41AB2C87CFB7728ADD"><enum>(3)</enum><header display-inline="yes-display-inline">Personnel as Federal employees</header><subparagraph commented="no" display-inline="no-display-inline" id="H6B338D085A2142C5B0FF98559522AC51"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Executive Director and any personnel of the Commission who are employees shall be employees under section 2105 of title 5, United States Code, for purposes of chapters 63, 81, 83, 84, 85, 87, 89, and 90 of such title 5.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H88AE7C1DC250438A99369FF74A37A68A"><enum>(B)</enum><header display-inline="yes-display-inline">Members of the Commission</header><text display-inline="yes-display-inline">Subparagraph (A) shall not be construed to apply to members of the Commission.</text></subparagraph></paragraph><paragraph id="H9988186059A84488ACBDCF34EAA13881"><enum>(4)</enum><header>The compensation of members</header><subparagraph id="HB607A01D2CCF4574840393B71BE6343D"><enum>(A)</enum><header>Non-federal employees</header><text>A member of the commission who is not an officer or employee of the Federal Government shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under section 5315 of title 5, United States Code, for each day (including travel time) during which the member is engaged in the performance of the duties of the Board.</text></subparagraph><subparagraph id="H915762F37F5F41EE84574D4F7DCB8220"><enum>(B)</enum><header>Federal employees</header><text>A member of the commission who is an officer or employee of the Federal Government shall serve without compensation in addition to the compensation received for the services of the member as an officer or employee of the Federal Government.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H52730BF1AD0D4513BFC3B3278654BE6C"><enum>(5)</enum><header display-inline="yes-display-inline">Travel expenses</header><text display-inline="yes-display-inline">A member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular places of business of the member in the performance of services for the Commission.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H24C88A7F2EFF4A31B347A35E4B62D854"><enum>(b)</enum><header display-inline="yes-display-inline">Experts and consultants</header><text display-inline="yes-display-inline">With the approval of the Commission, the Executive Director may procure temporary and intermittent services under section 3109(b) of title 5, United States Code.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H4E93D6F627F84C0192ECEE99204D86A6"><enum>(c)</enum><header display-inline="yes-display-inline">Detail of government employees</header><text display-inline="yes-display-inline">Upon the request of the Commission, a Federal Government employee may be detailed to the Commission without reimbursement, and such detail shall be without interruption or loss of civil service status or privilege.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H7B0FA64983C543C6AF27375F8FBCA732"><enum>(d)</enum><header display-inline="yes-display-inline">Other resources</header><paragraph commented="no" display-inline="no-display-inline" id="H7EDD4FCA159C41229D15F464BD6A85E6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall have reasonable access to materials, resources, statistical data, and other information such Commission determines to be necessary to carry out its duties from—</text><subparagraph commented="no" display-inline="no-display-inline" id="HD27D93ACE022455EAC831CE1D641047E"><enum>(A)</enum><text display-inline="yes-display-inline">the Library of Congress;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7B754D3B92994EE9B5D0BDC0BA1E371D"><enum>(B)</enum><text display-inline="yes-display-inline">the Department of Justice;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H00A00EB2CB614165AA9AE7E9EB75EE40"><enum>(C)</enum><text display-inline="yes-display-inline">the Office of National Drug Control Policy;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFBBA13478BB04E58A3E0DA238AC761C1"><enum>(D)</enum><text display-inline="yes-display-inline">the Department of State; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H82F0640C519F48EEACC3A497E41561BF"><enum>(E)</enum><text display-inline="yes-display-inline">other agencies of the executive or legislative branch of the Federal Government.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5E8B6D9C6F3F4267BD5F84E82FC0C720"><enum>(2)</enum><header>Requests for resources</header><text display-inline="yes-display-inline">The co-chairpersons of the Commission shall make requests for the access described in paragraph (1) in writing when necessary.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H316B0F0F7F314C05B560876F5E1B1FFC"><enum>(e)</enum><header display-inline="yes-display-inline">Volunteer services</header><text display-inline="yes-display-inline">Notwithstanding section 1342 of title 31, United States Code, the Commission—</text><paragraph commented="no" display-inline="no-display-inline" id="HD07E04563D234FD1B89C2D9E6EEA32D3"><enum>(1)</enum><text display-inline="yes-display-inline">may—</text><subparagraph commented="no" display-inline="no-display-inline" id="HCA7DE8DE22904B53AEB13B96D1A32974"><enum>(A)</enum><text display-inline="yes-display-inline">accept and use the services of an individual volunteering to serve without compensation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H106AF21AFFC5465EA3AFFC6CCF411A80"><enum>(B)</enum><text display-inline="yes-display-inline">reimburse the individual described in subparagraph (A) for local travel, office supplies, and for other travel expenses, including per diem in lieu of subsistence, as authorized by section 5703 of title 5, United States Code; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5303D250ECB94944996049A6324548F4"><enum>(2)</enum><text display-inline="yes-display-inline">shall consider the individual described in paragraph (1) an employee of the Federal Government in performance of those services for the purposes of—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA456B436939C42958F849B309CA13E9B"><enum>(A)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, relating to compensation for work-related injuries;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE9E7F84E03FA4563B6880E9E704873D3"><enum>(B)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code, relating to tort claims; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4618277E79174239A714149C4DB1B3BA"><enum>(C)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/11">chapter 11</external-xref> of title 18, United States Code, relating to conflicts of interest.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H267968E355A74BB88C78A10BAA6A9692"><enum>(f)</enum><header display-inline="yes-display-inline">Obtaining official data</header><paragraph commented="no" display-inline="no-display-inline" id="HA4240C42C3FD4A029077DD21BC9606A6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), the Commission may directly secure from an agency of the United States information necessary to enable the Commission to carry out this title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCD99CBCC9DD7485990E6D0E9B3DC4B51"><enum>(2)</enum><header>Procedures</header><text display-inline="yes-display-inline">Upon the request of the co-chairpersons of the Commission, the head of the agency shall furnish any information requested under paragraph (1) to the Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H31EDA0F7A71145F08F5D62DF4760E225"><enum>(3)</enum><header>Sensitive information</header><text display-inline="yes-display-inline">The Commission may not have access to sensitive information regarding ongoing investigations.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8CFEB61E5D0243AA9E60FF299075281A"><enum>(g)</enum><header display-inline="yes-display-inline">Mails</header><text display-inline="yes-display-inline">The Commission may use the United States mails in the same manner and under the same conditions as other departments and agencies of the United States.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H46AFD187222E42B8B5232F5C1A0A5D54"><enum>(h)</enum><header display-inline="yes-display-inline">Biannual reports</header><text display-inline="yes-display-inline">The Commission shall submit biannual status reports to Congress regarding—</text><paragraph commented="no" display-inline="no-display-inline" id="H38CF24BF822B48B1A98AA97CDFE569A1"><enum>(1)</enum><text display-inline="yes-display-inline">the use of resources;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H02E65A1628D14B9F93750C2DFABE951C"><enum>(2)</enum><text display-inline="yes-display-inline">salaries; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFC2A8CC0E2454C40A5B446636B145646"><enum>(3)</enum><text display-inline="yes-display-inline">all expenditures of appropriated funds.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4DB17DD645D74AB9B189ABBBE898CD6E"><enum>(i)</enum><header display-inline="yes-display-inline">Contracts</header><paragraph commented="no" display-inline="no-display-inline" id="H28637D78D5434F52B7AA8C7FB34BECF8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission may enter into a contract with a Federal or State agency, a private firm, an institution, or an individual for the conduct of an activity necessary to the discharge of a duty or responsibility of the Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD6D951B16C144F1C9217B06B19CBA649"><enum>(2)</enum><header>Timing</header><text display-inline="yes-display-inline">A contract, lease, or other legal agreement the Commission enters into may not extend beyond the date of the termination of the Commission.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H763548C0A86B4A1781885CF89F738C5D"><enum>(j)</enum><header display-inline="yes-display-inline">Gifts</header><text display-inline="yes-display-inline">The Commission may accept, use, or dispose of a gift or donation of a service or property.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H44528E1850E345F0A04A282672701962"><enum>(k)</enum><header display-inline="yes-display-inline">Administrative assistance</header><text display-inline="yes-display-inline">The Administrator of General Services shall provide to the Commission, on a reimbursable basis, the administrative support services necessary for the Commission to carry out the responsibilities of the Commission under this title, which may include—</text><paragraph commented="no" display-inline="no-display-inline" id="H40BDF92B4C2D439C8B4361198CA31CAB"><enum>(1)</enum><text display-inline="yes-display-inline">human resource management;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCDDC02FD137544B196C949BEFA8E9199"><enum>(2)</enum><text display-inline="yes-display-inline">budget;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H657A084C89A045879890B8D4C38CD6B9"><enum>(3)</enum><text display-inline="yes-display-inline">leasing;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H733E3B677CEE47628B877F311E7D9D08"><enum>(4)</enum><text display-inline="yes-display-inline">accounting; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7AF024929E6E4799ABD9F3AFE7C8DDE8"><enum>(5)</enum><text display-inline="yes-display-inline">payroll services.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H639D279CBFF9477DB6A37CE6D9F54223"><enum>(l)</enum><header display-inline="yes-display-inline">Non-Applicability of FACA and public access to meetings and minutes</header><paragraph commented="no" display-inline="no-display-inline" id="H6C3336A13EE24549A9024D7D76836956"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H62E5E49935D249E68DD7F8D48820EF2E"><enum>(2)</enum><header display-inline="yes-display-inline">Meetings and minutes</header><subparagraph commented="no" display-inline="no-display-inline" id="H4B5844D44FCF455C8A152E2BC4F2A15A"><enum>(A)</enum><header display-inline="yes-display-inline">Meetings</header><clause commented="no" display-inline="no-display-inline" id="H084EB95849AF488B9F6B020062182581"><enum>(i)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">Each meeting of the Commission shall be open to the public, except that a meeting or any portion of it may be closed to the public if it concerns matters or information described in section 552b(c) of title 5, United States Code.</text></clause><clause commented="no" display-inline="no-display-inline" id="HECC22D03361144A4A3FAADB26CAB1263"><enum>(ii)</enum><header>Interested individuals</header><text display-inline="yes-display-inline">An interested individual may—</text><subclause commented="no" display-inline="no-display-inline" id="HCB75EA86DE534C7C9BA16DB47929406A"><enum>(I)</enum><text display-inline="yes-display-inline">appear at an open meeting;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H7DF8DEEF8E614DBDA92DDD95382D6353"><enum>(II)</enum><text display-inline="yes-display-inline">present an oral or written statement on the subject matter of the meeting; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HB21F224A05D74DB981E55CCC7D28AB3D"><enum>(III)</enum><text display-inline="yes-display-inline">be administered an oath or affirmation.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H2C10F9B035914BC8956BB6DBC709FE35"><enum>(iii)</enum><header display-inline="yes-display-inline">Notice</header><text display-inline="yes-display-inline">Each open meeting of the Commission shall be preceded by timely public notice in the Federal Register of the time, place, and subject of the meeting.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9EF679926AC8452C8681B99498834B91"><enum>(B)</enum><header display-inline="yes-display-inline">Minutes and public access</header><clause commented="no" display-inline="no-display-inline" id="HB7452C09795E4AD1BFEDF92EED4E42AC"><enum>(i)</enum><header>Minutes</header><text display-inline="yes-display-inline">Minutes of each open meeting shall be kept and shall contain a record of—</text><subclause commented="no" display-inline="no-display-inline" id="HC44A85558AF24E3596CF056B384E274A"><enum>(I)</enum><text display-inline="yes-display-inline">the people present;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H1193A219B55F4620B3513559D7C8C0FC"><enum>(II)</enum><text display-inline="yes-display-inline">a description of the discussion that occurred; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HB29EBD3C10A14C7EBE7914FF7C39E050"><enum>(III)</enum><text display-inline="yes-display-inline">a copy of each statement filed.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HDB0296CE8E474E55A24CA9DBDABF7550"><enum>(ii)</enum><header>Public access</header><text display-inline="yes-display-inline">The minutes and records of each open meeting and other documents that were made available to or prepared for the Commission shall be available for public inspection and copying at a single location in the offices of the Commission.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA4037419B07C434485AC1CE1E2FA63EB"><enum>(m)</enum><header display-inline="yes-display-inline">Archiving</header><text display-inline="yes-display-inline">Not later than the date described in section 609, all records and papers of the Commission shall be delivered to the Archivist of the United States for deposit in the National Archives.</text></subsection></section><section id="HBDA7CDAD462144E68072FA334F6A0F31"><enum>608.</enum><header>Direct appropriations</header><subsection id="HB4AF100926F3463E8BF6F29EE81DBF5E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For the purpose of carrying out this title, there is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2021, $14,000,000, to remain available until expended.</text></subsection><subsection id="H386006E223274A1BAF1407FCAD0BC608"><enum>(b)</enum><header>Limitation</header><text>None of the funds provided by this section may be used for international travel.</text></subsection></section><section id="H82740445BC134995A4C21931779D33E2" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>609.</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="no-display-inline">The Commission shall terminate 60 days after the date on which the Commission submits the report required under section 605(c) to Congress.</text></section></title><title id="H5BCF01EEDCBD48E9873815666FE43157" style="OLC"><enum>VII</enum><header>Law Enforcement Agency Hiring and Education</header><subtitle id="H6A484B6DEBD94D99B74E6FC841E427C1" style="OLC"><enum>A</enum><header>Hiring</header><section id="HA03EE98CAF0D4405A4D186F511B19A73" section-type="subsequent-section"><enum>701.</enum><header>Law enforcement agency hiring</header><text display-inline="no-display-inline">Section 1701(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381(b)</external-xref>) is amended—</text><paragraph id="H9F8D273463EB465DABA29C3CD9F051F4"><enum>(1)</enum><text>by redesignating paragraphs (22) and (23) as paragraphs (23) and (24), respectively;</text></paragraph><paragraph id="H1654074EBD454921A59FDC977E79648A"><enum>(2)</enum><text>in paragraph (23), as so redesignated, by striking <quote>(21)</quote> and inserting <quote>(22)</quote>; 82 Stat. 197), as so redesignated by this Act, is amended by striking <quote>this subpart $1,095,000,000 for each of the fiscal years 2006 through 2012</quote> and inserting <quote>this subpart, including sections 508, 509, and 510, $800,000,000 for each of fiscal years 2021 through 2025</quote>.</text></subsection><subsection id="HE6F06BF3C97E4161B0C09CEED9250232" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Reauthorization of cops on the beat grant program</header><text display-inline="yes-display-inline">Section 1001(a)(11)(A) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10261">34 U.S.C. 10261(a)(11)(A)</external-xref>) is amended by striking <quote>part Q, to remain available until expended $1,047,119,000 for each of fiscal years 2006 through 2009</quote> and inserting <quote>part Q, including section 1701(n), to remain available until expended $400,000,000 for each of fiscal years 2021 through 2025</quote>. </text></subsection></section></subtitle><subtitle id="HE04C31EF6AA14A33A3B763C42DF31A5F" style="OLC"><enum>B</enum><header>Training</header><section id="HBB211C7965FD43DC829E9B20EFF2DFFC"><enum>711.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph commented="no" id="H453281D1F7A64DDC8FAF5B7D34AC45BD"><enum>(1)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the National Museum of African American History and Culture. </text></paragraph><paragraph id="H89C099B847E5432585E804E26C837B1B"><enum>(2)</enum><header>Eligible program participant</header><text display-inline="yes-display-inline">The term <term>eligible program participant</term> means a Federal, State, or local law enforcement officer or recruiter, or a candidate in a law enforcement academy. </text></paragraph></section><section id="H104651E05F56430D9B6173CDBA7D7A88"><enum>712.</enum><header>Program authorized</header><subsection id="H0C94B57F5D68433BBB1ED1C7F5899026"><enum>(a)</enum><header>Direct appropriations</header><text display-inline="yes-display-inline">For the purpose of carrying out this subtitle, there is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2021, $10,000,000, to remain available until expended.</text></subsection><subsection id="HF6C0F377B99248009AEA3932F0E8C20A"><enum>(b)</enum><header>Donations, gifts, bequests, and devises of property</header><text display-inline="yes-display-inline">In accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/23">chapter 23</external-xref> of title 36, United States Code, and in furtherance of the purposes of this subtitle, the Director is authorized to solicit, accept, hold, administer, invest, and use donated funds and gifts, bequests, and devises of property, both real and personal.</text></subsection><subsection commented="no" id="H37435F7B9EEA4447B1DE9F37649D3063"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">The Director, using funds appropriated under subsection (a) and resources received under subsection (b), including through the engagement of eligible program participants as appropriate and in consultation with the National Law Enforcement Museum—</text><paragraph commented="no" id="H84FE854EFF72439EB79E22511CB2B4E3"><enum>(1)</enum><text display-inline="yes-display-inline">shall develop and nationally disseminate a curriculum to educate eligible program participants on the history of racism in the United States; and</text></paragraph><paragraph id="H7BDBCE0DB8434753B48281944354CA52"><enum>(2)</enum><text display-inline="yes-display-inline">shall carry out education program training for eligible program participants that focuses on—</text><subparagraph id="HD800B65FFCA84C14AECE83CC73C1E980"><enum>(A)</enum><text display-inline="yes-display-inline">racial reconciliation with the goal of understanding the history of racism in America;</text></subparagraph><subparagraph id="H31DE6D17A1B746738FD0E778223480B3"><enum>(B)</enum><text display-inline="yes-display-inline">improving relationships between law enforcement and the communities they serve; and </text></subparagraph><subparagraph id="H3200977E297944B897CC602181E679D5"><enum>(C)</enum><text display-inline="yes-display-inline">training eligible program participants who can effectively train their law enforcement peers in their State and communities. </text></subparagraph></paragraph></subsection><subsection id="H7111664064164216ACF5C687FBC54461"><enum>(d)</enum><header>Applications</header><text>The Director may seek the engagement of an eligible program participant under subsection (c) by requiring submission of an application to the Director at such time, in such manner, and based on such competitive criteria as the Director may require.</text></subsection></section><section id="H4C4917B676EA436794A8D5743ACED797"><enum>713.</enum><header>Online education resources</header><subsection id="HC58D59CF68134C8B849932BCC46D1CF5"><enum>(a)</enum><header>Website</header><text display-inline="yes-display-inline">The Director shall maintain on the website of the National Museum of African American History and Culture a special section designated for education resources to improve awareness and understanding of the history of racism in the United States and to promote racial reconciliation through best practices to improve relations between law enforcement and the communities they serve. The website and resources shall be made publicly available.</text></subsection><subsection id="H3DB8BFB1C1944E568BB5BC9C51799E2F"><enum>(b)</enum><header>Information distribution</header><text display-inline="yes-display-inline">The Director shall distribute information about the activities funded under this subtitle through the website of the National Museum of African American History and Culture, and shall respond to inquiries for supplementary information concerning such activities.</text></subsection><subsection id="HE6ADF41F52F34C73A72A693D500D875C"><enum>(c)</enum><header>Best practices</header><text>The information distributed by the Director shall include best practices for educators.</text></subsection></section><section id="H24D4E531A6A24576817EEFF55A16E3D6" commented="no"><enum>714.</enum><header>National Museum of African American History and Culture Council</header><text display-inline="no-display-inline">The National Museum of African American History and Culture Council established under section 5 of the National Museum of African American History and Culture Act (<external-xref legal-doc="usc" parsable-cite="usc/20/80r-3">20 U.S.C. 80r–3</external-xref>), shall have governance responsibility for the programs and activities carried out under this subtitle in accordance with the National Museum of African American History and Culture Act (<external-xref legal-doc="usc" parsable-cite="usc/20/80r">20 U.S.C. 80r</external-xref>). </text></section><section id="H1D6CAE8073944C128748A4422CDBF817"><enum>715.</enum><header>Engagement of eligible program participants</header><subsection id="H41DD1AB37BDD4706BC6634413E1C4AB0"><enum>(a)</enum><header>In general</header><text>An eligible program participant shall be engaged at the discretion of the Director to participate in education program activities authorized under this subtitle and approved by the Director pursuant to an application described in section 712(d).</text></subsection><subsection id="H1AD0EFA03602418D96A46D07499A1500"><enum>(b)</enum><header>Engagement period</header><text>Engagement of eligible program participants under this subtitle shall be for a period determined by the Director.</text></subsection><subsection id="H090417E1BEB6428299CC56FC01DCC448"><enum>(c)</enum><header>Priority</header><text display-inline="yes-display-inline">In engaging eligible program participants under section 712, the Director shall give priority to applications from such participants who work for a Federal, State, or local law enforcement agency that does not, at the time application is made, offer any education programming on the history of racism or best practices to improve race relations between law enforcement and the communities they serve.</text></subsection></section><section id="H42B4E926D9FA40A48996A788958997F6" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>716.</enum><header>Annual report</header><text display-inline="no-display-inline">Not later than February 1 of each year, the Director shall submit to the Congress a report describing the activities carried out under this subtitle.</text></section></subtitle></title><title id="H9DEE446BCEA9465483EB15217C4F472F" style="OLC"><enum>VIII</enum><header>Best practices and studies</header><section id="HF09C86FB5C914F89813F4FA506B375A3" section-type="subsequent-section"><enum>801.</enum><header>Best practices</header><subsection id="HEAB55D8833D74783A8BA406F164A2A1B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The National Criminal Justice Commission established under title VIII (referred to in this title as the <quote>Commission</quote>) shall—</text><paragraph id="H3C58F8E0E436477898A4EC483E43886F"><enum>(1)</enum><text display-inline="yes-display-inline">develop recommended best practices guidelines to ensure fair and effective policing tactics and procedures that encourage equitable justice, community trust, and law enforcement officer safety; </text></paragraph><paragraph id="H842A10185E8E4E4DB87E457BBE9024A9"><enum>(2)</enum><text>include the recommended best practices described in paragraph (1) in the recommendations of the Commission required under section 705; and</text></paragraph><paragraph id="H42350B865AF6491FB93B81D4BE3FDDDD"><enum>(3)</enum><text>best practices for developing standards for law enforcement officer due process. </text></paragraph></subsection><subsection id="H1B52AFD688AA4828AC32C4B41D13654F"><enum>(b)</enum><header>Requirements</header><text>The best practices required to be developed under subsection (a) shall include—</text><paragraph id="H12E0A381F342486FAC40E976D8D76DDA"><enum>(1)</enum><text>best practices for the hiring, firing, suspension, and discipline of law enforcement officers; and</text></paragraph><paragraph id="HF3DAC888833C469880670DBBC5D6EBA5"><enum>(2)</enum><text> best practices for community transparency and optimal administration of a law enforcement agency. </text></paragraph></subsection></section><section section-type="subsequent-section" id="H1A11A61A32C148DA8BD55E8523F0AC64"><enum>802.</enum><header>Study</header><subsection id="HAE762F9E3A6F4C2287CE38BF49F1EDC4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall conduct a study on the establishment and operation of use of force review boards by States and units of local government, wherein citizens can assist law enforcement agencies in reviewing use of force incidents. </text></subsection><subsection id="H54DE58679BE4453089E10BDCF57676FD"><enum>(b)</enum><header>Inclusion in Commission recommendations</header><text>The Commission shall include a report on the study conducted under subsection (a), which shall include recommendations, if any, for best practices for State and local use of force review boards, as well as best practices for developing standards for law enforcement officer due process, in the recommendations of the Commission required under section 705.</text></subsection></section><section id="H7D5EF870F71A46B2AF9B5129521BD584"><enum>803.</enum><header>Mental health study</header><subsection id="H3850643258C847489672935E943EAEFB"><enum>(a)</enum><header>In general</header><text>The Commission shall conduct a study on law enforcement officer training, crisis intervention teams, co-responder programs, personnel requirements, Federal resources, and pilot programs needed to improve nationwide law enforcement officer engagement on issues related to mental health, homelessness, and addiction.</text></subsection><subsection id="H61D535D227A7453DB817B6737C89F907"><enum>(b)</enum><header>Inclusion in Commission recommendations</header><text>The Commission shall include a report on the study conducted under subsection (a), which shall include recommendations, if any, in the recommendations of the Commission required under section 705.</text></subsection></section><section id="H5410695393BF41C18024BAC99A2A0A24"><enum>804.</enum><header>Study and proposal on improving accountability for DOJ grants</header><subsection id="H877445D7E19440748814B64E6CF98E2C"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="H37D29FB54CF349CDACB25D8B933340FC"><enum>(1)</enum><text>the term <term>covered grant</term> means a grant awarded under a covered grant program; and</text></paragraph><paragraph id="H2D6E2A15E9E14622A93C843624503F3D"><enum>(2)</enum><text>the term <term>covered grant program</term> means—</text><subparagraph id="H180048A208EE4FCEBAD853D9BBD037EA"><enum>(A)</enum><text>the Edward Byrne Memorial Justice Assistance Grant Program under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151</external-xref> et seq.);</text></subparagraph><subparagraph id="HF1E1E22B338045C9B98C27A2EDABE759"><enum>(B)</enum><text>the <quote>Cops on the Beat</quote> program under part Q of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref> et seq.); and</text></subparagraph><subparagraph id="H43CCD470ECA0443F843BDC7300CCB4FA"><enum>(C)</enum><text>any other grant program administered by the Attorney General that provides funds to law enforcement agencies.</text></subparagraph></paragraph></subsection><subsection id="HF475220C69604453860DBE12A906C6A5"><enum>(b)</enum><header>Study and proposal</header><text>Not later than 1 year after the date of enactment of this Act, the Attorney General shall study, and submit to Congress a proposal regarding, the possible implementation of a method to improve accountability for law enforcement agencies that receive funds from covered grant programs.</text></subsection><subsection id="H0C26B8CFE162490EB566C752FEE4BB16"><enum>(c)</enum><header>Contents</header><text>In carrying out subsection (b), the Attorney General shall develop discrete performance metrics for law enforcement agencies that apply for and receive funds from covered grant programs, the parameters of which shall—</text><paragraph id="HBD885F6B751646ACA05DC7DBE97CB4B5"><enum>(1)</enum><text>establish benchmarks of progress, measured on a semiannual or annual basis, as appropriate;</text></paragraph><paragraph id="H3018E90459F74759899F797AD41D1781"><enum>(2)</enum><text>require annual accounting by a recipient of a covered grant of the progress made toward each benchmark described in paragraph (1); and</text></paragraph><paragraph id="H3357BE22A0A046A9BDC6544A0D3672D9"><enum>(3)</enum><text>provide that—</text><subparagraph id="HEF80EC62C4D042079F55596C1B71DBB5"><enum>(A)</enum><text>the failure to achieve a benchmark described in paragraph (1) shall constitute a violation of the grant agreement;</text></subparagraph><subparagraph id="H05FDF4EBAB9641108D16D9F503A03C43"><enum>(B)</enum><text>if a recipient does not cure a violation by achieving the applicable benchmark not later than 90 days after the date of the violation, the recipient shall return the amounts of the covered grant to the Attorney General; and</text></subparagraph><subparagraph id="HB155F81F8ACE4995846C1408A9237749"><enum>(C)</enum><text>a law enforcement agency that violates a grant agreement may not apply for a covered grant for a period of 1 year. </text></subparagraph></paragraph></subsection></section></title><title id="HA6D354DDDF744AF4A80F9DFF535776C4" style="OLC"><enum>IX</enum><header>Closing the Law Enforcement Consent Loophole Act</header><section id="HDE5152886CC24767ACF88001FAC93A99"><enum>901.</enum><header>Prohibition on engaging in sexual acts while acting under color of law</header><subsection id="H37BD6F52BDBB41B6A2840BB1909E633F"><enum>(a)</enum><header>In general</header><text>Section 2243 of title 18, United States Code, is amended—</text><paragraph id="HBD34F17B2CB44A2FB5B06F2B61646DAB"><enum>(1)</enum><text>in the section heading, by adding at the end the following: <quote><header-in-text level="section" style="USC">or by any person acting under color of law</header-in-text></quote>;</text></paragraph><paragraph id="HC63BA18EEDB548AC9C00F9C8C3AC6157"><enum>(2)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively;</text></paragraph><paragraph id="HB44ADDA4665B4FD38AD00476C282F423"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text><quoted-block display-inline="no-display-inline" id="H0B95FB66891E4D1CB654ADC9148945BB" style="OLC"><subsection id="HEE019C15723041A1B080F4C7FFF170A3"><enum>(c)</enum><header>Of an individual by any person acting under color of law</header><paragraph id="HC8B02CC44C5F4E959CA7A250A5B032EA"><enum>(1)</enum><header>In general</header><text>Whoever, acting under color of law, knowingly engages in a sexual act with an individual who has been arrested by, is detained by, or is in custody of any Federal law enforcement officer, shall be fined under this title, imprisoned not more than 15 years, or both. </text></paragraph><paragraph id="H9D9C877DDE374577A09368B478D8D19C"><enum>(2)</enum><header>Definition</header><text>In this subsection, the term <term>sexual act</term> has the meaning given the term in section 2246.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H05AF15A7E2904D2C9998D4C001BB5454"><enum>(4)</enum><text>in subsection (d), as so redesignated, by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H2EB44AB5B6E945EBADCC67ADD331AA89" style="OLC"><paragraph id="H9DD31084917D4FE7BAD9F82B0A983238"><enum>(3)</enum><text>In a prosecution under subsection (c), it is not a defense that the other individual consented to the sexual act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBB701BA7508C4CD48ACBE3F359126B52"><enum>(b)</enum><header>Abusive sexual contact</header><text>Section 2244(a) of title 18, United States Code, is amended by—</text><paragraph id="H93EA9B804626469CA52B6693CC53F691"><enum>(1)</enum><text>in paragraph (4), by striking <quote>or</quote> at the end; </text></paragraph><paragraph id="HDBE767AA48C64FF4A4DAA3A872926D0A"><enum>(2)</enum><text>by redesignating paragraph (5) as paragraph (6); and</text></paragraph><paragraph id="H24DDF6663752433DB7FD20F5AC9677C4"><enum>(3)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF576D02021EC4BEBAD3F94CD2E91CCF3"><paragraph id="HE80A47F00E66488EB3AEB4EF37EF54C9"><enum>(5)</enum><text>subsection (c) of section 2243 of this title had the sexual contact been a sexual act, shall be fined under this title, imprisoned not more than 15 years, or both; or </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H60CD585A01CF4B57B550AF779E4C6B50"><enum>(c)</enum><header>Definition</header><text>Section 2246 of title 18, United States Code, is amended—</text><paragraph id="H11DD298B35EB4048B7CA719AB1B2448B"><enum>(1)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HE700AD2B560F48DBAA2420F8958E23C8"><enum>(2)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H9D18B770604243B0A83667506A699D46"><enum>(3)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block display-inline="no-display-inline" id="HE4DB49058AD84FB2A82EFBC32028926E" style="OLC"><paragraph id="H727B15FBD4014505B777EA08425B505A"><enum>(7)</enum><text>the term <term>Federal law enforcement officer</term> has the meaning given the term in section 115.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4BA16E59B52A4DFC9E8DE32D92142220"><enum>(d)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/109A">chapter 109A</external-xref> of title 18, United States Code, is amended by amending the item related to section 2243 to read as follows:</text><quoted-block display-inline="no-display-inline" id="H977212CF1438456D98FEE75F9A7ECEDA" style="OLC"><toc><toc-entry bold="off" level="section">2243. Sexual abuse of a minor or ward or by any person acting under color of law.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H2BE27F52EB9F44C092586256A47B133C"><enum>902.</enum><header>Incentive for States</header><subsection id="H404994ED815C405CA261707570013CEB"><enum>(a)</enum><header>Authority To make grants</header><text>The Attorney General is authorized to make grants to States that have in effect a law that—</text><paragraph id="HFB75806C9D3640AA88FD24837EBCEC00"><enum>(1)</enum><text>makes it a criminal offense for any person acting under color of law of the State to engage in a sexual act (as defined in section 2246 of title 18, United States Code) with an individual who has been arrested by, is detained by, or is in custody of any law enforcement officer; and</text></paragraph><paragraph id="H19FEFD67D3E0430EB77DF6A2F2A2C247"><enum>(2)</enum><text>prohibits a person charged with an offense described in paragraph (1) from asserting the consent of the other individual as a defense.</text></paragraph></subsection><subsection id="HADC7E771500A4BD7BBD12DC738CBDC89"><enum>(b)</enum><header>Reporting requirement</header><text>A State that receives a grant under this section shall submit to the Attorney General, on an annual basis, information on—</text><paragraph id="HC4E048DB8ADE4B2FAADDA42ADE03C920"><enum>(1)</enum><text>the number of reports made to law enforcement agencies in that State regarding persons engaging in a sexual act (as defined in section 2246 of title 18, United States Code) while acting under color of law during the previous year; and</text></paragraph><paragraph id="H88C0E0F3343C4264AE1CE7939292B33F"><enum>(2)</enum><text>the disposition of each case in which sexual misconduct by a person acting under color of law was reported during the previous year.</text></paragraph></subsection><subsection id="H4A021A2F9B924A49986716B2A01AC2D9"><enum>(c)</enum><header>Application</header><text>A State seeking a grant under this section shall submit an application to the Attorney General at such time, in such manner, and containing such information as the Attorney General may reasonably require, including information about the law described in subsection (a).</text></subsection><subsection id="H5B0E9FFF3DFC4617B74567834B858600"><enum>(d)</enum><header>Grant amount</header><text>The amount of a grant to a State under this section shall be in an amount that is not greater than 10 percent of the average of the total amount of funding of the 3 most recent awards that the State received under the following grant programs:</text><paragraph id="H3F85FAF2FAEB45ADAF489E5CE07214DB"><enum>(1)</enum><text>Part T of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10441">34 U.S.C. 10441</external-xref> et seq.) (commonly referred to as the <quote>STOP Violence Against Women Formula Grant Program</quote>).</text></paragraph><paragraph id="H3DFB3E64B04B448EB52740A6A1993517"><enum>(2)</enum><text>Section 41601 of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12511">34 U.S.C. 12511</external-xref>) (commonly referred to as the <quote>Sexual Assault Services Program</quote>).</text></paragraph></subsection><subsection id="HB049AC28BF9741279475138E07FDC6CB"><enum>(e)</enum><header>Grant term</header><paragraph id="H681FFA790E34495B8902F42AF80B272F"><enum>(1)</enum><header>In general</header><text>The Attorney General shall provide an increase in the amount provided to a State under the grant programs described in subsection (d) for a 2-year period.</text></paragraph><paragraph id="HC9FF2DA9BC284BC9BE8B802285F2B47B"><enum>(2)</enum><header>Renewal</header><text>A State that receives a grant under this section may submit an application for a renewal of such grant at such time, in such manner, and containing such information as the Attorney General may reasonably require.</text></paragraph><paragraph id="H0DBBFE0EB1CE4526A0C0D3D1BBC688F9"><enum>(3)</enum><header>Limit</header><text>A State may not receive a grant under this section for more than 4 years.</text></paragraph></subsection><subsection id="H0765D4F019D940F4B3BDAC6A948D4000"><enum>(f)</enum><header>Uses of funds</header><text>A State that receives a grant under this section shall use—</text><paragraph id="H4B030237235B46CD869BAB76B0CC66ED"><enum>(1)</enum><text>25 percent of such funds for any of the permissible uses of funds under the grant program described in paragraph (1) of subsection (d); and</text></paragraph><paragraph id="H27FBFC019EFF45F38D0702D5ECEE4E3F"><enum>(2)</enum><text>75 percent of such funds for any of the permissible uses of funds under the grant program described in paragraph (2) of subsection (d).</text></paragraph></subsection><subsection id="HB772E09D3E0E4FD7BD9294893176BC2B"><enum>(g)</enum><header>Direct appropriations</header><text display-inline="yes-display-inline">For the purpose of making grants under this section, there is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2021, $25,000,000, to remain available until expended. </text></subsection><subsection id="H6F770E888A7240F896E3B7BD4DE59CB9"><enum>(h)</enum><header>Definition</header><text>For purposes of this section, the term <term>State</term> means each of the several States and the District of Columbia, Indian Tribes, and the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, and the Northern Mariana Islands.</text></subsection></section><section id="H13DEF310AA65480DAFE760AD719BA613"><enum>903.</enum><header>Reports to Congress</header><subsection id="H33465BA529E14E20994F68B9DFA9D88F"><enum>(a)</enum><header>Report by attorney general</header><text>Not later than 1 year after the date of enactment of this Act, and each year thereafter, the Attorney General shall submit to Congress a report containing—</text><paragraph id="H0457DCAD00C047A4A5FE67087F326D1A"><enum>(1)</enum><text>the information required to be reported to the Attorney General under section 902(b); and</text></paragraph><paragraph id="H510D833F8E51456C90A74D5E7B69C68C"><enum>(2)</enum><text>information on—</text><subparagraph id="HA14A86DD77284987BA3BBD12C6C34B7D"><enum>(A)</enum><text>the number of reports made, during the previous year, to Federal law enforcement agencies regarding persons engaging in a sexual act (as defined in section 2246 of title 18, United States Code) while acting under color of law; and</text></subparagraph><subparagraph id="H0A10CBCF15B14129BF769E93CDA1AC7E"><enum>(B)</enum><text>the disposition of each case in which sexual misconduct by a person acting under color of law was reported.</text></subparagraph></paragraph></subsection><subsection id="H11291BDC88CC47CD8CDC193D7F58D669" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report by GAO</header><text>Not later than 1 year after the date of enactment of this Act, and each year thereafter, the Comptroller General of the United States shall submit to Congress a report on any violations of section 2243(c) of title 18, United States Code, as amended by section 901, committed during the 1-year period covered by the report.</text></subsection></section></title><title id="H6564EB33CA6D4B7B8161FE99D51F8F16" style="OLC"><enum>X</enum><header>Emergency Funding</header><section id="H27E2CA04F74442EF81C27557F24A1766" section-type="subsequent-section"><enum>1001.</enum><header>Emergency designation</header><subsection id="H5167B41E5633414DA21E8C28431CA079"><enum>(a)</enum><header>In general</header><text>The amounts provided under this Act, or an amendment made by this Act, are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></subsection><subsection id="H16F3917425A84A89ABE17B9CB656D61F"><enum>(b)</enum><header>Designation in senate</header><text>In the Senate, this Act, and the amendments made by this Act, is designated as an emergency requirement pursuant to section 4112(a) of H.
