which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of the Interior to establish a grant program to provide funds for the removal of Confederate symbols, and for other purposes.</official-title></form><legis-body id="H5676A93729C74929AAD9A66CC0375F01" style="OLC"><section id="H17AEE6B8927C41A8A3826CA60123F4C2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rejecting and Eliminating the Foul Use of Symbols Exulting Confederate Principles Act</short-title></quote> or the <quote><short-title>REFUSE Confederate Principles Act</short-title></quote>.</text></section><section id="H979F61006F2F411BB86E74DD1E81794F"><enum>2.</enum><header>Emancipation historic preservation program</header><subsection id="HAE2EF385EF894EDEA26238217A595ABC"><enum>(a)</enum><header>Establishment of program</header><text>The Secretary, in consultation with the Director, shall establish, within the National Park Service, a program to be known as the <quote>Emancipation Historic Preservation Program</quote> to—</text><paragraph id="H49BCE88D27904E359032527D88C2DFD2"><enum>(1)</enum><text>award grants to eligible entities in accordance with this section to—</text><subparagraph id="HDA37CB70F134437DBD902DC192DFC3EE"><enum>(A)</enum><text>remove a Confederate symbol;</text></subparagraph><subparagraph id="H44362DECA82A4C1D8C2F07919A4EBA8F"><enum>(B)</enum><text>remove and replace a Confederate symbol with an alternative monument, memorial, statue, commemorative structure, symbol, or signage;</text></subparagraph><subparagraph id="H1F7951D1B27841139DC89ADC21838585"><enum>(C)</enum><text>remove and replace a Confederate symbol with an alternative monument, memorial, statue, commemorative structure, symbol, or signage to commemorate or depict the freedom of enslaved African Americans; and</text></subparagraph><subparagraph id="H5E0D937693A144EAB596A54B28832337" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">remove and transfer a Confederate symbol to a State historic preservation program as defined in section 60.3 of title 36, Code of Federal Regulations; and </text></subparagraph></paragraph><paragraph id="HCED8CCE0C53643FDBE82172415FB8B56"><enum>(2)</enum><text>provide technical assistance to eligible entities related to the activities described in paragraph (1).</text></paragraph></subsection><subsection id="HB53D8A6A88C14300BC80E270913F65DD"><enum>(b)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to applications that include activities described in subsection (a)(1)(C) and (a)(1)(D).</text></subsection><subsection id="HF80C1AF36EA24AF9B7C2B7FBE9927B32"><enum>(c)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including—</text><paragraph id="H75F3811962B242C48A6A0311BFFDE858"><enum>(1)</enum><text>a plan for how the eligible entity will use grant funds to carry out one or more of the activities described in subsection (a)(1);</text></paragraph><paragraph id="HAD3CD7026D074C5BA996DD2FD0145B21"><enum>(2)</enum><text display-inline="yes-display-inline">if the application is for activities described in subsection (a)(1)(C), information demonstrating the relevance of the eligible entity’s application to activities described in subsection (a)(1)(C); and</text></paragraph><paragraph id="H3995A3D9EE024FB6928464BF86F73D96"><enum>(3)</enum><text display-inline="yes-display-inline">if the application is for activities described in subsection (a)(1)(D), information identifying the eligible entity as a State historic preservation program as defined in section 60.3 of title 36, Code of Federal Regulations for activities described in subsection (a)(1)(D).</text></paragraph></subsection><subsection id="H32AE1C66F1504DE0B2C389EAC675577A"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to provide grants under this section, $15,000,000 for each fiscal year through 2031, of which $9,000,000 for each fiscal year shall be made available to State historic preservation programs as defined in section 60.3 of title 36, Code of Federal Regulations, for costs related to the removal, transfer, and storage of Confederate symbols under subsection (a)(1)(D).</text></subsection></section><section id="H5803B43D0FD545C9A961D78C895F18C8"><enum>3.</enum><header>Limitations on use of funds</header><text display-inline="no-display-inline">None of the funds made available by this Act may be used by the Secretary, the Director, or an eligible entity for the preservation, rehabilitation, restoration, reconstruction, or new construction of a Confederate symbol.</text></section><section id="HAA20A255AC1444228BB00996054D4E40"><enum>4.</enum><header>Reports</header><subsection id="HD5A33317BBCB4EAC8B190ED006C38249"><enum>(a)</enum><header>Grantee reports to secretary and director</header><text>Not later than 90 days after the earlier of the date of expiration of a project period or the completion of a project, each entity that receives a grant under this Act shall submit to the Secretary and the Director a final report containing such information as the Secretary may require.</text></subsection><subsection id="H8B636A9EA6FA444C87E8D96CC1C0BE0A"><enum>(b)</enum><header>Annual report to congress</header><text>Not later than October 31 of each calendar year after the enactment of this Act, the Secretary shall submit to Congress a report of the progress of the grant program established pursuant to this Act.</text></subsection></section><section id="H72A4F75B0C194BFBA2354C101D35E8DD"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HF179189BB79441E69EED8FE7CBE6182F"><enum>(1)</enum><header>Confederate symbol</header><text>The term <term>Confederate symbol</term> includes—</text><subparagraph id="HE904113793CC43C8ADC8BC6371286977"><enum>(A)</enum><text>a Confederate flag; or</text></subparagraph><subparagraph id="HAFCC21A73A554C85AC015C10809A2E17"><enum>(B)</enum><text>a monument, memorial, statue, commemorative structure, symbol, or signage that honors a Confederate leader, Confederate soldier, the Confederate States of America, or the Confederacy in general.</text></subparagraph></paragraph><paragraph id="H1850FA17848A4B978D5B59DECED56863"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the National Park Service.</text></paragraph><paragraph id="HB30BAE889AD04C919BBA6B6053715F8E"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H7A2C4252BFF04A3884FFE40D28CB13C0"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="H08C7D48B6089496DB8DB86D3531BBB92"><enum>(B)</enum><text>a political subdivision of a State, including—</text><clause id="H2AA4DB52405B4E709AABD4CBACF3F61E"><enum>(i)</enum><text>a city; and</text></clause><clause id="H0413D3F3ABB24F72B216D294B8ECE892"><enum>(ii)</enum><text>a county;</text></clause></subparagraph><subparagraph id="HCC711569FB4C4688BD0173312BA8BB79"><enum>(C)</enum><text>a territory or insular possession of the United States;</text></subparagraph><subparagraph id="H477A1910AA7D4B61BD46AD30ECFDCA66"><enum>(D)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="H677B2CA221AE45BDB4B100B1A69C5302"><enum>(E)</enum><text display-inline="yes-display-inline">an Indian Tribe (which has the meaning given the term <quote>Indian tribe</quote> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>));</text></subparagraph><subparagraph id="H3BE275C0E2E14CCEBAED1ED7EBFB3FCA"><enum>(F)</enum><text>a special purpose district, including park districts;</text></subparagraph><subparagraph id="H0EF2256A3D9140BA942F32DCBD9DD549"><enum>(G)</enum><text>an academic institution; or</text></subparagraph><subparagraph id="H66C9494E2EF349008AED4D6B58AA8A0E"><enum>(H)</enum><text display-inline="yes-display-inline">a State historic preservation program, as defined in section 60.3 of title 36, Code of Federal Regulations.</text></subparagraph></paragraph><paragraph id="H3F6A89657F594FB385B9D4DA48CEDC0F"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section></legis-body></bill>
