R. 658</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210201">February 1, 2021</action-date><action-desc><sponsor name-id="N000147">Ms. Norton</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To transfer from the United States Parole Commission to the District of Columbia the authority to grant, deny, and revoke parole and impose conditions on an order of parole, and the authority to modify, revoke, and terminate a term of supervised release and impose conditions on an order of supervised release, in the case of individuals who are imprisoned felons eligible for parole, reparole, or supervised release under the laws of the District of Columbia, and for other purposes.</official-title></form><legis-body id="H2D13F0EF8CE34A67A9018A99EF689270" style="OLC"><section id="H96BA8F2421784C3AAF6BF0F60E4CC46C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>District of Columbia Parole and Supervised Release Act</short-title></quote>.</text></section><section id="HC9C75F752F0543E5B958FEFD86A05514" section-type="subsequent-section"><enum>2.</enum><header>Authority of District of Columbia over parole and supervised release under District of Columbia laws</header><subsection id="H82660E817DBD455FA341C88DAA9F645C"><enum>(a)</enum><header>Authority described</header><text display-inline="yes-display-inline">Effective November 1, 2022—</text><paragraph id="H624A51381F47459EB226BBB011FE96B9"><enum>(1)</enum><text display-inline="yes-display-inline">the District of Columbia shall have the authority—</text><subparagraph id="H80F5290C3C584E5B91FE6A393EDD3F50"><enum>(A)</enum><text>to grant, deny, and revoke parole, and impose conditions on an order of parole, in the case of any individual who is an imprisoned felon who is eligible for parole or reparole, and in the case of any individual who is on parole or reparole, under the laws of the District of Columbia;</text></subparagraph><subparagraph id="H27CA44F8FC474CD2BFEEAE847DAEBD46"><enum>(B)</enum><text display-inline="yes-display-inline">to set conditions on, revoke, and terminate a term of supervised release imposed on any individual who is subject to supervised release under the laws of the District of Columbia; and</text></subparagraph><subparagraph id="HFD60BB098B484B70B2B43DE441FF6C0F"><enum>(C)</enum><text display-inline="yes-display-inline">to exercise any other jurisdiction or authority the United States Parole Commission had prior to such date over individuals described in subparagraphs (A) or (B) (whether such individuals are sentenced before, on, or after such date), as provided under subchapter 3 of subtitle C of title XI of the National Capital Revitalization and Self-Government Improvement Act of 1997 (sec. 24–131 et seq., D.C. Official Code); and</text></subparagraph></paragraph><paragraph id="H33FDCB5A6AAD47A180C4D89996376C3A"><enum>(2)</enum><text display-inline="yes-display-inline">the District of Columbia shall have the authority to enact legislation, promulgate regulations and guidelines, and take other actions to carry out paragraph (1).</text></paragraph></subsection><subsection id="H2F176AB2F99E487F86E5299BB23397CC"><enum>(b)</enum><header>Termination of authority of United States Parole Commission</header><paragraph id="HCEEB93D0E3EF4E5A85F49198969BABF7"><enum>(1)</enum><header>Parole</header><text>Section 11231(a) of the National Capital Revitalization and Self-Government Improvement Act of 1997 (sec. 24–131(a), D.C. Official Code) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H7052DC5AA00C41138402041735D05E1E" display-inline="no-display-inline"><paragraph id="HE7BD121E77FB4EC891B596D71407D7DE"><enum>(4)</enum><header>Termination</header><text display-inline="yes-display-inline">The jurisdiction and authority of the United States Parole Commission under this section shall terminate on November 1, 2022.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H5B346BE538034A219BE0E0839D6BA47E"><enum>(2)</enum><header>Rulemaking and legislative responsibility</header><text>Section 11231(c) of such Act (sec. 24–131(c), D.C. Official Code) is amended by adding at the end the following new sentence: <quote>This subsection shall terminate on November 1, 2022.</quote>.</text></paragraph></subsection><subsection id="H3EE9AE8644CA43B1A7EAA53FB59DA739"><enum>(c)</enum><header>Conforming amendments relating to authority of Court Services and Offender Supervision Agency</header><paragraph id="HA598871EB36D4F9D9B8ACA9DF1D09B5F"><enum>(1)</enum><header>Powers and duties of Director</header><text display-inline="yes-display-inline">Section 11233(b)(2)(B) of such Act (sec. 24–133(b)(2)(B), D.C. Official Code) is amended by striking <quote>and the Chairman of the United States Parole Commission</quote> and inserting <quote>and the District of Columbia</quote>. </text></paragraph><paragraph id="H6E983E2D09FA4135A709C45734062F23"><enum>(2)</enum><header>Supervision of released offenders</header><text display-inline="yes-display-inline">Section 11233(c)(2) of such Act (sec. 24–133(c)(2), D.C. Official Code) is amended to read as follows:</text><quoted-block style="OLC" id="HAB0ECCC09E554ED8BA8ADD15B65E31C0" display-inline="no-display-inline"><paragraph id="HC8CBF8E7503643D29627E186347E2189"><enum>(2)</enum><header>Supervision of released offenders</header><text display-inline="yes-display-inline">The Agency shall supervise any offender who is released from imprisonment for any term of supervised release imposed by the Superior Court of the District of Columbia. Such offender shall be subject to the authority of the District of Columbia.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H64F9D8F9E9EA495791A626F7586A5782"><enum>(3)</enum><header>Supervision of parolees</header><text>Section 11233(c)(4) of such Act (sec. 24–133(c)(4), D.C. Official Code) is amended to read as follows:</text><quoted-block style="OLC" id="H8EDF5BAF3D5C463E9A6084BEE70CD0E2" display-inline="no-display-inline"><paragraph id="H8101D1106207415A9D1E9A53A7A1DD64"><enum>(4)</enum><header>Supervision of parolees</header><text display-inline="yes-display-inline">The Agency shall supervise all individuals on parole pursuant to the laws of the District of Columbia. The Agency shall carry out the conditions of release imposed by the District of Columbia and shall make such reports to the District of Columbia with respect to an individual on parole supervision as the District of Columbia may require.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H90B2B290121A44378D9A2D12AF8CB51E"><enum>(4)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect November 1, 2022, and shall apply to individuals who are subject to supervised release or parole under the laws of the District of Columbia before, on, or after such date.</text></paragraph></subsection><subsection id="H5EF8404713BD465C956ED22DC048F8E4"><enum>(d)</enum><header>Continuation of Federal benefits for former employees of Parole Commission</header><paragraph id="H3D34DD4615A0456097C4F9E92770033D"><enum>(1)</enum><header>Continuation</header><text display-inline="yes-display-inline">Any individual who is an employee of the United States Parole Commission as of October 31, 2022, and who, on or after such date, is an employee of the office of the District of Columbia which exercises the authority described in paragraph (1) of subsection (a), shall continue to be treated as an employee of the Federal Government for purposes of receiving benefits under any chapter of subpart G of part III of title 5, United States Code.</text></paragraph><paragraph id="H2CBF2B1A0AC042B99759BAEDEB7605F8"><enum>(2)</enum><header>Responsibility for employer contribution</header><text display-inline="yes-display-inline">Beginning on November 1, 2022, the District of Columbia shall be treated as the employing agency with respect to the benefits described in paragraph (1) which are provided to an individual who, for purposes of receiving such benefits, is continued to be treated as an employee of the Federal Government under such paragraph.</text></paragraph></subsection></section></legis-body></bill>
