which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 54, United States Code, to provide for congressional approval of national monuments and restrictions on the use of national monuments, to establish requirements for declaration of marine national monuments, and for other purposes.</official-title></form><legis-body id="H96EE40C6BE6449769F75BCE8F97B28B6" style="OLC"><section id="HDDAE163362F5430B86DE2417D0DDA15D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marine Access and State Transparency</short-title></quote> or the <quote><short-title>MAST Act</short-title></quote> .</text></section><section id="HBF11253DAAFB4225BAE98C0BBCD6700A"><enum>2.</enum><header>Congressional authorization of declarations of national monuments and restrictions on public use</header><subsection id="HA6C57CB656D24E728D165A965F7D9E96"><enum>(a)</enum><header>Declarations of national monuments</header><text display-inline="yes-display-inline">Section 320301 of title 54, United States Code, is amended—</text><paragraph display-inline="no-display-inline" id="HE3049FF1D32240EE85868F625FC70B9E"><enum>(1)</enum><text>in subsection (a), by striking <quote>The President may</quote> and inserting <quote>After obtaining congressional approval of a proposed national monument and certifying compliance with the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) with respect to the proposed national monument, and subject to subsection (e), the President may</quote>; and</text></paragraph><paragraph display-inline="no-display-inline" id="H5D5013C0E6C8429693D7E231B1F71041"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H10886E7F73844CFA9968626FCBA5CA9F" style="OLC"><subsection id="H27BA1279E8C74CBBBF56344EA974D0A0"><enum>(e)</enum><header>Requirements for declarations of marine national monuments</header><paragraph id="HFC6E4E8D4D0941F9B6D173F18A627415"><enum>(1)</enum><header>Requirements</header><text display-inline="yes-display-inline">The President may not declare any area of the exclusive economic zone to be a national monument unless—</text><subparagraph id="HF48B7EBAB3724D52B751F1CA9985C23D"><enum>(A)</enum><text>such declaration is specifically authorized by an Act of Congress;</text></subparagraph><subparagraph id="HE597BADDA0C143A4B292134350738D89"><enum>(B)</enum><text>the President has submitted a proposal to make such declaration to the Governor of each State, and of each territory, any part of which is located within 200 nautical miles of that area;</text></subparagraph><subparagraph id="H92321D7586D04787ADA5C93076306F90"><enum>(C)</enum><text>each such Governor submits to the President notice that the legislature of that State or territory has approved the proposal; and</text></subparagraph><subparagraph id="HCFA4E086301140018726698796A5D2F5"><enum>(D)</enum><text>the declaration is substantially the same as the proposal.</text></subparagraph></paragraph><paragraph id="H6E1FA85753CC44E494C494CC909701DB"><enum>(2)</enum><header>Exclusive economic zone defined</header><text display-inline="yes-display-inline">In this subsection the term <quote>exclusive economic zone</quote> means the zone established by Proclamation Numbered 5030, dated March 10, 1983.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H74E46CD8722E414CBDA82D1348E3657F"><enum>(b)</enum><header>Restrictions on public use</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/3203">Chapter 3203</external-xref> of title 54, United States Code, is amended—</text><paragraph id="H1AE85BF3AB164C49BE0603198287FDCB"><enum>(1)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H332277C981454B149A57A9BBA784EAF1" style="USC"><section id="H5174E97F845546498EF9E273A65FD6A2" section-type="subsequent-section"><enum>320304.</enum><header>Restrictions on public use</header><text display-inline="no-display-inline">The Secretary of the Interior, and the Secretary of Commerce with respect to any area of the exclusive economic zone (as defined in section 320301(e)) designated as a national monument, shall not implement any restrictions on the public use of a national monument until the expiration of an appropriate review period (as determined by such Secretary) providing for public input and congressional approval.</text></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H116EDAC6619B4EE393AFCC3D6250DA1A"><enum>(2)</enum><text display-inline="yes-display-inline">in the analysis at the beginning of the chapter, by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HAF2EC5408BF446A3BC7412B8446E0ED5" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">320304.
