R. 626</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="W000827">Mr. Wright</sponsor> (for himself, <cosponsor name-id="M001195">Mr. Mooney</cosponsor>, <cosponsor name-id="A000055">Mr. Aderholt</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="L000564">Mr. Lamborn</cosponsor>, <cosponsor name-id="W000804">Mr. Wittman</cosponsor>, <cosponsor name-id="J000302">Mr. Joyce of Pennsylvania</cosponsor>, <cosponsor name-id="B001291">Mr. Babin</cosponsor>, <cosponsor name-id="S001195">Mr. Smith of Missouri</cosponsor>, <cosponsor name-id="N000190">Mr. Norman</cosponsor>, <cosponsor name-id="G000576">Mr. Grothman</cosponsor>, <cosponsor name-id="A000372">Mr. Allen</cosponsor>, <cosponsor name-id="J000289">Mr. Jordan</cosponsor>, <cosponsor name-id="H001071">Mr. Hice of Georgia</cosponsor>, <cosponsor name-id="D000615">Mr. Duncan</cosponsor>, <cosponsor name-id="J000299">Mr. Johnson of Louisiana</cosponsor>, <cosponsor name-id="B001299">Mr. Banks</cosponsor>, <cosponsor name-id="J000304">Mr. Jackson</cosponsor>, and <cosponsor name-id="H001084">Ms. Herrell</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit chemical abortions performed without the presence of a healthcare provider, and for other purposes.</official-title></form><legis-body id="HF10449C8DDA44B88BD219FF0C984AAAA" style="OLC"><section id="H69E8A21EA4D743CC82EABCECD04CF418" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Teleabortion Prevention Act of 2021</short-title></quote>.</text></section><section id="HD24E6337234E4572A8E6416646F0CDD6"><enum>2.</enum><header>Chemical abortions prohibited without a healthcare provider present</header><subsection id="H2B05D9BE42B34E239FA2781A0F41368D"><enum>(a)</enum><header>Chemical abortions prohibited without a physician present</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/74">Chapter 74</external-xref> of title 18, United States Code, is amended—</text><paragraph id="HE8EBCD97C72F4F3D8FB12E0830EBEBDC"><enum>(1)</enum><text>in the chapter heading by striking <quote><header-in-text level="chapter" style="USC">Partial-Birth</header-in-text></quote>; and</text></paragraph><paragraph id="H69EC32813AB8441CA143F4916A857E78"><enum>(2)</enum><text>by inserting after section 1531 the following:</text><quoted-block display-inline="no-display-inline" id="HC37BD7F411EC4838A5AE9DC60C1333AA" style="USC"><section id="H91B1D6CD1E424C6FA20517255E0974CE"><enum>1532.</enum><header>Chemical abortions prohibited without a healthcare provider physically present</header><subsection id="HA7C2CCD3FC1C4BCD94DF0DCED2C226F5"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Any healthcare provider who, in or affecting interstate or foreign commerce, who knowingly provides or attempts to provide a chemical abortion—</text><paragraph id="HBAB1E9518084465A8206B2A5316884F1"><enum>(1)</enum><text>without physically examining the patient;</text></paragraph><paragraph id="H0D73580524B84A848E60BF45B3A3AD40"><enum>(2)</enum><text>without being physically present at the location of the chemical abortion; or</text></paragraph><paragraph id="HB480D3995B514AAC81A35D2C276B945E"><enum>(3)</enum><text>without scheduling a follow-up visit for the patient to occur not more than 14 days after the administration or use of the drug to assess the patient’s physical condition,</text></paragraph><continuation-text continuation-text-level="subsection">shall be fined not more than $1,000 or imprisoned not more than 2 years, or both. This subsection does not apply to a chemical abortion that is necessary to save the life of a mother whose life is endangered by a physical disorder, physical illness, or physical injury, including a life-endangering physical condition caused by or arising from the pregnancy itself. </continuation-text></subsection><subsection id="H7D0DDFC7E05D414F947C0681DC69BDFC"><enum>(b)</enum><header>No liability of the patient</header><text display-inline="yes-display-inline">A patient upon whom an abortion is performed may not be prosecuted under this section or for a conspiracy to violate this section.</text></subsection><subsection id="H3D534002040F4A9FBD673ABEF0AB34D1"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HE9CB6C5A49B54BD19103DD1A0755EB9B"><enum>(1)</enum><header>Abortion drug</header><text>The term <term>abortion drug</term> means any medicine, drug or any other substance, or any combination of drugs, medicines or substances, when it is used—</text><subparagraph id="HF2C99B3D5F84412FAB5C55D949A131B1"><enum>(A)</enum><text>to intentionally kill the unborn child of a woman known to be pregnant; or</text></subparagraph><subparagraph id="H95D61CEF92A24CF3B1F9E7FFD57AAC92"><enum>(B)</enum><text>to intentionally terminate the pregnancy of a woman known to be pregnant, with an intention other than—</text><clause id="H877A5302E6FA4DE78AF0A97040350B6F"><enum>(i)</enum><text>to produce a live birth; or</text></clause><clause id="H29B0FA101C0E4257859D1B9955C6C588"><enum>(ii)</enum><text>to remove a dead unborn child.</text></clause></subparagraph></paragraph><paragraph id="H228BFEAA3F8C4279818E7EE95A6D2652"><enum>(2)</enum><header>Attempts to provide</header><text>In this section, the term <term>attempts to provide</term>, means conduct that, under the circumstances as the actor believes them to be, constitutes a substantial step in a course of conduct planned to culminate in a chemical abortion.</text></paragraph><paragraph id="H4680A0CD7F814C8F9EC45B9BF1C12B10"><enum>(3)</enum><header>Healthcare provider</header><text>The term <term>healthcare provider</term> means any person licensed to prescribe prescription drugs under applicable Federal and State laws.</text></paragraph><paragraph id="H61C0D28AAC954B7AB0A59643F902790D"><enum>(4)</enum><header>Provide</header><text>In this section, the term <term>provide</term>, means to dispense or prescribe an abortion drug, or to otherwise make an abortion drug available to a patient.</text></paragraph><paragraph id="HCADD3610DB834FE9BBA706014E409D16"><enum>(5)</enum><header>Chemical abortion</header><text>The term <term>chemical abortion</term> refers to the use of an abortion drug to—</text><subparagraph id="H5711CE42AA434342A608F9FC55C86937"><enum>(A)</enum><text>intentionally kill the unborn child of a woman known to be pregnant; or</text></subparagraph><subparagraph id="HDA05FDE296354D65B95EEC527F373F2D"><enum>(B)</enum><text>intentionally terminate the pregnancy of a woman known to be pregnant, with an intention other than—</text><clause id="H47B1888154EF49AE8B5E4B04E9131ED0"><enum>(i)</enum><text>to produce a live birth; or</text></clause><clause id="H082D13A7380E4FDEA35319896C997E80"><enum>(ii)</enum><text>to remove a dead unborn child.</text></clause></subparagraph></paragraph><paragraph id="H55FC07C9C6C849B6AFFB9D5EBC565BB1"><enum>(6)</enum><header>Unborn child</header><text>The term <term>unborn child</term> means an individual organism of the species homo sapiens, beginning at fertilization, until the point of being born alive as defined in section 8(b).</text></paragraph></subsection><subsection id="H12234989A4FB42108AE91B43CFAF8769"><enum>(d)</enum><header>Rule of construction regarding ectopic pregnancy</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to have any impact on the treatment of a verified ectopic pregnancy.</text></subsection><subsection id="H3715A111621249FB8DFC196F1DD5645B"><enum>(e)</enum><header>Severability</header><text display-inline="yes-display-inline">If any provision of this section or the application of such provision to any person or circumstance is held to be invalid, the remainder of this section and the application of the provisions of the remainder to any person or circumstance shall not be affected thereby.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6B2D1DC804E742E79C603850ADC20F2F"><enum>(b)</enum><header>Clerical amendments</header><paragraph id="H0B83379C0F7B4E04B89D5967DE3394C8"><enum>(1)</enum><header>Chapter 74</header><text>The table of sections for such chapter is amended by inserting after the item relating to section 1531 the following:</text><quoted-block display-inline="no-display-inline" id="H309E2DD96AF14B7DB78172B3F156DE20" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1532.
