<official-title display="yes">To amend section 6 of the Joint Resolution entitled <quote>A Joint Resolution to approve the Covenant To Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America, and for other purposes</quote>.</official-title>

<section id="HAF97EF5C287348AEA85F8984A225C29B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Northern Mariana Islands Legal Residents Relief Act of 2021</short-title></quote>.</text></section> <section id="H356DB5A697E14AA189A568BA6E353D49"><enum>2.</enum><header>Long-term legal residents of the Commonwealth of the Northern Mariana Islands</header> <subsection id="H08CDD217203847C8ACCDFA94B2746F73"><enum>(a)</enum><header>In general</header><text>Section 6(e)(6) of the Joint Resolution entitled <quote>A Joint Resolution to approve the Covenant To Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America, and for other purposes</quote>, approved March 24, 1976 (<external-xref legal-doc="usc" parsable-cite="usc/48/1806">48 U.S.C. 1806</external-xref>; <external-xref legal-doc="public-law" parsable-cite="pl/94/241">Public Law 94–241</external-xref>), is amended—</text>
<paragraph id="H950A0B35D96440189EF22DE2AE7DBCA2"><enum>(1)</enum><text>in subparagraph (A)—</text> <subparagraph id="HD36D2A3BE7E144D686A540ED2215A348"><enum>(A)</enum><text>in clause (ii)—</text>
<clause id="HDBF26D56AC6048B88A11574570CB0880"><enum>(i)</enum><text>in subclause (I), by inserting <quote>(aa)</quote> before <quote>shall establish a process</quote>;</text></clause> <clause id="HC91F55B8EAF24D2C902FAEAC026761AA"><enum>(ii)</enum><text>by striking <quote>; and</quote> and inserting <quote>or during the 180-day period beginning on the date that is 90 days after the date of the enactment of the Northern Mariana Islands Legal Residents Relief Act of 2021;</quote>;</text></clause>
<clause id="H2AB78A23CC234B5BA0C6F4883DF42424"><enum>(iii)</enum><text>by adding the following:</text> <quoted-block id="H726D173E759040299ED17ADD7E32806B" style="OLC"> <item id="H0E0A9FC7B5E94A8982279287F2B53358" indent="up1"><enum>(bb)</enum><header>Waiver of application deadline</header><text>The Secretary of Homeland Security may accept an application for CNMI Resident Status submitted after the application deadline if—</text>
<subitem id="H7503CB28FB454726BA387F30B19B98A2"><enum>(AA)</enum><text>the applicant is eligible for CNMI Resident Status; and</text></subitem> <subitem id="H017E7883A0FF4025B799050A37C72908"><enum>(BB)</enum><text>the applicant timely filed an application for CNMI Resident Status and made a good faith effort to comply with the application requirements as determined by the Secretary.</text></subitem></item><after-quoted-block>;</after-quoted-block></quoted-block></clause>
<clause id="H061979BB7B7D4CC698D36B89DF3308B6"><enum>(iv)</enum><text>in subclause (II), by striking the period and inserting “; and”; and</text></clause> <clause id="H08232A66B409465AB9ABEB43FDE3A4C2"><enum>(v)</enum><text>by adding at the end the following:</text>
<quoted-block id="H5511B425A77C4F2CA7F360F0C36F755D" style="OLC">
<subclause id="H1D96579516744287987E96F911965530"><enum>(III)</enum><text>in the case of an alien who has nonimmigrant status on the date on which the alien applies for CNMI Resident Status, the Secretary of Homeland Security shall extend such nonimmigrant status and work authorization, if applicable, through the end of the 180-day period described in subclause (I)(aa) or the date of adjudication of the alien’s application for CNMI Resident Status, whichever is later.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H88A61BE37B82425998D387FE39D57CF6"><enum>(B)</enum><text>in clause (iii), by inserting after the period at the end the following: </text>
<quoted-block id="H44A78C6F70994B59A36CD7376668D3AD" style="OLC" display-inline="yes-display-inline"><text>An alien granted status under this paragraph shall be deemed a qualified alien under section 431 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641</external-xref>) for purposes of receiving relief or assistance available in connection with—</text> <subclause id="H02D3C4C2F71644F78647B6AE1AB56B9B"><enum>(I)</enum><text>a presidentially declared major disaster or emergency under section 401 or 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref> or 5191); or</text></subclause>
<subclause id="HFA28B749CACD494285157AE9BD2BC644"><enum>(II)</enum><text>a presidentially declared national emergency under section 201 of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.).</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H1502EAC0B1F64A2380B442D8673D15FF"><enum>(2)</enum><text>in subparagraph (B)—</text>
<subparagraph id="H9AD72448F4C2496A9556E613EEB1E023"><enum>(A)</enum><text>in clause (i), by striking <quote>on June 25, 2019, or on December 31, 2018,</quote> and inserting <quote>on December 31, 2020, June 25, 2019, or December 31, 2018,</quote>;</text></subparagraph> <subparagraph id="HA14E27DA55AC4B598E185DDC6827E678"><enum>(B)</enum><text>in clause (iii), by inserting <quote>except in the case of an alien who meets the requirements of subclause (III) or (VI) of clause (v),</quote> before <quote>resided continuously and lawfully</quote>; and</text></subparagraph>
<subparagraph id="HBECA73792A434B10B7570BF8EE04160D"><enum>(C)</enum><text>in clause (v)—</text> <clause id="HE1502729748B468DBEED50EE9881AE90"><enum>(i)</enum><text>in subclause (III), by striking <quote>subclause (I) or (II)</quote> and inserting <quote>subclause (I), (II), (IV), (V), (VI), (VII), or (VIII)</quote>;</text></clause>
<clause id="HD60D5A90282B450DBD96B3E9C8484502"><enum>(ii)</enum><text>in subclause (IV), by striking <quote>; or</quote> and inserting a semicolon;</text></clause> <clause id="HD95BB80348DB4425AEDBF1CA57E55240"><enum>(iii)</enum><text>in subclause (V), by striking the period at the end and inserting a semicolon; and</text></clause>
<clause id="H682BA8C9ADD14A6680193DBF983DF127"><enum>(iv)</enum><text>by adding at the end the following:</text> <quoted-block id="H1E81B1EA3D5B41C884E2EFAAA5F47429" style="OLC"> <subclause id="H9EF0D12FD0A14DEE935682D1545F28BE"><enum>(VI)</enum><text>was admitted to the Commonwealth as a Commonwealth Only Transitional Worker during fiscal year 2015, and during every subsequent fiscal year beginning before the date of the enactment of the Northern Mariana Islands U.S. Workforce Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/218">Public Law 115–218</external-xref>);</text></subclause>
<subclause id="H2E3706004EE140B094E825757141C973"><enum>(VII)</enum><text>resided in the Northern Mariana Islands as an investor under Commonwealth immigration law, and is presently a resident classified as a CNMI-only nonimmigrant under section 101(a)(15)(E)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(E)(ii)</external-xref>); or</text></subclause> <subclause id="H6F4312EC5F2F46D689EF276FE352DB47"><enum>(VIII)</enum><text>resided in the Northern Mariana Islands as a guestworker under Commonwealth immigration law for at least 5 years prior to May 8, 2008, and is presently a resident classified as a Commonwealth Only Transitional Worker.</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph>
<paragraph id="HAEA84282BED04948A692ACA2EF717178"><enum>(3)</enum><text>in subparagraph (C)(ii), by striking <quote>180-period</quote> and inserting <quote>180-day period</quote>; and</text></paragraph> <paragraph id="H22A1604D31654F21AC35D76CD2A038A9"><enum>(4)</enum><text>by adding at the end the following:</text>

<subparagraph id="H555026532B7B4187ABD1EA5C7F7DBCF9"><enum>(F)</enum><header>Adjustment of status for cnmi residents</header><text>An alien with CNMI Resident Status may adjust his or her status to that of an alien lawfully admitted for permanent residence 5 years after the date of enactment of the Northern Mariana Islands Legal Residents Relief Act of 2021 or 5 years after the date on which CNMI Resident Status is granted, whichever is later.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H4CEB83B4B37246A0B1CA27516885F75F"><enum>(b)</enum><header>Technical amendments</header><text>Section 6(b)(1) of <external-xref legal-doc="public-law" parsable-cite="pl/94/241">Public Law 94–241</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/48/1806">48 U.S.C. 1806(b)(1)</external-xref>) is amended—</text>
<paragraph id="HDDD5E3B775D445AA9C97A4B3DAA5AFF1"><enum>(1)</enum><text>in subparagraph (A)—</text> <subparagraph id="H534A5605710D4ABFB8108B91A32E69F3"><enum>(A)</enum><text>by striking <quote>(8 USC 1101(a)(15)(H))</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)</external-xref>)</quote>; and</text></subparagraph>
<subparagraph id="HF93EFA49BAE646CEA559337944E5D324"><enum>(B)</enum><text>by striking <quote>(8 USC 1184(g))</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)</external-xref>)</quote>; and</text></subparagraph></paragraph> <paragraph id="H48B4896C1DE44554AB93EAF491943FBA"><enum>(2)</enum><text>in subparagraph (B)(i), by striking <quote>contact</quote> and inserting <quote>contract</quote>.</text></paragraph></subsection>
<subsection id="H9B6DA51F46FC4464AA4513D04E7D6147"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of enactment of this Act.</text></subsection></section> <section id="H61FFC562631F4057B717B435772A4B0F"><enum>3.</enum><header>Temporary labor certification</header> <subsection id="HF910940AEC42474A8B85AAEB1C392C56"><enum>(a)</enum><header>In general</header><text>Section 6(d)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/94/241">Public Law 94–241</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/48/1806">48 U.S.C. 1806(d)(2)</external-xref>) is amended in subparagraph (B), by striking <quote>an annual</quote> and inserting <quote>a biennial</quote>.</text></subsection>
<subsection id="H1E3B3543C95E4856811B856A20F828DB"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of enactment of this Act.</text></subsection></section> <section id="H7DA7E2065340464F9C0674BD59F4BBBF"><enum>4.</enum><header>Additional time for receipt of visa</header><text display-inline="no-display-inline">Section 6(d)(3)(D)(iii) of <external-xref legal-doc="public-law" parsable-cite="pl/94/241">Public Law 94–241</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/48/1806">48 U.S.C. 1806(d)(3)(D)(iii)</external-xref>) is amended in subclause (I)(bb) by striking <quote>10 days</quote> and inserting <quote>90 days</quote>.</text></section>
<section id="H715159D90F054E5F9E1C104E5627C2D9"><enum>5.</enum><header>Amendments to the requirement to remain outside the United States</header>
<subsection id="H6624E8EF59F4424CAD92741082720C1F"><enum>(a)</enum><header>In general</header><text>Section 6(d)(7) of <external-xref legal-doc="public-law" parsable-cite="pl/94/241">Public Law 94–241</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/48/1806">48 U.S.C. 1806(d)(7)</external-xref>) is amended—</text> <paragraph id="HD2CFD0116F824B9EB1697313D346C5F6"><enum>(1)</enum><text>in subparagraph (A)—</text>
<subparagraph id="H6D6137D20E484CD2A4BB0348B004B84F"><enum>(A)</enum><text>in the matter preceding clause (i), by inserting <quote>and (C)</quote> after <quote>subparagraph (B)</quote>; and</text></subparagraph> <subparagraph id="H79A0BC23D59B4A62AC2170F83FA3802D"><enum>(B)</enum><text>in clause (ii)—</text>
<clause id="H57082FF08A5A4C55890B4CC5EA6C37FF"><enum>(i)</enum><text>by inserting <quote>at any time after the expiration of the first renewal period</quote> after <quote>30 days</quote>; and</text></clause> <clause id="H7AF66FBBBFBE476293700AE830E5964C"><enum>(ii)</enum><text>by inserting <quote>third</quote> after <quote>submission of a</quote>; and</text></clause></subparagraph></paragraph>
<paragraph id="H153BAF4CB0F3442D8452AFDC4B25A9C5"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="H6037044DBA9B44BAB645A9F05B0227D5" style="OLC"> <subparagraph id="H6676F9C37F0348C0A611417A30EA11EB"><enum>(C)</enum><header>Deferral</header><text><header-in-text level="paragraph">In general</header-in-text>.—The Secretary of Homeland Security may defer the requirement to remain outside of the United States during or in connection to—</text>
<clause id="HC387C02B28344DC189E675CC1F206798"><enum>(i)</enum><text>a presidentially declared major disaster or emergency under section 401 or 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref> or 5191); or</text></clause> <clause id="HD99C04CB96C64428A6FBCB5B4DEBAA6B"><enum>(ii)</enum><text>a presidentially declared national emergency under section 201 of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H1019C3EA17B74930A13F073B66816A85"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as if included in the enactment of <external-xref legal-doc="public-law" parsable-cite="pl/115/218">Public Law 115–218</external-xref>.</text></subsection></section> <section id="H68DDFCC6597E408685714AA5AAA42538"><enum>6.</enum><header>Qualified alien</header> <subsection id="H4C6D4DF01F104B20AD4E0B43D99035DD"><enum>(a)</enum><header>In general</header><text>Section 6(d) of <external-xref legal-doc="public-law" parsable-cite="pl/94/241">Public Law 94–241</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/48/1806">48 U.S.C. 1806(d)</external-xref>) is further amended by adding at the end the following:</text>
