which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To extend the supplemental security income program to Puerto Rico, the United States Virgin Islands, Guam, and American Samoa, and for other purposes.</official-title></form><legis-body id="H1AE16F7789254641899D924509C7451A" style="OLC"><section id="H142BCF1D7BE94BE486EE420CFE112807" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supplemental Security Income Equality Act</short-title></quote>.</text></section><section id="H3E58F670AEC046CFB6C6E94ACBC9EE30"><enum>2.</enum><header>Extension of the supplemental security income program to Puerto Rico, the United States Virgin Islands, Guam, and American Samoa</header><subsection id="H659F2D348E464969A451566E8AD5F5BC"><enum>(a)</enum><header>In general</header><text>Section 303 of the Social Security Amendments of 1972 (86 Stat. 1484) is amended by striking subsection (b).</text></subsection><subsection id="H5153343F9AC448A4807E361ADE753C19"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="H45EFBE879BC147C88F5D3628C30CC130"><enum>(1)</enum><header>Definition of state</header><text>Section 1101(a)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1301">42 U.S.C. 1301(a)(1)</external-xref>) is amended by striking the 5th sentence and inserting the following: <quote>Such term when used in title XVI includes Puerto Rico, the United States Virgin Islands, Guam, and American Samoa.</quote>.</text></paragraph><paragraph id="H4EDAFD375F8142AFA10ACD105F78544A"><enum>(2)</enum><header>Elimination of limit on total payments to the territories</header><text>Section 1108 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308</external-xref>) is amended—</text><subparagraph id="H00325EEA9D3C405B9C90405CFFA9B2ED"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">; limitation on total payments</header-in-text></quote>;</text></subparagraph><subparagraph id="HF8C2D4B7467241258D3E4BB0D12A9CD3"><enum>(B)</enum><text>by striking subsection (a); and</text></subparagraph><subparagraph id="HB1423285A1BA42BBADEA21495454E6BE"><enum>(C)</enum><text>in subsection (c), by striking paragraphs (2) and (4) and redesignating paragraphs (3) and (5) as paragraphs (2) and (4), respectively.</text></subparagraph></paragraph><paragraph id="H5F590B15C5B4454AB677679D77B0EFBE"><enum>(3)</enum><header>United States nationals treated the same as citizens</header><text>Section 1614(a)(1)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382c">42 U.S.C. 1382c(a)(1)(B)</external-xref>) is amended—</text><subparagraph id="H22C6D3EBDC7F44F8990AE50DE4D12626"><enum>(A)</enum><text>in clause (i)(I), by inserting <quote>or national,</quote> after <quote>citizen</quote>;</text></subparagraph><subparagraph id="HFA8BFCA0B969467990FC93EA029D4384"><enum>(B)</enum><text>in clause (i)(II), by adding <quote>; or</quote> at the end; and</text></subparagraph><subparagraph id="H3B7EF7E60FFE4D5F81DC1C8CC1A1C853"><enum>(C)</enum><text>in clause (ii), by inserting <quote>or national</quote> after <quote>citizen</quote>.</text></subparagraph></paragraph><paragraph id="H49F224DA199C4298A33E0DBE2F30F385"><enum>(4)</enum><header>Territories included in geographic meaning of United States</header><text>Section 1614(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382c">42 U.S.C. 1382c(e)</external-xref>) is amended by striking <quote>and the District of Columbia</quote> and inserting <quote>, the District of Columbia, Puerto Rico, the United States Virgin Islands, Guam, and American Samoa</quote>.</text></paragraph></subsection><subsection id="H00D7D5F932B446989891BF31EF6E18D7"><enum>(c)</enum><header>Waiver authority</header><text display-inline="yes-display-inline">The Commissioner of Social Security may waive or modify any statutory requirement relating to the provision of benefits under the Supplemental Security Income Program under title XVI of the Social Security Act in Puerto Rico, the United States Virgin Islands, Guam, or American Samoa, to the extent that the Commissioner deems it necessary in order to adapt the program to the needs of the territory involved.</text></subsection><subsection id="HF2315DF631074D6E8430341F813C9F4C"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section and the amendments made by this section shall take effect on the 1st day of the 1st Federal fiscal year that begins 1 year or more after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
