which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To end the use of body-gripping traps in the National Wildlife Refuge System, and for other purposes.</official-title></form><legis-body id="H306974D47FDA4E70B032BED0F67FA77D" style="OLC"><section id="H2F7F8D37186549CB8D4378F31C0EEB3D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Refuge From Cruel Trapping Act of 2021</short-title></quote>.</text></section><section id="H19C6D6AB5F91480A9A80AA7633C7E980"><enum>2.</enum><header>Possession or use of body-gripping trap prohibited</header><text display-inline="no-display-inline">The National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H113038BCED9A4EB4B6DFE03C520C9A5B" style="OLC"><section id="H03591572D5C34F8D9CD38ADEC0A7F532"><enum>6.</enum><header>Possession or use of body-gripping trap prohibited</header><subsection id="HB954BE6BD4134BC7B6C3A3AD723CCC5E"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), no person may possess or use a body-gripping trap in the System.</text></subsection><subsection id="H8F4156405601447F80979FE632194E6F"><enum>(b)</enum><header>Exceptions</header><paragraph id="HEE17163372B14B3FB238B9E59D943294"><enum>(1)</enum><header>In general</header><text>Subsection (a) shall not apply to the use of a body-gripping trap—</text><subparagraph id="HAF08250955CF4279B1E96AE4D65F2042"><enum>(A)</enum><text>by an agency of the Federal Government;</text></subparagraph><subparagraph id="HE1D04A1BB7374A8281ABBE7C6CC907BE"><enum>(B)</enum><text>to—</text><clause id="H5E575CB25FE740F9AE6690C9E5C93B34"><enum>(i)</enum><text>control an invasive species (as such term is defined in section 10(a) of the Fish and Wildlife Coordination Act) to achieve resource management objectives; or</text></clause><clause id="H3B3FEABD50324290ADC0EAC1DC6C69B7"><enum>(ii)</enum><text>protect a species that—</text><subclause id="HF1C7E77D9D6F43A3914CB3507656866E"><enum>(I)</enum><text>is listed as endangered or threatened under the Endangered Species Act of 1973; or</text></subclause><subclause id="H7811AAA7D7814AAE9DC85C9AEA62ABDF"><enum>(II)</enum><text>the Secretary of the Interior has designated as a sensitive species; and</text></subclause></clause></subparagraph><subparagraph id="HC8BA8A4DE0AA4C1FB52984628D1BC8C2"><enum>(C)</enum><text>if—</text><clause id="H222B574008BF4728B7E71165A907A389"><enum>(i)</enum><text>such use is in accordance with Federal and State law; and</text></clause><clause id="HC3ED565E600541CCA735114CF98BDDA1"><enum>(ii)</enum><text>all viable nonlethal methods for achieving a goal described in paragraph (1) have been attempted and such documentation is maintained at the headquarters of the department that carried out such attempt.</text></clause></subparagraph></paragraph><paragraph id="H8ADCDB3DFE004238B08D4C4615B87451"><enum>(2)</enum><header>Training</header><text>Subsection (a) does not apply to training in the dismantling of body-gripping traps.</text></paragraph></subsection><subsection id="H63E08B8F82C54C1C9157C7419E750661"><enum>(c)</enum><header>Enforcement provisions</header><text>Notwithstanding section 4(f), a person who possesses or uses a body-gripping trap in the System shall be subject to the following:</text><paragraph id="H83FC0F3B264A43FA829A18A560E61E21"><enum>(1)</enum><text>In the case of a first offense, a civil fine of not more than $500 imposed by the Secretary for each body-gripping trap possessed or used.</text></paragraph><paragraph id="H44985E511E9C4CE7B7B8D4E6BFFEE377"><enum>(2)</enum><text>In the case of a subsequent offense—</text><subparagraph id="H2F1823879A07407097694C35C57DDB98"><enum>(A)</enum><text>a civil fine of not more than $1,000 imposed by the Secretary for each body-gripping trap possessed or used;</text></subparagraph><subparagraph id="H9078957FC62F4D828FA4A1A56902F82A"><enum>(B)</enum><text>imprisonment for not more than 180 days; or</text></subparagraph><subparagraph id="HF4C6914C446B45E0B1B5E55B266C3E24"><enum>(C)</enum><text>both a civil fine and imprisonment in accordance with subparagraphs (A) and (B).</text></subparagraph></paragraph></subsection><subsection id="H9C105950D1BA4766AF47F662BE506DB2"><enum>(d)</enum><header>Forfeiture of body-Gripping trap</header><text>Any body-gripping trap that is possessed or used in violation of this section, and any wildlife captured by the use of such trap, including the pelt or raw fur of such wildlife, shall be subject to forfeiture to the United States in accordance with the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">chapter 46</external-xref> of title 18, United States Code, relating to civil forfeitures.</text></subsection><subsection id="HC27CADD2FDA148AE97509730DB38B9F1"><enum>(e)</enum><header>Payment of court costs and other associated expenses</header><text>A person found to be in violation of subsection (a) shall pay all associated court costs.</text></subsection><subsection id="HA0FB9367B768453594BA8CE00BCB8BEB"><enum>(f)</enum><header>Regulations</header><text>Not later than 120 days after the date of the enactment of this section, the Secretary shall issue any regulations necessary to carry out this section.</text></subsection><subsection id="H301441AA168D451AABD390E313723D10"><enum>(g)</enum><header>Definitions</header><paragraph id="H9B76526AF1AF4D88B9FAC9FC4E0A7EF1"><enum>(1)</enum><header>Body-Gripping trap</header><text display-inline="yes-display-inline">In this section, the term <quote>body-gripping trap</quote>—</text><subparagraph id="H7181A45CB61E4A138212CC450FFF2862"><enum>(A)</enum><text>except as provided in paragraph (3), means any device that is intended to kill or capture wildlife by physically restraining any part of the animal;</text></subparagraph><subparagraph id="H657F7B1A42D94469827CB71ABD1D4C38"><enum>(B)</enum><text>includes any—</text><clause id="H2C902B782D544049A18C28246995AC8C"><enum>(i)</enum><text>steel-jaw, padded, or other modified leghold trap;</text></clause><clause id="H9C42AD87C9D84E37BDC7D58086F32BD1"><enum>(ii)</enum><text>kill-type trap;</text></clause><clause id="H7D9F95F449F643D2AFA911B64C51F6C2"><enum>(iii)</enum><text>snare trap; or</text></clause><clause id="H2DB57AB91A754A87B2CCB7B286807BA0"><enum>(iv)</enum><text>modified version of any such trap; and</text></clause></subparagraph><subparagraph id="H639A9CCB51694758AA246CD8FF2FFBA7"><enum>(C)</enum><text>does not include any—</text><clause id="H24F443C7A1454BDEBB52DCBBEDB54B06"><enum>(i)</enum><text>cage or box trap; or</text></clause><clause id="H54A9B321A17744288D9A93680C42D749"><enum>(ii)</enum><text>suitcase-type live beaver trap.</text></clause></subparagraph></paragraph><paragraph id="H638A5A522ECF419780FE95203767B11D"><enum>(2)</enum><header>Nonlethal methods</header><text>The term <quote>nonlethal methods</quote>—</text><subparagraph id="HC45FB468C1DF4DFD8AE10AE9A845E2A0"><enum>(A)</enum><text>includes exclusions, barriers, harassment and scaring devices, and any other method that does not result in the death of target or non-target species, except</text></subparagraph><subparagraph id="H0FE69186C6924EECBFB50E89A8924E0E"><enum>(B)</enum><text>does not include the use of a body-gripping trap.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
