which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To designate residents of the Hong Kong Special Administrative Region as Priority 2 refugees of special humanitarian concern, and for other purposes.</official-title></form><legis-body id="H11399DB112314D0B8E9E23EE6FDDD738" style="OLC"><section section-type="section-one" id="H541FC8B89CDE4857AFF6F7F3A6FB7FA6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hong Kong Safe Harbor Act</short-title></quote>.</text></section><section id="H62A0B0241D624BBB88CF3E6AC4C813EF"><enum>2.</enum><header>Designation of certain residents of Hong Kong as Priority 2 refugees</header><subsection id="HB39A8FF0F8914CCAB5065CDEA3439A29"><enum>(a)</enum><header>In general</header><text>The Secretary of State, in consultation with the Secretary of Homeland Security, shall designate as Priority 2 refugees of special humanitarian concern the following categories of aliens:</text><paragraph id="H560991C517DC4CF983352E1353918689"><enum>(1)</enum><text display-inline="yes-display-inline">Individuals who are residents of the Hong Kong Special Administrative Region who suffered persecution, or have a well-founded fear of persecution, on account of their peaceful expression of political opinions or peaceful participation in political activities or associations.</text></paragraph><paragraph id="H73C4A5573A4E44FEA4EAF4FC2103442F"><enum>(2)</enum><text display-inline="yes-display-inline">Individuals who have been formally charged, detained, or convicted on account of their peaceful actions as described in section 206(b)(2) of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5726">22 U.S.C. 5726</external-xref>).</text></paragraph><paragraph id="HD580094C3A194D218EF2D76E608B1070"><enum>(3)</enum><text display-inline="yes-display-inline">The spouses, children, and parents (as such terms are defined in subsections (a) and (b) of section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)) of individuals described in paragraph (1) or (2), except such parents who are citizens of a country other than the People's Republic of China. </text></paragraph></subsection><subsection id="H13899D8122BA40109D199F06636E5FB0"><enum>(b)</enum><header>Processing of Hong Kong refugees</header><text>The processing of individuals described in subsection (a) for classification as refugees may occur in Hong Kong or in a third country.</text></subsection><subsection id="H19D6CEC0CDB649718D809D0BDC176880"><enum>(c)</enum><header>Eligibility for admission as refugees</header><text>An alien may not be denied the opportunity to apply for admission as a refugee under this section primarily because such alien—</text><paragraph id="H5035D1EA3A4047BB8FBF87C171D26A99"><enum>(1)</enum><text>qualifies as an immediate relative of a citizen of the United States; or</text></paragraph><paragraph id="HF76CB65DA5F04124A7AEAB4140724B83"><enum>(2)</enum><text>is eligible for admission to the United States under any other immigrant classification.</text></paragraph></subsection><subsection id="HE077E9B379184C1F883D1357FF0E6924"><enum>(d)</enum><header>Facilitation of admissions</header><text display-inline="yes-display-inline">An applicant for admission to the United States from the Hong Kong Special Administrative Region may not be denied primarily on the basis of a politically motivated arrest, detention, or other adverse government action taken against such applicant as a result of the participation by such applicant in protest activities.</text></subsection><subsection id="HBED2B202932B4479AE7E39E0D68EE79C"><enum>(e)</enum><header>Exclusion from numerical limitations</header><text>Aliens provided refugee status under this section shall not be counted against any numerical limitation under section 201, 202, 203, or 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>, 1152, 1153, or 1157). </text></subsection><subsection id="H761EBC11174D46CFB3FED8415B7534D7"><enum>(f)</enum><header>Reporting requirements</header><paragraph id="H19EC8D1851F140059614890850E4525B"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and every 90 days thereafter, the Secretary of State and the Secretary of Homeland Security shall submit a report on the matters described in paragraph (2) to—</text><subparagraph id="H198E77F5DA184E66ADAD5109D79817A5"><enum>(A)</enum><text>the Committee on the Judiciary and the Committee on Foreign Relations of the Senate; and</text></subparagraph><subparagraph id="H49D4B22BF47E4929B58CC323846CC5E1"><enum>(B)</enum><text>the Committee on the Judiciary and the Committee on Foreign Affairs of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H68FA8B6F63BE46D39918099D344953AE"><enum>(2)</enum><header>Matters to be included</header><text>Each report required by paragraph (1) shall include—</text><subparagraph id="H16AB6B704FC047048CE85F7B6BA529FC"><enum>(A)</enum><text>the total number of applications that are pending at the end of the reporting period;</text></subparagraph><subparagraph id="HE39F473C3A604446BC01EB517C6EC5D8"><enum>(B)</enum><text>the average wait-times for all applicants who are currently pending—</text><clause id="H8E53279DF9AE46A9A9CD41E52FCB145F"><enum>(i)</enum><text>employment verification;</text></clause><clause id="H923DFDCAEBFA457296E9B2DB9618DE72"><enum>(ii)</enum><text>a prescreening interview with a resettlement support center;</text></clause><clause id="HB4066DB7433B439090CF7553A033CD95"><enum>(iii)</enum><text>an interview with U.S. Citizenship and Immigration Services; and</text></clause><clause id="HA1C04C9EA7EA4CD3A5CB7CD109B8C01D"><enum>(iv)</enum><text>the completion of security checks; and</text></clause></subparagraph><subparagraph id="H08CFD207441D4B39AEE0DABC180B194F"><enum>(C)</enum><text>the number of denials of applications for refugee status, disaggregated by the reason for each such denial.</text></subparagraph></paragraph><paragraph id="H868EC8C1615341198199BBDE217CA64E"><enum>(3)</enum><header>Form</header><text>Each report required by paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph><paragraph id="HF6695A9D1E4A4062BA41E8E91D4DD13F"><enum>(4)</enum><header>Public reports</header><text>The Secretary of State shall make each report submitted under this subsection available to the public on the internet website of the Department of State.</text></paragraph></subsection><subsection id="HBA036E05F86C4F6FA2D04707557448F3"><enum>(g)</enum><header>Satisfaction of other requirements</header><text>Aliens granted status under this section as Priority 2 refugees of special humanitarian concern under the refugee resettlement priority system shall be considered to satisfy the requirements under section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>) for admission to the United States.</text></subsection></section><section id="H08BCBCA2055D482DB9F34534DA3FD02A"><enum>3.</enum><header>Waiver of immigrant status presumption</header><subsection id="HC6E88CBAB3B44E768C414FBC7B35CB1F"><enum>(a)</enum><header>In general</header><text>The presumption under the first sentence of section 214(b) (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(b)</external-xref>) that every alien is an immigrant until the alien establishes that the alien is entitled to nonimmigrant status shall not apply to an alien described in subsection (b).</text></subsection><subsection id="HD2419F721F334C2FAEEBFF0024FB44D0"><enum>(b)</enum><header>Alien described</header><paragraph id="H36D59BA9F417471D89F209D04F820B4F"><enum>(1)</enum><header>In general</header><text>An alien described in this paragraph is an alien who—</text><subparagraph id="HD91C508FA981449EBAC2F2EEE75D116C" commented="no"><enum>(A)</enum><text>on June 30, 2020, is a resident of the Hong Kong Special Administrative Region; </text></subparagraph><subparagraph id="H951EB04A59EC43458DD06175E29B7408"><enum>(B)</enum><text>is seeking entry to the United States to apply for asylum under section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>); and</text></subparagraph><subparagraph id="H62E3FDA9749E4BD081E5D45568D0D673"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H52E11DAE9EEB40EA9D453E1EE83D6DE8"><enum>(i)</enum><text>had a leadership role in civil society organizations supportive of the protests in 2019 and 2020 relating to the Hong Kong extradition bill and the encroachment on the autonomy of Hong Kong by the People’s Republic of China;</text></clause><clause id="H6A0B9AE1A9734DEEAEF90A7B9FEA1D6A" indent="up1"><enum>(ii)</enum><text>had an organizing role for such protests;</text></clause><clause id="H825C52F13E6E4CAD8BE4F0B1E68DAD10" indent="up1"><enum>(iii)</enum><text>acted as a first aid responder for such protests;</text></clause><clause id="HC5955334516842FA817B8973D8610C2C" indent="up1"><enum>(iv)</enum><text>suffered harm while covering such protests as a journalist;</text></clause><clause id="H68F95C41E5664E1EB3704486B461F75D" indent="up1"><enum>(v)</enum><text>provided paid or pro-bono legal services to 1 or more individuals arrested for participating in such protests; or</text></clause><clause id="H83BBD2B67DC242C8BDD0C91BF8F33D2A" indent="up1" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text>during the period beginning on June 9, 2019, and ending on June 30, 2020, was formally charged, detained, or convicted for his or her participation in such protests. </text></clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="H9F2E03A2141C4A7A8F48A74510FFD099"><enum>(2)</enum><header>Exclusion</header><text>An alien described in this paragraph does not include any alien who is a citizen of a country other than the People's Republic of China.</text></paragraph></subsection></section><section display-inline="no-display-inline" commented="no" id="HC193C62310D144A2A9B9CA63683DC857"><enum>4.</enum><header>Refugee and asylum determinations under the Immigration and Nationality Act</header><subsection id="HBB66F6EBA8314433A2E323F6161C3FEA"><enum>(a)</enum><header>Persecution on account of political opinion</header><paragraph id="HC25405CB83624DA48A303DEDC86C3C32"><enum>(1)</enum><header>In general</header><text>For purposes of refugee determinations under this Act in accordance with section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>), an individual whose citizenship, nationality, or residency is revoked for having submitted to any United States Government agency a nonfrivolous application for refugee status, asylum, or any other immigration benefit under the immigration laws (as defined in section 101(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>) shall be considered to have suffered persecution on account of political opinion.</text></paragraph><paragraph id="HF7F52A523B74472688C87059D1AF0DCD"><enum>(2)</enum><header>Nationals of the People's Republic of China</header><text>For purposes of refugee determinations under this Act in accordance with section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>), a national of the People's Republic of China whose residency in the Hong Kong Special Administrative region, or any other area within the jurisdiction of the People's Republic of China, as determined by the Secretary of State, is revoked for having submitted to any United States Government agency a nonfrivolous application for refugee status, asylum, or any other immigration benefit under the immigration laws shall be considered to have suffered persecution on account of political opinion.</text></paragraph></subsection><subsection id="HF4A1D7BD2DE4447EAA5E97C3E40FC51C"><enum>(b)</enum><header>Changed circumstances</header><text>For purposes of asylum determinations under this Act in accordance with section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>), the revocation of the citizenship, nationality, or residency of an individual for having submitted to any United States Government agency a nonfrivolous application for refugee status, asylum, or any other immigration benefit under the immigration laws shall be considered to be a changed circumstance under subsection (a)(2)(D) of that section.</text></subsection></section><section id="H6B8DCFB135C94D8BBF3ADA64935D820A"><enum>5.</enum><header>Statement of policy on encouraging allies and partners to make similar accommodations</header><text display-inline="no-display-inline">It is the policy of the United States to encourage allies and partners of the United States to make accommodations similar to the accommodations made in this Act for residents of the Hong Kong Special Administrative Region who are fleeing oppression by the Government of the People’s Republic of China. </text></section><section id="H244D263D6E3C4FC4BBEC1B3EE31DB540"><enum>6.</enum><header>Termination</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall cease to have effect on the date that is 5 years after the date of the enactment of this Act.</text></section></legis-body></bill>
