<official-title display="yes">To amend the Immigration and Nationality Act to allow the Secretary of State to make available to the public certain records pertaining to the refusal of a visa or permit based on an alien’s involvement in corruption or human rights abuse, and for other purposes.</official-title>

<section id="H73B887D978484A1A9E16F7BF5C5488F6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Revealing and Explaining Visa Exclusions for Accountability and Legitimacy Act</short-title></quote> or the <quote><short-title>REVEAL Act</short-title></quote>.</text></section> <section id="H021FFF9DD7BD4EAA8B2A10D41A9351C0"><enum>2.</enum><header>Limiting confidentiality of records</header> <subsection id="HD722583E05C846E6A33F31E742578C45"><enum>(a)</enum><header>In general</header><text>Section 222(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1202">8 U.S.C. 1202(f)</external-xref>) is amended—</text>
<paragraph id="H052F2967517E43ECB04998AF908166C0"><enum>(1)</enum><text>in paragraph (1), by striking the period at the end and inserting a semicolon;</text></paragraph> <paragraph id="HD2F1DB98E74F46EDAE8CA4CD5433FB44"><enum>(2)</enum><text>in paragraph (2)(B), by striking the period at the end and inserting the following: <quote>; and</quote>; and</text></paragraph>
<paragraph id="H30015285DC054E00929D472E1C66ABE1"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="H86F7C3C7C12743FA9B95C05175681A62" style="OLC"> <paragraph id="H8E79A05E0707486A91C087B11F118F3F"><enum>(3)</enum><text display-inline="yes-display-inline">the Secretary of State may make available to the public the identity of an individual alien determined to be inadmissible to the United States pursuant to subparagraph (C) of section 212(a)(3), and the grounds on which a determination was made to refuse a visa or permit. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HAC24A4C48C034B1AB87D5BA774B54504"><enum>(b)</enum><header>Application</header><text>This Act and the amendments made by this Act shall apply with respect to any determination under section 212(a)(3)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(C)</external-xref>) made before, on, or after the date of enactment of this Act.</text></subsection> <subsection id="H92E12F7656FD456990BF92D0142D260F"><enum>(c)</enum><header>Consideration of certain information in revealing bans</header><text display-inline="yes-display-inline">In determining whether to waive confidentiality under section 222(f)(3) of the Immigration and Nationality Act, as added by subsection (a), the Secretary of State shall consider—</text>
<paragraph id="H560F78AFBEE3407AB1CF63E95D90D7B6"><enum>(1)</enum><text>information provided by the chairperson and ranking member of each of the appropriate congressional committees; and</text></paragraph> <paragraph id="H996D04CCBE2E4505B9FFE9C869F39B9C"><enum>(2)</enum><text>credible information obtained by other countries and nongovernmental organizations that monitor corruption and human rights abuse.</text></paragraph></subsection></section>
<section id="H73F85D73D7DC4005B715580934030083"><enum>3.</enum><header>Reports to Congress</header>
<subsection id="H51C63B7004FD484899751A36C5FD584F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, and annually thereafter, the President shall submit to the appropriate congressional committees a report that includes, for the previous year—</text> <paragraph id="H50B2727EFA6345F6BA6A5D0B7B627A2C"><enum>(1)</enum><text display-inline="yes-display-inline">a list of each individual that the Secretary of State determined was ineligible for an immigrant or nonimmigrant visa pursuant to subparagraph (C) of section 212(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)</external-xref>); and </text></paragraph>
<paragraph id="H9BC7FB6C8EE1452D8BB3E77B83D389A0"><enum>(2)</enum><text display-inline="yes-display-inline">a list of each individual described in paragraph (1), but for whom the Secretary of State determined not to make public the identity of the individual, and the grounds on which the determination of ineligibility was made. </text></paragraph></subsection> <subsection id="H23BCFF12E7C6443BA71770DD5FF77307"><enum>(b)</enum><header>Form of report</header> <paragraph id="H67E305AB24D4486EA10CFAD0C4595A19"><enum>(1)</enum><header>In general</header><text>Each report required by subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph>
<paragraph id="H7143BFFD407A4C47BB53BEF6C35B8A1B"><enum>(2)</enum><header>Exception</header><text>The name of an alien to be included in the list required by subsection (a)(1) may be submitted in the classified annex authorized by paragraph (1) only if the President—</text> <subparagraph id="H7882B5B528224DD7AF5CAE56943BC4A5"><enum>(A)</enum><text>determines that it is vital for the national security interests of the United States to do so;</text></subparagraph>
<subparagraph id="H65FE8921E6D84CDAB5883CEF06FE4121"><enum>(B)</enum><text>uses the annex in a manner consistent with congressional intent and the purposes of this Act; and</text></subparagraph> <subparagraph id="H49AED38701C845E0B98421608F6D956A"><enum>(C)</enum><text>not later than 15 days before submitting the name in a classified annex, provides to the appropriate congressional committees notice of, and a justification for, including the name in the classified annex. </text></subparagraph></paragraph></subsection>
<subsection id="H3C402576548145EF85414A93E64C332D"><enum>(c)</enum><header>Public availability</header>
<paragraph id="H7E0A06016E1C460A854007A290E0FC6E"><enum>(1)</enum><header>In general</header><text>The unclassified portion of the report required by subsection (a) shall be made available to the public, including through publication in the Federal Register.</text></paragraph> <paragraph id="H0B81B2DD208641B6BE5571F24352C25A"><enum>(2)</enum><header>Nonapplicability of confidentiality requirement with respect to visa records</header><text>The President shall publish the list required by subsection (a)(1) without regard to the requirements of section 222(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1202">8 U.S.C. 1202(f)</external-xref>) with respect to confidentiality of records pertaining to the issuance or refusal of visas or permits to enter the United States.</text></paragraph></subsection>
<subsection id="H983CD155C11449088F5DAE510A86AC42"><enum>(d)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph id="H0FEA4BC8F03B4873BA614847088CBF9A"><enum>(1)</enum><text>the Committee on the Judiciary and the Committee on Foreign Relations of the Senate; and</text></paragraph>
<paragraph id="HE6631C564D784F8B810DE27D3781770C"><enum>(2)</enum><text>the Committee on the Judiciary and the Committee on Foreign Affairs of the House of Representatives.</text></paragraph></subsection></section> </legis-body> </bill>
