R. 4298</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210701">July 1, 2021</action-date><action-desc><sponsor name-id="J000306">Mr. Jones</sponsor> (for himself, <cosponsor name-id="G000574">Mr. Gallego</cosponsor>, and <cosponsor name-id="J000032">Ms. Jackson Lee</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To clarify the disparate burden test, and for other purposes.</official-title></form><legis-body id="H3134002619C949A6BE6E50F5DAB6690E" style="OLC"><section id="HBE508504E8514D47A61F2E80F3D85F86" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Inclusive Elections Act of 2021</short-title></quote>.</text></section><section id="H3B8CA42E7525497D9104B7E0CB8B0D6B"><enum>2.</enum><header>Disparate burden test</header><text display-inline="no-display-inline">Section 2 of the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/52/10301">52 U.S.C. 10301</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H574330BE192E4BF09B0CCD256AFADEA5" display-inline="no-display-inline"><subsection id="HCD64AC37F76F434DA1E901A5689D89D8"><enum>(c)</enum><text display-inline="yes-display-inline">In determining whether members of a class of citizens have less opportunity than other members of the electorate to participate in the political process and to elect representatives of their choice, a court shall consider whether—</text><paragraph id="H9AE0F6677DC54423A511C408307818F3"><enum>(1)</enum><text display-inline="yes-display-inline">the challenged standard, practice, or procedure imposes a disparate burden on members of a class of citizens protected by subsection (a); and</text></paragraph><paragraph id="H07D40D7D37034D8683F56B84AD241FB6"><enum>(2)</enum><text display-inline="yes-display-inline">the disparate burden is in part caused by or related to social and historical conditions that produce or produced discrimination against members of the protected class.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
