R. 4294</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210630">June 30, 2021</action-date><action-desc><sponsor name-id="W000808">Ms. Wilson of Florida</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to authorize the Secretary of Health and Human Services to award grants to nursing homes, assisted living facilities, and other long-term care facilities to improve their preparedness for power outages.</official-title></form><legis-body id="HB95D6A694809437195DD134C0CDA7012" style="OLC"><section id="H4B000C07180842ECB24E6E48567A7E5F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Preparedness for Power Outages Act of 2021</short-title></quote>.</text></section><section id="H6BD0EF3726EC44C4A92C62A0941AAD58"><enum>2.</enum><header>Improving the preparedness of nursing homes, assisted living facilities, and other long-term care facilities for power outages</header><text display-inline="no-display-inline">The Public Health Service Act is amended by inserting after section 319C–3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-3c">42 U.S.C. 247d–3c</external-xref>) the following new section:</text><quoted-block display-inline="no-display-inline" id="HC5666D3F4272451A91DBB0E9A9B3A707" style="OLC"><section id="H69A2052C604D4861A619B6F3E6B6E3CA"><enum>319C–4.</enum><header>Improving the preparedness of nursing homes, assisted living facilities, and other long-term care facilities for power outages</header><subsection id="HB4DD3679993A4280A6350A4FE01B26FC"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">The Secretary may award grants to nursing homes, assisted living facilities, and other long-term care facilities to improve their preparedness for power outages, including during and after a natural disaster.</text></subsection><subsection id="H10C64084726847658C750A6D2538F280"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">The preparedness activities funded through a grant under this section may include—</text><paragraph id="HA7E2B8513B1D49B0B9EB500118CB0552"><enum>(1)</enum><text>the purchase of a backup power source, such as a generator, and any related equipment; and</text></paragraph><paragraph id="H788EE3B01AA349508CE2AB7FF427E24C"><enum>(2)</enum><text>the creation of a regional resource directory on disaster and post-disaster preparedness for power outages.</text></paragraph></subsection><subsection id="H50ECEAB33F684AC1978ED6FAE0CEA70D"><enum>(c)</enum><header>Preference</header><text>In awarding grants under this section, the Secretary shall give preference to nursing homes, assisted living facilities, and other long-term care facilities that—</text><paragraph id="HD91B88CEA6A0453F8DA93C29F01769AF"><enum>(1)</enum><text>are located in areas that—</text><subparagraph id="H1E41F0C2FE174FE1A68E5F56002E8D5C"><enum>(A)</enum><text>have a high proportion of—</text><clause id="H43E79495EE4B462A89292CACD9908F20"><enum>(i)</enum><text>elderly residents; or</text></clause><clause id="H83B80B069E0B4F219A45CD479EBD0E6F"><enum>(ii)</enum><text>individuals who are enrolled in a State plan under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) (or under a waiver of such plan); and</text></clause></subparagraph><subparagraph id="H43ACC539D4B1491E8493584243E6114C"><enum>(B)</enum><text>have a high risk of hurricanes or other natural disasters; and</text></subparagraph></paragraph><paragraph id="HFFB32526F8994F0FA6945F4684ACF597"><enum>(2)</enum><text display-inline="yes-display-inline">have not been cited for a substantive Federal, State, or local violation.</text></paragraph></subsection><subsection id="H5CD8BEF04E664E76858847ABAFD0A433"><enum>(d)</enum><header>Authorization of appropriations</header><text>To carry out this section, there are authorized to be appropriated such sums as may be necessary.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
