R. 4281</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210630">June 30, 2021</action-date><action-desc><sponsor name-id="P000605">Mr. Perry</sponsor> (for himself, <cosponsor name-id="T000165">Mr. Tiffany</cosponsor>, and <cosponsor name-id="D000616">Mr. DesJarlais</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To impose sanctions on persons who are knowingly responsible for or complicit in, or have directly or indirectly engaged in, supporting the illegal occupation of Tibet, and for other purposes.</official-title></form><legis-body id="HA538A59624324C109B618FEBC11DAD3A" style="OLC"><section id="H6E558FB5296D4C56AA81C7E0F9911D02" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tibet Independence Act</short-title></quote>.</text></section><section id="HF947CA81797046389D44A19270268E13"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HE06881D2368B49878BCCD9039D142DCB"><enum>(1)</enum><text>Congress listed Tibet as a separate country from the People’s Republic of China in the Export-Import Bank Act Amendments of 1986.</text></paragraph><paragraph id="H9DAB8970BC714ACDA3681B2327444C0E"><enum>(2)</enum><text>The Foreign Relations Authorization Act, Fiscal Years 1992 and 1993 declares that Congress views Tibet as an <quote>occupied country</quote>, and that China’s control of Tibet remains illegal under international law.</text></paragraph><paragraph id="H231671BB93694BB1B643673698172BB6"><enum>(3)</enum><text>The Foreign Relations Authorization Act, Fiscal Years 1992 and 1993 further establishes that <quote>it is the policy of the United States to oppose aggression and other illegal uses of force by one country against the sovereignty of another as a manner of acquiring territory, and to condemn violations of international law, including the illegal occupation of one country by another</quote>.</text></paragraph><paragraph id="H5B2DD118C62B4FD8BB4B83C699435270"><enum>(4)</enum><text>The Foreign Relations Authorization Act, Fiscal Years 1994 and 1995 conveyed the Sense of Congress that <quote>the United States should seek to establish a dialogue with those recognized by Congress as the true representatives of the Tibetan people, the Dalai Lama, his representatives and the Tibetan Government in Exile</quote>.</text></paragraph><paragraph id="H254B03669BA349DD94DFEAD665F2678C"><enum>(5)</enum><text>On November 18, 2020, the United States House of Representatives approved without objection H. Res. 697, which <quote>affirms the cultural and religious significance of the goal of genuine autonomy for the people of Tibet and the deep bond between the American and Tibetan people</quote>.</text></paragraph><paragraph id="HCB8B1067C488478F99B7B1EB167913C9"><enum>(6)</enum><text>In 1951, the People’s Republic of China coerced Tibetan representatives to sign, under duress, an unlawful settlement known as the Seventeen Point Agreement. This agreement states that <quote>the Tibetan people have the right to exercise national regional autonomy under the unified leadership of the Central People’s Government</quote> and additionally, that <quote>the central authorities will not alter the existing political system in Tibet</quote>.</text></paragraph><paragraph id="H46CE8276B3334A679BDC2E223131839A"><enum>(7)</enum><text display-inline="yes-display-inline">The establishment of the independent state of Tibet predates the 1951 Seventeen Point Agreement by many hundreds of years.</text></paragraph><paragraph id="HE93D905344554DA6A1CFD8501452897A"><enum>(8)</enum><text>In rejecting the seven-decade long illegal occupation of Tibet by the forces of the Chinese Communist Party, the United States of America would provide relief to a long-suffering people and reinforce its reputation as a strident defender of global human rights.</text></paragraph><paragraph id="H1EB20264EDCA472EBD3EBFB32B7E3325"><enum>(9)</enum><text>It would benefit the national security of the United States to recognize Tibet, which comprises the original three Tibetan provinces of Amdo, Kham, and U–Tsang, as a separate, independent country.</text></paragraph></section><section id="HA8512A78ACC64C02A5A37B70FA8F9C2D"><enum>3.</enum><header>Statement of policy; authorization; sense of congress</header><subsection id="HE1C139C6513344CCB6A473A0A39564A0"><enum>(a)</enum><text>It is the policy of the United States to—</text><paragraph id="H647617B55CE34733AD45275ED4AA6738"><enum>(1)</enum><text>acknowledge that Tibet was an independent country prior to the People’s Republic of China’s illegal occupation of Tibet’s sovereign territory in 1951;</text></paragraph><paragraph id="H74DFDE4B474249058602AF22F1F45E86"><enum>(2)</enum><text>affirm that all territorial claims by the People’s Republic of China over the area known as Tibet, which comprises the original three Tibetan provinces of Amdo, Kham, and U–Tsang, are invalid and without merit; and</text></paragraph><paragraph id="HD9A97385D68649A48307063777E62580"><enum>(3)</enum><text>recognize that the democratically elected government of Tibet, presently named as the Central Tibetan Administration, is the only governing authority of Tibet.</text></paragraph></subsection><subsection id="H31816ECF784B4D0FBC5E6C0BC1888BAD"><enum>(b)</enum><header>Authorization</header><text>The President is authorized to recognize Tibet, which comprises the original Tibetan provinces of Amdo, Kham, and U–Tsang, as a separate, independent country, in accordance with subsection (a), immediately upon enactment of this Act.</text></subsection><subsection id="H2F4454C350E944328343D49B4C95BB54"><enum>(c)</enum><header>Sense of congress</header><text>The President of the United States should invite the incumbent Sikyong (President) of Tibet to the United States for an official state visit no later than 1 year after the date of the enactment of this Act.</text></subsection></section><section id="HEED0216D6C6E41B3B04857132ACE0613"><enum>4.</enum><header>Imposition of sanctions with respect to the continued illegal occupation of Tibet</header><subsection id="H194931D02D3448A48F9F621E14FA1171"><enum>(a)</enum><header>Imposition of sanctions</header><text>The President shall impose the sanctions described in subsection (c) with respect to each foreign person included in the most recent list submitted pursuant to subsection (b).</text></subsection><subsection id="H9264C673F4EF4F82B2A3C1C65404EBE2"><enum>(b)</enum><header>List of persons</header><paragraph id="H0C2B93A4B55143AA82838028EAF82149"><enum>(1)</enum><text>Not later than 180 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a list of foreign persons, including senior government officials, military leaders, and other persons, who the President determines are knowingly responsible for or complicit in, or have directly or indirectly engaged in, supporting the Chinese Communist Party’s illegal occupation of Tibet.</text></paragraph><paragraph id="HDBA2B1889F5244A689BA5E782C85DB4C"><enum>(2)</enum><header>Updates of lists</header><text>The President shall submit to the appropriate congressional committees an updated list under paragraph (1)—</text><subparagraph id="H40C288B7C24C4AD9A5DA956EEAD99784"><enum>(A)</enum><text>not later than 180 days after the date of the enactment of this Act and annually thereafter for 5 years; or</text></subparagraph><subparagraph id="HC23CDD61178F45BD91574234FBE3A85B"><enum>(B)</enum><text>as new information becomes available.</text></subparagraph></paragraph><paragraph id="H8D56ADF9FDCB4837A01414377417FEDA"><enum>(3)</enum><header>Form</header><text>The list required by paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph></subsection><subsection id="HAB9734B2008C48F2B03F7A6B5EF56A70"><enum>(c)</enum><header>Sanctions described</header><text>The sanctions described in this subsection are the following:</text><paragraph id="HC7AA126A008D48E09BEA7AA7C808EE78"><enum>(1)</enum><header>Blocking of property</header><text>The President shall exercise all of the powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in property and interests in property of the person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph id="H5A87D23E0D6F4EC88D21AC469955F6F5"><enum>(2)</enum><header>Inadmissibility of certain individuals</header><subparagraph id="H8515BCF90A19446CA2CB74D7B9FA4A00"><enum>(A)</enum><header>Ineligibility for visas, admission, or parole</header><text>A foreign person included in the most recent list submitted pursuant to subsection (b) is—</text><clause id="HC76FB00EB4D9421BAC5332D44E095C52"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="H5EE8F7C491B943CE99C0A392404D400C"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause id="H82862B0BC2C8496C9FE217B9612D7541"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="HA1896B98DA2D4C689F74F9877EB46E60"><enum>(B)</enum><header>Current visas revoked</header><text>A foreign person described in subparagraph (A) is also subject to the following:</text><clause id="HA8FF1B54F134435BBDB81AB0B393B918"><enum>(i)</enum><text>Revocation of any visa or other entry documentation regardless of when the visa or other entry documentation is or was issued.</text></clause><clause id="HBDA207FA0EA146DFA54862792DFCC310"><enum>(ii)</enum><text>A revocation under clause (i) shall take effect immediately and automatically cancel any other valid visa or entry documentation that is in the foreign person’s possession.</text></clause></subparagraph></paragraph><paragraph id="HD5E824F5D2DE43D4AFE4B361E5AA5096"><enum>(3)</enum><header>Exception</header><text>Sanctions under paragraph (2) shall not apply to an alien if admitting or paroling the alien into the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations of the United States.</text></paragraph></subsection><subsection id="HB3124E00BA2F4965A01833F3D37E2922"><enum>(d)</enum><header>Penalties</header><text>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person who violates, attempts to violate, conspires to violate, or causes a violation of regulations promulgated to carry out subsection (a) to the same extent that such penalties apply to a person who commits an unlawful act described in section 206(a) of that Act.</text></subsection><subsection id="H5B0BBB95CA0C4F27BDB9AE8468F6DA61"><enum>(e)</enum><header>Exception To comply with national security</header><text>The following activities shall be exempt from sanctions under this section:</text><paragraph id="HE345D06963E04C8ABEE0AC24C32BBF3E"><enum>(1)</enum><text>Activities subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>).</text></paragraph><paragraph id="HA46F5F780F5B44C2A541ECB56199393D"><enum>(2)</enum><text>Any authorized intelligence or law enforcement activities of the United States.</text></paragraph></subsection><subsection id="HCE9E06089E7B462DA3477F6FA7DDB470"><enum>(f)</enum><header>Waiver</header><paragraph id="HD842630AC6224EB0BF6758E400C64334"><enum>(1)</enum><header>In general</header><text>The President may waive, for one or more periods not to exceed 90 days, the application of sanctions imposed on a foreign person under this section if the President—</text><subparagraph id="H6A6AC7555A0747B0878321CA5A615048"><enum>(A)</enum><text>determines that such a waiver is in the national interest of the United States; and</text></subparagraph><subparagraph id="HBD372EC22A644BDC9A2987E8D7B9DF91"><enum>(B)</enum><text>not later than the date on which such waiver will take effect, submits to the appropriate congressional committees a notice of and justification for such waiver.</text></subparagraph></paragraph></subsection></section><section id="HC96D4DC2D5A74F65993FD1C31FD34EA7"><enum>5.</enum><header>Appropriate congressional committees defined</header><text display-inline="no-display-inline">In this Act, the term <term>appropriate congressional committees</term> means—</text><paragraph id="H7AA93409C0D3499AAD55D70006B3112F"><enum>(1)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives; and</text></paragraph><paragraph id="H06980A28BF064ACDB9C731298CCBFF96"><enum>(2)</enum><text>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate.</text></paragraph></section></legis-body></bill>
