committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Agriculture to establish the Dairy Pricing and Policy Commission, and for other purposes.</official-title></form><legis-body id="H2957DEA16943422FBCABFA8E92D1FD7D" style="OLC"><section id="H66155FC6F2D24493B0CE1F631499204F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dairy Pricing and Policy Commission Act of 2021</short-title></quote>.</text></section><section id="H8ED9273527B740F0B2393FDCEAE27E5C"><enum>2.</enum><header>Dairy Pricing and Policy Commission</header><subsection id="H46CB9A0406C644C88F8D8645C2F749C8"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text><paragraph id="HC18552D1356B4AC99E9081932F06D6EB"><enum>(1)</enum><text display-inline="yes-display-inline">The pace of consolidation in the dairy industry as it relates to herd size is far surpassing that seen in the majority of U.S. agriculture.</text></paragraph><paragraph id="H68028437B90D473F9FA28F37EEF28183"><enum>(2)</enum><text>The number of small commercial dairy operations has declined from 146,685 in 1987 to 30,373 in 2017.</text></paragraph><paragraph id="H432B798EC0AD4FCF9430EB8579435F45"><enum>(3)</enum><text>The number of licensed dairy herds fell by more than half between 2002 and 2019, despite milk production continuing to grow.</text></paragraph><paragraph id="H03DA613A207B41A9B1410E9BBB2167FD"><enum>(4)</enum><text>The loss of dairy operations poses significant economic challenges to many rural communities with historic ties to dairy farming.</text></paragraph><paragraph id="HD3080CFCB9014C7BB67081069AE08ECE"><enum>(5)</enum><text>A diverse and cross-regional dairy industry is critical for food security and resiliency in the United States.</text></paragraph><paragraph id="H59FF5B069E7C4A408AB1C501A4E6981B"><enum>(6)</enum><text>Continued declines of approximately 4 percent of dairy farms annually will negatively impact rural communities throughout the country.</text></paragraph><paragraph id="H2AA2FFADC8324335A1E04BC68642934A"><enum>(7)</enum><text>In 2016, dairy farmers of all herd sizes below 1,000 cows experienced higher total costs than gross returns.</text></paragraph><paragraph id="H76658C0247FE4486B62A78F6F1EDF6DE"><enum>(8)</enum><text>In 2019, monthly exit rates among Wisconsin licensed dairy farms more than doubled from 2016 levels.</text></paragraph></subsection><subsection id="HC11D149C3DE844EBB82FBE7BDA6878B3"><enum>(b)</enum><header>Establishment</header><text>Not later than 6 months after the date on which funds are first made available to carry out this section, the Secretary shall establish a commission to be known as the <quote>Dairy Pricing and Policy Commission</quote> (in this section referred to as the <quote>Commission</quote>).</text></subsection><subsection id="H3059C5F3BDF94EF080BE2D31052706BD"><enum>(c)</enum><header>Recommendations</header><paragraph id="H14806382E70D4D9C84EBAE0B37891F8E"><enum>(1)</enum><header>In general</header><text>The Commission shall develop legislative, regulatory, and market-based recommendations for the following:</text><subparagraph id="H114DA1D656364CDD82785D80640E8A02"><enum>(A)</enum><text>Responding to periods of heightened dairy production during low prices by considering better supply chain coordination and market price signals.</text></subparagraph><subparagraph id="H14CC887C51AB4B39A653C0CF14F89E21"><enum>(B)</enum><text>Enhancing the competitiveness of U.S. dairy producers and dairy products in world markets by identifying challenges and opportunities for new markets for dairy exports.</text></subparagraph><subparagraph id="H33BBEA5FBDB64F39B3545072C37280CA"><enum>(C)</enum><text display-inline="yes-display-inline">Ensuring that Federal milk marketing orders and rulemakings that relate to such orders are transparent and provide a fair return to producers regardless of the end product for which the milk is used.</text></subparagraph></paragraph><paragraph id="H5CF9200210D94DEFB9202EA384836AD5"><enum>(2)</enum><header>Available research</header><text display-inline="yes-display-inline">In developing recommendations under paragraph (1), the Commission shall draw upon available research, including the report published in 2020 by the Economic Research Service of the United States Department of Agriculture and titled <quote>Consolidation in U.S. Dairy Farming</quote>. </text></paragraph></subsection><subsection id="H0293D30B1D0046BAB1730CF74D28BC2E"><enum>(d)</enum><header>Membership</header><paragraph id="H674D0C90BDAF4B8DA7A6F93F1405A68A"><enum>(1)</enum><header>Number and appointment</header><text>The Commission shall be composed of 13 members appointed by the Secretary as follows:</text><subparagraph id="H6C52A12654004BF78349386D48AC361A"><enum>(A)</enum><text>At least 1 member representing a national consumer organization.</text></subparagraph><subparagraph id="HD10C28777E184838B291E68FE0DE7985"><enum>(B)</enum><text>At least 1 member representing land-grant colleges and universities or covered NLGCA Institutions.</text></subparagraph><subparagraph id="HAA8B72A5ABAA4A9A8E74984155C26A1E"><enum>(C)</enum><text>At least 1 member representing the food and beverage retail sector.</text></subparagraph><subparagraph id="H6F36DA6523A84A3982F0CB88BF5C64C8" commented="no"><enum>(D)</enum><text>5 dairy producers (representing a variety of farming practices and sizes) and 2 dairy processors, appointed so as to balance geographical distribution of milk production and dairy processing, reflect major product segments of dairy processing, and represent all regions of the United States equitably, including States that operate outside of a Federal milk marketing order.</text></subparagraph><subparagraph id="H26E392348309462491EC5599A3EBD1E5"><enum>(E)</enum><text>At least 2 members representing dairy farmer, cooperative, or dairy processor, associations.</text></subparagraph><subparagraph id="H70A8A3C8096447E98E7E78F41E82FF08"><enum>(F)</enum><text>At least 1 member representing dairy industry experts in the field of milk pricing, finance, marketing, risk management, consulting, or advisory services (or some combination thereof).</text></subparagraph></paragraph><paragraph id="HD82F4B1EA3A94CBA95F830CB81BC9B2D"><enum>(2)</enum><header>Terms</header><text>Each member shall be appointed for the duration of the Commission.</text></paragraph><paragraph id="H8EEF81C4A65E48BC9616802B0898EBD6"><enum>(3)</enum><header>Vacancy</header><text>Any vacancy occurring before the termination of the Commission shall be filled in the same manner as the original appointment.</text></paragraph><paragraph id="H8E06CA10FC0842B2863D541FC63A7B94"><enum>(4)</enum><header>Payment and travel expenses</header><subparagraph id="HD088A4789B3D43DD834020FFBB96F8F3"><enum>(A)</enum><header>Payment</header><text display-inline="yes-display-inline">Members of the Commission shall serve without pay.</text></subparagraph><subparagraph id="HCCF17F9E3E1942AB85F3CD5AAC123222"><enum>(B)</enum><header>Travel expenses</header><text display-inline="yes-display-inline">For travel relating to meetings under paragraph (7), each member of the Commission shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="H58DF48B19A0C4B25A19316D761D6ADE7"><enum>(5)</enum><header>Administrative support services</header><text>The Secretary shall provide to the Commission the administrative support services necessary for the Commission to carry out the requirements under this section.</text></paragraph><paragraph id="H08CE1E5DB4564E47B2DE620A78E7A222"><enum>(6)</enum><header>Chairperson</header><text>The members shall elect a member to serve as Chairperson of the Commission for the duration of the Commission.</text></paragraph><paragraph id="H5DF04005B2D04773A9E4283A55F63D47"><enum>(7)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Commission shall meet at least 4 times each year until the date on which the Commission terminates pursuant to subsection (i).</text></paragraph><paragraph id="HF9BAB736A37E4362A4625EE72DEDEF07"><enum>(8)</enum><header>Quorum</header><text>A quorum shall consist of not fewer than 7 members of the Commission.</text></paragraph><paragraph id="H43EC9B1CBC7B4BF2946A7E8CA14FA91B"><enum>(9)</enum><header>Voting</header><subparagraph id="HCD20037BA7AC405A8C21EF3B2D32B507"><enum>(A)</enum><header>In general</header><text>If the Commission is unable to reach a consensus on a proposed recommendation or determination, the Commission may decide the matter by majority vote of its members.</text></subparagraph><subparagraph id="HF5CE3E08C9994AA1A84F80FAF9D381C6"><enum>(B)</enum><header>Tie votes</header><text>The Chairperson of the Commission, in addition to voting, may also break any tie vote.</text></subparagraph></paragraph></subsection><subsection id="HBAAE209223214294AA052AD42A378DB1"><enum>(e)</enum><header>Information from Federal agencies</header><text display-inline="yes-display-inline">The Commission may secure directly from any Federal agency of the United States information necessary to enable it to carry out this Act. Upon request of the Chairperson of the Commission, the head of such agency shall furnish that information to the Commission.</text></subsection><subsection id="H940003E51B54400EB6424FB38A1866C6"><enum>(f)</enum><header>Report</header><paragraph id="HD6CBA9AF370E48D696F29C878BAD81BB"><enum>(1)</enum><header>Submission of report</header><text>Not later than 2 years after the date of the establishment of the Commission, the Commission shall submit to the Secretary and Congress a report containing the legislative and regulatory recommendations developed pursuant to subsection (c).</text></paragraph><paragraph id="H7E70E37FECF047CEA42938309F2A87A9"><enum>(2)</enum><header>Opinions</header><subparagraph id="HE95CA465EA1F4DCDA0AD8E46541B32D2"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the report shall reflect, to the extent practicable, a consensus opinion of the members.</text></subparagraph><subparagraph id="H54B05F7ECAA44E3189C2BA04D482C008"><enum>(B)</enum><header>Exception</header><text>If the members did not reach a consensus opinion with respect to a matter, the report may include majority and minority findings regarding such matter.</text></subparagraph></paragraph></subsection><subsection id="H4386177013C04AAAB7A6574B9A4F9BB6"><enum>(g)</enum><header>No effect on existing programs</header><text>The Secretary shall not allow the existence of the Commission to impede, delay, or otherwise affect any decision-making process of the Department of Agriculture, including any rulemaking procedures planned, proposed, or near completion.</text></subsection><subsection id="H624BA61D77464BE2A9B7EACBA445547A"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $50,000 to carry out this section.</text></subsection><subsection id="H4400A81356BC41919D368D43CEB3966F"><enum>(i)</enum><header>Termination</header><text>The Commission shall terminate on the earlier of the following:</text><paragraph id="HAB6857DB30D848BB8084821491FC836E"><enum>(1)</enum><text>The date of the submission of the report pursuant to subsection (f).</text></paragraph><paragraph id="H1841C1DBE4604F7FA98DADC2B8A0DFAA"><enum>(2)</enum><text>The date that is 2 years after the date of the establishment of the Commission.</text></paragraph></subsection><subsection id="H55B4A69D92D0496686A20506F77F2B21"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF64B7F60ED0F4297AD88780994CCD71D"><enum>(1)</enum><header>Covered NLGCA Institution</header><text>The term <quote>covered NLGCA Institution</quote> means an institution that—</text><subparagraph id="HBA3745FCC1604FAFB0AF57906238AA9C"><enum>(A)</enum><text>is an NLGCA Institution; and</text></subparagraph><subparagraph id="HC0DCA0A33DC84F3F937FF47A173CADD9"><enum>(B)</enum><text>offers an accredited dairy economic program.</text></subparagraph></paragraph><paragraph id="H0117198C932B4695A189BF6D4EEF2B76"><enum>(2)</enum><header>Federal milk marketing order</header><text>The term <quote>Federal milk marketing order</quote> means a Federal milk marketing order issued under section 8c of the Agricultural Adjustment Act (<external-xref legal-doc="usc" parsable-cite="usc/7/608c">7 U.S.C. 608c</external-xref>), reenacted with amendments by the Agricultural Marketing Agreement Act of 1937.</text></paragraph><paragraph id="H54CF00D3582E443A911D1EF7B4750BC7"><enum>(3)</enum><header>Land-grant colleges and universities</header><text>The term <quote>land-grant colleges and universities</quote> has the meaning given such term in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>).</text></paragraph><paragraph id="HE35305AF01A748B78326FA4F7EA84B8B"><enum>(4)</enum><header>NLGCA Institution</header><text>The term <quote>NLGCA Institution</quote> has the meaning given such term in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>).</text></paragraph><paragraph id="H63A7295D996E4FD89E49D8D2E476701D"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph></subsection></section></legis-body></bill>
