which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to require full inspection, and complete transparency, with respect to entities receiving financial assistance from the National Institutes of Health, and for other purposes.</official-title></form><legis-body id="H7EB188121DA549FBB9F15DAEE0D7D797" style="OLC"><section id="H79B60B26EBD44B609CD4DB049F954251" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enabling More Penetrating Oversight When Examining Research for NIH Act of 2021</short-title></quote> or the <quote><short-title>EMPOWER NIH Act of 2021</short-title></quote>.</text></section><section id="H823BF39138D24EEE82FABC8876A9B162"><enum>2.</enum><header>Onsite inspections required of NIH award recipients</header><text display-inline="no-display-inline">Part A of title IV of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/281">42 U.S.C. 281 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H42D11810DA71430589136B22C4D43605" display-inline="no-display-inline"><section id="H3DC8C5E808B64C3B9BDDE1EA2BD99DAD"><enum>404O.</enum><header>Onsite inspections of award recipients</header><subsection id="H0C67D7FE18554C6CB79F363A3CA49BC2"><enum>(a)</enum><header>Scope</header><paragraph id="HDFD7DB9C8E3B4F0D82BADB2088D74E4A"><enum>(1)</enum><header>In general</header><text>This section applies with respect to any financial assistance from the National Institutes of Health to any non-Federal entity for research-related activities, whether the assistance is made available directly or indirectly, including through the award of a subgrant or other subaward.</text></paragraph><paragraph id="H284D1C4FDB9D413C8EC7AF1821C55DB7"><enum>(2)</enum><header>Special rule</header><text display-inline="yes-display-inline">This section applies even where an entity described in paragraph (1) is located or operates at—</text><subparagraph id="H2C0EF0E7696046208ADC9292A54F95CC"><enum>(A)</enum><text>a site that is in a foreign country whose government—</text><clause id="H8F5936DA7BDB4EADAD3017364A6E0B4D"><enum>(i)</enum><text>prevents inspectors from reaching the site;</text></clause><clause id="H2A350816C7454846A920DECFA9FB1DE3"><enum>(ii)</enum><text>impedes or impairs inspection; or</text></clause></subparagraph><subparagraph id="HC1C0388C462D469EA9ADF1E0CE6AA66F"><enum>(B)</enum><text>a site that restricts or delays the entry of the inspectors for any reason.</text></subparagraph></paragraph></subsection><subsection id="H365BB0E51F104A599F94E61DEA1F137A"><enum>(b)</enum><header>Condition on receipt</header><text>As a condition on receipt of any financial assistance described in subsection (a), an entity shall agree to undergo an annual in-person inspection pursuant to this section.</text></subsection><subsection id="HEC30C52C9A2846D8BF8BA3D62831633B"><enum>(c)</enum><header>Inspection requirements</header><text display-inline="yes-display-inline">The Director of NIH shall conduct an annual inspection of each entity receiving financial assistance described in subsection (a) in accordance with the following:</text><paragraph id="HC8B8DD3A49EB4BCEB7AF8B3D22CF3A82"><enum>(1)</enum><text>The inspection shall be unannounced.</text></paragraph><paragraph id="HFBEA3D512B6B4BF5A834807437B5BAB0"><enum>(2)</enum><text>The timing of the inspection shall vary each year.</text></paragraph><paragraph id="HEFD7C04C11E345AA965D7AF8E67D9C18"><enum>(3)</enum><text>The inspection shall take place at all the sites at which activities are being funded through the financial assistance.</text></paragraph><paragraph id="H76696766B8FD4C0299BACAB758112AD7"><enum>(4)</enum><text>The inspection shall examine—</text><subparagraph id="HF9D1A27B69214659B0EF95FE67BA5AE5"><enum>(A)</enum><text>whether the funded research is consistent with the description and assurances in the relevant proposal;</text></subparagraph><subparagraph id="H43E99AE4B9844F17869B1419AC596117"><enum>(B)</enum><text>whether each site at which the research is conducted, and the research itself, is in compliance with all applicable standards and requirements of the National Institutes of Health; and</text></subparagraph><subparagraph id="H8481896C373A447AA313A717F1BDDA7F"><enum>(C)</enum><text display-inline="yes-display-inline">whether each entity receiving the financial assistance keeps detailed and updated records of the research conducted.</text></subparagraph></paragraph><paragraph id="H1562C05D9F994D23B569BD6083BA8A0C"><enum>(5)</enum><text>The inspection shall include—</text><subparagraph id="HCD3BC70B6C294B279A3147357967B1E1"><enum>(A)</enum><text>the facility at the research site;</text></subparagraph><subparagraph id="HF55EBEC43A134B6195A62457B272830A"><enum>(B)</enum><text>the materials used to conduct the research;</text></subparagraph><subparagraph id="H03209BAC707348AF95516F44B0E0F401"><enum>(C)</enum><text>any electronic or hard-copy materials relevant to the research; and</text></subparagraph><subparagraph id="HCFD69DFCE3A54FEEB3C7416860601AB5"><enum>(D)</enum><text>photographic and video evidence of the inspection.</text></subparagraph></paragraph><paragraph id="H7E4E30DDCE9843D0A720559DAC530E0C" commented="no"><enum>(6)</enum><text>Each team of inspectors shall consist of at least three individuals, each of whom shall have no affiliation with any of the entities receiving the financial assistance.</text></paragraph><paragraph id="H6ECDDD2CF9E54347AD198DD4CD682290"><enum>(7)</enum><text>Each team of inspectors shall certify in writing that they have no financial conflict of interest with respect to the operations, researchers, or potential findings involved.</text></paragraph><paragraph id="H7945C633828A4DFB8CB31A5058D74C80"><enum>(8)</enum><text>Each inspector upon arrival at the site to be inspected shall present officials of the entity to be inspected with credentials confirming the inspector’s identity and authority to inspect the entity.</text></paragraph></subsection><subsection id="HFF3AFA080E6844FEAD9A313630AEDF10"><enum>(d)</enum><header>Penalties</header><paragraph id="H85DCCE5DA67747FEB32138D918A3A2EF"><enum>(1)</enum><header>In general</header><text>If an entity fails an inspection under this section—</text><subparagraph id="H9FF4A17AAB784ED1A9B113E14A71D9AD"><enum>(A)</enum><text>the entities receiving the financial assistance involved shall, collectively, return the full amount of such assistance to the Treasury; and</text></subparagraph><subparagraph id="H18CCA66E537C4F71B107BE386752F259"><enum>(B)</enum><text>each entity receiving the financial assistance involved, including each entity that receives the assistance directly from the National Institutes of Health and each entity that receives the assistance indirectly, shall be ineligible to receive financial assistance from the National Institutes of Health for a period of—</text><clause id="HCA63C9FFCBA24EE0903CC9412DB0D950"><enum>(i)</enum><text>not less than 5 years; and</text></clause><clause id="H88293535B8D94506A103F853528B11F5"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of an entity that is determined by the Director of NIH to have failed the inspection for a violation described in paragraph (2), not less than 15 years. </text></clause></subparagraph></paragraph><paragraph id="H3C2A099E05E64B81BCA5ED45E5E73727"><enum>(2)</enum><header>Violations described</header><text>A violation referred to in paragraph (1)(B)(ii) is—</text><subparagraph id="HEE6844D2409444BBA7DC2321FBA719CD"><enum>(A)</enum><text>without regard to whether the conduct is knowing or not—</text><clause id="H645884D2CE1048AFA26DEF3E28F9113A"><enum>(i)</enum><text>denial of entry by the entity to inspectors;</text></clause><clause id="H812C218584AA43CC86961BD2BC97076F"><enum>(ii)</enum><text>maintaining incomplete or falsified research records;</text></clause><clause id="HCA69991849DD44DBB0AF623F0C13925C"><enum>(iii)</enum><text>damaging or destroying research records;</text></clause><clause id="HD17F3123BF6C4F999D5CFE1A1B15FAFE"><enum>(iv)</enum><text>withholding research records from inspectors; or</text></clause><clause id="HA4A08193994A4238904E3CFF6069AB54"><enum>(v)</enum><text>relocating research materials to alternate sites to avoid inspection; or</text></clause></subparagraph><subparagraph id="HB976039C72534EB593FE8F00955F6CD9"><enum>(B)</enum><text>any action taken knowingly to prevent a full and complete inspection.</text></subparagraph></paragraph><paragraph id="H357EB92EBE9E4D979318385A2B1C3034"><enum>(3)</enum><header>Relation to other penalties</header><text>The penalties specified in this subsection are in addition to any other penalties applicable to an act or omission causing an entity to fail an inspection under this section.</text></paragraph></subsection><subsection id="H7AD2CC235B5A4AA48DD53C297579EC7A"><enum>(e)</enum><header>Annual report to Congress</header><paragraph id="H55782AF9BC2A4ABE895A7FBA5B195B31"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than October 1, 2024, and annually thereafter, The Director of NIH shall submit an annual report on the implementation of this section to the following congressional committees:</text><subparagraph id="HC187A24574C048D28BA12DCFD2E95CA5"><enum>(A)</enum><text>The Committee on Homeland Security and Governmental Affairs of the Senate.</text></subparagraph><subparagraph id="H6EDFCE18CA7344178B09133261F4361D"><enum>(B)</enum><text>The Committee on Finance of the Senate.</text></subparagraph><subparagraph id="H9FEB2A9C9C274D9E966D218777CD897F"><enum>(C)</enum><text>The Select Committee on Intelligence of the Senate.</text></subparagraph><subparagraph id="HC4782FC2B9EF47A5AABEA4A6D6BEE8CD"><enum>(D)</enum><text>The Committee on Oversight and Reform of the House of Representatives.</text></subparagraph><subparagraph id="H16DC751639404E05B33232D580DF1280"><enum>(E)</enum><text>The Committee on Energy and Commerce of the House of Representatives.</text></subparagraph><subparagraph id="H367781260A1B4245B8428EF144526960"><enum>(F)</enum><text>The Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph><paragraph id="HBBAC7131C8C2447A9E7604B83EB2B991"><enum>(2)</enum><header>Contents</header><text>Each report under paragraph (1) shall, with respect to the period covered by the report, include—</text><subparagraph id="H70974AC194AA459CBE0F7470808DB077"><enum>(A)</enum><text>the full text of each proposal receiving financial assistance from the National Institutes of Health;</text></subparagraph><subparagraph id="HF8A9BFF04A63471BA1F37E4A0EBB789A"><enum>(B)</enum><text>data regarding whether research conducted using financial assistance from the National Institutes of Health is consistent with the substance of the corresponding proposal;</text></subparagraph><subparagraph id="H8595164963664A179ED528784325F604"><enum>(C)</enum><text display-inline="yes-display-inline">data regarding whether each site at which research is conducted using financial assistance from the National Institutes of Health, and the research itself, is in compliance with all applicable standards and requirements of the National Institutes of Health;</text></subparagraph><subparagraph id="HE03E91A0EC1E40308485C12C6200B015"><enum>(D)</enum><text display-inline="yes-display-inline">data regarding whether each entity receiving financial assistance from the National Institutes of Health keeps detailed and updated records of the research conducted;</text></subparagraph><subparagraph id="HEDC72D82740A44E9B03ECBE954EFED37"><enum>(E)</enum><text display-inline="yes-display-inline">a final assessment of whether each entity receiving financial assistance from the National Institutes of Health remains eligible to continue receiving such assistance; and</text></subparagraph><subparagraph id="H6F58E15CE03E4F248B4D15090B9EEE8A"><enum>(F)</enum><text>a plan for the National Institutes of Health to enforce the penalties under subsection (d) with respect to each entity fails an inspection under this section.</text></subparagraph></paragraph><paragraph id="HF8DF887D1C6F412F8DCBECE97CA6A342"><enum>(3)</enum><header>Publication</header><text>The Director of NIH shall post each report under paragraph (1) in its entirety on the public website of the National Institutes of Health.</text></paragraph></subsection><subsection id="HBE2D25FC90B340FB86447EE97D6FD057"><enum>(f)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section applies beginning on October 1, 2023, irrespective of whether the financial assistance involved is awarded before or after such date.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
