subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the national service laws to prioritize national service programs and projects that are directly related to the response to and recovery from the COVID–19 public health emergency, and for other purposes.</official-title></form><legis-body id="H1079CB3369C04ED683582FDF937D61E9" style="OLC"><section id="HB84CD9100F364F39AB44038256C71311" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cultivating Opportunity and Recovery from the Pandemic through Service Act</short-title></quote> or the <quote><short-title>CORPS Act</short-title></quote>.</text></section><section id="HCA16FD9322DE474089A391DB0070F937"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H76200A09CD1A44EF9E907F77B9017432"><enum>(1)</enum><text>The United States has a strong history of citizen response to national calls to service in order to help the Nation recover in times of crisis.</text></paragraph><paragraph id="HAAA13FB1FCC344558F774AA7971B9A68"><enum>(2)</enum><text>More than 80 years ago, the Nation rose to the challenge of the Great Depression with the creation of citizen service programs.</text></paragraph><paragraph id="H6FC18C2EFBFF48298562902FC50E339B"><enum>(3)</enum><text>Millions of participants benefitted from paid employment and opportunities to develop their skills while constructing national parks and public lands infrastructure and producing cultural works still enjoyed today.</text></paragraph><paragraph id="H3A398CB366C84682BE205D57ED8E1E43"><enum>(4)</enum><text display-inline="yes-display-inline">Founded in 1990, the Corporation for National and Community Service today coordinates national service by individuals in the United States across every State and territory, partnering with State-level commissions and supporting locally driven services in partnership with nongovernmental organizations and State governments.</text></paragraph><paragraph id="H0AD9AB196C3A419EA8B15FF4DAAA124B"><enum>(5)</enum><text>National service programs provide public health, education, employment training, and nutrition services for which the Nation has a critical need in the current crisis.</text></paragraph><paragraph id="H9FE155C90BD94FB79C1FBFDE48E72B07"><enum>(6)</enum><text>The signature programs of the Corporation for National and Community Service, which are the AmeriCorps State and National, AmeriCorps National Civilian Community Corps, AmeriCorps Volunteers in Service to America (referred to in this Act as <quote>VISTA</quote>), and National Senior Service Corps programs, can and should be expanded to meet current needs.</text></paragraph><paragraph id="H8F4F652A3753427BBC2E95C77BA253CA"><enum>(7)</enum><text>The novel coronavirus pandemic has infected and killed individuals in every State and territory, causing more than 31,000,000 cases and 560,000 deaths so far.</text></paragraph><paragraph id="H23A9FD1E3ABB42938CCA1158666D840E"><enum>(8)</enum><text>In response, States, Tribal governments, and cities across the country have closed down businesses, schools, and public events, leading to dramatic swings in the economy.</text></paragraph><paragraph id="H747E86AA37E84D12AA3041D4AFBE807E"><enum>(9)</enum><text>Millions of people in the United States have filed for unemployment benefits since the start of the pandemic, with unemployment rates peaking at an unprecedented level.</text></paragraph><paragraph id="HC456FC84FC14459486B286C424C0BE7C"><enum>(10)</enum><text>More than 1 in every 10 adults in the United States has applied for unemployment insurance since the crisis began.</text></paragraph><paragraph id="H895DBCA86C0A469E8B7F064541059317"><enum>(11)</enum><text>The pandemic and the associated economic consequences have disproportionately impacted people of color across many States.</text></paragraph><paragraph id="H73E412814D12490395ABDE477FA7C7B1"><enum>(12)</enum><text>To recover, the Nation needs meaningful employment opportunities, as well as a significant expansion of the human capital working to address community needs around public health, behavioral health, hunger, education, and conservation.</text></paragraph><paragraph id="HC6C2A17233224C4BB6D4FEF97F3ACEB9"><enum>(13)</enum><text>Experience has demonstrated the centrality of community participation in pandemic response, to overcome stigma and structural barriers and meet the full needs of all members of a diverse community.</text></paragraph><paragraph id="HD673DFE15E024ACCA8FF981C5E820087"><enum>(14)</enum><text>As the Nation works to respond to and recover from the current twin challenges of a public health pandemic and an economic crisis, national service presents a unique opportunity for flexible, locally driven responses to meet State and local employment and recovery needs.</text></paragraph></section><section id="H442BF12414064066BDBCBC05664EE153"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="H213E03B659CE4F4A8904F90E697C2A48"><enum>(1)</enum><text>to provide for annual growth in the number of participants, over 3 years, in national service programs that will provide services in response to the pandemic and economic crisis;</text></paragraph><paragraph id="HB562ABA3EACA4CD9822E36BCFE4FA388"><enum>(2)</enum><text>to ensure that participant allowances cover the reasonable cost of participation and provide participants with economic and educational opportunity;</text></paragraph><paragraph id="H639068FFB7B048199087520D622FF6D0"><enum>(3)</enum><text>to stabilize such national service programs during economic crisis, including by supporting adaptations to service models in light of the crisis; and</text></paragraph><paragraph id="H362BFF8642BB46079D25974EFB0D049F"><enum>(4)</enum><text>to support opportunities for all individuals in the United States to engage in service, including through the recruitment of increasingly diverse and representative participants.</text></paragraph></section><section id="HDA082E6C255E4F9C9B692853D6BE6CD1"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HAFCF2F87DCF543FA8643B65EAF185779"><enum>(1)</enum><header>National and Community Service Act definitions</header><text>The terms <term>approved national service position</term>, <term>Corporation</term>, <term>disadvantaged youth</term>, <term>national service laws</term>, <term>participant</term>, <term>service sponsor</term>, and <term>State Commission</term> have the meanings given such terms in section 101 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12511">42 U.S.C. 12511</external-xref>).</text></paragraph><paragraph id="H9055DF390FB3448D9F68EC41A0F49580"><enum>(2)</enum><header>COVID–19 emergency recovery period</header><text>The term <term>COVID–19 emergency recovery period</term> means the period beginning on the date of enactment of this Act and ending at the end of fiscal year 2024.</text></paragraph><paragraph id="HB9F30A526987485E925FE72219826385"><enum>(3)</enum><header>High-poverty area</header><text>The term <term>high-poverty area</term> means a census tract defined as high-poverty by the Bureau of the Census.</text></paragraph></section><section id="H771F4900120943909B5E31E95FE0FDEF"><enum>5.</enum><header>Economic equity and opportunity</header><subsection id="H8D8BF66B577041B292E34C796AA2220B"><enum>(a)</enum><header>Living allowance</header><paragraph id="HF52C72F2E6234F85887637A1CBA85F4D"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 105(b) of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4955">42 U.S.C. 4955(b)</external-xref>) and section 140 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12594">42 U.S.C. 12594</external-xref>), during the COVID–19 emergency recovery period, the minimum subsistence or living allowance for an individual under section 105 of the Domestic Volunteer Service Act of 1973 and section 140 of the National and Community Service Act of 1990 shall, subject to paragraph (3), be an amount equal to 175 percent of the poverty line (as defined in section 673(2) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>)) for a single individual as expected for each fiscal year.</text></paragraph><paragraph id="HBBB72D0A64BD4C248621D01D598A3668"><enum>(2)</enum><header>Grants for living allowance increases</header><text>Notwithstanding the limits described in subsections (a) and (e) of section 189 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12645c">42 U.S.C. 12645c</external-xref>) or any other limitation imposed by the Corporation, during the COVID–19 emergency recovery period, the Corporation shall, for purposes of paragraph (1), award supplemental grant funds to entities operating a program receiving grant funds under the national service laws (referred to in this paragraph as <quote>grantees</quote>), including continuing grantees, to—</text><subparagraph id="H0187A1540590442CB3F57612729ADC7F"><enum>(A)</enum><text>increase the minimum subsistence or living allowance provided under section 105(b) of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4955">42 U.S.C. 4955(b)</external-xref>) or section 140 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12594">42 U.S.C. 12594</external-xref>); and </text></subparagraph><subparagraph id="HE6F64900D71F4D9ABBCC03CBD241F500"><enum>(B)</enum><text>cover additional costs associated with the increase to the minimum subsistence or living allowance required under paragraph (1). </text></subparagraph></paragraph><paragraph id="H612F94E9DF5A4EEF9A18D37280199AD3"><enum>(3)</enum><header>Limitation</header><subparagraph id="H2DCC6850797B45CABE529036E62411DE"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), a stipend or allowance under section 105 of the Domestic and Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4955">42 U.S.C. 4955</external-xref>) or an allowance under section 140 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12594">42 U.S.C. 12594</external-xref>) shall not be increased by this Act unless the funds appropriated for carrying out part A of the Domestic and Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4951">42 U.S.C. 4951 et seq.</external-xref>) or subtitle C of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12571">42 U.S.C. 12571 et seq.</external-xref>), respectively, are sufficient to maintain, for the fiscal year involved, a number of participants to serve under that part A or that subtitle C, respectively, that is at least equal to the number of such participants so serving during the fiscal year preceding such fiscal year involved. </text></subparagraph><subparagraph id="HB382B0B200394C69A448837BD47C611A" commented="no"><enum>(B)</enum><header>Adjustment for insufficient appropriations</header><text>In the event that sufficient appropriations for any fiscal year are not available to increase any stipend or allowance under section 105 of the Domestic and Volunteer Service Act of 1973 or allowance under section 140 of the National and Community Service Act of 1990 to the minimum amount specified under paragraph (1), the Corporation shall increase the stipend or allowance involved to such amount as appropriations for such year permit consistent with subparagraph (A). </text></subparagraph></paragraph></subsection><subsection id="H1A71B6FC8B3F40FC8EB9626F37DE7DEF"><enum>(b)</enum><header>Concurrent COVID–19 educational award</header><paragraph id="H531FD4AD27824CE1B84E929E9F4AE18C"><enum>(1)</enum><header>In general</header><text>The Corporation shall award to any individual who successfully completes a term of service resulting in an educational award under section 147 of the National and Community Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12603">42 U.S.C. 12603</external-xref>), with any part of such term of service occurring within the COVID–19 emergency recovery period, a concurrent COVID–19 educational award for an amount described under paragraph (2). </text></paragraph><paragraph id="H0248FC45BD9F4B44AFCA8B98E723332E"><enum>(2)</enum><header>Amount of award</header><text>The concurrent COVID–19 educational award awarded under this subsection shall be in an amount which bears the same proportion to the full amount of the education award the individual received under section 147 of such Act as the length of time of the term of service of such individual that occurs within the COVID–19 emergency recovery period bears to the total length of time of the term of service of such individual.</text></paragraph></subsection><subsection id="H093B3810B457489D9562BBC3212B2818"><enum>(c)</enum><header>National Senior Service Corps</header><text>Notwithstanding section 201, subsections (d) and (e) of section 211, and section 213(a) of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/5001">42 U.S.C. 5001</external-xref>, 5011, 5013(a)), to address the critical needs of local communities across the United States, during the COVID–19 pandemic emergency recovery period—</text><paragraph id="HCC8EC653460C45C5AB14356D6E63ECCF"><enum>(1)</enum><text>individuals age 45 or older may be enrolled as volunteers to provide services under part A of title II of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/5001">42 U.S.C. 5001</external-xref>); and </text></paragraph><paragraph id="H147F4A1002864FFB8098D5DA149BC0F9"><enum>(2)</enum><text>for purposes of parts B and C of title II of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/5002">42 U.S.C. 5002</external-xref>, 5003), the terms <quote>low-income person</quote> and <quote>person of low income</quote> mean a person whose income is not more than 400 percent of the poverty line defined in section 673(2) of the Community Services Block Grant (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>) and adjusted by the Director of the Retired and Senior Volunteer and Foster Grandparent programs in the manner described in such parts.</text></paragraph></subsection><subsection id="H232CC7EF4F434883A33FE62E3EFBFF02"><enum>(d)</enum><header>Tax provisions</header><paragraph id="HBBDB1EAD53FC4FFD90548A45F80156E3"><enum>(1)</enum><header>Income tax exclusion for living allowance</header><subparagraph id="H78EBF74F0D744D57B6A19C98693593D5"><enum>(A)</enum><header>In general</header><text>Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 139I the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC52F6877B5E24E4F9603C56607714D52"><section id="H038E495B0E284459838BBFF12D9A17D0"><enum>139J.</enum><header>Living allowance for national service participants</header><text display-inline="no-display-inline">Gross income does not include the amount of any living allowance provided under section 105(b) of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4955">42 U.S.C. 4955(b)</external-xref>) or section 140(a) or 158(b) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12594">42 U.S.C. 12594(a)</external-xref>, 12618(b)).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="H87C3407CD4934D53B33E938E53824A9E"><enum>(B)</enum><header>Clerical amendment</header><text>The table of sections for part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after the item relating to section 139I the following new item:</text><quoted-block style="OLC" id="HB084790AE46841E884F99E3E49A8469B"><toc><toc-entry level="section" idref="H038E495B0E284459838BBFF12D9A17D0">Sec. 139J. Living allowance for national service participants.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="H2A352DBD204341B0B58C418BB6FDD841" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Effective date</header><text>The amendments made by this paragraph shall apply to taxable years beginning after the date of the enactment of this Act.</text></subparagraph></paragraph><paragraph id="H896EE5119393464CA7F6E017E694380F"><enum>(2)</enum><header>Exclusion from gross income of national service educational awards</header><subparagraph id="H935B3C6CA3334C39BB2D323DBDAD1B01"><enum>(A)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/117">Section 117</external-xref> of the Internal Revenue Code of 1986 (relating to qualified scholarships) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE564DC8ED15A4BBBA9A1EB9120EDB87E"><subsection id="H88EF93B90D664EAE9E91DE89B0205CD0"><enum>(e)</enum><header>National service educational awards</header><text>Gross income shall not include any payments from the National Service Trust established under section 145 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12601">42 U.S.C. 12601</external-xref>), including the national service educational award described in subtitle D of title I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12601">42 U.S.C. 12601 et seq.</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="H714CE398B1B14CAA8C9025386452C40D"><enum>(B)</enum><header>Exclusion of discharge of student loan debt</header><text>Subsection (f) of section 108 of such Code is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H25BE84485834469AA4C32672DF529160"><paragraph id="HCAC1BA458EFC4DA1B75AF5E8AF485B63"><enum>(6)</enum><header>Payments under national service educational award programs</header><text>In the case of an individual, gross income shall not include any amount received as a national service educational award under subtitle D of title I of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12601">42 U.S.C. 12601 et seq.</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="HB0131A2931C14FB78C91F9CA1B269239"><enum>(C)</enum><header>Effective date</header><text>The amendments made by this paragraph shall apply to taxable years ending after the date of the enactment of this Act.</text></subparagraph></paragraph></subsection></section><section id="H40A0B304C20E443DB1E1449BED0FABD9"><enum>6.</enum><header>Supporting expansion</header><subsection id="H7D535B1046C24C428B9C478DA271764A"><enum>(a)</enum><header>Grants and pilot program</header><paragraph id="H1E5CA9C5BD164E7EA7B37092174643F0"><enum>(1)</enum><header>Priority</header><text display-inline="yes-display-inline">The Corporation, in awarding grants under paragraph (2), and State Commissions, in directly placing individuals in approved national service positions under paragraph (3), shall—</text><subparagraph id="H98CC9482D02046159154FB89195C9E76"><enum>(A)</enum><text>give priority to—</text><clause id="H63637969C8AF40BF80D87583C0CEE98A"><enum>(i)</enum><text>entities serving communities—</text><subclause id="H669D612D0C72414B8009C22B7C4B0146"><enum>(I)</enum><text>disproportionately impacted by COVID–19; </text></subclause><subclause id="H02BA3AC5BAE7422B87A8158A9755183B"><enum>(II)</enum><text>using culturally competent and multilingual strategies in the provision of services; and </text></subclause><subclause id="H12ACF4260861475BABF53D21DA526049"><enum>(III)</enum><text>with proposals for activities directly related to recovery from the COVID–19 public health emergency and the attendant economic and social consequences of such public health emergency, such as—</text><item id="H8DA5C9F69BC147A398A6F9850ACAF748"><enum>(aa)</enum><text>work that furthers the capacity of nonprofit and community-based organizations to respond to the immediate needs of individuals affected by COVID–19;</text></item><item id="H1CC2302D42424FD3A898F6644297B487"><enum>(bb)</enum><text>services that support economic opportunity;</text></item><item id="H815B82E2DA3F4A66B263FE4A66662956"><enum>(cc)</enum><text>educational activities, including enrichment and adult education and literacy activities;</text></item><item id="H9A21A5BEADB0454CA4C144EB7F774738"><enum>(dd)</enum><text>services to address housing and food insecurity; and</text></item><item id="H7B7E1F9B7BCC4C9BADDA0FEBE3E7F570"><enum>(ee)</enum><text>jobs for youth in preserving and restoring nature, including ensuring environmental resiliency; and</text></item></subclause></clause><clause id="HBF73D81825D74E6A83441BBE2F7B613F"><enum>(ii)</enum><text>community-based organizations located in rural or high-poverty areas, or community-based organizations that serve Tribal communities, with greater priority for community-based organizations that propose recruiting applicants for positions to serve in the same metropolitan or micropolitan statistical area or county as the area or county in which such applicants attended a secondary school or institution of higher education; and</text></clause></subparagraph><subparagraph id="HD775070C242B4341906D2019BBDE2D4D"><enum>(B)</enum><text>take into account the diversity of communities and participants served by entities seeking funding under this Act, including racial, ethnic, socioeconomic, linguistic, or geographic diversity. </text></subparagraph></paragraph><paragraph id="H38B9435101EB46E7BAD4E6BC0F297AF0"><enum>(2)</enum><header>Augmentation and expansion grants</header><text>Notwithstanding any other provision of law, during the COVID–19 emergency recovery period, the Corporation may award noncompetitive augmentation grants to meet the compelling needs of grantees or subgrantees and expansion grants under the national service laws, at such time and in such manner and from such funds as the Corporation determines appropriate.</text></paragraph><paragraph id="H488984E273474A3EB52F6D4E2B24F4DA"><enum>(3)</enum><header>Pilot program</header><subparagraph id="H79581DB98B514314A518AC73E551BCC1"><enum>(A)</enum><header>In general</header><clause id="H1549A6A52CEA4125A314D15B909F48C6"><enum>(i)</enum><header>Establishment</header><text>Notwithstanding section 178(h) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12638">42 U.S.C. 12638(h)</external-xref>), during the COVID–19 emergency recovery period, the Corporation shall implement a pilot program under section 121 and 122 of such Act allowing State Commissions to directly place individuals in approved national service positions. </text></clause><clause id="H9E203E59359040ADB3E1171D893EF934"><enum>(ii)</enum><header>Application and review process</header><text>Notwithstanding any other provision of law, the Corporation may establish the time, place, and manner of the application and review process for the pilot program established under this paragraph.</text></clause></subparagraph><subparagraph id="H696A5F2A21674CB38D46889B7D36C937"><enum>(B)</enum><header>Priorities</header><text>In addition to the priorities under paragraph (1), State Commissions participating in the pilot program shall, to the extent practicable, prioritize the placement of individuals in national service programs carried out by entities that have not previously been service sponsors for participants.</text></subparagraph><subparagraph id="H538B5C4101D04A03967D16A7169EA878"><enum>(C)</enum><header>Report</header><text>The Corporation shall prepare and submit a report to Congress at the end of the pilot program described in subparagraph (A), containing recommendations about whether and how to continue such a program of direct placements.</text></subparagraph></paragraph></subsection><subsection id="H5E6FFD9603A049E797DF39879F958D7D"><enum>(b)</enum><header>Flexibility during the COVID–19 emergency recovery period</header><paragraph id="HAFFC66D846664B6EB7389A0EDFCDC73B"><enum>(1)</enum><header>Match waiver</header><text>Notwithstanding any other provision of law, an entity (including a State Commission and an entity receiving subgrant funds) that receives assistance from the Corporation for any program under the national service laws, including under sections 5(a)(2) and 6(a)(2), during the COVID–19 emergency recovery period shall not be subject to any requirements to provide matching funds for any such program, and the Federal share of such assistance for a recipient (including for a State Commission and a subgrant recipient) may be 100 percent.</text></paragraph><paragraph id="H4BFE7FD4B74349D597288D06BDBF62A4"><enum>(2)</enum><header>Vista limitation applicability</header><text>Notwithstanding subsections (a) and (b) of section 108 of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4958">42 U.S.C. 4958</external-xref>), during the COVID–19 emergency recovery period, in order to address the needs of underserved communities related to the COVID–19 pandemic, of funds appropriated for the purposes of part A of title I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4951">42 U.S.C. 4951 et seq.</external-xref>) under section 501 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5081">42 U.S.C. 5081</external-xref>), not more than 75 percent may be obligated for the direct cost of supporting volunteers in programs and projects (including new programs and projects that begin after the date of enactment of this Act) carried out pursuant to part A of title I of such Act, and such funds may be obligated regardless of when grant recipients commenced such programs and projects.</text></paragraph><paragraph id="H3D96744078FD4C2194662BB2128859AD"><enum>(3)</enum><header>Seasonal program</header><text>Notwithstanding sections 152(b)(2) and 154 of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12612">42 U.S.C. 12612(b)(2)</external-xref>, 12614), during the COVID–19 emergency recovery period, members of the National Civilian Community Corps established under subtitle E of title I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12611">42 U.S.C. 12611 et seq.</external-xref>) may receive training and perform service in a seasonal national service program established under section 154 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12614">42 U.S.C. 12614</external-xref>) with service lasting for a period of not less than 3 months and not more than 6 months, as specified by the Director appointed pursuant to section 159(c)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12619">42 U.S.C. 12619(c)(1)</external-xref>).</text></paragraph><paragraph id="HD6A4D50D35CF46E5B68486B197F80E0B"><enum>(4)</enum><header>Increase in limitation on total grant amount for educational award only program during COVID–19 emergency recovery period</header><text>Notwithstanding the limit described in section 129A(b) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12581a">42 U.S.C. 12581a(b)</external-xref>), during the COVID–19 emergency recovery period, the Corporation may provide operational support under section 129A of such Act for a program in an amount that is not more than $1,600 per individual enrolled and serving in an approved national service position, or not more than $2,000 per such individual if at least 50 percent of the persons enrolled and serving in the program are disadvantaged youth.</text></paragraph><paragraph id="H796658FA0B274C5A883738B3D0BAD102"><enum>(5)</enum><header>No summer limitation</header><subparagraph id="H8B643CE7433A4B05B9B99D6F5D34C59D"><enum>(A)</enum><header>Enrollment</header><text>Notwithstanding any other provision of part A of title I of the Domestic Volunteer Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4951">42 U.S.C. 4951 et seq.</external-xref>), during the COVID–19 emergency recovery period, the Director of the VISTA program may enroll full-time VISTA associates in a program, during any months of the year, under such terms and conditions as such Director shall determine to be appropriate. Such individuals shall be assigned to projects that address the needs of underserved communities impacted by the COVID–19 public health emergency.</text></subparagraph><subparagraph id="HB6F275FE797546C8A2494118C43313BA"><enum>(B)</enum><header>Reports</header><text>In preparing reports relating to programs under the Domestic Volunteer Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4950">42 U.S.C. 4950 et seq.</external-xref>), the Director of the VISTA program shall report on participants, costs, and accomplishments under the program under this subsection separately.</text></subparagraph><subparagraph id="H57D0031C408B4D5292439AD7F66EDAB9"><enum>(C)</enum><header>Limitation</header><text>The limitation on funds appropriated for grants and contracts, as contained in section 108 of the Domestic Volunteer Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4958">42 U.S.C. 4958</external-xref>), shall not apply to the program under this subsection.</text></subparagraph></paragraph></subsection><subsection id="H5269287A418140638125EF61BFC76CC3"><enum>(c)</enum><header>Report</header><text>Not later than 90 days after the enactment of this Act, the Chief Executive Officer of the Corporation for National and Community Service shall prepare and submit a report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Labor of the House of Representatives containing recommendations on—</text><paragraph id="H8BB38096B21748B0AED13209FDBB4202"><enum>(1)</enum><text>how to improve grant programs related to the national service laws, including those under subtitle C of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12571">42 U.S.C. 12571 et seq.</external-xref>), such as any recommended changes to—</text><subparagraph id="H8270D2D2FC984BD8B38256A05A93D411"><enum>(A)</enum><text>the requirements of section 121(e) such Act and section 2521.60 of title 45, Code of Federal Regulations (as in effect on the day before the date of enactment of this Act); and </text></subparagraph><subparagraph id="H966E49AFC63D4579A3EE050803CA6825"><enum>(B)</enum><text>the fixed-amount grants awarded under section 129(l) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12581">42 U.S.C. 12581(l)</external-xref>), including improvements to account for start-of-year costs and to ensure robust member benefits and the long-term strength and viability of such program;</text></subparagraph></paragraph><paragraph id="H830D636348A74E8F84A15C0F37258685"><enum>(2)</enum><text>whether a new unit within the Corporation for National and Community Service should be established to provide additional assistance or manage the enrollment process to ensure compliance with sections 189D and 199I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12645g">42 U.S.C. 12645g</external-xref>; 12655i) for incoming participants in national service programs, particularly new national service programs receiving program assistance for the first time; and </text></paragraph><paragraph id="H23481EBD976D4272BF8E22BDD2651DE0"><enum>(3)</enum><text>actions to maximize flexibility for State Commissions that would strengthen the work of State Commissions and their grantees. </text></paragraph></subsection></section><section id="H5B807D7E36E7410386FB300689002E52"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">In addition to any amounts appropriated to carry out activities or programs under the national service laws (including under the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>)), there is authorized to be appropriated to carry out this Act $8,000,000,000 for fiscal year 2021, which shall remain available to be expended through fiscal year 2024. </text></section></legis-body></bill>
