which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Omnibus Crime Control and Safe Streets Act of 1968 to impose certain additional requirements on applicants for COPS grants, and for other purposes.</official-title></form><legis-body id="H7B0C87DFE28C47A09DDA5597B17D419D" style="OLC"><section id="H886DD3FBE75A4414B030F745A140C8C0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Corey Jones Act</short-title></quote>.</text></section><section id="HF222F09ACC444B8DB967497E3D8096AF"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H3EC9139256C94150912EE55C8F47F435"><enum>(1)</enum><text display-inline="yes-display-inline">Corey Jones of Lake Worth, Florida, was shot and killed by a plainclothes law enforcement officer operating an unmarked vehicle on October 18, 2015.</text></paragraph><paragraph id="H2B3D00A55242471FB0ED15413E861B6A"><enum>(2)</enum><text>Mr. Jones was legally and peacefully pulled to the side of the road while he awaited roadside assistance at approximately 3 a.m. in the morning because his car had broken down.</text></paragraph><paragraph id="H6DB38CB60B5943059A4F976A65DB52AB"><enum>(3)</enum><text>While Mr. Jones awaited roadside assistance, he was approached by a law enforcement officer driving an unmarked van and dressed in plainclothes.</text></paragraph><paragraph id="H6A1B41ED21C144BF971365F9BBB5EDCA"><enum>(4)</enum><text>Mr. Jones would not have had any reasonable reason to believe that the person in plainclothes driving the unmarked vehicle was a law enforcement officer.</text></paragraph><paragraph id="H8505F683D0334BBF83EEBAF13442FB15"><enum>(5)</enum><text>Any confusion as to the nature of the law enforcement officer’s interaction with Mr. Jones could likely have been avoided had a uniformed officer in a marked vehicle been called to the scene.</text></paragraph><paragraph id="H3672AA469C7541CC9EB8A48403787C29"><enum>(6)</enum><text>Tragic incidents like the death of Mr. Jones can easily be avoided by prohibiting law enforcement officers in plainclothes or law enforcement officers in plainclothes and unmarked vehicles from engaging in routine traffic stops.</text></paragraph></section><section id="H14C66FA3F9C742958FA3B60D0994FA47"><enum>3.</enum><header>Ensuring the safety of the public and law enforcement officers during routine traffic stops involving unmarked vehicles and plainclothes officers</header><subsection id="H50E02E59303D419AB73B4ACA042A38F3"><enum>(a)</enum><header>Certification required</header><text display-inline="yes-display-inline">Section 1702 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd-1">42 U.S.C. 3796dd–1</external-xref>) is amended—</text><paragraph id="H24693CE5674343FFACE3A302DA045490"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="H1FADF15A18A844CDB7A885A5FFDDC0AD"><enum>(A)</enum><text>in paragraph (10), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H9E9C4C12DC414F8A96A846881C6B0D44"><enum>(B)</enum><text>in paragraph (11), by striking the period and inserting <quote>; and</quote> at the end; and</text></subparagraph><subparagraph id="H09B6ACE58332480AAE24453870F07255"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1AC52D294FBA43B092D209A0F7A190BA" style="OLC"><paragraph id="H95A1A1EC53B44AC4BB1B01C8C4FCA45F"><enum>(12)</enum><text display-inline="yes-display-inline">certify that no law enforcement agency that will receive grant funds from the applicant allows law enforcement officers to engage in routine traffic stops while in plainclothes or while in plainclothes and in a police vehicle that is unmarked or that otherwise is not clearly identified as a police vehicle.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3E89C76E425D460CAA215D4A1E3AE715"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="H6F8A2B6A245E4A51B56EF8F10726D5E5"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting after <quote>1 or more of the requirements of subsection (c)</quote> the following <quote>(other than paragraph (12)</quote>;</text></subparagraph><subparagraph id="HBF311514EFC24437AAD511F4C24A3881"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting after <quote>1 or more of the requirements of subsection (c)</quote> the following <quote>(other than paragraph (12)</quote>; and</text></subparagraph><subparagraph id="H5788BDA7FF014555825643722A584AAF"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7F866096A25247EEA6F5A9FA686627A4" style="OLC"><paragraph id="HBEACF6B59ECB472E8D7C05EF8A0EA933"><enum>(3)</enum><header>No waiver of plainclothes certification</header><text display-inline="yes-display-inline">The Attorney General may not waive the requirement under subsection (c)(12).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HEBB7B8D940844E24B2ADD01AC561AE14"><enum>(b)</enum><header>Civil action</header><text display-inline="yes-display-inline">If the Attorney General determines, as a result of the reviews required by section 1705 of the Omnibus Crime Control and Safe Streets Act of 1968, that a law enforcement officer has engaged in conduct that violates a certification under section 1702(c)(12) of such Act applicable to that law enforcement officer, and such conduct has resulted in serious injury or death to any person, that person may bring a civil action against that law enforcement officer and any grantee under part Q of title I of such Act that is a grantee that is a State, unit of local government, Indian tribal government, or other entity with direct authority over that law enforcement officer.</text></subsection><subsection id="HD591B935D72B4183B23D58200312B134"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Attorney General of the United States shall submit to Congress a report that includes data relating to the number and nature of incidences where a law enforcement officer dressed in plainclothes or dressed in plainclothes and operating an unmarked vehicle, engaged in a routine traffic stop that resulted in injury or death.</text></subsection></section></legis-body></bill>
