which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 to require that supplemental nutrition assistance program benefits be calculated using the value of the low-cost food plan, and for other purposes.</official-title></form><legis-body id="H0B37EE77217A423EA14DC014189F4ABD" style="OLC"><section id="HFE8E2EB7895F4558B30310422F5EE2CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Closing the Meal Gap Act of 2021</short-title></quote>.</text></section><section id="HFE0D66C3783E4860B6066A0AA2434443"><enum>2.</enum><header>Calculation of program benefits using low-cost food plan</header><subsection id="HD02E768EB53D4ADB87783AA9BE61CDC1"><enum>(a)</enum><header>Definition of low-Cost food plan</header><text display-inline="yes-display-inline">Section 3 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>) is amended—</text><paragraph id="HB5DE1146D6ED458F95511C4FD0F68BFC"><enum>(1)</enum><text>by striking subsection (u);</text></paragraph><paragraph id="H366906C635964886AFE2FB8CD658BD0C"><enum>(2)</enum><text>by redesignating subsections (n) through (t) as subsections (o) through (u), respectively; and</text></paragraph><paragraph id="H70974A56B40545DF92CC5872FC804F9C"><enum>(3)</enum><text>by inserting after subsection (m) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB551FE25837E46EF9E89A2CF8A24F1EB"><subsection id="H953261D498CB42A98FCC2EBAE477616F"><enum>(n)</enum><header>Low-Cost food plan</header><paragraph id="HF75F9616211241E8AF6A7688DD635479"><enum>(1)</enum><header>In general</header><text>The term <term>low-cost food plan</term> means the diet, determined in accordance with the calculations of the Secretary, required to feed a 4-person family that consists of—</text><subparagraph id="H60AF129C10694223B1986CBCE9369BED"><enum>(A)</enum><text>a man and a woman who are each between 19 and 50 years of age;</text></subparagraph><subparagraph id="H8FFDF4B462A34A8091339236C46A6674"><enum>(B)</enum><text>a child who is between 6 and 8 years of age; and </text></subparagraph><subparagraph id="HEED5F0C01CBD404BAE4828CC15DC1705"><enum>(C)</enum><text>a child who is between 9 and 11 years of age.</text></subparagraph></paragraph><paragraph id="H26E4F2FF5D7744F7B457D125537E77BF"><enum>(2)</enum><header>Re-evaluation</header><text>Not later than January 1, 2027, and at 5-year intervals thereafter, the Secretary shall re-evaluate and publish the market baskets of the low-cost food plan based on current food prices, food composition data, consumption patterns, and dietary guidance.</text></paragraph><paragraph id="HFB35DADF876C4A2A934325AE47DB03D4"><enum>(3)</enum><header>Cost</header><text>For purposes of paragraph (1), the cost of the diet described in that paragraph shall be the basis for uniform allotments for all households regardless of the actual composition of the household, except that the Secretary shall—</text><subparagraph id="H178ACA144C7641B7909E3F77889F8BEB"><enum>(A)</enum><text>make household-size adjustments (based on the unrounded cost of that diet) taking into account economies of scale;</text></subparagraph><subparagraph id="H53FA1F56488A4646898F3D2024E03B2C"><enum>(B)</enum><text>make cost adjustments in the low-cost food plan for the State of Hawaii and the urban and rural parts of the State of Alaska to reflect the cost of food in Hawaii and urban and rural Alaska, respectively;</text></subparagraph><subparagraph id="HF69F0A307934416CAB4560C3A9220DF1"><enum>(C)</enum><text>make cost adjustments in the separate low-cost food plans for Guam, the Commonwealth of Puerto Rico, American Samoa, the Commonwealth of the Northern Mariana Islands, and the United States Virgin Islands, to reflect the cost of food in those territories, but not to exceed the cost of food in the 50 States and the District of Columbia; and</text></subparagraph><subparagraph id="H5066D34020E14B3B8167FBA2251AC89D"><enum>(D)</enum><text>on October 1, 2021, and each October 1 thereafter, adjust the cost of the diet to reflect the cost of the diet in the immediately preceding June, and round the result to the nearest lower-dollar increment for each household size.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H80192C717474415781B9976966C156EE"><enum>(b)</enum><header>Value of allotment</header><text>Section 8(a) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2017">7 U.S.C. 2017(a)</external-xref>) is amended—</text><paragraph id="HF58CC58F73F842E593A168596F0E43DC"><enum>(1)</enum><text>by striking <quote>thrifty food plan</quote> each place it appears and inserting <quote>low-cost food plan</quote>; and</text></paragraph><paragraph id="HB4C3717B052C4FDA84FB1D39FF47592E"><enum>(2)</enum><text>in the proviso, by striking <quote>8 percent</quote> and inserting <quote>10 percent</quote>.</text></paragraph></subsection><subsection id="HD29C4B6D487749D3BA20727CA45DDE75"><enum>(c)</enum><header>Quality control system</header><text>Section 16(c)(1)(A)(ii) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2025">7 U.S.C. 2025(c)(1)(A)(ii)</external-xref>) is amended—</text><paragraph id="H1BC22F14E00E4C55AAD1410F9546D1CD"><enum>(1)</enum><text>in subclause (I)—</text><subparagraph id="HD5A54104DDB3442993B936E6B3225C80"><enum>(A)</enum><text>by striking <quote>2014, at an amount not greater than $37</quote> and inserting <quote>2021, at an amount equal to not more than $50</quote>; and</text></subparagraph><subparagraph id="H83B1816343DF433989462B8301E22956"><enum>(B)</enum><text> by striking <quote>and</quote> at the end;</text></subparagraph></paragraph><paragraph id="H94C16D3777594295869D0E48B4002CCC"><enum>(2)</enum><text>in subclause (II)—</text><subparagraph id="H9361FA98A5944EA2871D4D5F1B09FA62"><enum>(A)</enum><text>by striking <quote>(II)</quote> and inserting <quote>(III)</quote>;</text></subparagraph><subparagraph id="H810A329A55C64074A39570D3398F6D60"><enum>(B)</enum><text>by striking <quote>thrifty food plan is adjusted under section 3(u)(4)</quote> and inserting <quote>low-cost food plan is adjusted under section 3(n)(2)(D)</quote>; and</text></subparagraph><subparagraph id="H1DCA210DE49E4805A4CDD90E88E8DC4D"><enum>(C)</enum><text>by striking <quote>2013</quote> and inserting <quote>2022</quote>; and</text></subparagraph></paragraph><paragraph id="H8D4B58563D1744BBBC4938468B58E070"><enum>(3)</enum><text display-inline="yes-display-inline"> by inserting after subclause (I) the following:</text><quoted-block style="OLC" id="H634C416DDDE64858A6BAA169D25D594D" display-inline="no-display-inline"><subclause id="HD1A65C03AD214E88B8561C7A1B8CB50E"><enum>(II)</enum><text display-inline="yes-display-inline">for fiscal year 2022, the amount specified in subclause (I) shall be adjusted by the difference between the thrifty food plan and the low-cost food plan; and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB01661963CA148ADA82C5C21F4589DBC" commented="no"><enum>(d)</enum><header>Conforming amendments</header><paragraph id="HBC769E77A288450288A2107CE5F7610E"><enum>(1)</enum><text>Section 10 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2019">7 U.S.C. 2019</external-xref>) is amended, in the first sentence, by striking <quote>3(o)(4)</quote> and inserting <quote>3(p)(4)</quote>. </text></paragraph><paragraph id="HCD4EF194D2584C9E9594195AB0AF9AEE"><enum>(2)</enum><text>Section 11 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020</external-xref>) is amended—</text><subparagraph id="H96C709A5302C4F2D96F6613B11C5CF16"><enum>(A)</enum><text>in subsection (a)(2), by striking <quote>3(s)(1)</quote> and inserting <quote>3(t)(1)</quote>;</text></subparagraph><subparagraph id="H36F0192E709F4BA0B43D812BEEA05FAA"><enum>(B)</enum><text>in subsection (d)—</text><clause id="HA5EF872CC95C433EA6C5C4DD6582971A"><enum>(i)</enum><text>by striking <quote>3(s)(1)</quote> each place it appears and inserting <quote>3(t)(1)</quote>;</text></clause><clause id="H897E5BAC306D41FFB1076A49F7327FCE"><enum>(ii)</enum><text>by striking <quote>3(s)(2)</quote> each place it appears and inserting <quote>3(t)(2)</quote>; and</text></clause><clause id="H7259DE8B0BBF46DEB77F61F800EF020F"><enum>(iii)</enum><text>by striking <quote>Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450">25 U.S.C. 450</external-xref>)</quote> and inserting <quote>and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3501">25 U.S.C. 3501 et seq.</external-xref>)</quote>; and </text></clause></subparagraph><subparagraph id="H434D7FB3EE654F769883EA4D5597EE18" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>in subsection (e)(17), by striking <quote>3(s)(1)</quote> and inserting <quote>3(t)(1)</quote>.</text></subparagraph></paragraph><paragraph id="H605B3AD8B33B460E98A1314A8F616098" commented="no"><enum>(3)</enum><text>Section 19(a)(2)(A)(ii) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2028">7 U.S.C. 2028(a)(2)(A)(ii)</external-xref>) is amended by striking <quote>thrifty food plan has been adjusted under section 3(u)(4)</quote> and inserting <quote>low-cost food plan has been adjusted under section 3(n)(2)(D)</quote>.</text></paragraph><paragraph id="HED4D55934DD449F79E83E545F565C551" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">Section 27(a)(2) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2036">7 U.S.C. 2036(a)(2)</external-xref>) is amended—</text><subparagraph id="H87089CE76B6441BFA1517266CBF96FDF"><enum>(A)</enum><text>in subparagraph (C) by striking <quote>2023</quote> and inserting <quote>2020</quote>;</text></subparagraph><subparagraph id="HBB46ABC7EE034562958D0F31148E9899"><enum>(B)</enum><text>in subparagraph (D)—</text><clause id="H982F611D24BE40CEB6491ADD9054E0D0"><enum>(i)</enum><text>by striking <quote>through 2023</quote> and inserting <quote>through 2020</quote>;</text></clause><clause id="H6F8F6BB0E1F648238724C7EB51B66652"><enum>(ii)</enum><text>in clause (vi) by adding <quote>and</quote> at the end;</text></clause><clause id="H7CDAABE13CDB41BE890973C8FE8EB76E"><enum>(iii)</enum><text display-inline="yes-display-inline">in clause(vii) by adding <quote>and</quote> at the end; and</text></clause><clause id="HC0AC628107EF4FA4BC7ACF163F595CDF"><enum>(iv)</enum><text>by striking clauses (viii) and (ix);</text></clause></subparagraph><subparagraph id="H92C4376B4E974A258325DCC95281C107"><enum>(C)</enum><text>in subparagraph (E)—</text><clause id="HAD001F3760D8482CB757E9AB83F005E8"><enum>(i)</enum><text>by striking <quote>2024 and each subsequent fiscal year</quote> and inserting <quote>2020</quote>;</text></clause><clause id="H230E3648159C48EE820A73D0423880EC"><enum>(ii)</enum><text>by striking <quote>2023</quote> and inserting <quote>2019</quote>; and</text></clause><clause id="H01286B2ADEEA4067ACABEF26222A10E1"><enum>(iii)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></clause></subparagraph><subparagraph id="H81F17AAE998A4AED839046243ABE1EFE"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HE02D000878CA4EFF95989B6E1F9E6844" display-inline="no-display-inline"><subparagraph id="H0170B5A8CD074A8CB399694439D16953"><enum>(F)</enum><text display-inline="yes-display-inline">for fiscal year 2021, the dollar amount of commodities specified in subparagraph (B) shall be adjusted by the difference between the cost of the thrifty food plan and the cost of low-cost food plan; and</text></subparagraph><subparagraph id="HF55153C81D5B42B487143458279041D8"><enum>(G)</enum><text>for each of the fiscal years 2022 through 2023, the dollar amount of commodities specified in subparagraph (B) shall be adjusted by the percentage by which the low-cost food plan has been adjusted under 3(n)(2)(D) between June 30, 2021, and June 30 of the immediately preceding fiscal year;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA921CF65BD1B4CFBBF093C2C067B74E7" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text>Section 408(a)(12)(B)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)(12)(B)(i)</external-xref>) is amended by striking <quote>(r)</quote> each place it appears.</text></paragraph></subsection></section><section id="H8575470A1E4D44718AFEF1E63A176535"><enum>3.</enum><header>Deductions from income</header><subsection id="H1D8476DA604A47DAA27F2AF34A789422"><enum>(a)</enum><header>Standard medical expense deduction</header><text display-inline="yes-display-inline">Section 5(e)(5) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(e)(5)</external-xref>) is amended—</text><paragraph id="H5DFF01D049BB41C2B42F4765F6D1DFFC"><enum>(1)</enum><text>in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">Excess medical</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Medical</header-in-text></quote>;</text></paragraph><paragraph id="H1FDA9D81B80A41D190BA8A837A6DED9C"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>an excess medical</quote> and all that follows through the period at the end and inserting <quote>a standard medical deduction or a medical expense deduction of actual costs for the allowable medical expenses incurred by the elderly or disabled member, exclusive of special diets.</quote>; </text></paragraph><paragraph id="H60E1F61A5D5547149D4FA3863193B81B"><enum>(3)</enum><text>in subparagraph (B)(i), by striking <quote>excess</quote>; and</text></paragraph><paragraph id="H0D7AF2E82E1C45E4AF82C47D89768E2A"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H51CA098A84C048638B142ED59A67013B"><subparagraph id="H4D70176D0E9B45E3A278B90EA6C3AA40"><enum>(D)</enum><header>Standard medical expense deduction amount</header><clause id="H2018F1A93295493C8519D9A6DA25F9D1"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the standard medical expense deduction shall be—</text><subclause id="H6574195DB7404DC1989C2A619A2C545A"><enum>(I)</enum><text>for fiscal year 2021, $140; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB97651CE6FF642CAAD0D244C52C18C35"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H695C984697294FF2BD4AE7D26EEEC5FF"><subsection id="H9AE37307F0FC48A1BB4BDA365D8E2CC9"><enum>(f)</enum><header>Transition of Puerto Rico, American Samoa, and the Northern Mariana Islands to supplemental nutrition assistance program</header><paragraph id="H59456B3C8D644392B581C221FD85C661"><enum>(1)</enum><header>Request for participation</header><text>A governmental entity may submit to the Secretary a request to participate in the supplemental nutrition assistance program, which shall include a plan of operation described in section 11(d), which shall include the date on which the governmental entity intends to begin participation in the program.</text></paragraph><paragraph id="HDEFF050FF38241949B62C694AFB1D213"><enum>(2)</enum><header>Certification by Secretary</header><subparagraph id="H3DBB73F376354DF1A853BF4E537B37E0"><enum>(A)</enum><header>In general</header><text>The Secretary shall certify a governmental entity that submits a request under paragraph (1) as qualified to participate in the supplemental nutrition assistance program if the Secretary—</text><clause id="H2BFB4D75B41D41DE9E6CFB0035BD7143"><enum>(i)</enum><text>approves the plan of operation submitted with the request, in accordance with this subsection; and</text></clause><clause id="H545019975BF64524B0FEE11478BB786E"><enum>(ii)</enum><text>approves the applications described in paragraph (4) in accordance with that paragraph.</text></clause></subparagraph><subparagraph id="H1D585018A4F8474CAC44AFDBF91FC87E"><enum>(B)</enum><header>Submission of certification to Congress</header><text>The Secretary shall submit each certification under subparagraph (A) to Congress.</text></subparagraph></paragraph><paragraph id="H57DE04B7FF474ADF8D3F638FBD27E8B9"><enum>(3)</enum><header>Determination of plan of operation</header><subparagraph id="H77CF133BDF064967A5971993ABC2529A"><enum>(A)</enum><header>Approval</header><text>The Secretary shall approve a plan of operation submitted with a request under paragraph (1) if the plan satisfies the requirements under this Act for a plan of operation.</text></subparagraph><subparagraph id="H5F35D372651D49A69733D6B32037476C"><enum>(B)</enum><header>Disapproval</header><text>If the Secretary does not approve a plan of operation submitted with a request under paragraph (1), the Secretary shall provide to the governmental entity a statement that describes each requirement under this Act that is not satisfied by the plan.</text></subparagraph></paragraph><paragraph id="HF1176EBEF37F4202BBA68BD3031BC19A"><enum>(4)</enum><header>Approval of retail food stores</header><subparagraph id="HBDD70E0DEEFF401CBBF9BF04AED8D25E"><enum>(A)</enum><header>Solicitation of applications</header><text>If the Secretary approves a plan of operation under paragraph (3)(A) for a governmental entity, the Secretary shall accept applications from retail food stores located in that governmental entity to be authorized under section 9 to participate in the supplemental nutrition assistance program. </text></subparagraph><subparagraph id="H5D7A6CDB98E44A1091B3991D8D66AF74"><enum>(B)</enum><header>Determination</header><text>The Secretary shall authorize a retail food store applying to participate in the supplemental nutrition assistance program under subparagraph (A) if the application satisfies the requirements under this Act for authorization of a retail food store.</text></subparagraph></paragraph><paragraph id="H8A0A30BFDCB34F42A699B48CBD18DF26"><enum>(5)</enum><header>Puerto Rico</header><text>In the case of a request under paragraph (1) by the Commonwealth of Puerto Rico, notwithstanding subsection (g), the Secretary shall allow the Commonwealth of Puerto Rico to continue to carry out under the supplemental nutrition assistance program the Family Market Program established pursuant to this section.</text></paragraph><paragraph id="H6A3B91A9D14D41AA9E7BE31F834BB48F"><enum>(6)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary to carry out this subsection such sums as are necessary for fiscal year 2021, to remain available until expended.</text></paragraph></subsection><subsection id="H89BCD6A3521A4D8CB870090AC279C797"><enum>(g)</enum><header>Termination of effectiveness</header><paragraph id="HA06D95FB69D147AC9F61959430B8C9E7"><enum>(1)</enum><header>In general</header><text>Subsections (a) through (e) shall cease to be effective with respect to the Commonwealth of Puerto Rico, American Samoa, and the Commonwealth of the Northern Mariana Islands, as applicable, on the date described in paragraph (2) if the Secretary submits to Congress a certification under subsection (f)(2)(B) for that governmental entity.</text></paragraph><paragraph id="HCF02C4F3CF2B4F928EEBBCEDB41ABA8D"><enum>(2)</enum><header>Date described</header><text>The date referred to in paragraph (1) is, with respect to the Commonwealth of Puerto Rico, American Samoa, and the Commonwealth of the Northern Mariana Islands, the date established by the Commonwealth of Puerto Rico, American Samoa, or the Commonwealth of the Northern Mariana Islands, respectively, in the applicable plan of operation submitted to the Secretary under subsection (f)(1)(A).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
