R. 4059</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210622">June 22, 2021</action-date><action-desc><sponsor name-id="N000026">Mr. Nehls</sponsor> (for himself and <cosponsor name-id="M001157">Mr. McCaul</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reimburse the States for border wall expenses, and for other purposes.</official-title></form><legis-body id="H8128DE4CBCB34F3D835CA8870914516A" style="OLC"><section id="H5A3FAFA19C7F498A982F269015004ED2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Wall Reimbursement Act of 2021</short-title></quote>.</text></section><section id="HE34B3ED200B94169B0B839607D34B897"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HDE5BE427E13D461DB428EEBCEA1D7E3D"><enum>(1)</enum><text>Border security is primarily a Federal responsibility.</text></paragraph><paragraph id="H61F87ACC53CE43C59E9DB340B9228E5B"><enum>(2)</enum><text display-inline="yes-display-inline">Texas has declared the on-going situation on its southern border a disaster and due to failures of the Federal Government the State of Texas has been forced to provide resources to secure the border.</text></paragraph><paragraph id="H58C13BBA71A8466EBB31E988EA4AC7B7"><enum>(3)</enum><text display-inline="yes-display-inline">Since 2014, Texas has spent approximately $3.5 billion to help secure the border and protect public safety. In June 2021, Texas obligated $250,000,000 to build a border security wall.</text></paragraph><paragraph id="H215D43C8841B41DDBE16C3E2F16020D7"><enum>(4)</enum><text display-inline="yes-display-inline">Citizens of Texas are being taxed twice for the same purpose.</text></paragraph><paragraph id="H0EC9179A014141F2BDC0A6A444881676"><enum>(5)</enum><text display-inline="yes-display-inline">The State of Texas is re-allocating critical State funding to meet public safety obligations which are clearly Federal responsibilities, to begin construction of a border security wall, imposes an undue burden on the State. </text></paragraph></section><section id="H430FC4A7092240BBA81B20D882459477"><enum>3.</enum><header>Reimbursement</header><subsection id="H428C2BB6AFD54CDBBDBD993365E711F6"><enum>(a)</enum><header>Qualification</header><text>Notwithstanding any other provision of law, any amounts the border States have expended on the construction of a border security wall in support of Federal efforts shall be reimbursed.</text></subsection><subsection id="H0DFEBCC36E034BDB9D8DCD9851EF345C"><enum>(b)</enum><header>Application</header><text>Not later than 180 days after the date of the enactment of this Act, to receive reimbursement pursuant to subsection (a), the Governor of the border State shall submit—</text><paragraph id="HB529906C29404C7081DF5AD6FF0C45A4"><enum>(1)</enum><text>an accounting of all non-federally funded border security wall expenses incurred by the State and its municipalities; and</text></paragraph><paragraph id="H9A7A5123F91A4002803D6EE253440AE3"><enum>(2)</enum><text>the total sum of such expenses.</text></paragraph></subsection><subsection id="HE9A511385C5E452496D3432DCEF9D7A9"><enum>(c)</enum><header>Reimbursement</header><text>Not later than one year after the date on which a State submits the application pursuant to subsection (b), the Federal Government shall reimburse the State for the amounts expended as described in subsection (a).</text></subsection><subsection id="HE43B5A7593984DF5A7E328CCF75A06BA"><enum>(d)</enum><header>Availability</header><text display-inline="yes-display-inline">Amounts made available by sections 602 and 603 of title VI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801 et seq.</external-xref>) for the Coronavirus State Fiscal Recovery Fund and the Coronavirus Local Fiscal Recovery Fund may also be made available to border States for the purposes described in subsection (a).</text></subsection></section></legis-body></bill>
