which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To improve the management of driftnet fishing.</official-title></form><legis-body id="H4477FDAD08814947A6AF3BA10913321E" style="OLC"><section id="H7E89168C727F4F71AEEE39AEE8353F30" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Driftnet Modernization and Bycatch Reduction Act of 2021</short-title></quote>.</text></section><section id="H8F6681B1BFEE404B8AE451F579117DD2"><enum>2.</enum><header>Definition</header><text display-inline="no-display-inline">Section 3(25) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802(25)</external-xref>) is amended by inserting <quote>, or with a mesh size of 14 inches or greater,</quote> after <quote>more</quote>.</text></section><section id="HB9C83D7B8E1D4CFDAABF3FF2B3BAFD6B"><enum>3.</enum><header>Findings and policy</header><subsection id="HF7CF30C395EE4F31865CCFDCE0C3AD5D"><enum>(a)</enum><header>Findings</header><text>Section 206(b) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826">16 U.S.C. 1826(b)</external-xref>) is amended—</text><paragraph id="H0255B88B09084FE993CAF9A0892D0402"><enum>(1)</enum><text>in paragraph (6), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H5C72B491C3964586AEFF2EB8C8244817"><enum>(2)</enum><text>in paragraph (7), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HF9FD6B2675CF442FBECF2BA66276AC0A"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1189C26E9A8B4E539926B373F3246A03" style="OLC"><paragraph id="HBDC79A0E73144559BE52F251000FC626"><enum>(8)</enum><text>within the exclusive economic zone, large-scale driftnet fishing that deploys nets with large mesh sizes causes significant entanglement and mortality of living marine resources, including myriad protected species, despite limitations on the lengths of such nets.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA1FEA3416C114C8E86A0229771217B7D"><enum>(b)</enum><header>Policy</header><text>Section 206(c) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826">16 U.S.C. 1826(c)</external-xref>) is amended—</text><paragraph id="HBE77FCEDDCCA434BBAB11E619ED53FA1"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HE519CA0C6FF7406694ACD2B1E11799CD"><enum>(2)</enum><text>in paragraph (3), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H9B226C746A11455186AB7B60BCE499AE"><enum>(3)</enum><text>by adding at the end the following—</text><quoted-block display-inline="no-display-inline" id="HDBD8597B73B74C898E87F65E3488BE56" style="OLC"><paragraph id="HA2E3AD4CE6464A189626C70E2FEE3401"><enum>(4)</enum><text>prioritize the phase out of large-scale driftnet fishing in the exclusive economic zone and promote the development and adoption of alternative fishing methods and gear types that minimize the incidental catch of living marine resources.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HB6C52D2E2C1B4AB7A32328D289F3B032"><enum>4.</enum><header>Transition program</header><text display-inline="no-display-inline">Section 206 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826">16 U.S.C. 1826</external-xref>) is amended—</text><paragraph id="H7F4606514E7C4399A07E854E28C8BB6C"><enum>(1)</enum><text>by redesignating subsection (h) as subsection (i); and</text></paragraph><paragraph id="H36CC83F5E5DE487EB85E14F69E5BF467"><enum>(2)</enum><text>by inserting after subsection (g) the following:</text><quoted-block display-inline="no-display-inline" id="H78E4E41D76714ACA993B1522693A957B" style="OLC"><subsection id="HAD1BC32538D14AEAAF9D9CF71D1FF622"><enum>(h)</enum><header>Fishing gear transition program</header><paragraph id="H437C8F9405A845AA840D1445441D10CE"><enum>(1)</enum><header>In general</header><text>During the 5-year period beginning on the date of enactment of the <short-title>Driftnet Modernization and Bycatch Reduction Act of 2021</short-title>, the Secretary shall conduct a transition program to facilitate the phase-out of large-scale driftnet fishing and adoption of alternative fishing practices that minimize the incidental catch of living marine resources, and shall award grants to eligible permit holders who participate in the program.</text></paragraph><paragraph id="H12CA2B355F884E05BECC8945BC499ACE"><enum>(2)</enum><header>Permissible uses</header><text>Any permit holder receiving a grant under paragraph (1) may use such funds only for the purpose of covering—</text><subparagraph id="HB30DE78516714255A65B8E9F7CB71003"><enum>(A)</enum><text>any fee originally associated with a permit authorizing participation in a large-scale driftnet fishery, if such permit is surrendered for permanent revocation, and such permit holder relinquishes any claim associated with the permit;</text></subparagraph><subparagraph id="HA13607848EA34EE194AED7C5EB1EDCBD"><enum>(B)</enum><text>a forfeiture of fishing gear associated with a permit described in subparagraph (A); or</text></subparagraph><subparagraph id="H1087EE53666D409099DBA673AA6F8587"><enum>(C)</enum><text>the purchase of alternative gear the use of which is likely to result in minimal incidental catch of living marine resources, if the fishery participant is authorized to continue fishing using such alternative gear.</text></subparagraph></paragraph><paragraph id="H28B038D9DA164334BE9DF9C2734C0F91"><enum>(3)</enum><header>Certification</header><text>The Secretary shall certify that, with respect to each participant in the program under this subsection, any permit authorizing participation in a large-scale driftnet fishery has been permanently revoked and that no new permits will be issued to authorize such fishing.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H84D1E653A0EB45FF93754E93448E1AEE"><enum>5.</enum><header>Exception</header><text display-inline="no-display-inline">Section 307(1)(M) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1857">16 U.S.C. 1857(1)(M)</external-xref>) is amended by inserting before the semicolon the following: “, unless such large-scale driftnet fishing—</text><quoted-block display-inline="no-display-inline" id="HE0C139C4272747D3AB1CE403FA1AC1F8" style="OLC"><clause id="H7007EAA6A41044F2A49099A336E9FB01"><enum>(i)</enum><text>deploys, within the exclusive economic zone, a net with a total length of less than two and one-half kilometers and a mesh size of 14 inches or greater; and</text></clause><clause id="H209A36C3482440BC94A8B9699B10C424"><enum>(ii)</enum><text>is conducted within 5 years of the date of enactment of the <short-title>Driftnet Modernization and Bycatch Reduction Act of 2021</short-title></text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
