which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Help America Vote Act of 2002 to require State and local election officials to notify the chief State election official of a State with respect to the number of voted ballots that have been received and counted in an election for Federal office at the time of the closing of polls for such election, and for other purposes.</official-title></form><legis-body id="H20F7658173FB4B16A1645B695CE68ED4" style="OLC"><section id="H8E369A907AF14EBCB12A9BFC64BCF26F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vote Outcome Transparency in Elections Act</short-title></quote> or the <quote><short-title>VOTE Act</short-title></quote>. </text></section><section id="H0ECA25F290D946E8A910684D05F1FC87" section-type="subsequent-section"><enum>2.</enum><header>Ballot count reporting requirement</header><subsection id="H04C6036BBCBE4188B65F00B174A6E1F4" commented="no"><enum>(a)</enum><header>In general</header><text>Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081 et seq.</external-xref>) is amended—</text><paragraph id="HEE36FB7F935B468E9BEA60E767E0EE66" commented="no"><enum>(1)</enum><text>by redesignating sections 304 and 305 as sections 305 and 306; and</text></paragraph><paragraph id="HF68206562C464BC89B9895FA9DB05695" commented="no"><enum>(2)</enum><text>by inserting after section 303 the following new section:</text><quoted-block id="H13DD294C9E5644D7BB6F9A9AA3D02BEA"><section id="HE6399F8612064CF8A054DB076A3CF1D8" commented="no"><enum>304.</enum><header>Reporting requirements with respect to number of ballots</header><subsection id="H2C2E9DD997B644F58623F9F08AE6C028"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 hour after a polling place in a State closes in an election for Federal office on the date of such election, the appropriate State or local election official for such polling place shall provide to the chief State election official of the State a report that documents, as of such time—</text><paragraph id="HD394EBD5C18748F5893A983016E52AD4"><enum>(1)</enum><text>the total number of voted ballots in the possession of State and local election officials for the election; and</text></paragraph><paragraph id="H5701BA4C58A44E97A64215C0E0F3BA4D"><enum>(2)</enum><text>the total number of voted ballots that have been tabulated for such election.</text></paragraph></subsection><subsection id="HCFB87F22C69C4D10B90938973EF60351"><enum>(b)</enum><header>Additional reporting requirements</header><paragraph id="H1730BB315AF14C6181207E6917DF36AD"><enum>(1)</enum><header>Submission to chief executive</header><text>Not later than 1 hour after the latest time that all polling places in a State close in an election for Federal office on the date of such election, the chief State election official of the State shall prepare and submit to the chief executive of the State a final report that documents the results of each report received under subsection (a).</text></paragraph><paragraph id="H0C5F553C803743CE92BA790935534A01"><enum>(2)</enum><header>Public availability of final report</header><text>Not later than 1 hour after the final report is received under paragraph (1), the chief executive of the State shall make the results of the report publicly available on a Government website.</text></paragraph></subsection><subsection id="HBF585B3EF72D42F8B6927FF8AE15DB9F"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">This requirement shall apply with respect to the regularly scheduled general election for Federal office held in November 2022 and each succeeding election for Federal office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H33A0E8C57E294338ADB0022336F8FEAB" display-inline="no-display-inline"><enum>(b)</enum><header>Conforming amendment relating to enforcement</header><text display-inline="yes-display-inline">Section 401 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21111">52 U.S.C. 21111</external-xref>) is amended by striking <quote>and 303</quote> and inserting <quote>303, and 304</quote>.</text></subsection><subsection display-inline="no-display-inline" id="HC5D13A623EA545E2AEE8EEB183049E2C"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended—</text><paragraph id="H766BD62D2A154D008D6EC1E890AD8FB2"><enum>(1)</enum><text>by redesignating the items relating to sections 304 and 305 as relating to sections 305 and 306; and</text></paragraph><paragraph id="H2A3047C738044516B01D837BAAC08150"><enum>(2)</enum><text>by inserting after the item relating to section 303 the following new item:</text><quoted-block display-inline="no-display-inline" id="HEA20A9129E754F6AA4B257BF26D1E210" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 304. Reporting requirements with respect to number of ballots. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HED7B10C2775C484F81B18A4D54B73405" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Requirements for ballots delivered by mail</header><subsection id="H844BCB10BD21461A82BD00BDDF5CB641"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081 et seq.</external-xref>), as amended by <internal-xref idref="H20F7658173FB4B16A1645B695CE68ED4" legis-path="1.(a)">section 2(a)</internal-xref>, is amended—</text><paragraph id="HDCC867632DC1488CB20C110E61954FBA"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating sections 305 and 306 as sections 306 and 307; and</text></paragraph><paragraph id="HD345D88CFDA74AE9ACD1F1A3A4DCC504"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 304 the following new section:</text><quoted-block style="OLC" id="H6704221CC5A44B6187D280BBF50841DB" display-inline="no-display-inline"><section id="HEAA05E49BAED47D8A3EF41A67F0D6DE7"><enum>305.</enum><header>Requirements with respect to a ballot delivered by mail</header><subsection id="HAAFB3E1AD04741749633C8A710586305"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each State and local jurisdiction shall have in place policies to ensure that a voted ballot delivered by postal mail to the appropriate election official in an election for Federal office can be verified to have been delivered by the United States Postal Service by means of an appropriate postmark, signature, or other indication from the United States Postal Service.</text></subsection><subsection id="H31155169D5504C7D8F4075F59659CA00"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">This section shall not apply with respect to the ballot of an absent uniformed services voter or an overseas voter (as such terms are defined in section 107 of the Uniformed and Overseas Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/52/20310">52 U.S.C. 20310</external-xref>)).</text></subsection><subsection id="HA45D3BAB9E974C7F9637C9D553B3A576"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">This requirement shall apply with respect to the regularly scheduled general election for Federal office held in November 2022 and each succeeding election for Federal office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H118F9869A82342A1B3AFC478D5CB59E9" display-inline="no-display-inline"><enum>(b)</enum><header>Conforming amendment relating to enforcement</header><text display-inline="yes-display-inline">Section 401 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21111">52 U.S.C. 21111</external-xref>), as amended by <internal-xref idref="H20F7658173FB4B16A1645B695CE68ED4" legis-path="1.(b)">section 2(b)</internal-xref>, is amended by striking <quote>303, and 304</quote> and inserting <quote>303, 304, and 305</quote>.</text></subsection><subsection display-inline="no-display-inline" id="HE66207F0B46E486E8DF5EE9A3CC7E567"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents of such Act, as amended by <internal-xref idref="H20F7658173FB4B16A1645B695CE68ED4" legis-path="1.(c)">section 2(c)</internal-xref>, is amended—</text><paragraph id="HC00FD0DB9D7F4D099C4EC9C647256EB2"><enum>(1)</enum><text>by redesignating the items relating to sections 305 and 306 as relating to sections 306 and 307; and</text></paragraph><paragraph id="H4FDE35C295F34C59BF4C568B47E29AAA"><enum>(2)</enum><text>by inserting after the item relating to section 304 the following new item:</text><quoted-block display-inline="no-display-inline" id="H083364B9EB41472F880026FC448DFE1A" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 305.
