which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to extend telehealth flexibilities under the Medicare program, and for other purposes.</official-title></form><legis-body id="H084C01FFB8744264B173A2ACFE2657AE" style="OLC"><section id="HF7BF411AB58F47FE996AD4ACFBF1AB9E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Telehealth Beyond COVID–19 Act of 2021</short-title></quote>.</text></section><section id="H95DC565E7D424062B40900060A95B3DD" display-inline="no-display-inline"><enum>2.</enum><header>Extending Medicare telehealth flexibilities</header><subsection id="H5FE261C7D58A4055977872AEF974B810"><enum>(a)</enum><header>Expanding access to telehealth services</header><paragraph id="H4C969776108D42FA9105058C1C9500A6"><enum>(1)</enum><header>In general</header><text>Section 1834(m)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)</external-xref>) is amended by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3F0F46F65E2C4656B740AAACC5FA56EA"><clause id="HFF21AF8C4B334DF7A995EDFBB3B2CE59"><enum>(iii)</enum><header>Expanding access to telehealth services</header><text>With respect to telehealth services furnished beginning on the first day after the end of the emergency period described in section 1135(g)(1)(B), the term <term>originating site</term> means any site at which the eligible telehealth individual is located at the time the service is furnished via a telecommunications system, including the home of an individual.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H866970570D3246FDA6C26E97A8321532"><enum>(2)</enum><header>Conforming amendments</header><text>Such section is amended—</text><subparagraph id="H29E1B7ADA6F24E518C4FBC3F968D3DDA"><enum>(A)</enum><text>in paragraph (2)(B)—</text><clause id="HFA445AA7028442B3A99A72BA603D48B8"><enum>(i)</enum><text>in clause (i), in the matter preceding subclause (I), by striking <quote>clause (ii)</quote> and inserting <quote>clauses (ii) and (iii)</quote>; and</text></clause><clause commented="no" id="H6EBC1C52493D4FE38BCAF978850AFDA0"><enum>(ii)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H591DEA3020D74F3A82603C7F1468DD36"><clause commented="no" id="HC0170DEE144B40AAB5A0A17F52785B1B"><enum>(iii)</enum><header>No facility fee for new sites</header><text>With respect to telehealth services furnished on or after the date of enactment of this clause, a facility fee shall only be paid under this subparagraph to an originating site that is described in paragraph (4)(C)(ii) (other than subclause (X) of such paragraph).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HF3A6171DE6894ADCAA16E96F2EB72044"><enum>(B)</enum><text>in paragraph (4)(C)—</text><clause id="HAC3BED06759B4D6DAD29FBBFF1CBAE2E"><enum>(i)</enum><text>in clause (i), in the matter preceding subclause (I), by inserting <quote>and clause (iii)</quote> after <quote>and (7)</quote>; and</text></clause><clause id="H5FC78160EE614B6B99E2E2BC39311448"><enum>(ii)</enum><text>in clause (ii)(X), by inserting <quote>prior to the first day after the end of the emergency period described in section 1135(g)(1)(B)</quote> before the period;</text></clause></subparagraph><subparagraph id="HEF52799EFE894767AB6010E629D571BB"><enum>(C)</enum><text>in paragraph (5), by inserting <quote>and prior to the first day after the end of the emergency period described in section 1135(g)(1)(B)</quote> after <quote>January 1, 2019,</quote>;</text></subparagraph><subparagraph id="H9917BF28584147159696C7E38B00A66B"><enum>(D)</enum><text>in paragraph (6)(A), by inserting <quote>and prior to the first day after the end of the emergency period described in section 1135(g)(1)(B),</quote> after <quote>January 1, 2019,</quote>; and</text></subparagraph><subparagraph id="H72FA549DC66444068955F4728B94879C"><enum>(E)</enum><text>in paragraph (7), by inserting <quote>and prior to the first day after the end of the emergency period described in section 1135(g)(1)(B),</quote> after <quote>July 1, 2019,</quote>. </text></subparagraph></paragraph></subsection><subsection id="H97FC090211FC42D4820845EA1D38305B"><enum>(b)</enum><header>Expanding practitioners eligible To furnish telehealth services</header><text>Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><paragraph id="HCAA22EC5222A41B4A8DBFB5106491B0E"><enum>(1)</enum><text>in paragraph (1), by striking <quote>(described in section 1842(b)(18)(C))</quote> and inserting <quote>(defined in paragraph (4)(E))</quote>; and</text></paragraph><paragraph id="H2BC28E8C0EA9414A8CAF6E71EC3BDB5C"><enum>(2)</enum><text>in paragraph (4)(E)—</text><subparagraph id="HBBD916C196D74FFDAC0200B22542E80F"><enum>(A)</enum><text>by striking <quote><header-in-text level="subparagraph" style="OLC">practitioner</header-in-text>.—The term</quote> and inserting “<header-in-text level="subsection" style="OLC">practitioner</header-in-text>.—</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0963AD00C41A4F2D995D98E4F2330E02"><subparagraph id="HF04E4731747D4757B95D7A6A9961CD6C"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H814140D1D52747F8B755035E00DA71F1"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDE9654C90A7E465AA6D5317A477CFE90"><subparagraph id="H1132CDA1B03B46B5BC3917F269B3E8DC"><enum>(B)</enum><header>Expansion</header><text>The Secretary, after consulting with stakeholders regarding services that are clinically appropriate, may expand the types of practitioners who may furnish telehealth services to include any health care professional that is eligible to bill the program under this title for their professional services.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H049892BDD8744932AFD8513B54F537D6"><enum>(c)</enum><header>Allowing for the furnishing of audio-only telehealth services</header><text>Section 1834(m)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H3A7AC303CEB4491F8C793E1ABF963F10" display-inline="no-display-inline"><subparagraph id="H309B85C384E240CCAA204F09F6246E85"><enum>(G)</enum><header>Telecommunications system</header><clause id="HABAFE7765F764EDF9DB776C56D2A4759"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>telecommunications system</quote> includes, in the case of a specified telehealth service (as defined in clause (ii)) furnished to an individual, a communications system consisting only of audio capabilities.</text></clause><clause id="H1ADA9AE214484FA3918F90173D4B30A5"><enum>(ii)</enum><header>Specified telehealth service defined</header><text display-inline="yes-display-inline">The term <quote>specified telehealth service</quote> means a telehealth service consisting of—</text><subclause id="H96FEFBD0998D499CA47E37BAA2B86EE8"><enum>(I)</enum><text>evaluation and management services;</text></subclause><subclause id="HECAA9748C7864AFE9BB75D1F5F18C5C5"><enum>(II)</enum><text>mental and behavioral health services;</text></subclause><subclause id="H0E732A1BF612480AB968C13423BEBE3A"><enum>(III)</enum><text>substance use disorder services; or</text></subclause><subclause id="HD8A44E29BB0A4A71B7D6F396E7F99137"><enum>(IV)</enum><text>any other service specified by the Secretary.</text></subclause><continuation-text continuation-text-level="clause">Such term does not include communication of lab results from a physician or practitioner to an individual via a telecommunications system unless such communication involves a diagnosis of such individual based on such results or the prescription, or modification of a prescription, of a drug based on such results.</continuation-text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HC71C919E36E743A482813A0AD4046147"><enum>3.</enum><header>Making permanent the ability of federally qualified health centers and rural health clinics to furnish telehealth services under the Medicare program</header><text display-inline="no-display-inline">Section 1834(m)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(8)</external-xref>) is amended—</text><paragraph id="H8782903DB3944069B4D18D881570D2E2"><enum>(1)</enum><text>in the header, by striking <quote><header-in-text level="paragraph" style="OLC">during emergency period</header-in-text></quote>; </text></paragraph><paragraph id="HF2145D49A0394073B47F266598D09D2E"><enum>(2)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>During</quote> and inserting <quote>Beginning on the first day of</quote>; and</text></paragraph><paragraph id="HA370A4E64FD14296AD1153AC796B77AC"><enum>(3)</enum><text>in subparagraph (B)(i), by striking <quote>during such emergency period</quote>. </text></paragraph></section><section id="HE843B1E3A7E24642827B23D0387533C3"><enum>4.</enum><header>Clarification for fraud and abuse laws regarding technologies provided to beneficiaries</header><text display-inline="no-display-inline">Section 1128A(i)(6) of the Social Security Act (42 U.S.C. 1320a–7a(i)(6)) is amended—</text><paragraph id="H55E83C7852F6418AB0E77AAF550A7E2B"><enum>(1)</enum><text>in subparagraph (I), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph><paragraph id="H3369A2E6227246EF92603341A45921A6"><enum>(2)</enum><text>in subparagraph (J), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H29EBA082EFB540ACBFBCB28AFF6A29AE"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H2182B8EC5BA243E6985EC143681601F7" style="OLC"><subparagraph id="HB3F656A0E521486094AB9DECCD739709"><enum>(K)</enum><text>the provision of technologies (as defined by the Secretary) on or after the date of the enactment of this subparagraph, by a provider of services or supplier (as such terms are defined for purposes of title XVIII) directly to an individual who is entitled to benefits under part A of title XVIII, enrolled under part B of such title, or both, for the purpose of furnishing telehealth services, remote patient monitoring services, or other services furnished through the use of technology (as defined by the Secretary), if—</text><clause id="H107174CD3AE04917A26DDB04C9255C40"><enum>(i)</enum><text>the technologies are not offered as part of any advertisement or solicitation; and</text></clause><clause id="H1E79291262AC43EBB428F8A54DB721E6"><enum>(ii)</enum><text>the provision of the technologies meets any other requirements set forth in regulations promulgated by the Secretary.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
