R. 4035</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210622">June 22, 2021</action-date><action-desc><sponsor name-id="J000032">Ms. Jackson Lee</sponsor> (for herself and <cosponsor name-id="N000002">Mr. Nadler</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Omnibus Crime Control and Safe Streets Act of 1968 to prioritize veterans court treatment programs that ensure equal access for racial and ethnic minorities and women, and for other purposes.</official-title></form><legis-body id="HEFB81A1D23324237ABD6E9C7480FA434" style="OLC"><section id="HFC889DE0439D40AA971FDB0DCC71F7D2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Real Justice for Our Veterans Act of 2021</short-title></quote>. </text></section><section id="HFA39D881D0014F94A922CE63B0846445"><enum>2.</enum><header>Equal access to veterans court treatment programs for racial and ethnic minorities and women</header><text display-inline="no-display-inline">Section 2991(i)(2) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10651">34 U.S.C. 10651(i)(2)</external-xref>) is amended—</text><paragraph id="H2EA7C4C0F8434E4DA12A483471E4A48F"><enum>(1)</enum><text>in subparagraph (B)—</text><subparagraph id="H7499AB1A37A8443A80E7D6A4D1F91460"><enum>(A)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HD9B894EC5ED047DEB7D9E03FC6B9A575"><enum>(B)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HE1CC71C5E73F447C9C495FC149858961"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H48AAD1D3C56342D2A19B1DE2E8A4379F" display-inline="no-display-inline"><clause id="H378A37B93B294F7791B018B7E0694B17"><enum>(iv)</enum><text display-inline="yes-display-inline">include a description of a proposal to implement a process to ensure that racial and ethnic minorities and women have equal access to the program, and an equal opportunity to complete the program, including by collecting and analyzing data related to admission in the program and completion of the program, to ensure there are not disparities related to race, ethnicity, or sex.</text></clause><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HBED4674312544775AA0E6C5539D13F00"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H2EDBC4772AB24EBCBE2A7FEDA81863CF" display-inline="no-display-inline"><subparagraph id="H33CE92C6A0B54D2B8461699714839E04"><enum>(C)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this subparagraph, the Attorney General shall submit to Congress a report on the effectiveness of veterans treatment court programs. In preparing such report, the Attorney General shall conduct a national multi-site evaluation of such programs, including an assessment of—</text><clause id="H6039E1F3A2CF41178C5A08BDC3189181"><enum>(i)</enum><text>the population served by such programs;</text></clause><clause id="HA58DAC3CDC9249188EF053A658DF42D3"><enum>(ii)</enum><text>whether such programs use evidence-based treatments for substance use and mental health, including medication for addiction treatment;</text></clause><clause id="H97C75788BB2B434BB486763143066D93"><enum>(iii)</enum><text>recidivism rates of participants in such programs; and</text></clause><clause id="HE3876AC75F9C40058C33CEB9EFBE1F6A"><enum>(iv)</enum><text>program completion rates. </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H8B51D4295E484DA08CD5FB3ABE4B84B3"><enum>3.</enum><header>Veterans pilot program on promising retention models</header><subsection id="H5A8F8CB0BBC04146A134CBD85C5827FD"><enum>(a)</enum><header>Establishment</header><text>The Attorney General, acting through the Director of the Bureau of Justice Assistance, shall carry out a pilot program—</text><paragraph id="HF932D29CA1794C21AD02AC2F49F6E2D7"><enum>(1)</enum><text>to provide training and technical support to local and State conviction review entities; and</text></paragraph><paragraph id="H543FE790F85346DBAF4F969BD34E47C1"><enum>(2)</enum><text display-inline="yes-display-inline">to make grants to eligible units of local government to improve retention in a veterans treatment court program (as such term is defined in section 2991 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10651">34 U.S.C. 10651</external-xref>)) and drug courts.</text></paragraph></subsection><subsection id="HBEAA7B87B68D441EBF3955FCBD8D75C9"><enum>(b)</enum><header>Eligibility</header><text>In order to be eligible for a grant under subsection (a)(2), a unit of local government shall operate a veterans treatment court program or a drug court.</text></subsection><subsection id="H9D705ADDE7DF40E19390D9AA0E338D79"><enum>(c)</enum><header>Application</header><text>A unit of local government seeking a grant through the pilot program under subsection (a)(2) shall submit to the Attorney General an application at such time, in such manner, and containing such information as the Attorney General may reasonably require, and shall contain, including—</text><paragraph id="H2B493685174A4E72922E2DA7FA619D6A"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the therapy model that they plan to implement and data to support the use of the therapy model, including information showing how the therapy will promote retention in and completion of veterans treatment court programs; and</text></paragraph><paragraph id="HEE45059A61354C82B29990979DF8947F"><enum>(2)</enum><text display-inline="yes-display-inline">detailed plans on how the applicant would test the efficacy of the therapy program.</text></paragraph></subsection><subsection id="H898D25913F5A48EBAA4571A5959B7CC6"><enum>(d)</enum><header>Reporting metrics</header><text display-inline="yes-display-inline">Not later than 180 days after receiving a grant under subsection (a)(2), a unit of local government shall submit to the Attorney General a report, which includes demographic information of participants in the veterans treatment court program and completion rates of such participants. The Attorney General shall develop guidelines for the report required under this subsection. </text></subsection><subsection id="H279409C870BC4A99BFED85E5B6E0F61D"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $3,000,000 for each of fiscal years 2022 through 2027 to carry out this section.</text></subsection></section><section id="H589CDDA0B5874876AF4BBBBA2A4960FD"><enum>4.</enum><header>Admission of veterans to drug courts</header><text display-inline="no-display-inline">In the case of a jurisdiction that does not operate a veterans treatment court program (as such term is defined in section 2991 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10651">34 U.S.C. 10651</external-xref>)), but that does operate a drug court under part EE of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10611">34 U.S.C. 10611 et seq.</external-xref>), a veteran who would be eligible to participate in a veterans treatment court program may participate in the drug court, including a veteran who is a violent offender (as such term is defined in section 2953(a) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10613">34 U.S.C. 10613(a)</external-xref>)). </text></section></legis-body></bill>
