Development to make grants to States for use to eliminate blight and assist in neighborhood revitalization, and for other purposes.</official-title></form><legis-body id="H59B056AF7BFA4EDE93E7F5C8A23800D8" style="OLC"><section id="H23461CC8417A4449A58910A79F7883A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Up Our Neighborhoods Act of 2021</short-title></quote>.</text></section><section id="HC199D727ECC34243826E6C79E207C28F"><enum>2.</enum><header>Blight elimination and neighborhood revitalization grants</header><subsection id="HEE4B221FF72549F9A5C96346C2C74C01"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development may make grants under this section, on a competitive basis, to States for use for eligible activities under subsection (c)(1) designed to eliminate blight and promote neighborhood revitalization.</text></subsection><subsection id="H721DCC96227D4D9E8F7712E0C8C0E03A"><enum>(b)</enum><header>Use in New Market Tax Credit areas</header><text>Amounts from a grant under this section may be used only to carry out eligible activities under subsection (c)(1) within low-income communities, as such term if defined in subsection (g).</text></subsection><subsection id="H5FBE07614A274E448F53BB58810D4F87"><enum>(c)</enum><header>Eligible activities</header><paragraph id="H746B103FF02143F3BDD6533CE5070006"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts from a grant under this section may be used only for the following activities:</text><subparagraph id="HECB14D4931F0434F86F41EB0C61E8280"><enum>(A)</enum><text display-inline="yes-display-inline">Demolition, clearance, and removal of blighted structures.</text></subparagraph><subparagraph id="H2BEB028E9FC44FCC8B1419634711718F"><enum>(B)</enum><text>Boarding of vacant properties and blighted structures.</text></subparagraph><subparagraph id="HBC1595FB44164DF5AC2B1FF1D14B922C"><enum>(C)</enum><text>Deconstruction of structures.</text></subparagraph><subparagraph id="H1E244FCA3A0F4584BE26768D8F64D493"><enum>(D)</enum><text>Removal of waste and site clearance and vacant land management.</text></subparagraph><subparagraph id="H957CF5F508C04B42AC117F06106AB2E6"><enum>(E)</enum><text display-inline="yes-display-inline">Stabilization activities in connection with providing vacant, open green space for the purpose of public access and redevelopment, including greening projects, and associated maintenance activities, including mowing.</text></subparagraph><subparagraph id="H779661EE8F1B4F208210CFA421743D10"><enum>(F)</enum><text>Renovation of existing structures, except that not more than 30 percent of any grant under this section may be used for such activities.</text></subparagraph></paragraph><paragraph id="HB48E42B2D9A9471097D692182FCBF806"><enum>(2)</enum><header>Use of amounts by local governments</header><text display-inline="yes-display-inline">A grantee State may use amounts from a grant under this Act to carry out eligible activities under paragraph (1) or may provide such amounts to land banks or units of general local government within the State whose jurisdictions include low-income communities for use to carry out such eligible activities within such low-income communities.</text></paragraph><paragraph id="H77BB707F0F354651B6D74B8A5F5AE440"><enum>(3)</enum><header>Priority for land banks</header><text>In areas where land banks exist, a grantee State shall give priority, in the use of amounts from a grant under this Act, to eligible activities that will be carried out by land banks, in accordance with such requirements as the Secretary shall establish.</text></paragraph><paragraph id="HC843C5DFAD554995A9C946C047C766D1"><enum>(4)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Amounts from a grant under this section may not be used to acquire any occupied residential dwelling unit.</text></paragraph></subsection><subsection id="HEC3AF5FFC72B4764A08F43D4A454CD2A"><enum>(d)</enum><header>Matching requirement</header><paragraph id="H24E01E1A678F40E4A3F5C805C50C4311"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall require each State that receives a grant under this section to contribute, toward carrying out the plan for the State under subsection (e)(2), an amount of matching funds from non-Federal sources that is equal to or greater than 15 percent of the amount of the grant.</text></paragraph><paragraph id="H25B52B9C9B834FA5922B2CBF3983720A"><enum>(2)</enum><header>Use of sale proceeds</header><text>Any proceeds from sales of properties renovated pursuant to subsection (c)(1)(F) may be counted toward compliance with the requirement under paragraph (1).</text></paragraph></subsection><subsection id="H137D270512CF4274B19F58C1398A03F5"><enum>(e)</enum><header>Application and plan</header><paragraph id="H39F8EEC09B85432E8BD7D079D253AC66"><enum>(1)</enum><header>Application</header><text display-inline="yes-display-inline">A grant under this section may only be provided to a State that submits to the Secretary an application for such a grant that contains a plan for use of grant funds in accordance with paragraph (2) and such other information, certifications, and assurances as the Secretary considers necessary to provide for selection of States in accordance with the process and criteria under subsection (f).</text></paragraph><paragraph id="H17FD09F54F5E438B9804BF0EE05BD5B7"><enum>(2)</enum><header>Plan</header><text>A plan under this paragraph shall be a detailed 5-year plan for the use of grant amounts under this section and matching amounts contributed pursuant to subsection (d) that includes—</text><subparagraph id="H8AEFAEB20E1E4FFEBC8AE1ADCF79D92A"><enum>(A)</enum><text>identification of the low-income communities in which eligible activities under subsection (c)(1) will be carried out using grant and matching amounts;</text></subparagraph><subparagraph id="H7E8F580951CA4013A48861D54C04F9F6"><enum>(B)</enum><text>a description of the eligible activities under subsection (c)(1) to be carried out using grant and matching amounts;</text></subparagraph><subparagraph id="H80248CCEE60949F983EFE5D92EED7F64"><enum>(C)</enum><text>a timetable for carrying out such eligible activities, which shall provide for the expenditure of grant and matching amounts within 5 years after receipt; and</text></subparagraph><subparagraph id="H9F14718EC6A94C1D947667739277C5FF"><enum>(D)</enum><text>identification of the sources of matching amounts to be provided in accordance with subsection (d) and assurances of the availability of such matching amounts.</text></subparagraph></paragraph></subsection><subsection id="HE774928E4EA24BF9AD48BDCA7BA9C115"><enum>(f)</enum><header>Selection; criteria</header><text display-inline="yes-display-inline">The Secretary shall select applications to receive grants under this section pursuant to a competition and based on criteria as established by the Secretary for such selection.</text></subsection><subsection id="H79828F0DF77D4702A275A4A5C6ED1C68"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section, the following definitions shall apply:</text><paragraph id="H0FB3A86352304CA1BDDA1807F60090F3"><enum>(1)</enum><header>Land bank</header><text display-inline="yes-display-inline">The term <quote>land bank</quote> means—</text><subparagraph id="H6DBA6B4AE8744E01BFCDB2EAF00E5AA1"><enum>(A)</enum><text>a land bank, as such term is defined under State law; and</text></subparagraph><subparagraph id="HD0222144602C41EBB28F1C5B277E34BD"><enum>(B)</enum><text>with respect to any State for which the laws of such State do not explicitly define such term, any publicly or community-owned entity established for the purpose of reducing or preventing blight by acquiring, managing, maintaining, and re-purposing vacant, abandoned, and foreclosed properties, including abandoned houses and buildings and empty lots.</text></subparagraph></paragraph><paragraph id="HA3A5F6E33419447A96D1BD060E35AD7E"><enum>(2)</enum><header>Low-income community</header><text display-inline="yes-display-inline">The term <quote>low-income community</quote> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/45D">26 U.S.C. 45D</external-xref>) and includes any census tract or other area that is treated as a low-income community for purposes of such section.</text></paragraph><paragraph id="H6B0BAD1F39A9422E992A7AA433EB5809"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Housing and Urban Development.</text></paragraph><paragraph commented="no" id="HF88922CA8A75486D9CEBE852D055E053"><enum>(4)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, the Trust Territory of the Pacific Islands, and any other territory or possession of the United States.</text></paragraph><paragraph id="H8630BCCE3A02493C809550272147092B"><enum>(5)</enum><header>Structure</header><text>The term <quote>structure</quote> includes residential structures and commercial structures.</text></paragraph></subsection><subsection id="HBE2749789FCD4F3B93B260EA7342E7A2"><enum>(h)</enum><header>Regulations</header><text>The Secretary shall issue any regulations necessary to carry out this section.</text></subsection><subsection id="HA2BAFE8F180F493FA25C8E72E30668C0"><enum>(i)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as may be necessary for grants under this section for each of fiscal years 2022 through 2027.</text></subsection></section></legis-body></bill>
