R. 3883</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210614">June 14, 2021</action-date><action-desc><sponsor name-id="W000815">Mr. Wenstrup</sponsor> (for himself and <cosponsor name-id="U000040">Ms. Underwood</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to prohibit smoking on the premises of any facility of the Veterans Health Administration, and for other purposes.</official-title></form><legis-body id="H50B2EEECFB7D416D965ED6ECDFC34707" style="OLC"><section id="H69FF1F450DB54238A54CEEF5AE9DC1E6" section-type="section-one"><enum>1.</enum><header>Prohibition on smoking in facilities of the Veterans Health Administration</header><subsection id="HE54C9F4E651044D19085766438AE29AB"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 1715 of title 38, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H9807F7073A98448F8ECE5F516BA804F6" style="USC"><section id="HEAF8CE8570934AF2B8096541DA694CE4"><enum>1715.</enum><header>Prohibition on smoking in facilities of the Veterans Health Administration</header><subsection id="HB21E88CDBCE046A39939AFFF59575B09"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No person (including any veteran, patient, resident, employee of the Department, contractor, or visitor) may smoke on the premises of any facility of the Veterans Health Administration.</text></subsection><subsection id="HF735E7C66C94442FBB3425D4E1882AEC"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD27D5CAC76FC4E839D62D332B42C81B4"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>smoke</quote> includes—</text><subparagraph id="HA4B54286005A4844B9A17A8A5673939E"><enum>(A)</enum><text>the use of cigarettes, cigars, pipes, and any other combustion or heating of tobacco; and</text></subparagraph><subparagraph id="HD56AFFCC08BB4A0982800C265FB1F640"><enum>(B)</enum><text display-inline="yes-display-inline">the use of any electronic nicotine delivery system, including electronic or e-cigarettes, vape pens, and e-cigars.</text></subparagraph></paragraph><paragraph id="H0DF69FA77C154176BD859FF2C204973E"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>facility of the Veterans Health Administration</quote> means any land or building (including any medical center, nursing home, domiciliary facility, outpatient clinic, or center that provides readjustment counseling) that is—</text><subparagraph id="HE173088A32B945339B653AE8A678E579"><enum>(A)</enum><text>under the jurisdiction of the Department of Veterans Affairs;</text></subparagraph><subparagraph id="H841F9AC340D747548A07403BB1D62187"><enum>(B)</enum><text>under the control of the Veterans Health Administration; and</text></subparagraph><subparagraph id="H176DC4822E9E42F3B2767B04AED9201A"><enum>(C)</enum><text>not under the control of the General Services Administration.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA851EFDF11FA4991905E7AD958926A9B"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="H9235F205848845748EB183625BFE7927"><enum>(1)</enum><header>Table of sections</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 17 of such title is amended by striking the item relating to section 1715 and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H421F07A25D864460B226710F81DE45D5" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1715. Prohibition on smoking in facilities of the Veterans Health Administration.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H0D5B8C4D3C5945118B2DD59BF031C9E0"><enum>(2)</enum><header>Veterans Health Care Act of 1992</header><text display-inline="yes-display-inline">Section 526 of the Veterans Health Care Act of 1992 (<external-xref legal-doc="public-law" parsable-cite="pl/102/585">Public Law 102–585</external-xref>) is repealed.</text></paragraph></subsection></section></legis-body></bill>
