<section id="H95103C9A5C89469BB50932D1A0948426" section-type="section-one"><enum>1.</enum><header>Prohibitions on requirement that a member of the Armed Forces receive a vaccination against COVID-19</header> 
<subsection id="HB4F3E8E47F5E42E5A169CB61ADD862FD"><enum>(a)</enum><header>Prohibition on funding</header><text display-inline="yes-display-inline">No Federal funds may be used to require a member of the Armed Forces to receive a vaccination against COVID-19.</text></subsection> <subsection id="H117D3B29F2DE4510BA7B151A64AD3833"><enum>(b)</enum><header>Prohibition on adverse action</header><text display-inline="yes-display-inline">The Secretary concerned may not take any adverse action against a member of the Armed Forces because such member refuses to receive a vaccination against COVID-19.</text></subsection> 
<subsection id="HDCCF9AD630444FC3ACFD68251D47DB7B"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HA09444DB77F94C519838F0FCC812D8E8"><enum>(1)</enum><text>The term <quote>adverse action</quote> includes the following:</text> 
<subparagraph id="H42B8467EFDE74750BA1E9BAC98200FDA"><enum>(A)</enum><text display-inline="yes-display-inline">Retaliation.</text></subparagraph> <subparagraph id="H4451F5B35B984CF9ACAE11385A229F83"><enum>(B)</enum><text>Punishment.</text></subparagraph> 
<subparagraph id="H1AE896BB29F8407BA9EC14AD27FDDA73"><enum>(C)</enum><text>Disparate treatment.</text></subparagraph> <subparagraph id="H4D7BFE8B5624469A991B92E718C29AC8"><enum>(D)</enum><text>A requirement to wear a mask.</text></subparagraph> 
<subparagraph id="HA00A9BB1A4C143A9BEA785722B4EF102"><enum>(E)</enum><text display-inline="yes-display-inline">A requirement to reside in substandard housing.</text></subparagraph></paragraph> <paragraph id="H4D0790AA763D4AF684AAB6BDD65BECC4"><enum>(2)</enum><text>The term <quote>Secretary concerned</quote> has the meaning given that term in section 101 of title 10, United States Code.</text></paragraph></subsection></section>
