which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide a requirement to improve data collection efforts.</official-title></form><legis-body id="HEC7E4B32AF1742D18AAEDF6BBD34072B" style="OLC"><section id="H9ACEB0D5A99540649B6578E572C0E9A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>LGBTQ Essential Data Act</short-title></quote>.</text></section><section id="H4F133B44239749B69755CD41C06061E1"><enum>2.</enum><header>Improving data collection on the sexual orientation and gender identity of deceased individuals through the National Violent Death Reporting System</header><subsection id="H5956556AFF2A4015AE9C07423C1D8CB7"><enum>(a)</enum><header>Collection of sexual orientation and gender identity data</header><paragraph id="H7EF62D8C716D45618640ABE8CC840B09"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Director of the Centers for Disease Control and Prevention shall take measures to improve the incidence of the collection of information on the sexual orientation and gender identity of deceased individuals through the National Violent Death Reporting System or any successor programs.</text></paragraph><paragraph id="HF18BCE3D3F3B43DE961A03CB6F2FC7AC"><enum>(2)</enum><header>Confidentiality</header><text display-inline="yes-display-inline">Any information collected relating to the sexual orientation or gender identity of a decedent shall be maintained in accordance with the confidentiality and privacy standards and policies for the protection of individuals applicable to all other data collected for purposes of the National Violent Death Reporting System.</text></paragraph></subsection><subsection id="H7FBF5232683D4D0EB1082A1CF52D5547"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H4DC942729BA74C44A1CD59EC21F88157"><enum>(1)</enum><header>Gender identity</header><text display-inline="yes-display-inline">The term <term>gender identity</term> means an individual’s sense of being male, female, transgender, or another gender, as distinct from the individual’s sex assigned at birth.</text></paragraph><paragraph id="H249C421CE0BF424FAA25364DDE1D6A4C"><enum>(2)</enum><header>Sexual orientation</header><text display-inline="yes-display-inline">The term <term>sexual orientation</term> means how a person identifies in terms of their emotional, romantic, or sexual attractions, and includes identification as straight, heterosexual, gay, lesbian, or bisexual, among other terms.</text></paragraph></subsection><subsection id="H0C858440C681434E98E177F90E850DF1"><enum>(c)</enum><header>Authorization</header><text display-inline="yes-display-inline">There is authorized to be appropriated $25,000,000 for fiscal year 2022 to carry out this section.</text></subsection></section><section id="H7AF251F322304DF6A0753A3A25A5E7BB"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of the Congress that—</text><paragraph id="H2B32B4838F1F4E9FA085142C64607758"><enum>(1)</enum><text>the Centers for Disease Control and Prevention has made significant efforts to encourage States and other jurisdictions to collect data on sexual orientation and gender identity through the National Violent Death Reporting System; and</text></paragraph><paragraph id="HB7533590079348C7B24415D02E6D053B"><enum>(2)</enum><text>jurisdictions that participate in the collection of such data through the National Violent Death Reporting System should be commended for their participation.</text></paragraph></section></legis-body></bill>
