which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To enforce the requirement that the National Instant Criminal Background Check System make a final disposition of requests to correct its records within 60 days, and for other purposes.</official-title></form><legis-body id="H6E3FB213DC644EC7A1674AE700F38951" style="OLC"><section id="HB960C83F499B4574BFE2A419A0C5BBF5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Firearm Due Process Protection Act </short-title></quote>.</text></section><section id="H83BA59DC6C94421B988924B4D5D7FF9D"><enum>2.</enum><header>Enforcement of deadline for final disposition of requests to correct records of the National Instant Criminal Background Check System; due process protections</header><text display-inline="no-display-inline">Section 925A of title 18, United States Code, is amended—</text><paragraph id="H6D583DC2F56846058F02726D46233A0E"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general.—</header-in-text></quote> before <quote>Any person</quote>;</text></paragraph><paragraph id="H0984A55A478D4FFFA2B18EFEA41EA94E"><enum>(2)</enum><text>by inserting <quote>or aggrieved by a violation of the penultimate sentence of section 103(g) of the Brady Handgun Violence Prevention Act</quote> after <quote>(s) or (t) of section 922</quote>;</text></paragraph><paragraph id="HAF1D841108E94443B3B7835B0ABDBF32"><enum>(3)</enum><text>by striking the last sentence; and</text></paragraph><paragraph id="H24EFEC26E9324CBCBBB09C585D04D509"><enum>(4)</enum><text>by adding after and below the end the following:</text><quoted-block display-inline="no-display-inline" id="H8CE0310A75A6441990651385D04BD863" style="OLC"><subsection id="HF77B52BDDDAA4B5383FE3C197BF4B675"><enum>(b)</enum><header>Procedural rules</header><paragraph id="H1E03C9A9F88D45129D3AFDB5ED8C72BB"><enum>(1)</enum><header>Expedited hearing</header><text>The court shall hold a hearing on an action brought under subsection (a), within 30 days after the action is brought.</text></paragraph><paragraph id="H5CA6A8754CD54054AE8667FA7AF627C9"><enum>(2)</enum><header>Burden of proof</header><text>At such a hearing, the respondent shall bear the burden of proving by clear and convincing evidence that the individual is ineligible to receive or possess a firearm.</text></paragraph></subsection><subsection id="HB7B8767263C6425B97C458DE609AB12D"><enum>(c)</enum><header>Remedies</header><paragraph id="H9ED86735899C46DB94675F4E454A4AB6"><enum>(1)</enum><header>In general</header><text>The court shall assess against the respondent reasonable attorney fees and other litigation costs reasonably incurred in an action brought under subsection (a) in which the complainant has substantially prevailed.</text></paragraph><paragraph id="H9AD9068C3D0A4DB4A6E487699599155F"><enum>(2)</enum><header>Substantially prevailed</header><text>For purposes of this section, a complainant has substantially prevailed if the complainant has obtained relief through—</text><subparagraph id="H960CE37C92014F959678B70564205DB9"><enum>(A)</enum><text>a judicial order;</text></subparagraph><subparagraph id="H47E56C49FE0C443993E6715237C37B09"><enum>(B)</enum><text>an enforceable written agreement or consent decree; or</text></subparagraph><subparagraph id="HAA54ED08777F4051B367060E9D7C22EC"><enum>(C)</enum><text>a voluntary or unilateral change in position by the United States, if the complainant’s claim is not insubstantial.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H60B2EF6717F648C1A854035FF1157241"><enum>3.</enum><header>Annual reports to the Congress on disposition of challenges to accuracy of records of the National Instant Criminal Background Check System</header><text display-inline="no-display-inline">The Director of the Federal Bureau of Investigation shall submit annually to the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate a written report that specifies—</text><paragraph id="H67135ED9EC65432198C6C02479FA5733"><enum>(1)</enum><text display-inline="yes-display-inline">the total number of challenges to the accuracy of the records of the National Instant Criminal Background Check System (in this section referred to as the <quote>NICS system</quote>) established under section 103 of the Brady Handgun Violence Prevention Act that were received by the NICS system during the year covered by the report;</text></paragraph><paragraph id="HBE677F788AC34EA1ADFCE521EF4D419F"><enum>(2)</enum><text>the total number of the challenges that were processed to final disposition by the NICS system;</text></paragraph><paragraph id="H772185C6AA6C4783AFCCC1828945B628"><enum>(3)</enum><text display-inline="yes-display-inline">the total number of the challenges with respect to which the initial determination of the NICS system was reversed, and with respect to those challenges, the total number in which each reason for the initial determination was made;</text></paragraph><paragraph id="H44612B071B3B4861B36FDDD2860E80B8"><enum>(4)</enum><text display-inline="yes-display-inline">the total number of the challenges with respect to which the initial determination of the NICS system was not reversed, and with respect to those challenges, the total number in which each reason for not doing so was made; and</text></paragraph><paragraph id="H0E46822C844F4F9E85A7DD86A8F99F9A"><enum>(5)</enum><text>the average length of time needed to complete the processing of the challenges referred to in paragraph (2).</text></paragraph></section><section id="H61A18B3B02AB4D6D890CFE8576EA645A"><enum>4.</enum><header>Sense of the Congress</header><text display-inline="no-display-inline">It is the sense of the Congress that—</text><paragraph id="HC0F94958E7AF449DAA716F8CA4359487"><enum>(1)</enum><text display-inline="yes-display-inline">the right of the people to keep and bear arms is a fundamental component of self-government, self-defense, and the preservation of individual liberty;</text></paragraph><paragraph id="HB30FE573B704476EBD0327F53055AC5C"><enum>(2)</enum><text>deprivation of the constitutional right to bear arms requires due process under the Fifth and Fourteenth Amendments to the Constitution of the United States;</text></paragraph><paragraph id="HD4D3A08AC86B4265BDD281AA3E77D4DB"><enum>(3)</enum><text>ignoring appeals of determinations made by the National Instant Criminal Background Check System (NICS) violates due process; and</text></paragraph><paragraph id="H9E3E18765D61496DB95E3EF52CCAA9EC"><enum>(4)</enum><text display-inline="yes-display-inline">NICS should have the burden of showing a valid reason for the denial of this constitutional right.</text></paragraph></section></legis-body></bill>
