R. 3809</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210611">June 11, 2021</action-date><action-desc><sponsor name-id="B001223">Mr. Bowman</sponsor> (for himself, <cosponsor name-id="K000397">Mrs. Kim of California</cosponsor>, and <cosponsor name-id="K000389">Mr. Khanna</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HSY00">Committee on Science, Space, and Technology</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Director of the National Science Foundation to establish a Chief Diversity Officer position and to develop a strategic plan to ensure participation in NSF activities by a diverse group of learners, researchers, and institutions.</official-title></form><legis-body id="H70495D1459E24BD29D6DF6B13B3EB6FE" style="OLC"><section id="H3F8060FFE217465092256EFA6D25B5FB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Research Excellence through STEM Inclusion Act</short-title></quote>.</text></section><section id="HEC7174B79A0F4E3F9F699FD0E7F61A1E" section-type="subsequent-section" commented="no" changed="not-changed"><enum>2.</enum><header>Chief Diversity Officer of the NSF</header><subsection id="HD49CF132E2BD491B9E7ABD4081B6846B" changed="not-changed"><enum>(a)</enum><header>Chief diversity officer</header><paragraph id="H298BAB3840BD4BC9A519CB9E0FF51BDF" commented="no" changed="not-changed"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Director shall appoint a senior agency official within the Office of the Director as a Chief Diversity Officer.</text></paragraph><paragraph id="HB8A125E8A7A14C65A9106E5CF859DC3A" changed="not-changed"><enum>(2)</enum><header>Qualifications</header><text>The Chief Diversity Officer shall have significant experience, within the Federal Government and the science community, with diversity- and inclusion-related matters, including—</text><subparagraph id="H20BD1BC62C334A76843EC4EE86FC9927" changed="not-changed"><enum>(A)</enum><text>civil rights compliance;</text></subparagraph><subparagraph id="H87DFF289BB03496ABE0EA5EAB8EEF88A" changed="not-changed"><enum>(B)</enum><text>harassment policy, reviews, and investigations; </text></subparagraph><subparagraph id="H1F7292B3456F489488B14490D2D98594" changed="not-changed"><enum>(C)</enum><text>equal employment opportunity; and</text></subparagraph><subparagraph id="HC918840C0A5943CF905F064975A6F749" changed="not-changed"><enum>(D)</enum><text>disability policy. </text></subparagraph></paragraph><paragraph id="H047E1D67AB894BF5BE0B7DE7BA49B057" changed="not-changed"><enum>(3)</enum><header>Oversight</header><text>The Chief Diversity Officer shall direct the Office of Diversity and Inclusion of the Foundation and report directly to the Director in the performance of the duties of the Chief Diversity Officer under this section.</text></paragraph></subsection><subsection id="HEC7EAF5EC3CE47DB9435F6B0977337B0" changed="not-changed"><enum>(b)</enum><header>Duties</header><text>The Chief Diversity Officer is responsible for providing advice on policy, oversight, guidance, and coordination with respect to matters of the Foundation related to diversity and inclusion, including ensuring the geographic diversity of the Foundation programs. Other duties may include—</text><paragraph id="H9F10D9F6B7FD4408B0FFB043A20F1BFA" changed="not-changed"><enum>(1)</enum><text>establishing and maintaining a strategic plan that publicly states a diversity definition, vision, and goals for the Foundation;</text></paragraph><paragraph id="H7D3DA3FFB16849779A01362F603B185C" changed="not-changed"><enum>(2)</enum><text>defining a set of strategic metrics that are—</text><subparagraph id="H119B8047C602455880F9BC66D9558252" changed="not-changed"><enum>(A)</enum><text>directly linked to key organizational priorities and goals; </text></subparagraph><subparagraph id="H03F12D67C5FB40889AAA31A3157FDF94" changed="not-changed"><enum>(B)</enum><text>actionable; and </text></subparagraph><subparagraph id="H6B1F3AC59F6442FFA4718237A135BC78" changed="not-changed"><enum>(C)</enum><text>actively used to implement the strategic plan under paragraph (1);</text></subparagraph></paragraph><paragraph id="HD21844CDABFD470D871AD14163F71944" changed="not-changed"><enum>(3)</enum><text>advising in the establishment of a strategic plan for diverse participation by individuals and institutions of higher education, including community colleges, historically Black colleges and universities, Tribal colleges or universities, minority-serving institutions, institutions of higher education with an established STEM capacity building program focused on traditionally underrepresented populations in STEM, including Native Hawaiians, Alaska Natives, and Indians, and institutions from jurisdictions eligible to participate under section 113 of the National Science Foundation Authorization Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862g">42 U.S.C. 1862g</external-xref>); </text></paragraph><paragraph id="HDD46E091A6DE4583B54DC924740F3050" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">advising in the establishment of a strategic plan for outreach to, and recruiting from, untapped locations and underrepresented populations;</text></paragraph><paragraph id="HFFE40C3F4D7643AC9463C8AC906254A7"><enum>(5)</enum><text>advising on a diversity and inclusion strategy for the Foundation’s portfolio of PreK–12 STEM education focused programs and activities, including goals for addressing barriers to participation;</text></paragraph><paragraph id="HAD688D5DB3D84EA2972F4F1C44C76376" changed="not-changed"><enum>(6)</enum><text>advising on the application of the Foundation's broader impacts review criterion; and</text></paragraph><paragraph id="HB19EEBF6375E4837988C5257B6FA0D7F" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(7)</enum><text>performing such additional duties and exercise such powers as the Director may prescribe.</text></paragraph></subsection><subsection id="H09ADF147987B4AF58BA905EA4AF20E49" changed="not-changed"><enum>(c)</enum><header>Funding</header><text>From any amounts appropriated for the Foundation for each of fiscal years 2022 through 2026, the Director shall allocate $5,000,000 to carry out this section for each such year. </text></subsection></section></legis-body></bill>
