R. 3786</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210608">June 8, 2021</action-date><action-desc><sponsor name-id="N000147">Ms. Norton</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 28, United States Code, to change the residency requirements for certain officials serving in the District of Columbia, and for other purposes.</official-title></form><legis-body id="HFC02685886034A75B4A276725AF18197" style="OLC"><section commented="no" id="H86EDB4974B674BFC968DA697275188B2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>District of Columbia Federal Officials Residency Equality Act of 2021</short-title></quote>.</text></section><section id="H0FD68F2B1DEF42288A916AABD0B59F33"><enum>2.</enum><header>Residency requirements for certain officials serving in the District of Columbia</header><subsection id="H8C737A3EBE5E4311BFB3E07683ADA7BD"><enum>(a)</enum><header>Circuit judges</header><text display-inline="yes-display-inline">Section 44(c) of title 28, United States Code, is amended—</text><paragraph id="HB250C643A1E24372BC7DBBA8950A2240"><enum>(1)</enum><text>by striking <quote>Except in the District of Columbia, each</quote> and inserting <quote>Each</quote>;</text></paragraph><paragraph id="HD5C105867B234FF69B3FDB26B4572685"><enum>(2)</enum><text>by striking <quote>his appointment</quote> and inserting <quote>his or her appointment</quote>; and</text></paragraph><paragraph id="HE597D36FE98C41F689CAE2EFB4307F28"><enum>(3)</enum><text>by striking <quote>state</quote> and inserting <quote>State</quote>.</text></paragraph></subsection><subsection id="H6475C0CC7C9B490D8CA1B0BD36F8421C"><enum>(b)</enum><header>District judges</header><text display-inline="yes-display-inline">Section 134 of title 28, United States Code, is amended—</text><paragraph id="H526783BB17FA4F2AB19A995B880722B6"><enum>(1)</enum><text>in the first sentence of subsection (b)—</text><subparagraph id="H5C2814BBF5534085914DEC815F7C111B"><enum>(A)</enum><text>by striking <quote>the District of Columbia, the Southern District of New York, and</quote> and inserting <quote>the Southern District of New York and</quote>; and</text></subparagraph><subparagraph commented="no" id="H3FF7BC008E11464E9A9BCB7629CE0E75"><enum>(B)</enum><text>by striking <quote>for which he</quote> and inserting <quote>for which he or she</quote>; and</text></subparagraph></paragraph><paragraph id="H7A8B67DA1063412AAB35A35EE35A3AC5"><enum>(2)</enum><text>in subsection (c), by striking <quote>his</quote> each place it appears and inserting <quote>his or her</quote>.</text></paragraph></subsection><subsection id="HC66E45A7B60147F9995AE03688EA9200"><enum>(c)</enum><header>United States attorneys</header><text>Section 545(a) of title 28, United States Code, is amended by striking the first sentence and inserting <quote>Each United States attorney shall reside in the district for which he or she is appointed, except that those officers of the Southern District of New York and the Eastern District of New York may reside within 20 miles thereof.</quote>.</text></subsection><subsection id="H03573B4F02914470960AF93A9D320F37"><enum>(d)</enum><header>United States marshals</header><text display-inline="yes-display-inline">Section 561(e)(1) of title 28, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H01392CAD26904CCE8997F988ED201134" style="OLC"><paragraph id="HF87FBB55591B4BA5A9B7A4451C5AD113"><enum>(1)</enum><text display-inline="yes-display-inline">the marshal for the Southern District of New York may reside within 20 miles of the district; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2E67F16DED19423E9F53AFBF670A5551"><enum>(e)</enum><header>Clerks</header><text display-inline="yes-display-inline">Section 751(c) of title 28, United States Code, is amended by striking <quote>District of Columbia and the</quote>. </text></subsection><subsection commented="no" id="HE8C1466AF6FE41CBAA5046475AC1E01F"><enum>(f)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply only to individuals appointed after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
