which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the disclosure of pension records under the Freedom of Information Act, and for other purposes.</official-title></form><legis-body id="HAC1E6BD6AD8440A2A23D79071B112589" style="OLC"><section id="HD701BE10484D48B390131BC106AF372D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Employee Disclosure (FED) Transparency Act</short-title></quote>.</text></section><section id="HC7A457C1324943199A7058797911F2A7"><enum>2.</enum><header>Disclosure of pension records under the Freedom of Information Act</header><subsection id="HEA8FFDB811E940AE8A42656889F24E6B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the pension record of an individual who is an annuitant under chapter 83 or 84 of title 5, United States Code, shall be considered a record for purposes of section 552 of title 5, United States Code (commonly referred to as the Freedom of Information Act), and shall be made available in accordance with subsection (a)(3) of such section.</text></subsection><subsection id="H873913DD603442CC90CDB04BF9E3FB94"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HE363B3B562B4419AB27C5B1840AA280B"><enum>(1)</enum><header>Annuitant</header><text>The term <term>annuitant</term> means an annuitant as defined in—</text><subparagraph id="H51E4084C745B4D91838D18F43C9A2801"><enum>(A)</enum><text>section 8331 of title 5, United States Code; or</text></subparagraph><subparagraph id="HE7C08427FB2541298D5117E85E81B1CF"><enum>(B)</enum><text>section 8401 of such title.</text></subparagraph></paragraph><paragraph id="HCAAFEBC0E6454043A25D1F367A0E1B44"><enum>(2)</enum><header>Pension record</header><subparagraph id="H5BCA079A3E7742BD9EA8F129AEB245DD"><enum>(A)</enum><header>In general</header><text>The term <term>pension record</term> means any record containing any information concerning an annuitant receiving an annuity under chapter 83 or 84 of title 5, United States Code, including, with respect to the annuitant—</text><clause commented="no" id="HDCA36872DD8A48FBA4B35910764FD900"><enum>(i)</enum><text>full name;</text></clause><clause id="H1C428ABCF9E04F3087ED52F3A5B4B4AA"><enum>(ii)</enum><text>the most recent position of the annuitant, including the agency and division for such position, position title, location, and ZIP code of the place of employment for such position;</text></clause><clause id="HFF1A9988CCA14A9EB26D91628EB60DD7"><enum>(iii)</enum><text>date of appointment to such position;</text></clause><clause id="H47A45C00739F40D1A42B2DF43070CB6E"><enum>(iv)</enum><text>monthly annuity amount;</text></clause><clause id="H815D4B57FBB545FB806EC1E3DDE94420"><enum>(v)</enum><text>last plan grade, if applicable;</text></clause><clause id="H8EA11089412648C0A42B54BC2C9539DA"><enum>(vi)</enum><text>total employee annuity contribution;</text></clause><clause id="H9AAAB7AEA9854CD0875D00D3D1072788"><enum>(vii)</enum><text>total reported wages;</text></clause><clause id="HC288CDB90B0445509BDCD6378364C50D"><enum>(viii)</enum><text>total service credits;</text></clause><clause id="HC863F9FF5A334C99BA1B9CBF889A6F3F"><enum>(ix)</enum><text>retirement date; and</text></clause><clause commented="no" id="H0201DF5E517B4ECC8E0C65B4E447CA10"><enum>(x)</enum><text>with respect to an annuitant who was an employee of the United States Postal Service, the name of the facility that was the last place of employment of the annuitant.</text></clause></subparagraph><subparagraph id="H555438BDB6E4423C930D86AF7C76306E"><enum>(B)</enum><header>Exclusions</header><text>Such term does not include—</text><clause id="H049E66B0B9544F6DA3B9CBBB87EE5403"><enum>(i)</enum><text>information regarding a medical condition of the annuitant; or</text></clause><clause id="HEF82381ABD3E4ED38594C8C025B9EF65"><enum>(ii)</enum><text>any information identifying a designated beneficiary of the individual.</text></clause></subparagraph></paragraph></subsection><subsection id="HD3B5760A028140F0A8B0792E07F712C7"><enum>(c)</enum><header>Update of regulations</header><text>Not later than 30 days after the date of the enactment of this Act, the Director of the Office of Personnel Management shall update section 293.311 of title 5, Code of Federal Regulations, in accordance with the requirements of this section.</text></subsection></section><section id="H6642491796C54254921C45F15CCD4BC7"><enum>3.</enum><header>Disclosure, documentation, and reporting of performance awards</header><subsection id="H07A56A086C78490AA1DDA8A3B0CFFB45"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/45">chapter 45</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA684D35CFC644A05B0C87837CBA376D9" style="USC"><section id="HD176E2B7039049A7A4087BADFA43DDE6"><enum>4510.</enum><header>Disclosure, documentation, and reporting of performance awards</header><subsection id="H9D486513403B48FC980621F38BA70991"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H5C66C142F60F4B9BAD2F177614CD467B"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than 30 days after the end of fiscal year 2021 and each fiscal year thereafter, the head of each agency shall submit a report to the Director of the Office of Personnel Management describing each performance bonus awarded to an employee of the agency during the most recently ended fiscal year, the name of the employee receiving the bonus, and the amount of the bonus.</text></paragraph><paragraph id="HABC9395697DA429697D78FA84A1467B2" indent="up1"><enum>(2)</enum><text>With respect to any performance bonus included in a report submitted under paragraph (1) that was equal to or greater than $10,000, the agency head shall include in the report a detailed description of the reasons why the bonus was awarded and the metrics used to determine that such bonus was appropriate.</text></paragraph></subsection><subsection id="H76241165AE8D4F5BB5EE2F75A80F9E50"><enum>(b)</enum><text display-inline="yes-display-inline">Not later than January 1 of each fiscal year, the Director of the Office of Personnel Management shall—</text><paragraph id="H15C3BDE1F7B64FE59F37DFADE789C8E5"><enum>(1)</enum><text>publish, on the Office’s public internet website, a list containing the name of any employee receiving a performance bonus in the most recently ended fiscal year, the agency that awarded the bonus, and the amount of the bonus; and</text></paragraph><paragraph id="HE01858A9C7224468BED49934545B0B88"><enum>(2)</enum><text>submit a report to Congress containing a list of each performance bonus awarded in the most recently ended fiscal year that was equal to or greater than $10,000, including the reasons why the bonus was awarded and the metrics used to determine that the bonus was appropriate, as provided under subsection (a)(2).</text></paragraph></subsection><subsection id="H1BC3FD69B7E64A39B379BB6203DB307A"><enum>(c)</enum><text>For purposes of this section—</text><paragraph id="HE093217A2AFD42B885A7E4B45C7E04F9"><enum>(1)</enum><text>the term <term>agency</term> has the meaning given such term in section 4501 and includes—</text><subparagraph id="HA6F1385F842A45FCBDD2E648992E740D"><enum>(A)</enum><text>the United States Postal Service and the Postal Regulatory Commission; and</text></subparagraph><subparagraph id="H210B54C7FC1E49FBB35A650476759608"><enum>(B)</enum><text>notwithstanding the matter following subparagraph (G) of such section, the Tennessee Valley Authority and the Central Bank for Cooperatives; and</text></subparagraph></paragraph><paragraph id="H31F25487108344A199B53FAB8B46F839"><enum>(2)</enum><text>the term <term>performance bonus</term> includes any performance-based bonus, including a bonus under this subchapter or section 5384.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF89262718B8A4DAFAD5CB03B1FE289C8"><enum>(b)</enum><header>Application</header><text>The amendment made by subsection (a) shall apply to any performance bonus (as that term is described in section 4510 of title 5, United States Code, as added by such subsection) made on or after the date of enactment of this Act.</text></subsection><subsection id="HAA1C40BF1C4F468C9EEDCAA65D285EEB"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/45">chapter 45</external-xref> of title 5, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/5/4509">section 4509</external-xref> the following:</text><quoted-block display-inline="no-display-inline" id="HCCBD4AF46ACA4AE6915E41B1AAE8004C" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">4510.
