which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Administrator of the Small Business Administration to establish a forgivable loan program for certain businesses located near the United States and Canadian border, and for other purposes.</official-title></form><legis-body id="H995FAFE5D7B04F998DE1C27F4D328B88" style="OLC"><section section-type="section-one" id="H2B764F6376404309B2753BF18D859C39" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Point Roberts Small Business Fairness Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H9798E029A2D14ADDBDF60EA0648E54BB"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HF86B08A962D8421E94F5E5FEF129011B"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Small Business Administration.</text></paragraph><paragraph id="HE3F48963F0034EAFACB616C64D781633"><enum>(2)</enum><header>Covered business</header><text display-inline="yes-display-inline">The term <term>covered business</term> means a small business concern (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>))—</text><subparagraph id="H33DD194CAC444800B542A61B1883FFD6"><enum>(A)</enum><text>located in the contiguous United States;</text></subparagraph><subparagraph id="HDB4A1FB9008B4D7C82EDDEBE81CDA6A6"><enum>(B)</enum><text display-inline="yes-display-inline">located within 75 miles of the United States and Canadian border; and</text></subparagraph><subparagraph id="H4827907C93D444D3BDF54F06EA06ACB6" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">only accessible by land via Canada. </text></subparagraph></paragraph></section><section id="HEBE653B6863749AB85C5F7046197753B"><enum>3.</enum><header>Forgivable loan program for covered businesses</header><subsection id="HB6410DA4F0CB45EDA260A4716944C2E1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall establish a program to make forgivable loans available to covered businesses that had gross receipts during the second, third, or fourth quarter of 2020 that demonstrate a greater than 50 percent reduction from the gross receipts of the entity during the same quarter in 2019.</text></subsection><subsection id="HD61E160F4E8B431D8705DA393F24677D"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible for a forgivable loan under subsection (a), a covered business shall—</text><paragraph id="H13B3055A64CC4297BD32B646C83EE708"><enum>(1)</enum><text display-inline="yes-display-inline">have been in operation on March 1, 2020; and</text></paragraph><paragraph id="HECD790B76CC041D182575EA5CA8819B4"><enum>(2)</enum><text display-inline="yes-display-inline">show that the closure of the United States and Canadian border—</text><subparagraph id="H652FB2CB1F80404AB79525AB1B32ED03"><enum>(A)</enum><text>directly resulted in a reduction in the gross receipts of the covered business; or</text></subparagraph><subparagraph id="HC2522A9AE1DA4429AEF5096BFC78BF9E"><enum>(B)</enum><text display-inline="yes-display-inline">restricted the ability of customers to access the location of the covered business.</text></subparagraph></paragraph></subsection><subsection id="H990CD9293B9847AA962F3EB44BDAECB4"><enum>(c)</enum><header>Loan amount</header><text display-inline="yes-display-inline">The maximum loan amount under subsection (a) shall be equal to 75 percent of the gross annual receipts for the covered business for fiscal year 2019.</text></subsection><subsection id="H8B7BE3981508465DB3D1518155D1E87C"><enum>(d)</enum><header>Forgiveness</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall forgive 100 percent of the value of a loan made to a covered business under subsection (a) less the amount the covered business received from—</text><paragraph id="H6BEF057AF6784D3BA61CEA993B31E849"><enum>(1)</enum><text>any other loan forgiveness program, including any program established under the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>); or</text></paragraph><paragraph id="H54B204F337C14EA4B4D4B9D8197CC900"><enum>(2)</enum><text>an advance under section 1110 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
