Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to establish in the Department of Veterans Affairs an Advisory Committee on United States Outlying Areas and Freely Associated States, and for other purposes.</official-title></form><legis-body id="HBC80977974B24A44AD9EB14D6C894114" style="OLC"><section id="H12B774D349C34D21839A9ECD49EB1013" section-type="section-one"><enum>1.</enum><header>Department of Veterans Affairs Advisory Committee on United States Outlying Areas and Freely Associated States</header><subsection id="HD4C2D2985385420EAED5980312080056"><enum>(a)</enum><header>Establishment of Advisory Committee</header><paragraph id="HAD9A0FCA5AC042F1A87E6E9F6B0040E3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/5">chapter 5</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="H92E5B9953B5245958A32BF3B5432DBB6" display-inline="no-display-inline"><section id="HB861C20158D64316B72D878CAC53B324"><enum>548.</enum><header>Advisory Committee on United States Outlying Areas and Freely Associated States</header><subsection id="H72773D8818B84987BE7F225F2A75D4B9"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish an advisory committee, to be known as the <quote>Advisory Committee on United States Outlying Areas and Freely Associated States</quote>, to provide advice and guidance to the Secretary on matters relating to covered veterans.</text></subsection><subsection id="HFC58E60F582A4B199CAB4B76AAF1F4A2"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The duties of the Committee shall be the following:</text><paragraph id="HAD3CE93185DB408BBC5FCED3AE05B6B4"><enum>(1)</enum><text display-inline="yes-display-inline">To advise the Secretary on matters relating to covered veterans, including how the Secretary can improve the programs and services of the Department to better serve such veterans.</text></paragraph><paragraph id="H269CF2032D1044B892254B08283FF6AE"><enum>(2)</enum><text display-inline="yes-display-inline">To identify for the Secretary evolving issues of relevance to covered veterans.</text></paragraph><paragraph id="HF02315B93AD342DAB20C1BB05AB53EAF"><enum>(3)</enum><text>To propose clarifications, recommendations, and solutions to address issues raised by covered veterans.</text></paragraph><paragraph id="H22CABA7B84644F35BFCE0F8E18971C0E"><enum>(4)</enum><text>To provide a forum for covered veterans, veterans service organizations serving covered veterans, and the Department to discuss issues and proposals for changes to regulations, policies, and procedures of the Department.</text></paragraph><paragraph id="HBDE9158B976D4110B6CAB49E3CF1DFEF"><enum>(5)</enum><text display-inline="yes-display-inline">To identify priorities for and provide advice to the Secretary on appropriate strategies for consultation with veterans service organizations serving covered veterans.</text></paragraph><paragraph id="HC60CB9E0ED264BC1998664BCD62C4570"><enum>(6)</enum><text>To encourage the Secretary to work with other departments and agencies of the Federal Government and Congress to ensure covered veterans are provided the full benefits of their status as covered veterans.</text></paragraph><paragraph id="H812EAF7F4EDC451ABABA67FFF9701F4C"><enum>(7)</enum><text>To highlight contributions of covered veterans in the Armed Forces.</text></paragraph><paragraph id="HF7BE512C57104AB2B4C3C17FE0E01417"><enum>(8)</enum><text>To conduct other duties as determined appropriate by the Secretary.</text></paragraph></subsection><subsection id="H52FDE5E009DE4FABA5BBA1210D032E37"><enum>(c)</enum><header>Membership</header><paragraph commented="no" display-inline="yes-display-inline" id="H137AAFDDE49E4F2594E9B52AB2645E77"><enum>(1)</enum><text display-inline="yes-display-inline">The Committee shall be comprised of 15 voting members appointed by the Secretary.</text></paragraph><paragraph id="H0FDA729257194383A17C12F48BC27C7E" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In appointing members pursuant to paragraph (1), the Secretary shall ensure the following:</text><subparagraph id="H367E3F8D3605468D85183F9927418670"><enum>(A)</enum><text display-inline="yes-display-inline">At least one member is appointed to represent covered veterans in each of the following areas:</text><clause id="HEC955A4B96FF4671AE0421B6F4DBFCC3" display-inline="no-display-inline"><enum>(i)</enum><text>American Samoa.</text></clause><clause id="HBD14201AEEA94EC3872DC1C503F50739"><enum>(ii)</enum><text>Guam.</text></clause><clause id="H5BE01E4E8FAF47368242EAC474580310"><enum>(iii)</enum><text>Puerto Rico.</text></clause><clause id="HDE71FC3B398C4066A971ABEFFABFC861"><enum>(iv)</enum><text display-inline="yes-display-inline">The Commonwealth of the Northern Mariana Islands.</text></clause><clause id="HD2BD4DB4CAE2417D80FB1A7235F664EC"><enum>(v)</enum><text display-inline="yes-display-inline">The Virgin Islands of the United States.</text></clause><clause id="HCF81408122DA4711999CA0C915328B59"><enum>(vi)</enum><text display-inline="yes-display-inline">The Federated States of Micronesia.</text></clause><clause id="H66F1309800984091B152CBD9553E5C07"><enum>(vii)</enum><text display-inline="yes-display-inline">The Republic of the Marshall Islands.</text></clause><clause id="HD91A5FCCDF374CE8997388564883F09C"><enum>(viii)</enum><text display-inline="yes-display-inline">The Republic of Palau.</text></clause></subparagraph><subparagraph id="HFF820EBB0A2D423EBA6951E60328ED4D"><enum>(B)</enum><text display-inline="yes-display-inline">Not fewer than half of the members appointed are covered veterans, unless the Secretary determines that an insufficient number of qualified covered veterans are available.</text></subparagraph><subparagraph id="H05CB72E73E894FBB81C8C16572AE01CE" commented="no"><enum>(C)</enum><text>Each member appointed resides in an area specified in subparagraph (A).</text></subparagraph></paragraph><paragraph id="H4507497A9980437099B00F80BA01F47F" indent="up1"><enum>(3)</enum><text>In appointing members pursuant to paragraph (1), the Secretary may consult with any Member of Congress who represents an area specified in paragraph (2)(A).</text></paragraph></subsection><subsection id="HBBFAD43921EB4FDD89D54D13479A9B5E"><enum>(d)</enum><header>Terms; vacancies</header><paragraph commented="no" display-inline="yes-display-inline" id="HF048C2F0596441CE9113940C9BF3E935"><enum>(1)</enum><text>A member of the Committee shall be appointed for a term of two years.</text></paragraph><paragraph id="HB6750E972B8849B6A564E85988932261" indent="up1"><enum>(2)</enum><text>Not later than 180 days after receiving notice of a vacancy in the Committee, the Secretary shall fill the vacancy in the same manner as the original appointment.</text></paragraph></subsection><subsection id="HBBB4B15E468B4E2F93043C91AE3F69C8"><enum>(e)</enum><header>Meeting format and frequency</header><paragraph commented="no" display-inline="yes-display-inline" id="H96FF77B5E2F94164921328A79833BA04"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (2), the Committee shall meet in-person with the Secretary not less frequently than twice each year and hold monthly conference calls as necessary.</text></paragraph><paragraph id="HFDE121715270430D92262442EE089016" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Meetings held under paragraph (1) may be conducted virtually during a public health emergency declared by the Secretary of Health and Human Services pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) or any renewal of such declaration.</text></paragraph></subsection><subsection id="H6AD7094FD57E4208BD253A3A1F6F5325"><enum>(f)</enum><header>Additional Representation</header><paragraph commented="no" display-inline="yes-display-inline" id="HEF2B10E92CF745FC9934BC24799B7B63"><enum>(1)</enum><text display-inline="yes-display-inline">Representatives of relevant departments and agencies of the Federal Government may attend meetings of the Committee and provide information to the Committee.</text></paragraph><paragraph id="HFC81035B63834A079CE40A7034B3462F" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">One representative of the Department shall attend each meeting of the Committee.</text></paragraph><paragraph id="H2396519B90CD4E23B86063E5FFF2B240" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Representatives attending meetings under this subsection—</text><subparagraph id="HACF84346230348B8B6C6EDD1833D643A"><enum>(A)</enum><text>shall not be considered voting members of the Committee; and</text></subparagraph><subparagraph id="HB6F9E7FFB59E442B97C89502601F78AA"><enum>(B)</enum><text>may not receive additional compensation for services performed with respect to the Committee.</text></subparagraph></paragraph></subsection><subsection id="HC3DD66756F3E43969792A866028D61F7"><enum>(g)</enum><header>Subcommittees</header><paragraph commented="no" display-inline="yes-display-inline" id="HEE1AEB45E00B4DBFB280958E21DD6FAB"><enum>(1)</enum><text display-inline="yes-display-inline">The Committee may establish subcommittees.</text></paragraph><paragraph id="H6AFD7861016A40D787CA0CD1EE51DF47" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may, in consultation with the Committee, appoint a member to a subcommittee established under paragraph (1) who is not a member of the Committee.</text></paragraph><paragraph id="H1014218089DB4A098F0584F539EDF66C" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A subcommittee established under paragraph (1) may enhance the function of the Committee, but may not supersede the authority of the Committee or provide direct advice or work products to the Secretary.</text></paragraph></subsection><subsection id="H6711126CA7304B9DB735E1450021F048"><enum>(h)</enum><header>Reports</header><paragraph commented="no" display-inline="yes-display-inline" id="HFBC53675A60F4674907DA97A942D0AD0"><enum>(1)</enum><text display-inline="yes-display-inline">Not less frequently than once each year, the Committee shall submit to the Secretary and the appropriate committees of Congress a report containing such recommendations as the Committee may have for legislative or administrative action.</text></paragraph><paragraph id="H3CAA6A3232C848B59D25D2400AC0D5CB" indent="up1"><enum>(2)</enum><text>Not later than 90 days after the date on which the Secretary receives a report under paragraph (1), the Secretary shall submit to the appropriate committees of Congress a written response to the report after—</text><subparagraph id="HD343842D22664407898636BB6C5CCACF"><enum>(A)</enum><text display-inline="yes-display-inline">giving the Committee an opportunity to review such written response; and</text></subparagraph><subparagraph id="HF233BFFA98544C8793D62DD2EF745C05"><enum>(B)</enum><text>including in such written response any comments the Committee considers appropriate. </text></subparagraph></paragraph><paragraph id="HF4A4874B0DF648E7A87DB7610E799B56" indent="up1"><enum>(3)</enum><text>Not less frequently than once every two years, the Committee shall submit to the Secretary and the appropriate committees of Congress a report describing the activities of the Committee during the previous two years.</text></paragraph><paragraph id="HDF744FC23AF54CC186679520D4970F9A" indent="up1"><enum>(4)</enum><text>The Secretary shall make publicly available on an internet website of the Department—</text><subparagraph id="H733D8420D0D44DA39C5ED7D154BD1FBA"><enum>(A)</enum><text display-inline="yes-display-inline">each report the Secretary receives under paragraph (1);</text></subparagraph><subparagraph id="H4A038954051F464F9C49B63A8D5CE41C"><enum>(B)</enum><text>each written response the Secretary submits under paragraph (2); and</text></subparagraph><subparagraph id="HA1DB989F8D7149CD9BE192276E671726"><enum>(C)</enum><text>each report the Secretary receives under paragraph (3).</text></subparagraph></paragraph></subsection><subsection id="H3A20D3BB6A404CBB8ED7D63A6F283C50"><enum>(i)</enum><header>Committee personnel matters</header><text display-inline="yes-display-inline">A member of the Committee shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5 while away from the home or regular place of business of the member in the performance of the duties of the Committee.</text></subsection><subsection id="HAA0109DE1A21415FA5B198D3322C892F"><enum>(j)</enum><header>Consultation</header><text>In carrying out this section, the Secretary shall consult with veterans service organizations serving covered veterans. </text></subsection><subsection id="H6FA6CDEB44E54F79BAAED0475D74EB19"><enum>(k)</enum><header>Federal Advisory Committee Act exemption</header><text display-inline="yes-display-inline">Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Committee.</text></subsection><subsection id="H78B656EF3E954D89B8716062B9752148"><enum>(l)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H64CD515DA749437A985652504E81C07C"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="H6F9A8859F2584821BE1AA347242F39EE"><enum>(A)</enum><text>the Committee on Veterans’ Affairs of the House of Representatives; and</text></subparagraph><subparagraph id="H80BD1F5D02994C6C8DC9B75CE7E92EBA"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Veterans’ Affairs of the Senate.</text></subparagraph></paragraph><paragraph id="H56C276A53D0645D195D06A0C06B8598B"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>Committee</term> means the Advisory Committee on United States Outlying Areas and Freely Associated States established under subsection (a).</text></paragraph><paragraph id="H7A66FEB8002F4E19BB3A47F8CE136FDC"><enum>(3)</enum><text display-inline="yes-display-inline">The term ‘covered veteran’ means a veteran residing in an area specified in subsection (c)(2)(A).</text></paragraph><paragraph id="HABAF0C1D328A42A79C6D09B3FD065AFF"><enum>(4)</enum><text>The term ‘veterans service organization serving covered veterans’ means any organization that—</text><subparagraph id="HEAFA803B7CA446489BFC6534D65A79BA"><enum>(A)</enum><text display-inline="yes-display-inline">serves the interests of covered veterans;</text></subparagraph><subparagraph id="HB14BD46420324DB8B11E97A0EABF5C13"><enum>(B)</enum><text>has covered veterans in substantive and policymaking positions within the organization; and</text></subparagraph><subparagraph id="HACE9664A7E1E44619325D3B1F239898E"><enum>(C)</enum><text>has demonstrated experience working with covered veterans.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H0FA318533AED43B7983ADD2A261EE4A2"><enum>(2)</enum><header>Clerical Amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 5 of such title is amended by inserting after the item relating to section 547 the following new item: </text><quoted-block style="USC" id="H1C58238852D6400F99A28A6B95F9DE42" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">548. Advisory Committee on United States Outlying Areas and Freely Associated States</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA2C5FD5386E643E29A3D623FF7145A0C"><enum>(b)</enum><header>Deadline for establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall establish the advisory committee required by section 548 of title 38, United States Code, as added by subsection (a)(1) of this section.</text></subsection><subsection id="H69951B116E274943BD681019AA9AA75A"><enum>(c)</enum><header>Deadline for initial appointments</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Secretary establishes the advisory committee required by such section 548, the Secretary shall appoint the members of such advisory committee.</text></subsection><subsection id="H2A0D63432E4A45F690F6752D373845FF"><enum>(d)</enum><header>Initial meeting</header><text display-inline="yes-display-inline">Not later than 120 days after the date on which the Secretary establishes the advisory committee required by such section 548, such advisory committee shall hold its first meeting.</text></subsection></section></legis-body></bill>
