<section id="H5AD513F09D314ED181A3CD499D54D6BD" section-type="section-one"><enum>1.</enum><header>Assistance to firefighters fire station construction grants</header>
<subsection id="H21355C92081C4EB4888163CFE7EF4CBB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Federal Emergency Management Agency shall establish a grant program to provide financial assistance to modify, upgrade, and construct fire and (EMS) department facilities.</text></subsection> <subsection id="H77FBA6CDB59F4003AA60FFF0AAA2A1A8"><enum>(b)</enum><header>Eligible applicants</header><text>The Administrator may make a grant under this section to the following:</text>
<paragraph id="H47587403C9594C3A924F1BDB25985E22"><enum>(1)</enum><text>Career, volunteer, and combination fire departments.</text></paragraph> <paragraph id="HEA5E1427969247CE94ABF199D24F0B77"><enum>(2)</enum><text>Fire training facilities.</text></paragraph>
<paragraph id="HE99312693B554C4FBA74B693A7146F7B"><enum>(3)</enum><text>Nonaffiliated EMS organizations, combination and volunteer emergency medical stations (except that for-profit EMS organizations are not eligible for a grant under this section).</text></paragraph></subsection> <subsection id="HB69DF6AED8174C57963151F45382A71A"><enum>(c)</enum><header>Applications</header><text>To be eligible for a grant under this section, an entity specified in subsection (b) shall submit to the Administrator an application in such form, at such time, and containing such information as the Administrator determines is appropriate.</text></subsection>
<subsection id="H4FCA6CFBA7D64E19AE79BDE165F5390E" display-inline="no-display-inline"><enum>(d)</enum><header>Meeting for recommendations</header>
<paragraph id="H4502823F54DC48999093868CA635200C"><enum>(1)</enum><header>In general</header><text>The Administrator shall convene a meeting of qualified members of national fire service organizations and, at the discretion of the Administrator, qualified members of emergency medical service organizations to obtain recommendations regarding the criteria for the awarding of grants under this section.</text></paragraph> <paragraph id="HE4FB3AC949E14615BAEBAA982C01092E"><enum>(2)</enum><header>Qualifications</header><text display-inline="yes-display-inline">For purposes of this subsection, a qualified member of an organization is a member who—</text>
<subparagraph id="H0FADAD9E1436412D97698B760DA6E61A"><enum>(A)</enum><text>is recognized for expertise in firefighting or emergency medical services;</text></subparagraph> <subparagraph id="HA8D3E330A0314F43B39552BC892E55BE"><enum>(B)</enum><text>is not an employee of the Federal Government; and</text></subparagraph>
<subparagraph id="HC6CC3A5482CB4A77A7045B61E9B57342"><enum>(C)</enum><text>in the case of a member of an emergency medical service organization, is a member of an organization that represents—</text> <clause id="H2FA8C039597042739268D63E10D896E3"><enum>(i)</enum><text>providers of emergency medical services that are affiliated with fire departments; or</text></clause>
<clause id="HD150B54D4A3C483DB066B265876ADD51"><enum>(ii)</enum><text>nonaffiliated EMS providers.</text></clause></subparagraph></paragraph></subsection> <subsection id="HC939D1EB6DA3427485193CFCCCCDEFC4"><enum>(e)</enum><header>Peer review of grant application</header><text display-inline="yes-display-inline">The Administrator shall, after consultation with national fire service and emergency medical services organizations, appoint fire service personnel to conduct peer reviews of applications received under subsection (c).</text></subsection>
<subsection id="H2ABD3AA213A3414B8AC3EEDED63220DB"><enum>(f)</enum><header>Priority of grants</header><text display-inline="yes-display-inline">In awarding grants under this section, the Administrator shall consider the findings and recommendations of the peer reviews carried out under subsection (e).</text></subsection> <subsection id="H3E755754FDD0457AA86AB7F7965763D8"><enum>(g)</enum><header>Uses of funds</header> <paragraph id="H8A24CD9382534D9FBAB6FC317C3F1A6E"><enum>(1)</enum><header>In general</header><text>A recipient of a grant under this section may use funds received for the following:</text>
<subparagraph id="H1B5526B30CA84B45B0D539CC8CFA2278"><enum>(A)</enum><text>Build, rebuild, or renovate fire and EMS department facilities.</text></subparagraph> <subparagraph id="H2B94AAB20E1348D38674E8321E23CB18"><enum>(B)</enum><text>Upgrade existing facilities to install exhaust emission control systems, install backup power systems, upgrade or replace environmental control systems (such as HVAC systems), remove or remediate mold, and construct or modify living quarters for use by male and female personnel.</text></subparagraph>
<subparagraph id="H132933088FE34FD5B17430C9F11B3A5E"><enum>(C)</enum><text display-inline="yes-display-inline">Upgrade fire and EMS stations or build new stations.</text></subparagraph></paragraph> <paragraph id="H2EA8BE17C9284829BDB85F124F1B6744"><enum>(2)</enum><header>Code compliant</header><text display-inline="yes-display-inline">In using funds under paragraph (1), a grant recipient is required to meet 1 of the 2 most recently published editions of building codes and standards established by the National Fire Protection Association and International Code Council, including NFPA 101, Life Safety Code and NFPA 1581, Standard on Fire Department Infection Control Program.</text></paragraph></subsection>
<subsection id="H80D27F404FB44D1A9B98A69B107B2A65"><enum>(h)</enum><header>Grant funding</header>
<paragraph id="H552E9AA904B545529DA84529DC2A16B5"><enum>(1)</enum><header>In general</header><text>The Administrator shall allocate grant funds as follows:</text> <subparagraph id="H9E464B74E5E34E94AB42C7065DD12E8C"><enum>(A)</enum><text display-inline="yes-display-inline">25 percent for career fire and EMS departments.</text></subparagraph>
<subparagraph id="HB4281AF10CC948A69FBA18F6A547B623"><enum>(B)</enum><text>25 percent for combination fire and EMS departments.</text></subparagraph> <subparagraph id="H1A6BAE9957474951B1ACADB9E1330A53"><enum>(C)</enum><text>25 percent for volunteer fire and EMS departments.</text></subparagraph>
<subparagraph id="H327F0213982F4D9891532BDBD494F50D"><enum>(D)</enum><text>25 percent to remain available for competition between the various department types.</text></subparagraph></paragraph> <paragraph id="H63CC153F743044629EE7560F61BCD134"><enum>(2)</enum><header>Insufficient applications</header><text>If the Administrator does not receive sufficient funding requests from a particular department type specified in subparagraphs (A) through (C) of paragraph (1), the Administrator may make awards to other departments in such paragraphs.</text></paragraph>
<paragraph id="HC639A06619C941E49B0FC5FEFE1836DD"><enum>(3)</enum><header>Limitation on awards amounts</header><text>A grant recipient may not receive more than $7,500,000 under this section.</text></paragraph></subsection> <subsection id="H4EDE450532C74154A4E05B3104C48F90"><enum>(i)</enum><header>Prevailing rate of wage and public contracts</header> <paragraph id="H6C6AEF9B237B498FB337819A59F65D51"><enum>(1)</enum><header>In general</header><text>All laborers and mechanics employed by contractors or subcontractors in the performance of construction work financed with the assistance of any contribution of Federal funds made by the Administrator under this section shall be paid wages at rates not less than those prevailing on similar construction in the locality as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40 (commonly known as the <quote>Davis-Bacon Act</quote>), and every such employee shall receive compensation at a rate not less than one and <fraction>1⁄2</fraction> times the basic rate of pay of the employee for all hours worked in any workweek in excess of eight hours in any workday or 40 hours in the workweek, as the case may be. The Administrator shall make no contribution of Federal funds without first obtaining adequate assurance that these labor standards will be maintained upon the construction work. The Secretary of Labor shall have, with respect to the labor standards specified in this subsection, the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (5 U.S.C. App.) and section 2 of the Act of June 13, 1934 (<external-xref legal-doc="usc" parsable-cite="usc/40/276">40 U.S.C. 276(c)</external-xref>).</text></paragraph>
<paragraph id="H274D6AFF16484670B147F47EB7171D65"><enum>(2)</enum><header>Public contracts</header><text display-inline="yes-display-inline">In addition to the wage rate set forth in paragraph (1), contractors and subcontractors performing construction work pursuant to this section shall follow the standards identified in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/83">chapter 83</external-xref> of title 41, United States Code, including a requirement that all supplies and construction materials purchased shall be produced in the United States, unless such materials are not reasonably available, or such a purchase would not be in the public interest. </text></paragraph></subsection> <subsection id="H5AC90575640241659E800D88F038587E"><enum>(j)</enum><header>Applicability of FACA</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to activities carried out pursuant to this section.</text></subsection>
<subsection id="H47C612D017C04650BA99421082FD3A07"><enum>(k)</enum><header>Definitions</header><text>For purposes of this section, the following definitions apply:</text> <paragraph id="H76625A9599954A46B4FBAF195E953AB4"><enum>(1)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the Federal Emergency Management Agency. </text></paragraph>
<paragraph id="H3F0AEC2BFB2A476BBBCAD207FCB33638"><enum>(2)</enum><header>Career fire department</header><text display-inline="yes-display-inline">The term <quote>career fire department</quote> means a fire department that has an all-paid force of firefighting personnel other than paid-on-call firefighters.</text></paragraph> <paragraph id="H7C1B2BEDC2A3409D9537DD81589205ED"><enum>(3)</enum><header>Combination fire department</header><text display-inline="yes-display-inline">The term <quote>combination fire department</quote> means a fire department that has—</text>
<subparagraph id="HEA909D59A4DE4B58B69A9B902C670364"><enum>(A)</enum><text>paid firefighting personnel; and</text></subparagraph> <subparagraph id="HAE9BD88B37AE43698552161ADD5EB317"><enum>(B)</enum><text>volunteer firefighting personnel.</text></subparagraph></paragraph>
<paragraph id="H38DD4545C89241E2BFA079BC87F96068"><enum>(4)</enum><header>EMS</header><text>The term <quote>EMS</quote> means emergency medical services. </text></paragraph> <paragraph id="HD1575B79CFBF409AA60EEE0A804E868C"><enum>(5)</enum><header>Nonaffiliated EMS organization</header><text display-inline="yes-display-inline">The term <quote>nonaffiliated EMS organization</quote> means a public or private nonprofit emergency medical services organization that is not affiliated with a hospital and does not serve a geographic area in which the Administrator finds that emergency medical services are adequately provided by a fire department.</text></paragraph>
<paragraph id="H99647ECB1EC748B3B4F7FE7EBBEDFA46"><enum>(6)</enum><header>Volunteer fire department</header><text display-inline="yes-display-inline">The term <quote>volunteer fire department</quote> means a fire department that has an all-volunteer force of firefighting personnel.</text></paragraph></subsection> <subsection id="HEFB0DE49FF34491C9523454739C45BAE"><enum>(l)</enum><header>Reporting requirements</header> <paragraph id="H2295341D052C4BF68B6BFC7A86E00303"><enum>(1)</enum><header>Annual report to administrator of FEMA</header><text display-inline="yes-display-inline">Beginning 1 year after the date of enactment of this section and every year thereafter during the term of a grant awarded under this section, a recipient of the grant shall submit to the Administrator an annual report describing how the recipient used such grant amounts. </text></paragraph>
<paragraph id="HE9CD4249234F4F5FA04559B287185218"><enum>(2)</enum><header>Annual report to Congress</header><text display-inline="yes-display-inline">Beginning 1 year after the date of enactment of this section and every year thereafter until the rebuilding or renovation of fire facilities and stations are completed using grant funds under this section, the Administrator shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committees on Transportation and Infrastructure and Science, Space, and Technology of the House of Representatives a report that provides an evaluation of the effectiveness of the grants awarded under this section. </text></paragraph></subsection> <subsection id="H1339099407B24E928F112CFC3F051DE5"><enum>(m)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $1,000,000,000 for fiscal year 2022 to carry out this section. Such funds shall remain available until expended.</text></subsection></section>
