which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Archivist of the United States to address certain record request backlogs, and for other purposes.</official-title></form><legis-body id="HBB4E2125B68F466B9A17D9E6C7686727" style="OLC"><section id="H498703172618465AA2157AEF107F66DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reopening to address Every COmplete Record request for Devoted Servicemembers Act of 2021</short-title></quote> or the <quote><short-title>RECORDS Act of 2021</short-title></quote> .</text></section><section id="HF2E57BDE490D48E388CBCEC454A36D4E"><enum>2.</enum><header>National Personnel Records Center backlog reduction</header><subsection id="H5213F9BFB2B24AFFB099A8A9B8D5AEF1"><enum>(a)</enum><header>Staffing levels</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Archivist of the United States shall take such actions as are necessary to ensure—</text><paragraph id="H72AB15ABB2E74FCBA203BDBF8EA8FD5D"><enum>(1)</enum><text>the number of individuals employed by the National Personnel Records Center is equal to or exceeds the number of such individuals employed on March 2, 2020; and</text></paragraph><paragraph id="H5581E2840DA147C7A0BE3B94788FE86D"><enum>(2)</enum><text display-inline="yes-display-inline">the percentage of such individuals regularly reporting to work in person is equal to or exceeds the percentage of such individuals regularly reporting to work in person on March 2, 2020.</text></paragraph></subsection><subsection id="H039DF4D735A042E6AC741BAF33AA7B88"><enum>(b)</enum><header>Comprehensive plan</header><paragraph id="H46704066DB494F148AE01B03541CBCF3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Archivist of the United States shall submit to the appropriate congressional committees a report that—</text><subparagraph id="H12E2FF98E88443CE8D0F36EF231AE403"><enum>(A)</enum><text>provides a comprehensive plan to address the record request backlog of the National Personnel Records Center and improve the efficiency and responsiveness of operations at the Center;</text></subparagraph><subparagraph id="H23232B2950ED4329834CA319A683495D"><enum>(B)</enum><text>identifies measurable goals with respect to the comprehensive plan and metrics for tracking progress toward such goals; and</text></subparagraph><subparagraph id="H11A9FF58E0CE4AA4A4541A0B0140960C"><enum>(C)</enum><text>describes strategies to prevent future record request backlogs, including backlogs caused by an event that prevents employees of the Center from reporting to work in person.</text></subparagraph></paragraph><paragraph id="HEF877AEE392B4AA2B44938897DC2BD09"><enum>(2)</enum><header>Updates</header><text display-inline="yes-display-inline">Not later than 90 days after submission of the report required under paragraph (1) and quarterly thereafter, the Archivist of the United States shall submit to the appropriate congressional committees an update of such report that—</text><subparagraph id="HC62E89B90D4E4C0989A969BFA8957632"><enum>(A)</enum><text>describes progress made by the National Personnel Records Center during the preceding 90-day period with respect to record request backlog reduction and efficiency and responsiveness improvement; </text></subparagraph><subparagraph id="HEB4A5948321B41569E9DC7ABC8EF40E8"><enum>(B)</enum><text>provides data on progress made toward the goals identified in such report; and</text></subparagraph><subparagraph id="HF6974C555102436BB7AB144A67B2424C"><enum>(C)</enum><text display-inline="yes-display-inline">describes any changes made to the comprehensive plan provided in such report. </text></subparagraph></paragraph><paragraph id="HC6CCBB9FFF244562A7E7D327242E31D6"><enum>(3)</enum><header>Consultation requirement</header><text display-inline="yes-display-inline">In carrying out this subsection, the Archivist of the United States shall consult with the Secretary of Veterans Affairs on best practices for reducing record request backlogs.</text></paragraph><paragraph id="H13975D3049FA41EBACA58F8C2BB954F6"><enum>(4)</enum><header>Appropriate congressional committees defined</header><text>In this subsection, the term <term>appropriate congressional committees</term> means—</text><subparagraph id="H95A6A89D504F43D094659DF8877DBB7D"><enum>(A)</enum><text>in the House of Representatives—</text><clause id="HB6F2A6556A7E497C8F23628C36825983"><enum>(i)</enum><text>the Committee on Oversight and Reform; and</text></clause><clause id="HFF077F4945FC4104A39CFE5EF762907F"><enum>(ii)</enum><text>the Committee on Veterans’ Affairs; and</text></clause></subparagraph><subparagraph id="HBCB2C89E2A77443C989C3BCDB2953BA3"><enum>(B)</enum><text>in the Senate—</text><clause id="HB2F2057C47784D1187B4307B0BD28ED2"><enum>(i)</enum><text>the Committee on Homeland Security and Governmental Affairs; and</text></clause><clause id="HCD4ACF4D17D64279823953A4C1B418CC"><enum>(ii)</enum><text>the Committee on Veterans’ Affairs.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
