which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require recipients of assistance for certain water infrastructure projects to provide job training, apprenticeships, and other employment opportunities for low-income persons and very low-income persons, and for other purposes.</official-title></form><legis-body id="H467915D6920E4CF6B5B70B9B03D5DBA5" style="OLC"><section id="H7D181DCF800845BC94DE8C4E4D3099EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Water Investments Benefit Communities Act</short-title></quote>.</text></section><section id="H27BC334F3FFE4C8F8A510455037F10B3"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text><paragraph id="H71BD3AF7730A4CEB84464173B6469C89"><enum>(1)</enum><text>Federal water infrastructure investments provide State and local governments and other recipients of Federal financial assistance with substantial support for activities that produce significant employment and other economic opportunities;</text></paragraph><paragraph id="HC0BBD72FF64545B8AD5DBB250A4E1391"><enum>(2)</enum><text display-inline="yes-display-inline">low-income persons and very low-income persons, who live in the areas in most need of such investments, often have restricted access to employment and other economic opportunities;</text></paragraph><paragraph id="H57B77DBE17384B799335121AB20593DF"><enum>(3)</enum><text display-inline="yes-display-inline">the employment and other economic opportunities generated by projects and activities that receive Federal water infrastructure investments offer an effective means of empowering low-income persons and very low-income persons, particularly those who live in the areas where these funds are being used to improve water infrastructure; and</text></paragraph><paragraph id="HFFD5FB2006BC4185A8FC987977A95FDD"><enum>(4)</enum><text display-inline="yes-display-inline">Federal efforts to invest in water infrastructure should also help create employment and other economic opportunities for low-income persons and very low-income persons in areas where these projects are taking place.</text></paragraph></section><section id="HC5870C9CD6BF4F29BBAEBD61EAE0EED3"><enum>3.</enum><header>Employment opportunities at water infrastructure projects</header><subsection id="H69AB0DEDC0F348628A9447B0E74BA406"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency shall require a covered entity, to the greatest extent feasible, and consistent with existing Federal, State, and local laws and regulations, to provide job training, apprenticeships, and other employment opportunities on a covered project for low-income persons and very low-income persons in the area in which the covered project is located, and to business concerns that provide employment opportunities to low-income persons and very low-income persons.</text></subsection><subsection id="H3E048AF02CC94C0AB73AF6425DC21717"><enum>(b)</enum><header>Priority</header><text display-inline="yes-display-inline">In carrying out subsection (a), the Administrator shall require a covered entity to provide job training, apprenticeships, and other employment opportunities in the following order of priority:</text><paragraph id="H82902F238B50475DAEAFA133A272E59A"><enum>(1)</enum><text display-inline="yes-display-inline">To low-income persons and very low-income persons residing within the service area of the covered project or the neighborhood in which the covered project is located.</text></paragraph><paragraph id="HE3C4ABE26D99422282AD356B470DAB02"><enum>(2)</enum><text display-inline="yes-display-inline">To low-income persons and very low-income persons residing within the metropolitan area (or nonmetropolitan county) in which the covered assistance is expended.</text></paragraph><paragraph id="H0FA43F9292A54247BA24F42E2D218623" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">To residents of an area described in paragraph (1) or (2) who are provided any assistance under a means-tested program administered by a Federal agency, including housing, supplemental nutrition, and temporary needy family assistance.</text></paragraph><paragraph id="HC606866FD4AF4253A89D6E00E291E3CC" commented="no"><enum>(4)</enum><text>To participants in YouthBuild programs under section 171 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3226">29 U.S.C. 3226</external-xref>) or the Job Corps program under subtitle C of title I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3191">29 U.S.C. 3191 et seq.</external-xref>).</text></paragraph></subsection><subsection id="H4A203F6EDFCE466A990369171B1358E5"><enum>(c)</enum><header>State plans and reports</header><text>With respect to a covered entity that is a State, the Administrator shall require the State to—</text><paragraph id="H83FEFCAA43E3480EB009828D4ED48DB3"><enum>(1)</enum><text>submit to the Administrator for approval a plan for carrying out the requirements of this section; and </text></paragraph><paragraph id="H765EC3F7420541B78354F238369D5E83"><enum>(2)</enum><text display-inline="yes-display-inline">annually submit to the Administrator a report containing data on job training, apprenticeship, employment, and contract opportunities created in the State pursuant to this section, including, for each covered project carried out by the State or for which covered assistance is provided by the State—</text><subparagraph id="HCE2E4DC60B4A4CF08A138BFD6A1F3670"><enum>(A)</enum><text>how many jobs and other opportunities were created to comply with this section;</text></subparagraph><subparagraph id="H9A1B0C8355BD4AFEAC00A79C13882109"><enum>(B)</enum><text>the total of amount of covered assistance used on the covered project; and</text></subparagraph><subparagraph id="HF4AB64BD37B44969AA040CF4BD47A5C0"><enum>(C)</enum><text>the amount of covered assistance used to hire low-income persons and very low-income persons to comply with this section.</text></subparagraph></paragraph></subsection><subsection id="H953C261F860C49E8B7C11AA4A8F3034E"><enum>(d)</enum><header>Regulations</header><paragraph id="H363CD98599274408965F5F06832C7A90"><enum>(1)</enum><header>Deadline</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall issue regulations to implement this section.</text></paragraph><paragraph id="HC2B6954E99D540649F5B705F698E8581"><enum>(2)</enum><header>Application date</header><text display-inline="yes-display-inline">The regulations issued under paragraph (1) shall apply to covered assistance made available beginning in the first full fiscal year following the date of enactment of this Act.</text></paragraph><paragraph id="HFB7C110872E749F48EE4CC4A46A274C2"><enum>(3)</enum><header>Complaint process</header><text display-inline="yes-display-inline">The Administrator shall include in the regulations issued under paragraph (1) a process by which affected persons or entities may file a complaint alleging a violation of this section.</text></paragraph></subsection><subsection id="H4DF19D44DA254D23ACA63084BD37EF1A"><enum>(e)</enum><header>Consultation</header><text>In carrying out this section, the Administrator shall consult with the Secretary of Labor, the Secretary of Health and Human Services, the Secretary of Commerce, the Secretary of Housing and Urban Development, the Secretary of Transportation, the Administrator of the Small Business Administration, and such other Federal agencies as the Administrator determines are necessary.</text></subsection><subsection id="H939D72BDEC8940ADA2C27D67AD90763A"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0C6E66898DE9404693DBC11E5D300E08"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="HCEF35E501DD34D3290BE6E0A7865316D" commented="no"><enum>(2)</enum><header>Apprenticeship</header><text display-inline="yes-display-inline">The term <term>apprenticeship</term> means an apprenticeship registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>).</text></paragraph><paragraph id="H8804B3C3E4934CEE80390A317F4596B5"><enum>(3)</enum><header>Business concern that provides economic opportunities</header><text display-inline="yes-display-inline">The term <term>business concern that provides economic opportunities</term> has the meaning given such term in section 3 of the Housing and Urban Development Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701u">12 U.S.C. 1701u</external-xref>).</text></paragraph><paragraph id="H6978F5517E8D40ECB180CEEFE1977D25"><enum>(4)</enum><header>Covered assistance</header><text>The term <term>covered assistance</term> means financial assistance provided under or pursuant to section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>), title VI of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381 et seq.</external-xref>), or the <short-title>Water Infrastructure Finance and Innovation Act of 2014</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/33/3901">33 U.S.C. 3901 et seq.</external-xref>).</text></paragraph><paragraph id="HF648ED5E59A24CC3971C5A204B437402"><enum>(5)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means—</text><subparagraph id="H5AD892C83D884145BC8598E3AC244DC7"><enum>(A)</enum><text>an entity that receives covered assistance; and</text></subparagraph><subparagraph id="HF2644CC52FB449768E4CF6A4E412AAD0"><enum>(B)</enum><text>a contractor or subcontractor of such entity with respect to a covered project.</text></subparagraph></paragraph><paragraph id="HBFEC901824C64C269D56C9C0E2354A72"><enum>(6)</enum><header>Covered project</header><text>The term <term>covered project</term> means a project for which an entity receives covered assistance.</text></paragraph><paragraph id="H50CA51D3D3F9460594AC9A1C493FC2ED" commented="no"><enum>(7)</enum><header>Low-income person; very low-income person</header><text display-inline="yes-display-inline">The terms <term>low-income person</term> and <term>very low-income person</term> have the same meanings given the terms <term>low-income families</term> and <term>very low-income families</term>, respectively, in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
