Treatment of certain records of criminal investigations.</toc-entry></toc></subsection></section><section id="HF8EACBB54F0C40B99AC2E3A5B0CF7D71"><enum>2.</enum><header>Pretrial confinement</header><subsection id="H5C47AEF304974CF6AE1CBD97D35F550A"><enum>(a)</enum><header>Standard for pretrial confinement</header><text display-inline="yes-display-inline">Section 809(d) of title 10, United States Code (article 9(d) of the Uniform Code of Military Justice), is amended to read as follows:</text><quoted-block style="USC" id="H8912F4E340BE4A6BBCB8E55ECB4BDD38" display-inline="no-display-inline"><subsection id="H0645342FD1864F15A7A1B675EBCAD7B9"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HBE020B1E7AD6487C8220D43369E1D721"><enum>(1)</enum><text display-inline="yes-display-inline">No person may be ordered into arrest except for probable cause.</text></paragraph><paragraph id="HFED8455EEE0D427D8122CC2A526F69D4" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HD6EF5C241931494297D45C288DB4F977"><enum>(A)</enum><text>Except as provided in subparagraph (B), no person may be ordered into confinement for more than seven days unless it is beyond a reasonable doubt that the person committed the offense for which confinement is ordered.</text></subparagraph><subparagraph id="HF2C4D08DBE124974881B872CE078D6AF" indent="up1"><enum>(B)</enum><text>In the event that a determination with respect to reasonable doubt has not been made by the expiration of the seven day period described in the subparagraph (A), a person may be placed under in-home confinement pending such determination.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HED79591B00984601B394001B195DC6FF"><enum>(b)</enum><header>Standard of proof for reviews of pretrial confinement</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the President shall issue regulations revising subsection (i)(2)(A)(iii) of Rule For Courts-Martial 305 (as set forth in the Manual for Courts-Martial, 2019 edition, or any successor to such rule) to provide that the requirements for confinement under subsection (h)(2)(B) of such rule must be proved beyond a reasonable doubt.</text></subsection><subsection id="HBDB8BD7DABDB40E8961EEFA026411F24"><enum>(c)</enum><header>Sentencing credit for pretrial confinement</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the President shall issue regulations revising subsection (k) of Rule for Courts-Martial 305 (as set forth in the Manual for Courts-Martial, 2019 edition, or any successor to such rule) to provide that—</text><paragraph id="HC4164A35B56242E3B195E2414C4F0255"><enum>(1)</enum><text display-inline="yes-display-inline">the remedy for noncompliance with subsection (f), (h), (i), or (j) of such rule shall be an administrative credit against the sentence adjudged for any confinement served as the result of such noncompliance; and</text></paragraph><paragraph id="H44C7AF339099478F96A489E72269D925"><enum>(2)</enum><text>such credit shall be computed at the rate of 20 days credit for each day of confinement served as a result of such noncompliance.</text></paragraph></subsection></section><section id="HC132404B50214960B7895019AE1F80B2"><enum>3.</enum><header>Qualifications and selection of members for courts-martial</header><subsection id="H45929A6CF4C943FF9A2D7AC1219E3C05"><enum>(a)</enum><header>Member qualifications</header><text>Section 825 of title 10, United States Code (article 25 of the Uniform Code of Military Justice), is amended by striking <quote>on active duty</quote> each place it appears.</text></subsection><subsection id="HAEBB7E30568D4AA1BBD04BB0B04E78F2"><enum>(b)</enum><header>Selection process</header><text>Section 825(e) of title 10, United States Code (article 25 of the Uniform Code of Military Justice), is amended—</text><paragraph id="H98B4B531C076400A923C78C97FEEAE9E"><enum>(1)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="USC" id="H91375A8456E34984B84B5763FCE8C8E5" display-inline="no-display-inline"><paragraph id="HA87310B9C3F44478B4B96609AD800561"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H75A81F455A944D758A5F2D88D0BE0029"><enum>(A)</enum><text display-inline="yes-display-inline">When convening a court-martial, the convening authority shall notify the Judge Advocate General of the armed force of which the convening authority is a member who shall select the members of the court-martial in accordance with subparagraph (B).</text></subparagraph><subparagraph id="H48A6793B7F404FFE9D503E9996043CBC" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HBB85854855D648688079A8437CC083C9"><enum>(i)</enum><text>After receiving a notification under subparagraph (A), the Judge Advocate General shall detail members of the armed forces at random to serve as members of the court-martial. The selection of members shall be made from a randomized list of potential members generated using a computer database that includes all members of the armed forces (including members serving on active duty and members of the reserve components) who are eligible to serve as members of the court martial.</text></clause><clause id="H3E12AE1677824C03925A422DFF96BC66" indent="up1"><enum>(ii)</enum><text>The Judge Advocate General shall detail not less than the number of members necessary to impanel the court-martial under section 829 of this title (article 29).</text></clause><clause id="HADFE3B11357F4D05902AB2A7D56761A1" indent="up1"><enum>(iii)</enum><text>When convening a court-martial in which the accused is a member of the reserve components, the Judge Advocate General shall ensure that not less than half of the panel members selected to serve on the court-martial are members of the reserve components.</text></clause></subparagraph><subparagraph id="HC99D5C83EEA34CA793608A0BC78D61F5" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">No member of an armed force is eligible to serve as a member of a general or special court-martial in a case in which that member—</text><clause id="H9C47242E55C74A679C39DFAEEF00A05A"><enum>(i)</enum><text>is the accuser or a witness for the prosecution;</text></clause><clause id="H09A1047FDD8048A0B771562F103BAA53"><enum>(ii)</enum><text>has acted as preliminary hearing officer or as counsel in the same case; or</text></clause><clause id="H4DEB480EB0034785A2C8719565D582DD"><enum>(iii)</enum><text>is assigned to the same unit as the accused.<italic></italic></text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HBA00249D5E294767A4D37F6252C3CA6A"><enum>(2)</enum><text>by striking paragraph (3).</text></paragraph></subsection></section><section id="H023709B12A0441C98C94AD0CC30E3498"><enum>4.</enum><header>Preliminary hearings and investigations</header><subsection id="HB60CA37BE71E4C0B9263BE636A0BFC61"><enum>(a)</enum><header>Preliminary hearing and investigation</header><paragraph id="H66F4F6D45E8F4092B7708B9EAFA083DA"><enum>(1)</enum><header>In general</header><text>Section 832 of title 10, United States Code (article 32 of the Uniform Code of Military Justice) is amended—</text><subparagraph id="HDC8C792AA3CC433D85148372230E3234"><enum>(A)</enum><text>in the section heading by inserting <quote><header-in-text level="section" style="USC">and investigation</header-in-text></quote> after <quote><header-in-text level="section" style="USC">Preliminary hearing</header-in-text></quote>;</text></subparagraph><subparagraph id="HA6A6124BC3DB4BD7A901F8867AF0B89C"><enum>(B)</enum><text>in subsection (a)—</text><clause id="H53B980EE848C47429E3B38E1189C6CA3"><enum>(i)</enum><text>in paragraph (1)(B)—</text><subclause id="H5848B69C6BBE4A24AA6654F7423EA780"><enum>(I)</enum><text>by striking <quote>Under regulations</quote> and inserting <quote>(i) Under regulations</quote>; and</text></subclause><subclause id="HB79FC953613940B69CD79FBC61E989FE"><enum>(II)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="HBB877F0DD10C4BACAF2435BCE836FB63" display-inline="no-display-inline"><clause id="H636D9C0EA78A4C45BFF021E9006C6029" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">In a case in which an a preliminary hearing is waived under clause (i), the convening authority shall make a determination as to the disposition which shall be made of the case in the interest of justice and discipline, including whether the case should be referred for trial by general court-martial in accordance with section 834(b) of this title (article 34(B)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subclause></clause><clause id="H7F975B79E7BA4973919DBB4C7AD8551F"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following new paragraphs:</text><quoted-block style="USC" id="H06CE6E19CD554A3AA65AD7FA54C9C051" display-inline="no-display-inline"><paragraph id="HFAF62681571C4427A848A81A7E8A6FD0"><enum>(2)</enum><text display-inline="yes-display-inline">A preliminary hearing shall include—</text><subparagraph id="H6258096191474C17ADE8531DFA1B94F3"><enum>(A)</enum><text display-inline="yes-display-inline">a thorough and impartial investigation of all the matters set forth in the charges and specifications, including inquiry as to the truth of the matter set forth in the charges and specifications;</text></subparagraph><subparagraph id="HE349AEED1DE64FC1AC8BB458362C2A10"><enum>(B)</enum><text display-inline="yes-display-inline">a determination, which shall be binding on the convening authority as described in section 834 of this title (article 34), as to—</text><clause id="H084C8218CC9E42EA86E7DE96ACC67752"><enum>(i)</enum><text>whether or not the specification alleges an offense under this chapter;</text></clause><clause id="HF4165C978A94408DB63F750B35AD3687"><enum>(ii)</enum><text>whether or not it is beyond a reasonable doubt that the accused committed the offense charged;</text></clause><clause id="H1322A42F4B4E47078C1B392C4D070696"><enum>(iii)</enum><text>whether or not the convening authority has court-martial jurisdiction over the accused and over the offense; and</text></clause><clause id="HF72BD71436A749459D1831CEEFA008B1" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">whether or not the case shall be referred for trial by general court-martial; and</text></clause></subparagraph><subparagraph id="HB613AA516AE9408CB16D8F7783E72A75"><enum>(C)</enum><text display-inline="yes-display-inline">if the case shall not be referred for trial by general court-martial, a recommendation as to the disposition which shall be made of the case in the interest of justice and discipline.</text></subparagraph></paragraph><paragraph id="H3302D60D2AC24724B20D08546F181C3A"><enum>(3)</enum><text>The standards for the admissibility of evidence in a preliminary hearing shall be the same as the standards for the admissibility of evidence in a court-martial.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H21ABECBE55524F3CA443821948602175"><enum>(C)</enum><text>in subsection (b), by striking <quote>conducted by</quote> and inserting <quote>presided over by</quote>;</text></subparagraph><subparagraph id="H84935D6A4DED44F1AD18EAC01B79465C"><enum>(D)</enum><text>by redesignating subsections (c) through (h) as subsections (d) through (i), respectively;</text></subparagraph><subparagraph id="H6143903904B246FDA799003EF8C4D385"><enum>(E)</enum><text>by inserting after subsection (b) the following new subsection:</text><quoted-block style="USC" id="H688F9CD4095A4E6484C8302CAC91FCD1" display-inline="no-display-inline"><subsection id="H3839374113E94EA68A85D4048FA56971"><enum>(c)</enum><header>Panel</header><paragraph id="HA6C71FEDED9F4EDE8B21C068347770A9"><enum>(1)</enum><header>In general</header><text>The determinations under subsection (a)(2)(B) shall be made by an impartial panel composed of three members of the armed forces who—</text><subparagraph id="H896C25BB02484386A69B9753DC16D5EA"><enum>(A)</enum><text>are eligible to serve on a court-martial under section 825 of this title (article 25); and</text></subparagraph><subparagraph id="HD176B36835EE4C29B1D0856D72F5EA1B"><enum>(B)</enum><text display-inline="yes-display-inline">may not be in a rank that is—</text><clause id="H5C614B42F5F64775A8D6E72B87E8EF22"><enum>(i)</enum><text>more than three ranks higher than the accused; or</text></clause><clause id="H13D01F615B4D4FD19F702489766B03A6"><enum>(ii)</enum><text>more than two ranks lower than the accused.</text></clause></subparagraph></paragraph><paragraph id="HA8D46920E975421CB06A2CE523BF736E"><enum>(2)</enum><header>Detail of panel members</header><subparagraph id="H157D0F7F970646DAAAEDA13F839A34C4"><enum>(A)</enum><text>The preliminary hearing officer shall detail members to serve on the panel.</text></subparagraph><subparagraph id="HED09F17083CA47439FA9772565BCBA41"><enum>(B)</enum><text>In addition to the members detailed under subparagraph (A), the preliminary hearing officer shall detail alternate members who may serve on the panel in the event that a panel member cannot fulfill the member’s duties.</text></subparagraph></paragraph><paragraph id="H64AE6EA1881A41959ED3A03D0A5A3CC5"><enum>(3)</enum><header>Level of concurrence required</header><text display-inline="yes-display-inline">All matters to be decided by the preliminary hearing panel shall be determined by the unanimous concurrence of all members present.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H9BD60FE7CFA6461C8981331E1395929B"><enum>(F)</enum><text>in subsection (d), as so redesignated—</text><clause id="HC4D0BEEFC2814B17854F076084A494A4"><enum>(i)</enum><text>in paragraph (1), by striking <quote>reasoning and conclusions of the hearing officer with respect to the determinations under subsection (a)(2)</quote> and inserting <quote>reasoning and conclusions of the preliminary hearing panel with respect to determinations under subsection (a)(2)</quote>; and</text></clause><clause id="H05E20401AE09491A8C5FF2B3D0D2E75C"><enum>(ii)</enum><text>in paragraph (2), by striking <quote>Recommendations for</quote> and inserting <quote>A determination with respect to</quote>.</text></clause></subparagraph></paragraph><paragraph id="H20655B347D894E00BAA90205C9F1F022"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice), is amended by striking the item relating to section 832 (article 32) and inserting the following new item:</text><quoted-block style="USC" id="HCFD950626D9246E08C862F78D82B911E" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">832. 32. Preliminary hearing and investigation required before referral to general court-martial.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H97472475A64143F1A202A565D0DB0DB1"><enum>(b)</enum><header>Investigative subpoena</header><text>Section 846(d) of title 10, United States Code (article 46 of the Uniform Code of Military Justice) is amended—</text><paragraph id="HAB10F2D1C0ED4E3DA5064D95892BFDF4"><enum>(1)</enum><text>in paragraph (1)(C), by striking the semicolon and inserting <quote>, including an investigation conducted as part of a preliminary hearing under section 832 of this title (article 32);</quote>; and</text></paragraph><paragraph id="HE4059887DE1B4CF382A9DCFAF6BB0AB0"><enum>(2)</enum><text display-inline="yes-display-inline">by amending paragraph (2) to read as follows:</text><quoted-block style="USC" id="H2A727DBF57D941BA85A1EA86AB079D5F" display-inline="no-display-inline"><paragraph id="HD8E9B963414748B192667AD68A461E81"><enum>(2)</enum><header>Investigative subpoena</header><text display-inline="yes-display-inline">An investigative subpoena under paragraph (1)(C) may be issued before referral of charges to a court-martial only if—</text><subparagraph id="HFAF9DCA2E0D645E1BA66B8A99BFC4D60"><enum>(A)</enum><text>a general court-martial convening authority has authorized counsel for the Government to issue such a subpoena;</text></subparagraph><subparagraph id="H7FCF0BEC28A44A818FD0D4509BBF38FD"><enum>(B)</enum><text>a military judge issues such a subpoena pursuant to section 830a of this title (article 30a); or</text></subparagraph><subparagraph id="H04953059F68943E4A23C30B0DD0D7D4A" commented="no"><enum>(C)</enum><text>an officer presiding over a preliminary hearing under section 832 of this title (article 32) issues such a subpoena.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H9864CBA6C3284A3EBBC91E3D5A469C7C"><enum>5.</enum><header>Role of convening authority</header><subsection id="H01A84D78401F426D89722659D56BD73F"><enum>(a)</enum><header>Referral for trial by convening authority</header><paragraph id="H2E956522FE0E43FC8432C7E273E6B78D"><enum>(1)</enum><header>In general</header><text>Section 834 of title 10, United States Code (article 33 of the Uniform Code of Military Justice) is amended—</text><subparagraph id="H07ED55A966C6422485BDC32FDCAC7239"><enum>(A)</enum><text display-inline="yes-display-inline">in the section heading by striking <quote><header-in-text level="section" style="USC">Advice to convening authority before referral for trial</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Referral for trial by convening authority</header-in-text></quote>;</text></subparagraph><subparagraph id="H4BFE3E49984340BD9AAF1842A630E5E8"><enum>(B)</enum><text>by redesignating subsections (a) through (d) as subsections (b) through (e), respectively;</text></subparagraph><subparagraph id="H144847197DA84305A97746627757416C"><enum>(C)</enum><text>by inserting before subsection (b) the following new subsection:</text><quoted-block style="USC" id="H26DE1DA634074B22A5B84F19D21BD1C8" display-inline="no-display-inline"><subsection id="HD208A3F7F68A46F580937BE98B0F22DB"><enum>(a)</enum><header>Referral to general court-Martial</header><paragraph id="HEAE0139F540D4990A990CAF937E19016"><enum>(1)</enum><text>The convening authority may not refer a specification under a charge to a general court-martial unless—</text><subparagraph id="H61F197144E3B41F2B988BF455243547F"><enum>(A)</enum><text>the report of the preliminary hearing under section 832(d) of this title (article 32(d)) concludes that—</text><clause id="HDEB5E96FB16E4B8C861E28A6FC7C702E"><enum>(i)</enum><text>the specification alleges an offense under this chapter;</text></clause><clause id="HE90A5D80055244D98A94262A6FF3C985"><enum>(ii)</enum><text>it is beyond a reasonable doubt that the accused committed the offense charged;</text></clause><clause id="HB3D3F0869AC2442ABCA1134B4BC8606B"><enum>(iii)</enum><text>a court-martial would have jurisdiction over the accused and the offense; and</text></clause><clause id="H2FF4260966104595A61749E4629A7F6D"><enum>(iv)</enum><text>the specification shall be referred to a general court-martial; or</text></clause></subparagraph><subparagraph id="H4C41A3B1BC9B4320857134E66A51961D"><enum>(B)</enum><text display-inline="yes-display-inline">the accused has waived a preliminary hearing under section 832(a)(B) of this title (article 32) and the convening authority determines, in accordance with subsection (b) of this section (article), that referral of the specification to a general court-martial is appropriate.</text></subparagraph></paragraph><paragraph id="HC0A3B59DF59D4E419AD96A527F388093"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE126FA0E0A1545168065714E4CA0F7CD"><enum>(A)</enum><text>Except as provided in subparagraph (B), if the report of the preliminary hearing indicates that charges and specifications shall be referred for trial by general court-martial, the convening authority shall make such referral.</text></subparagraph><subparagraph id="HE3B2B3D48967415298B7F3C8CBD14BFF" indent="up1"><enum>(B)</enum><text>The convening authority may elect not to make the referral required under subparagraph (A) only if the convening authority becomes aware of new evidence that was not considered at the preliminary hearing under section 832 of this title (article 32) and such evidence creates reasonable doubt with respect to the guilt of the accused.</text></subparagraph></paragraph><paragraph id="H36280B88F0CB419CB2CC6C81F592BF8C"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HA3B8C7844A1D44339D16C420B12CC5DF"><enum>(A)</enum><text>Except as provided in subparagraph (B), if the report of the preliminary hearing indicates that charges and specifications shall not be referred for trial by general court-martial, the convening authority shall—</text><clause id="HD6358CC1718142CEB2005B22625351E6" indent="up1"><enum>(i)</enum><text>dismiss the charges; or</text></clause><clause id="H8307D796CA9946668C2045A168A30F67" indent="up1"><enum>(ii)</enum><text>determine whether to dispose of the charges and specifications through a special court-martial, a summary court-martial, or through another authority or proceeding authorized under this chapter other than a general court martial.</text></clause></subparagraph><subparagraph id="HC9A23F795C884ECFAEC6B1F20D76AEA5" indent="up1"><enum>(B)</enum><text>In a case in which the convening authority becomes aware of new evidence that was not considered at the preliminary hearing under section 832 of this title (article 32), and such evidence indicates the guilt of the accused, the convening authority may order a new preliminary hearing to include consideration of such evidence.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HE1C1BAE4400941B6B493E3EBBFF13EE2"><enum>(D)</enum><text>in subsection (b), as so redesignated—</text><clause id="H15657AC9097B4BC480F371FC78635388"><enum>(i)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking <quote><header-in-text level="subsection" style="USC">General court-martial</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">Advice before referral without preliminary hearing</header-in-text></quote>; Referral for trial by convening authority.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC865F988B4414E8893C7A1CDAC27358A"><enum>(b)</enum><header>Who may convene general courts-Martial</header><text>Section 822(a) of title 10, United States Code (article 22 of the Uniform Code of Military Justice), is amended by striking <quote>General courts-martial</quote> and inserting <quote>Subject to section 834 of this title (article 34), general courts-martial</quote>.</text></subsection></section><section id="H05A079ABE91241C7BB581FB61E2D157C"><enum>6.</enum><header>Prohibition on certain communications regarding courts-martial</header><text display-inline="no-display-inline">Section 837 of title 10, United States Code (article 37 of the Uniform Code of Military Justice), is amended by adding at the end the following new subsection:</text><quoted-block style="USC" id="H40AE354A39E94EB5B9A6451F323A2B71" display-inline="no-display-inline"><subsection id="HE53B024DD99C4075A61E8D6A8582471F"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H06D95228E2B54A78B8B2E99F974D1CB6"><enum>(1)</enum><text>No court-martial convening authority, nor any other commanding officer, may provide a briefing concerning a pending court-martial, or allegations that may lead to a court-martial, to any subordinate who may be selected to serve as a member of such court-martial.</text></paragraph><paragraph id="H312C4815D539466C95A81F80609A727D" indent="up1"><enum>(2)</enum><text>The prohibition in paragraph (1) shall not apply to a briefing provided in the course of a court-martial proceeding to a member of the armed forces who is participating in such proceeding.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HDA8F68C3F94746F69DB47C9F0654AB91"><enum>7.</enum><header>Adequate representation of defendants</header><subsection id="HF9526B1DE34B47B58613002EA302BA96"><enum>(a)</enum><header>Adequate representation</header><text>Section 838(b) of title 10, United States Code (article 38(b) of the Uniform Code of Military Justice) is amended by adding at the end the following new paragraph:</text><quoted-block style="USC" id="HFFFB12A80F6B40B796C35613F3C60F1B" display-inline="no-display-inline"><paragraph id="HC136FB837B404EEDA89E54FC2A155549" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">Each Secretary of a military department shall ensure that—</text><subparagraph id="H60CBEA7E73124273B3A0EA7665F4E2B5"><enum>(A)</enum><text>an accused who is represented by military or civilian counsel has access to the investigative, expert, and other services that defense counsel determines is necessary for adequate representation under this subsection; and</text></subparagraph><subparagraph id="H18B35640D5EA4A429EBFADF07F1F6E89"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of funds and other resources provided to an accused for investigative, expert, and other services under subparagraph (A) is proportionate to the amount of funds and other resources provided to prosecutors for such services, except that the amount funds provided for such defense services may not exceed actual expenses.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7DC2965A165C46D0BE19FBF0153229F6"><enum>(b)</enum><header>Equal access to services</header><text>Section 846(a) of title 10, United States Code (article 46a of the Uniform Code of Military Justice), is amended by striking the period at the end and inserting <quote>and equal access to investigative, expert, and other services.</quote>.</text></subsection></section><section id="H391A03DD9FBC47B6AE770DD2A9B83CBB" display-inline="no-display-inline"><enum>8.</enum><header>Votes required for conviction, sentencing, and other matters</header><text display-inline="no-display-inline">Section 852 of title 10, United States Code (article 52 of the Uniform Code of Military Justice), is amended—</text><paragraph id="HA6CAE56B38274CB6BE24A8892726598C"><enum>(1)</enum><text>in subsection (a)(3), by striking <quote>by the concurrence of at least three-fourths of the members present</quote> and inserting <quote>by the unanimous concurrence of all members present</quote>; and</text></paragraph><paragraph id="H48C27775D0E346FC92966042441B445C"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(2), by striking <quote>by the concurrence of at least three-fourths of the members present</quote> and inserting <quote>by the unanimous concurrence of all members present</quote>.</text></paragraph></section><section id="HA5E8D054972A46DC9A4882171D1AF0FD"><enum>9.</enum><header>Electronic records of trial</header><text display-inline="no-display-inline">Section 854 of title 10, United States Code (article 54 of the Uniform Code of Military Justice), is amended—</text><paragraph id="H7FD6D56D0DBE4BEF978F36D555727538"><enum>(1)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively;</text></paragraph><paragraph id="HD2A63F708A234871BF770ACAD04A0164"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection:</text><quoted-block style="USC" id="HC4702561A1314EF6928E0122BB7922B2" display-inline="no-display-inline"><subsection id="H182ED1AB958A4A518FA857581F441304"><enum>(c)</enum><header>Form of record</header><text display-inline="yes-display-inline">The record shall be kept in electronic format. A hard copy of the record shall not be kept or maintained except under such circumstances as the President may prescribe by regulation. The President shall issue regulations establishing a process by which a court reporter or official described in subsection (a) may certify the electronic version of the record.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H0E0CAB034AF647B595F7BB2A08222562"><enum>(3)</enum><text>in subsection (e), as so redesignated, by striking <quote>copy</quote> and inserting <quote>electronic and hard copy</quote>; and</text></paragraph><paragraph id="HC3D947DC8FBB41FB9FF464790D2949CF"><enum>(4)</enum><text>in subsection (f), as so redesignated, by striking <quote>copy</quote> and inserting <quote>electronic and hard copy</quote>.</text></paragraph></section><section id="H6B20D91AE4FB4B609AB9872A99D2BCB2"><enum>10.</enum><header>Petition for new trial</header><text display-inline="no-display-inline">Section 873 of title 10, United States Code (article 73 of the Uniform Code of Military Justice) is amended—</text><paragraph id="HF5C842C523D64C2FB7F60FF39FA29AAC"><enum>(1)</enum><text>by striking <quote>At any time within three years after</quote> and inserting the following:</text><quoted-block style="OLC" id="H8F6A1912A7054C78871AA01A436CF7FD" display-inline="no-display-inline"><subsection id="H4420D6CEDC0D4F13804B2104C4539892"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), at any time after</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H503200750CBA4D9CAFC3DFF614A16B39"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="USC" id="HBDB23330851D4278AB1C10E4B8D3A32A" display-inline="no-display-inline"><subsection id="H30733821B152422ABCF2C3D74995C2DB"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">For any offense that is subject to a statute of limitations, the right of an accused to petition for a new trial under subsection (a) shall terminate three years after the date of the entry of judgment on the offense under section 860c of this title (article 60c).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HBB43D8FAD28F46518728900D156E4F17"><enum>11.</enum><header>Defense investigators for individuals accused of offenses under the Uniform Code of Military Justice</header><subsection id="H0DF035B5F3904008B60F0C399CE7AA06"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/53">Chapter 53</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/1044e">section 1044e</external-xref> the following new section:</text><quoted-block style="USC" id="H0B74CD8F7EDB4B9EBA65B8F802118400" display-inline="no-display-inline"><section id="H1BA664E2C63B4FD796DF302E34F21B01"><enum>1044f.</enum><header>Defense investigators for individuals accused of offenses under the Uniform Code of Military Justice</header><subsection id="HD9071E13C7654C0BAEC3FA9066F66AB5"><enum>(a)</enum><header>Designation; purposes</header><text display-inline="yes-display-inline">The Secretary concerned shall establish, within the department over which the Secretary has jurisdiction, an organization (to be known as a <quote>Defense Investigator Unit</quote>) for the purpose of providing investigative assistance to individuals who are accused of offenses under chapter 47 of this title (the Uniform Code of Military Justice).</text></subsection><subsection id="H18B2F9CC2DCF4198848319965C3EF364"><enum>(b)</enum><header>Administrative independence</header><text>Each Defense Investigator Unit shall be funded and maintained independently from any military criminal investigative organization in the department over which the Secretary concerned has jurisdiction.</text></subsection><subsection id="H664B3DB60B5B4970BCE4851B7C93CBBE"><enum>(c)</enum><header>Equitable support</header><text>The Secretary concerned shall provide to the Defense Investigator Unit a level of support, including funding, staffing, and administrative support, that is sufficient to ensure that an accused has access to the investigative services necessary for adequate representation, as required under section 838 of this title (article 38 of the Uniform Code of Military Justice).</text></subsection><subsection id="H245C4E60033848A8B6134A72977DFE10"><enum>(d)</enum><header>Equitable access to investigations</header><text display-inline="yes-display-inline">The Secretary concerned shall issue guidance under which a member of a Defense Investigator Unit—</text><paragraph id="HDFC4307BC8E64F399EAA2A5557217DB2"><enum>(1)</enum><text>may access a crime scene in the same manner and to the same extent that a member of a military criminal investigative organization may access a crime scene; and</text></paragraph><paragraph id="H04113B6ECF6E45AEA0A13299C0149C5C"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent practicable, shall be present during any investigative activities conducted by a military criminal investigative organization, including the processing of crime scenes and witness interviews.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H25CEE5941D6E4AC8ADE5F39C27D74303"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1044e the following new item:</text><quoted-block style="USC" id="H26EC299392F841C585549B975D9FF3B9" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1044f. Defense investigators for individuals accused of offenses under the Uniform Code of Military Justice.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDBAD015F30A446D686BC58706778ED68"><enum>(c)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out section 1044f of title 10, United States Code, as added by subsection (a), such sums as may be necessary for each fiscal year.</text></subsection></section><section id="H2C7E9D18DBB84C78BA744F33DEA1C4B9"><enum>12.</enum><header>Prohibition on involuntary separation as nonjudicial punishment for a charge brought under the Uniform Code of Military Justice</header><subsection id="H922B7A6BF4D54DA3AE1DB561785EED9D"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/59">Chapter 59</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/1167">section 1167</external-xref> the following new section:</text><quoted-block style="USC" id="HB91085C066144AE5914B7BC963FF81BD" display-inline="no-display-inline"><section id="H021F05261F414EF48071341FEE834ACC"><enum>1167a.</enum><header>Prohibition on involuntary separation as nonjudicial punishment for a charge brought under the Uniform Code of Military Justice</header><subsection id="H5E165A7DEC5F4CE0BF3F2FD5DF55F70A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in section 1167, a member charged with an offense under chapter 47 of this title (the Uniform Code of Military Justice) may not be involuntarily separated from the armed forces solely on the basis of such charge unless—</text><paragraph id="H565C0AF44A04463DB82C233BF8C71E89"><enum>(1)</enum><text>the member is convicted of the offense by a court-martial; and</text></paragraph><paragraph id="HAF582DE9AF594F94B0AA884DD3AE5BBC"><enum>(2)</enum><text>separation of the member from the armed forces is prescribed as a sentence by the court martial.</text></paragraph></subsection><subsection id="H8DD9381A4D614B2C9A8DAB8724B18B4F"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to prohibit the involuntary separation of a member from the armed forces for misconduct that is not subject to a charge brought under chapter 47 of this title (the Uniform Code of Military Justice).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB0F4B93E9E464432B7E13D8FBD6A7E90" display-inline="no-display-inline"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1067 the following new item:</text><quoted-block style="USC" display-inline="no-display-inline" id="HB79436FAC4744782B45E549F5E758C20"><toc regeneration="no-regeneration"><toc-entry level="section">1067a. 10</header><text>Section 867a(a) of title 10, United States Code (article 67a of the Uniform Code of Military Justice), is amended by striking <quote>The Supreme Court may not review by a writ of certiorari under this section any action of the United States Court of Appeals for the Armed Forces in refusing to grant a petition for review.</quote>.</text></subparagraph><subparagraph id="H1497BE50346D4A7F90553F57495C8121"><enum>(B)</enum><header>Time for application for writ of certiorari</header><text>Section 2101(g) of title 28, United States Code, is amended to read as follows:</text><quoted-block id="HE06EBE007AA04BC5A11BEF95CB290CB1" style="OLC"><subsection id="HD8D981B07644476A893194D599E38F16"><enum>(g)</enum><text>The time for application for a writ of certiorari to review a decision of the United States Court of Appeals for the Armed Forces, or the decision of a Court of Criminal Appeals that the United States Court of Appeals for the Armed Forces refuses to grant a petition to review, shall be as prescribed by rules of the Supreme Court.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H30C67AC85DEC4E29A976FFFC86146FE4"><enum>(b)</enum><header>Effective date</header><paragraph id="H8983AB5667924BC5AC5E87CF1563680F"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the amendments made by this section shall take effect upon the expiration of the 180-day period beginning on the date of the enactment of this Act and shall apply to any petition granted or denied by the United States Court of Appeals for the Armed Forces on or after that effective date.</text></paragraph><paragraph id="H98532CDD19CB468BB6BE8C061A71C1B3"><enum>(2)</enum><header>Authority to prescribe rules</header><text>The authority of the Supreme Court to prescribe rules to carry out section 2101(g) of title 28, United States Code, as amended by subsection (a)(2)(B) of this Act, shall take effect on the date of the enactment of this Act.</text></paragraph></subsection></section><section id="H5D22830BD16C4BF7945273AF875C6CB4"><enum>14.</enum><header>Treatment of certain records of criminal investigations</header><subsection id="H93D469E3F80841F58F491209A45B91B5"><enum>(a)</enum><header>Guidance required</header><text display-inline="yes-display-inline">The Secretary of Defense, in consultation with the Secretaries of the military departments, shall develop and implement uniform guidance to modify the systems used by Defense criminal investigative organizations to document records of criminal investigations (commonly known as <quote>title systems</quote>) to ensure that a record identifying a member of the Armed Forces as the subject of a criminal investigation is removed from such system if that member is cleared of wrongdoing as described in subsection (d).</text></subsection><subsection id="HF91F6CBE89D24D63B9100896D18AA7F5"><enum>(b)</enum><header>Documentation by judge advocate</header><text>As soon as practicable after a member of the Armed forces is cleared of wrongdoing as described in subsection (d), a judge advocate in the chain of command of the member shall submit to the Defense criminal investigative organization concerned a written notice verifying that the member has been cleared of wrongdoing.</text></subsection><subsection id="H96D9B049FDD74BDFBA7F2AE1CC9F1C01"><enum>(c)</enum><header>Deadline for removal</header><text>A record described in subsection (a) shall be removed from the title system of a Defense criminal investigative organization not later than 30 days after the date on which the organization receives the notice described in subsection (b).</text></subsection><subsection id="H75721ABE1C454A2A831C8EBA60CBE798"><enum>(d)</enum><header>Disposition of investigations</header><text>A member of the Armed Forces who is the subject of a criminal investigation shall be considered to have been cleared of wrongdoing for purposes of subsection (a) if—</text><paragraph id="HE9BB81E2C1CA4226AC3BD61159A17D4A"><enum>(1)</enum><text display-inline="yes-display-inline">the member is found not guilty, not responsible, or it is found that the reasons specified for the proceeding are unsupported by the evidence of the offense for which the member was under investigation—</text><subparagraph id="H9E12F3C909A04523B01704028E612025"><enum>(A)</enum><text>through a court-martial or other proceeding brought under the <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice);</text></subparagraph><subparagraph id="H63DB6822359D40A3BA048912308503E3"><enum>(B)</enum><text>through an administrative proceeding within the Department of Defense or the Armed Force concerned; or</text></subparagraph><subparagraph id="HE1F862FA0D99426C8E4CE19A1CB0ECD4"><enum>(C)</enum><text>by a civilian court; or</text></subparagraph></paragraph><paragraph id="H31DD4B4D13F64969AB1DCF142DE62171"><enum>(2)</enum><text display-inline="yes-display-inline">the Government makes a final determination not to prosecute the member for the criminal offense for which the member was under investigation.</text></paragraph></subsection><subsection id="H1F0C0BB7246E47C29BBDFF164688BB34"><enum>(e)</enum><header>Defense criminal investigative organization defined</header><text>In this section, the term <term>Defense criminal investigative organization</term> means any organization or element of the Department of Defense or an Armed Force that is responsible for conducting criminal
