BILL</legis-type><official-title display="yes">To prohibit the Federal Government from contracting with persons that have business operations with the Beijing Organising Committee for the 2022 Olympic and Paralympic Winter Games or the International Olympic Committee, and for other purposes.</official-title></form><legis-body id="H5C7681FB108A493FB5547F9C6D938D20" style="OLC"><section id="H6B302ED0BB1847F7948935865AC7A73E" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Beijing Winter Olympics Sponsor Accountability Act</short-title></quote>.</text></section><section id="HD9819C0B60D849C6B5FBE03C0DD4795B"><enum>2.</enum><header>Prohibition on contracting with persons that have business operations with the 2022 Winter Olympics in Beijing, China</header><subsection id="HFB361E653B8A4820A98B8759B21F329A" commented="no"><enum>(a)</enum><header>Civilian agency contracts</header><paragraph id="H7BAF15C9367C4D9BA9C15464AE8701E7" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the head of an executive agency may not enter into a contract (or subcontract at any tier) for the procurement of goods or services with any person that has business operations with the Beijing Organising Committee for the 2022 Olympic and Paralympic Winter Games or the International Olympic Committee.</text></paragraph><paragraph id="H2D060B453A984EC6AD5F3556B38EBFD8" commented="no"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the requirement does not apply to a contract (or subcontract at any tier) that the Secretary of State determines is vital to the national security interests of the United States.</text></paragraph><paragraph id="H6ED5CB06614A40CAA34149063A904709" commented="no"><enum>(3)</enum><header>Notification</header><text display-inline="yes-display-inline">The Secretary of State shall notify Congress of any contract (or subcontract at any tier) entered into on the basis of an exception provided for under paragraph (1).</text></paragraph></subsection><subsection id="HF2EA465B41CA4578912EEB9BDF5BB7AA" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Defense contracts</header><paragraph id="HC76ACEFCCE7C4AE5AF8E7D08F1BE5865"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Defense may not enter into a contract (or subcontract at any tier) for the procurement of goods or services with any person that has business operations with the Beijing Organising Committee for the 2022 Olympic and Paralympic Winter Games or the International Olympic Committee.</text></paragraph><paragraph id="HCEA0893003B74D35BF3897B417AEC7AC"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Paragraph (1) does not apply to a contract (or subcontract at any tier) that the Secretary of Defense, in consultation with the Secretary of State, determines is vital to the national security interests of the United States.</text></paragraph><paragraph id="HA5023C19BB234AC58AB370658E1E386D"><enum>(3)</enum><header>Notification</header><text display-inline="yes-display-inline">The Secretary of Defense shall notify Congress of any contract (or subcontract at any tier) entered into on the basis of an exception provided for under paragraph (1).</text></paragraph></subsection><subsection id="HC511B7EBEE2A44D8881C44837067F1BC"><enum>(c)</enum><header>Applicability</header><paragraph id="H5A67F334272E40D69FFA01C4B2CA9DD7"><enum>(1)</enum><header>Contracts</header><text>This section shall apply with respect to any contract entered into on or after the date of the enactment of this section.</text></paragraph><paragraph id="HDE57BBA113634156A1C2EC075DFA3A0F" commented="no"><enum>(2)</enum><header>Termination of business operations</header><text display-inline="yes-display-inline">This section shall not apply with respect to a person that terminates business operations with the Beijing Organising Committee for the 2022 Olympic and Paralympic Winter Games or the International Olympic Committee within 30 days after the date of the enactment of this section.</text></paragraph></subsection><subsection id="H9FC9758BA62F47509479F5A35C9EEFC1"><enum>(d)</enum><header>Sales prohibition</header><text display-inline="yes-display-inline">Effective 60 days after the date of the enactment of this Act, a facility of the Federal Government may not sell any product made by any person that has business operations with the Beijing Organising Committee for the 2022 Olympic and Paralympic Winter Games or the International Olympic Committee.</text></subsection><subsection id="H401ED657756C447EA73E485265FC4539" commented="no"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HDC641DB75AB04EF98D651FCF29A2C212" commented="no"><enum>(1)</enum><header>Business operations</header><text>The term <term>business operations</term> means engaging in commerce in any form, including acquiring, developing, maintaining, owning, selling, possessing, leasing, or operating equipment, facilities, personnel, products, services, personal property, real property, or any other apparatus of business or commerce.</text></paragraph><paragraph id="H03BC6BE68EF14CC9AA577FC7B010622F" commented="no"><enum>(2)</enum><header>Executive agency</header><text>The term <quote>executive agency</quote> has the meaning given that term in section 133 of title 41, United States Code. </text></paragraph><paragraph id="HE703D1D3189849AA9563CAAB965C6A6E" commented="no"><enum>(3)</enum><header>Person</header><text>The term <term>person</term> means—</text><subparagraph id="H124046D5D25F4145A8536B3B40A9905E" commented="no"><enum>(A)</enum><text>a natural person, corporation, company, business association, partnership, society, trust, or any other nongovernmental entity, organization, or group;</text></subparagraph><subparagraph id="H50D0CEF6A7374C4E93DBC08A0F0BB22F" commented="no"><enum>(B)</enum><text>any governmental entity or instrumentality of a government, including a multilateral development institution (as defined in section 1701(c)(3) of the International Financial Institutions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/262r">22 U.S.C. 262r(c)(3)</external-xref>)); and</text></subparagraph><subparagraph id="HD4C7BB3775CD4DC98976F0C62EE1251C" commented="no"><enum>(C)</enum><text>any successor, subunit, parent entity, or subsidiary of, or any entity under common ownership or control with, any entity described in subparagraph (A) or (B).</text></subparagraph></paragraph></subsection><subsection id="H222496B7B22D4459A17F85E56C427B2B"><enum>(f)</enum><header>Termination</header><text display-inline="yes-display-inline">This section and the requirements of this section shall terminate on—</text><paragraph id="HA700652ACBAE4D5E8EFC9D0032734799"><enum>(1)</enum><text display-inline="yes-display-inline">the date on which a determination is made that the 2022 winter Olympics will not be held in the People’s Republic of China; or</text></paragraph><paragraph id="H8BCA97B9C842407E956568104C77F9FD"><enum>(2)</enum><text>September 30, 2025.</text></paragraph></subsection></section></legis-body></bill>
