R. 3597</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210528">May 28, 2021</action-date><action-desc><sponsor name-id="K000386">Mr. Katko</sponsor> (for himself and <cosponsor name-id="A000376">Mr. Allred</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that for taxable years beginning before 1980 the Federal income tax deductibility of flight training expenses shall be determined without regard to whether such expenses were reimbursed through certain veterans educational assistance allowances, and for other purposes.</official-title></form><legis-body id="H21547F41DA81416CACC0CB4704849165" style="OLC"><section id="H8C0F08A784F34CD6AF150D6B75AEED29" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>William Becker Promoting Careers in Aviation for America’s Veterans Act</short-title></quote>. </text></section><section id="HF8F4238604CD4E65A282608B2126D5D1"><enum>2.</enum><header>Treatment of certain reimbursed flight training expenses</header><subsection id="HA5A127ABDB4F40E4AB9D611EE9DF94C0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a taxable year beginning before January 1, 1980, the determination of whether a deduction is allowable under <external-xref legal-doc="usc" parsable-cite="usc/26/162">section 162(a)</external-xref> of the Internal Revenue Code of 1986 for flight training expenses shall be made without regard to whether the taxpayer was reimbursed for any portion of such expenses under section 1677(b) of title 38, United States Code (as in effect before its repeal by <external-xref legal-doc="public-law" parsable-cite="pl/97/35">Public Law 97–35</external-xref>).</text></subsection><subsection id="H0D2E6C0AAB9F4C749D19D4E6A0AC8820"><enum>(b)</enum><header>Statute of limitations</header><text>If refund or credit of any overpayment of tax resulting from the application of subsection (a) is prevented at any time before the close of the 1-year period beginning on the date of the enactment of this Act by the operation of any law or rule of law (including res judicata), refund or credit of such overpayment (to the extent attributable to the application of subsection (a)) may, nevertheless, be made or allowed if claim therefor is filed before the close of such 1-year period.</text></subsection></section><section id="HC125607655DB4010A9FAA4E5BB21B3A2"><enum>3.</enum><header>Use of Department of Veterans Affairs educational assistance benefits for private pilot certification courses</header><text display-inline="no-display-inline">Section 3034(d) of title 38, United States Code, is amended—</text><paragraph id="H031872C1C9FC43F58D6558283C6E12E6"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="H824FDFA12D9D4B6EBFB7AC86452D1BA2"><enum>(2)</enum><text>by striking paragraph (2); and</text></paragraph><paragraph id="HA6AFDD2B8F964D0197EE9988AC99CF14"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph (2).</text></paragraph></section><section id="H73D48F8FDB4D43929287512457D26D3C"><enum>4.</enum><header>National strategy to provide assistance to veterans pursuing careers in aviation</header><text display-inline="no-display-inline">The Secretary of Veterans Affairs, in coordination with the Secretary of Defense and the Secretary of Labor, shall develop a national strategy for providing assistance to veterans in pursuing careers in aviation. Such strategy shall include—</text><paragraph id="H2B433625302145FCBBF41580BE537138"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of existing programs to develop methods and procedures of informing veterans of any benefits to which they may be entitled relating to the pursuit of a career in aviation;</text></paragraph><paragraph id="H9B6243EFCB134DA8A624DDBBC5757AFE"><enum>(2)</enum><text>a survey of existing private and public employment opportunities for veterans in the aviation industry; and</text></paragraph><paragraph id="H889A81347CE2456E89DA55477DE922E4"><enum>(3)</enum><text>policy recommendations for providing assistance to veterans who are interested in pursuing careers in aviation.</text></paragraph></section></legis-body></bill>
