accountability with respect to international reporting and monitoring of outbreaks of novel viruses and diseases.</official-title></form><legis-body id="H6E92CFCF99B747EF89BA90C0BFA16282" style="OLC"><section id="HC4B1ACB2A2D64566A9AD88036F7A2D13" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Never Again International Outbreak Prevention Act</short-title></quote>.</text></section><section id="H89D896A6D80D4159AA1B3BB929538F58"><enum>2.</enum><header>Lists of foreign countries based on compliance with international reporting and monitoring of outbreaks of novel viruses and diseases</header><subsection id="HDC7AA5361B3A464794FC6DC55E407810"><enum>(a)</enum><header>Lists of foreign countries</header><paragraph id="H8BC40691A51E448BA7733D1F4823B2CC"><enum>(1)</enum><header>Tier 1 list</header><subparagraph id="H059CC5494A9F4FB8BF886DB86C10BFC0"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall establish a list of foreign countries that the Secretary determines meet the requirements described in subsection (b). </text></subparagraph><subparagraph id="H91812FC9A6B84E3EB777B535F71B9A6B"><enum>(B)</enum><header>Reference</header><text>The list of foreign countries established under this paragraph shall be referred to as the <quote>Tier 1 list</quote>.</text></subparagraph></paragraph><paragraph id="H1F0C6E26195E4C7C9FA7867BE1F3D2E3"><enum>(2)</enum><header>Tier 2 list</header><subparagraph id="HC0A5146D68194B66A7BA4BD933489623"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall establish a list of foreign countries that the Secretary determines do not meet the requirements described in subsection (b) but are capable of meeting such requirements.</text></subparagraph><subparagraph id="HF46B63D27CEA4EE585914077C46B6911"><enum>(B)</enum><header>Review</header><text display-inline="yes-display-inline">The Secretary of State shall conduct a review on an ongoing basis of each country on the list established under this paragraph to ensure that the country is taking appropriate steps to meet the requirements described in subsection (b). </text></subparagraph><subparagraph id="HA41BD25636214229B2B91AF404D6A08C"><enum>(C)</enum><header>Reference</header><text display-inline="yes-display-inline">The list of foreign countries established under this paragraph shall be referred to as the <quote>Tier 2 list</quote>.</text></subparagraph></paragraph><paragraph id="HEAF71C0DAD0A4BA5ADD441F4EFE5E671"><enum>(3)</enum><header>Tier 3 list</header><subparagraph id="H7D2C0620C1BE48FDB3AED1D3658D7994"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall establish a list of foreign countries that the Secretary determines do not meet the requirements described in subsection (b) because such countries are not capable, based on financial, security, or government infrastructure reasons, of meeting such requirements.</text></subparagraph><subparagraph id="HBEC706FB768645DBA1550BA848A4210A"><enum>(B)</enum><header>Reference</header><text display-inline="yes-display-inline">The list of foreign countries established under this paragraph shall be referred to as the <quote>Tier 3 list</quote>.</text></subparagraph></paragraph><paragraph id="H3646E8D1BE6B4EC2987FA6D7F6ED1563"><enum>(4)</enum><header>Updates</header><text display-inline="yes-display-inline">The Secretary of State shall submit to the appropriate congressional committees an updated Tier 1 list under paragraph (1), an updated Tier 2 list under paragraph (2), and an updated Tier 3 list under paragraph (3)—</text><subparagraph id="H0894DDB1CEEC4E289A0308D46E6125A4"><enum>(A)</enum><text>not later than one year after the date of the enactment of this Act and annually thereafter; and </text></subparagraph><subparagraph id="H41D27A027D2E4D96B759F141B1E280FB"><enum>(B)</enum><text>as new information becomes available.</text></subparagraph></paragraph></subsection><subsection id="H49FCB03CF0C54FDD9E063DBA33AABD44"><enum>(b)</enum><header>International reporting and monitoring requirements described</header><text display-inline="yes-display-inline">The requirements described in this subsection are the following: </text><paragraph id="H124856C3518B4B01912303C71FEEF8C0"><enum>(1)</enum><text display-inline="yes-display-inline">The foreign country has established procedures and standards to comply with established international <quote>sentinel surveillance</quote> systems to collect data, identify trends, identify outbreaks, and provide monitoring with respect to the burden of disease in a community.</text></paragraph><paragraph id="H7B0104EC491E4F0C8B3DCE50CE964D6D"><enum>(2)</enum><text display-inline="yes-display-inline">The foreign country has established procedures and standards to ensure that novel viruses and diseases are reported such international <quote>sentinel surveillance</quote> systems not later than 3 days after identification.</text></paragraph></subsection><subsection id="H2006C080646845E2B358BBE79B3835FB"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to apply with respect to the territory of a foreign country with respect to which the internationally recognized government of the country does not control due to armed conflict.</text></subsection><subsection id="HAED7FC0996554ED8ADB55FB59D4CFDEA"><enum>(d)</enum><header>Inclusion in annual United States Government Global Health Security Strategy</header><text display-inline="yes-display-inline">The President shall ensure that the requirements of this section are appropriately reflected in the annual United States Government Global Health Security Strategy.</text></subsection></section><section id="HC16645A870184FE3BB744C6B25AADB00"><enum>3.</enum><header>Presidential actions with respect to foreign countries on the Tier 2 list</header><subsection id="H0ADBE49450C24CF9BD0977D9186870CE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President, in consultation with the Secretary of State, shall take one or more of the actions described in subsection (b) (or commensurate action in substitution thereto) with respect to a foreign country that is on the Tier 2 list established under section 2(a).</text></subsection><subsection id="H24EECE107F144467A42AF2E7F652DE3D"><enum>(b)</enum><header>Description of Presidential actions</header><text display-inline="yes-display-inline">The Presidential actions referred to in this subsection are the following:</text><paragraph id="H5866F95F63634C8C96C76E1DDDE91F18"><enum>(1)</enum><text>A private demarche.</text></paragraph><paragraph id="HDF20EC715B5341E2B99E5935CABBDC59"><enum>(2)</enum><text>An official public demarche.</text></paragraph><paragraph id="H290154A9BF0F4510A8A95C4C11450369"><enum>(3)</enum><text>A public condemnation.</text></paragraph><paragraph id="HB4B72E3C2C8A474F9289A112308F80F8"><enum>(4)</enum><text>A public condemnation within one or more multilateral fora.</text></paragraph><paragraph id="HF1EDB18580A14B0AA2A3A06699CF0E7B"><enum>(5)</enum><text>The delay or cancellation of one or more scientific exchanges.</text></paragraph><paragraph id="H1BA240BF5D1B4BAEBF5794419909BE5F"><enum>(6)</enum><text>The delay or cancellation of one or more cultural exchanges.</text></paragraph><paragraph id="H5DA3387B3F2B471C95401AF4AF5E04DE"><enum>(7)</enum><text>The denial of one or more working, official, or state visits.</text></paragraph><paragraph id="HE0F18EA05A1A4C13A87D1CC7489D5367"><enum>(8)</enum><text>The delay or cancellation of one or more working, official, or state visits.</text></paragraph><paragraph id="H782C4A4C67794DFE9231C94D217BF511"><enum>(9)</enum><text>The withdrawal, limitation, or suspension of United States development assistance in accordance with section 116 of the Foreign Assistance Act of 1961.</text></paragraph><paragraph id="H5836D491291C48889C69B8F936039869"><enum>(10)</enum><text>The withdrawal, limitation, or suspension of United States security assistance in accordance with section 502B of the Foreign Assistance Act of 1961.</text></paragraph><paragraph id="H894564EE07CE4384804736ECEAF78A6E"><enum>(11)</enum><text>Consistent with section 701 of the International Financial Institutions Act of 1977, directing the United States executive directors of international financial institutions to oppose and vote against loans primarily benefiting the specific foreign government, agency, instrumentality.</text></paragraph><paragraph id="H98584BDEE8204F4D8402AEFBEE0D53CE"><enum>(12)</enum><text>Ordering the heads of the appropriate United States agencies not to issue any (or a specified number of) specific licenses, and not to grant any other specific authority (or a specified number of authorities), to export any goods or technology to the specific foreign government, agency, instrumentality under—</text><subparagraph id="H319E6693C9534810A0B0705F34C1FAD9"><enum>(A)</enum><text>the Export Control Reform Act of 2018;</text></subparagraph><subparagraph id="HA5D8CBF4FBAE4688BCBF574B24E97065"><enum>(B)</enum><text>the Arms Export Control Act;</text></subparagraph><subparagraph id="H4BB0E3EEBB53430BBBC6256A81CCAD5E"><enum>(C)</enum><text>the Atomic Energy Act of 1954; or</text></subparagraph><subparagraph id="H7D61D0B298D64DB08399B72CBE677DFA"><enum>(D)</enum><text>any other statute that requires the prior review and approval of the United States Government as a condition for the export or reexport of goods or services.</text></subparagraph></paragraph><paragraph id="H9F56EA89F6E5442A89D430DD208AFFE6"><enum>(13)</enum><text>Prohibiting any United States financial institution from making loans or providing credits totaling more than $10,000,000 in any 12-month period to the specific foreign government, agency, instrumentality.</text></paragraph><paragraph id="H76EDB783E5064054AB7AC63AFA8D342B"><enum>(14)</enum><text>Prohibiting the United States Government from procuring, or entering into any contract for the procurement of, any goods or services from the foreign government, entities.</text></paragraph></subsection><subsection id="H119295CC595F4ECC952018EAFB6F518A" commented="no"><enum>(c)</enum><header>Waiver</header><text display-inline="yes-display-inline">The President may waive the application of subsection (a) with respect to a foreign country if the President determines it is important to the national interests of the United States to do so.</text></subsection></section><section id="HAEB85D98AEB34C82B0F5F24F83389BF8" section-type="subsequent-section"><enum>4.</enum><header>Sovereign immunity waiver</header><subsection id="H9C3E0E52EDC54AEABF48FC23CA05608C"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">Chapter 97</external-xref> of title 28, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/28/1605B">section 1605B</external-xref> the following:</text><quoted-block style="USC" id="H004A9C9448B5412BAC5098B197BD75FC" display-inline="no-display-inline"><section id="H8C8CA99561074F178A10682776A86C46"><enum>1605C.</enum><header> Responsibility of foreign states for pandemic outbreaks</header><subsection id="HFAEF9F4B7C4A42D59A1D6AB23F3E571B"><enum>(a)</enum><header>Responsibility of foreign states</header><text display-inline="yes-display-inline">A foreign state shall not be immune from the jurisdiction of the courts of the United States in any case in which damages are sought against a foreign state for physical injury to person or property or death occurring in the United States and caused by a failure to abide the requirements laid out in paragraphs (1) and (2) of section 2(b) of the <short-title>Never Again International Outbreak Prevention Act</short-title> or are determined to have intentionally misled the international community or the WHO on the outbreak or spread of a health concern that leads to a pandemic.</text></subsection><subsection id="H8E69287EF523413EADAC8BB1C5F040E3"><enum>(b)</enum><header>Rule of construction</header><text>A foreign state shall not be subject to the jurisdiction of the courts of the United States under subsection (a) on the basis of an omission or a tortious act or acts that constitute mere negligence.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H95BA2895BEAE419CA5130C8D2747AD00"><enum>(b)</enum><header>Clerical amendment</header><paragraph id="H6AB74693706A4F64AC39522B6BF2F8A9"><enum>(1)</enum><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">chapter 97</external-xref> of title 28, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/28/1605A">section 1605A</external-xref> the following: </text><quoted-block style="USC" id="HD1CD16A7379048A3BD0959EB7DE78C89" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1605C. Responsibility of foreign states for pandemic outbreaks.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H851C3200A54348B5B46A7C6798928C0F"><enum>(2)</enum><text>Subsection 1605(g)(1)(A) of title 28, United States Code, is amended by striking <quote>but for section 1605A or section 1605B</quote> and inserting <quote>but for section 1605A, 1605B, or 1605C</quote>.</text></paragraph></subsection><subsection id="H0F94F2A897A44860874391A08AC66DA2"><enum>(c)</enum><header>Stay of actions pending State negotiations</header><paragraph id="H82A7080FE9A1480BBC51E8EE641626B9"><enum>(1)</enum><header>Exclusive jurisdiction</header><text display-inline="yes-display-inline">The courts of the United States shall have exclusive jurisdiction in any action in which a foreign state is subject to the jurisdiction of a court of the United States under section 1605C of title 28, United States Code. </text></paragraph><paragraph id="HAC3B06579C2E42E2AEEC542D0B1E2391"><enum>(2)</enum><header>Intervention</header><text>The Attorney General may intervene in any action in which a foreign state is subject to the jurisdiction of a court of the United States under section 1605C of title 28, United States Code, for the purpose of seeking a stay of the civil action, in whole or in part. </text></paragraph><paragraph id="H42F998B0A88044C0B170DB3174C54271"><enum>(3)</enum><header>Stay</header><subparagraph id="H3DA0FBE98A934E069FCFAAFF4DA73C49"><enum>(A)</enum><header>In general</header><text>A court of the United States may stay a proceeding against a foreign state if the Secretary of State certifies that the United States is engaged in good faith discussions with the foreign state defendant concerning the resolution of the claims against the foreign state, or any other parties as to whom a stay of claims is sought. </text></subparagraph><subparagraph id="H7A2155267BDF4125A70C8563F0D95936"><enum>(B)</enum><header>Duration</header><clause id="H9B6A52B3A52840159A037E3B82F3A186"><enum>(i)</enum><header>In general</header><text>A stay under this subsection may be granted for not more than 180 days. </text></clause><clause id="HB2E963FD6D52427B8F71C6940D200282"><enum>(ii)</enum><header>Extension</header><subclause id="H349543228BA84A608A546FEBF55BFA69"><enum>(I)</enum><header>In general</header><text>The Attorney General may petition the court for an extension of the stay for additional 180-day periods. </text></subclause><subclause id="HC49FB189119D47DC9808CEBF7B5270BF"><enum>(II)</enum><header>Recertification</header><text>A court shall grant an extension under subclause (I) if the Secretary of State recertifies that the United States remains engaged in good faith discussions with the foreign state defendant concerning the resolution of the claims against the foreign state, or any other parties as to whom a stay of claims is sought.</text></subclause></clause></subparagraph></paragraph></subsection></section><section id="HFA6E1570487C4FD89CDD0965D166CD61"><enum>5.</enum><header>Imposition of sanctions with respect to government officials of foreign countries on the Tier 2 list</header><subsection id="HF55F1E2955D04BF2AE59FD1F3FBD5BCE"><enum>(a)</enum><header>In general</header><text>The President may impose the sanctions described in subsection (b) with respect to any foreign person the President determines, based on credible evidence—</text><paragraph id="H5E5C2B2E13F249E398186B3DADA58819"><enum>(1)</enum><text display-inline="yes-display-inline">is a government official of a foreign country on the Tier 2 list established under section 2(a), or a senior associate of such an official, that is responsible for, or complicit in, ordering, controlling, or otherwise directing, or financially benefits from, acts intended to deliberately conceal or distort information about a public health emergency of international concern, including acts intended to deliberately withhold information from or obstruct the activities of the World Health Organization with respect to a public health emergency of international concern; or</text></paragraph><paragraph id="H9EEC44B3B91C4057B7BBA1238B6AA073"><enum>(2)</enum><text>has materially assisted, sponsored, or provided financial, material, or technological support for, or goods or services in support of, an act described in paragraph (1).</text></paragraph></subsection><subsection id="HB63B0EC2E39F4FD29DF86C82C79B6822"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions to be imposed with respect to a foreign person under subsection (a) are the following:</text><paragraph id="H70720A4B3319405AB53871C189B758FB" commented="no"><enum>(1)</enum><header>Inadmissibility of certain individuals</header><subparagraph id="H2C308CADB05A4B50A9361D71CD72ACD2" commented="no"><enum>(A)</enum><header>Ineligibility for visas, admission, or parole</header><text>A foreign person who meets any of the criteria described subsection (a) is—</text><clause id="H351D997941EE4A3CA62939A63B6B7D7B" commented="no"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="HC11C66E9000348A6B921B39F01F44663" commented="no"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause id="H24CDE63A41FF4A6892C6F0975BF31E77" commented="no"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="H190D2BD10C4542A682BAFADAF7710F7E" commented="no"><enum>(B)</enum><header>Current visas revoked</header><text>A foreign person subject to subsection (a) is subject to the following:</text><clause id="H79CB196E7451416785E398C78E307D6A" commented="no"><enum>(i)</enum><text>Revocation of any visa or other entry documentation regardless of when the visa or other entry documentation is or was issued. </text></clause><clause id="H8F61B085070A4738A9AA69A9B18707ED" commented="no"><enum>(ii)</enum><text>A revocation under clause (i) shall—</text><subclause id="H08DB32D4AB854590B35EB8B553AD6DCB" commented="no"><enum>(I)</enum><text>take effect immediately; and </text></subclause><subclause id="H78477F18F6724EEBA7B5A8C3702008EF" commented="no"><enum>(II)</enum><text>automatically cancel any other valid visa or entry documentation that is in the foreign person’s possession.</text></subclause></clause></subparagraph></paragraph><paragraph id="H87F7FDC7BDE54E4F80276A042094AD59"><enum>(2)</enum><header>Blocking of property</header><text>The President shall exercise all of the powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in property and interests in property of the person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph></subsection><subsection id="H7F221A1E41C44D7FAB00B00BB771104C"><enum>(c)</enum><header>Consideration of certain information in imposing sanctions</header><text>In determining whether to impose sanctions under subsection (a), the President shall consider—</text><paragraph id="H1E5B9BFD1FC442879F2BECD5716FB1F9"><enum>(1)</enum><text>information provided jointly by the chairperson and ranking member of each of the appropriate congressional committees; and</text></paragraph><paragraph id="H4A9508E4F9B7474CB47D09BCC71A0D53"><enum>(2)</enum><text>credible information obtained by other countries and nongovernmental organizations that monitor violations of human rights and global health issues, including issues related to infectious disease.</text></paragraph></subsection><subsection id="HC5E2C1869B67425F991F241AEAD33E85"><enum>(d)</enum><header>Requests by appropriate congressional committees</header><paragraph id="H826C13B1083B4A6AAB64A5694278D933"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after receiving a request that meets the requirements of paragraph (2) with respect to whether a foreign person is described in subsection (a), the President shall—</text><subparagraph id="H4C2922B6D06442A39E95448A8A650C5D"><enum>(A)</enum><text>determine if that person is so described; and </text></subparagraph><subparagraph id="H30AF5E196D084339B767BBE144A20B92"><enum>(B)</enum><text>submit a classified or unclassified report to the chairperson and ranking member of the committee or committees that submitted the request with respect to that determination that includes—</text><clause id="H4221C0A46FF34BF2AE19AF3451900429"><enum>(i)</enum><text>a statement of whether or not the President imposed or intends to impose sanctions with respect to the person; and</text></clause><clause id="H500E344885164E488F81C07D48D983EE"><enum>(ii)</enum><text>if the President imposed or intends to impose sanctions, a description of those sanctions.</text></clause></subparagraph></paragraph><paragraph id="H050D923AB4A34056AFFF5870DAB93802"><enum>(2)</enum><header>Requirements</header><text>A request under paragraph (1) with respect to whether a foreign person is described in subsection (a) shall be submitted to the President in writing jointly by the chairperson and ranking member of one of the appropriate congressional committees.</text></paragraph></subsection><subsection id="HCA04CAED7166440BAB780FAA56BE0ACE"><enum>(e)</enum><header>Exception To comply with United Nations headquarters agreement and law enforcement objectives</header><text>Sanctions under subsection (b)(1) shall not apply to an individual if admitting the individual into the United States—</text><paragraph id="H506AF9D04AA448EFBE51745E995D5C8F"><enum>(1)</enum><text>would further important law enforcement objectives; or </text></paragraph><paragraph id="H62DBF28194264B969B8C2F76A072A496"><enum>(2)</enum><text>is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations of the United States.</text></paragraph></subsection><subsection id="HD4CAC2B030844F2D9CC05542E3C3BE2C"><enum>(f)</enum><header>Enforcement of blocking of property</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of subsection (b)(2) or any regulation, license, or order issued to carry out that subsection shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></subsection><subsection id="H34995370D04749DA800D6A11E419F3BF"><enum>(g)</enum><header>Reports required</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, and annually thereafter, the President shall submit to the appropriate congressional committees a report that includes—</text><paragraph id="HF2FB6444152242B6AF5641027A3D0A41"><enum>(1)</enum><text>a list of each foreign person with respect to which the President imposed sanctions under subsection (b) during the year preceding the submission of the report;</text></paragraph><paragraph id="HA0879D969C12494E84A95A0B3BE30AA7"><enum>(2)</enum><text>a description of the type of sanctions imposed with respect to each such person;</text></paragraph><paragraph id="HE9E2A51F962E481B8C339F9A336BD9DC"><enum>(3)</enum><text>the number of foreign persons with respect to which the President—</text><subparagraph id="H1D61016CDE814744A2BD6CD01C014E1D"><enum>(A)</enum><text>imposed sanctions under subsection (b) during that year; or</text></subparagraph><subparagraph id="HFC67C08A593A4849B475F3292DADA08F"><enum>(B)</enum><text>terminated sanctions under subsection (h) during that year;</text></subparagraph></paragraph><paragraph id="H673099BDC59F48C584A2DC32D9ED8FB9"><enum>(4)</enum><text>the dates on which such sanctions were imposed or terminated, as the case may be;</text></paragraph><paragraph id="H628792A54BCF44DC85B4FC019ECF6E0C"><enum>(5)</enum><text>the reasons for imposing or terminating such sanctions; and</text></paragraph><paragraph id="H215253EA0C4B48C986EE350406133EB4" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text>a description of the efforts of the President to encourage the governments of other countries to impose sanctions that are similar to the sanctions authorized by this section. </text></paragraph></subsection><subsection id="H5739D436C6454E89B179BFDA4F50AF4E"><enum>(h)</enum><header>Termination of sanctions</header><text>The President may terminate the application of sanctions under this section with respect to a person if the President determines and reports to the appropriate congressional committees not later than 15 days before the termination of the sanctions that—</text><paragraph id="H82D642F4B2BA4DC485F0F1DDFFFC842A"><enum>(1)</enum><text>credible information exists that the person did not engage in the activity for which sanctions were imposed;</text></paragraph><paragraph id="H48F7B439E827485E8D430A196BB42772"><enum>(2)</enum><text>the person has been prosecuted appropriately for the activity for which sanctions were imposed;</text></paragraph><paragraph id="HAEEE3112A0CF4911A85EDBABCA33A915"><enum>(3)</enum><text>the foreign country of the person has been upgraded from the Tier 2 list to the Tier 1 list established under section 2(a); and</text></paragraph><paragraph id="H9E4E7353AE2444AD914659068D8B79E5"><enum>(4)</enum><text>the termination of the sanctions is in the national security interests of the United States.</text></paragraph></subsection><subsection id="H3E12CB98FA3F4131AA9B1C83CED41A4C"><enum>(i)</enum><header>Regulatory authority</header><text>The President shall issue such regulations, licenses, and orders as are necessary to carry out this section.</text></subsection><subsection id="HDA4DFAF28B7340FEA1CE5491EE97210B"><enum>(j)</enum><header>Exception relating to importation of goods</header><paragraph id="H68803E2C0A4A4E40B182BC86EB9403EC"><enum>(1)</enum><header>In general</header><text>The authorities and requirements to impose sanctions under this section shall not include the authority to impose sanctions on the importation of goods.</text></paragraph><paragraph id="H9E5BEB75D9E4469686326D8B6BC1230A"><enum>(2)</enum><header>Good defined</header><text>In this subsection, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data. </text></paragraph></subsection><subsection id="HFFF318E9415544149E398AFCAD82924C"><enum>(k)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H7E6F91621F1640F38CE907FE5724DB06"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H02FF29F747FC44A88A21182CA2CCFE16"><enum>(A)</enum><text>the Committee on Banking, Housing, and Urban Affairs and the Committee on Foreign Relations of the Senate; and </text></subparagraph><subparagraph id="H03659C22D6824DD8957E13069F169FFC"><enum>(B)</enum><text>the Committee on Financial Services and the Committee on Foreign Affairs of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H543F55701617427393788B4886B60A5C"><enum>(2)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means a person that is not a United States person.</text></paragraph><paragraph id="H32BF8C34D7D84C5BB8912FCB5D723418"><enum>(3)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text></paragraph><paragraph id="HAB558A3055DA47A8934B8404013FDEA7"><enum>(4)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text><subparagraph id="HE6F2EC53A89B4B0E867DDF8DBDB16FFE"><enum>(A)</enum><text>an individual who is a United States citizen or an alien lawfully admitted for permanent residence to the United States;</text></subparagraph><subparagraph id="HA156851D7FB64E73872A05B705B46F2A"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity; or</text></subparagraph><subparagraph id="HB0315B7D55804D898ECAE7B02EEB9A4E" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>any person in the United States.</text></subparagraph></paragraph></subsection></section><section id="H139E7A31C32D48B98F95837B8257F7F5" commented="no"><enum>6.</enum><header>G–20 investigation of international response to COVID–19</header><subsection id="H5C2962FC30D04228A6838ABC74FEF0DD" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall seek to work with the heads of other Group of Twenty (commonly referred to as the <quote>G–20</quote>) countries and international organizations to—</text><paragraph id="HA49D82E1E1E9409FB4798A690DA18D39" commented="no"><enum>(1)</enum><text>investigate and prepare a report on the international response to the coronavirus disease 2019 (commonly known as <quote>COVID–19</quote>); and</text></paragraph><paragraph id="H2563A9E9B1AD4ADA9A8E9E1161C47FBB" commented="no"><enum>(2)</enum><text>conduct an audit of the World Health Organization relating to its actions in response to COVID–19.</text></paragraph></subsection><subsection id="HB94825F3AB134AAB8B3B51123734C8FA" commented="no"><enum>(b)</enum><header>United Nations actions</header><text display-inline="yes-display-inline">The Permanent United States Representative to the United Nations shall request the United Nations Office of Internal Oversight Services to establish a panel with representatives from each G–20 country and international organization to—</text><paragraph id="H592E8BA132B245E8A3277B51C6DA422B" commented="no"><enum>(1)</enum><text>conduct a review of the World Health Organization’s response to COVID–19; and</text></paragraph><paragraph id="HD19A0F5EA14D42F99DAEFA17454BC634" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">make recommendations to the United Nations and the United Nations Security Council on actions that can be taken to—</text><subparagraph id="H2BE26ABB1BC940C4A19D3909B421CC8E" commented="no"><enum>(A)</enum><text>ensure improved future responses; and</text></subparagraph><subparagraph id="HEB7C9C4C23B44BBEBD4B9746F15890A8" commented="no"><enum>(B)</enum><text>ensure accountability of World Health Organization officials for identified failures.</text></subparagraph></paragraph></subsection></section><section id="H8AF34057E58644EDB36DB4C3ACF82FC6" commented="no"><enum>7.</enum><header>International response to wet markets globally</header><subsection id="HB4D9431A4B4B4A628F6CF48AA2CF0D0D" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Permanent United States Representative to the United Nations shall use the voice, vote, and influence of the United States to seek the adoption in the United Nations General Assembly or Security Council of a resolution to ban wet markets described in subsection (b) globally.</text></subsection><subsection id="H827D25A1709B4378A205D77755FE23C5" commented="no"><enum>(b)</enum><header>Wet markets described</header><text display-inline="yes-display-inline">A wet market described in this subsection is a market where—</text><paragraph id="H86353979C9C94AF5A51B29AD5276E830" commented="no"><enum>(1)</enum><text>animals are sold, dead or alive, for human consumption;</text></paragraph><paragraph id="H5C028A1A90044C1B8BE75ADED2BAEA5B" commented="no"><enum>(2)</enum><text>the origin of such animals and their health cannot be certified; and</text></paragraph><paragraph id="H3410B56578BB45F581FFE7E440962962" commented="no"><enum>(3)</enum><text>the conditions in which such animals are raised, kept, or sold are unhygienic.</text></paragraph></subsection></section><section id="H4F8B9D014A6140A5975F0C69492B2A73"><enum>8.</enum><header>Public health emergency of international concern defined</header><text display-inline="no-display-inline">In this Act, the term <term>public health emergency of international concern</term> means a public health emergency determined to be a public health emergency of international concern by the World Health Organization.</text></section></legis-body></bill>
