which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Afghan Allies Protection Act of 2009 to make 4,000 visas available for the Afghan Special Immigrant Visa program, and for other purposes.</official-title></form><legis-body id="H42C39D66513D44A3A00D424789A5E241" style="OLC"><section id="HCA7258BB05BF4C5C90C79EF590F7B3F1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Afghan Allies Protection Act of 2021</short-title></quote>.</text></section><section id="H6FDF7093B3EE45E6BC39637B0631438A"><enum>2.</enum><header>Special immigrant visas for afghan allies</header><subsection id="H1148061D36E74721858BA3F3F3B6FFAD"><enum>(a)</enum><header>In general</header><text>Section 602(b)(2)(A)(ii) of the Afghan Allies Protection Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note) is amended, in the matter preceding subclause (I), by inserting <quote>for the first time</quote> after <quote>submitting a petition</quote>.</text></subsection><subsection id="H589E4C060EDE4AF1A3AF6C2D3E04F0F9"><enum>(b)</enum><header>Numerical limitations</header><text>Section 602(b)(3) of the Afghan Allies Protection Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note) is amended—</text><paragraph id="H19EDF45543294265B1F3AE735611C8DF"><enum>(1)</enum><text>by striking subparagraph (A) and inserting the following:</text><quoted-block id="H1E298F9CF17443929CF95D902C14DE02" style="OLC"><subparagraph id="HAB717719332F45B98302A8CE92C68B5A"><enum>(A)</enum><header>Fiscal year 2021</header><clause id="H8695FAE4BEA74332AAEB88E29AEA101F"><enum>(i)</enum><header>In general</header><text>In addition to any unused balance under subparagraph (F), for fiscal year 2021, not more than 4,000 principal aliens may be granted special immigrant status under this subsection.</text></clause><clause id="HA07EB4AD194A4F3983FF45BDB4188B4F"><enum>(ii)</enum><header>Period of employment</header><text>For purposes of this subparagraph, the period of employment referred to in paragraph (2)(A)(ii) shall end not later than December 31, 2023.</text></clause><clause id="H22C79C98A6034B1DA335684AD5ADEF01"><enum>(iii)</enum><header>Application</header><text>For purposes of this subparagraph, not later than December 31, 2023, a principal alien seeking special immigrant status under this subsection shall submit an application to the Chief of Mission.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H73FA40DA9BF04B0E9515E81CEA1A307C"><enum>(2)</enum><text>by striking subparagraph (C) and inserting the following:</text><quoted-block id="HEEE0321A97104C8DBF56FE7B3DEA4C57" style="OLC"><subparagraph id="H392486FCD655405C9E0425E2B4C3127A"><enum>(C)</enum><header>Carry forward</header><text>If the numerical limitation described in subparagraph (A)(i) is not reached for fiscal year 2021, the numerical limitation for each subsequent fiscal year shall be established at a number equal to the difference between—</text><clause id="HA17776D21E14481F91F3516396054B29"><enum>(i)</enum><text>the numerical limitation described in subparagraph (A)(i); and</text></clause><clause id="H2C67A2C829A64F43874FDBA825DC6F9C"><enum>(ii)</enum><text>the number of principal aliens granted special immigrant status under this subsection during each fiscal year beginning in fiscal year 2021.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H30EEA7DAB2A343CD9306763F8897E807"><enum>(3)</enum><text>in subparagraph (D), by striking <quote>notwithstanding the provisions of paragraph (C),</quote>; and</text></paragraph><paragraph id="H411C1E5145E543C0BB81E58BAA08A7EA"><enum>(4)</enum><text>in subparagraph (F), as amended by this Act,—</text><subparagraph id="H21162C0C37FC4502B2C39C3D7BC1192E"><enum>(A)</enum><text>by redesignating clauses (i) through (iii) as subclauses (I) through (III), respectively, and indenting appropriately;</text></subparagraph><subparagraph id="HF5D0A67C6D0D4396A1F0B89457D09EF6"><enum>(B)</enum><text>in the matter preceding subclause (I) (as so redesignated), in the second sentence, by striking <quote>For purposes</quote> and inserting the following:</text><quoted-block id="H50816C287A504645B5E84F07CD2DB1A9" style="OLC"><clause id="HBF5870D5AF6A4D6280FE08B3CDC2A77E"><enum>(ii)</enum><header>Requirements</header><text>For purposes</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H3806006543764F96BD42D8DAD7E8DE2E"><enum>(C)</enum><text>in the matter preceding clause (ii) (as so designated)—</text><clause id="H81BBC555891747A4B65FC098B33A69D0"><enum>(i)</enum><text>by striking <quote>exhausted,,</quote> and inserting <quote>exhausted,</quote>; and</text></clause><clause id="H153D28BA43644D5C94B7347B0F563CD4"><enum>(ii)</enum><text>by striking <quote>In addition</quote> and inserting the following:</text><quoted-block id="H01D4B9919B3C4BC5974F5FEA600F13CC" style="OLC"><clause id="H22E38422E9F2405192C4F9886A93C67A"><enum>(i)</enum><header>In general</header><text>In addition</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H12D74C28F2794B0A9517A8566785A133"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="HD037B4D5F1BD43B88108D44EE4870C36" style="OLC"><clause id="HEEFB8AF7A7FB43E6839F0E60061399B2"><enum>(iii)</enum><header>Unused visas</header><text>Any unused balance under this subparagraph shall be added to the number under subparagraph (A)(i) for use in fiscal year 2021.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H9CC37C7A7E724321BE80A57F08FBC338"><enum>(c)</enum><header>Conversion of petitions</header><text>Section 2 of <external-xref legal-doc="public-law" parsable-cite="pl/110/242">Public Law 110–242</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note) is amended by striking subsection (b) and inserting the following:</text><quoted-block id="HE4BFE44D95314AC6A6DE52117E9687A6" style="OLC"><subsection id="H2732124B9A5C42AD9E553E235EC81654"><enum>(b)</enum><header>Duration</header><text>The authority under subsection (a) shall expire on the date on which the numerical limitation specified under section 1244 of the National Defense Authorization Act for Fiscal Year 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/181">Public Law 110–181</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref> note) is reached.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
