which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to eliminate copayments by the Department of Veterans Affairs for medicines relating to preventive health services, and for other purposes.</official-title></form><legis-body id="H495F4CFC37254B258E11C9D24199D6AC" style="OLC"><section id="H7801738908ED40E2A97CD6E8CEBC28E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Preventive Health Coverage Fairness Act</short-title></quote>.</text></section><section id="H0737F028755343FE83D9BAA661DE9041" section-type="subsequent-section"><enum>2.</enum><header>Improvement to preventive health services furnished by Department of Veterans Affairs</header><subsection id="H4F6BD883961341BAA396FAF3155F5410"><enum>(a)</enum><header>Elimination of medication copayments</header><text display-inline="yes-display-inline">Section 1722A(a)(3) of title 38, United States Code, is amended—</text><paragraph id="HFA1E1B650B2545A9BA40EBB945D193C6"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>or</quote>;</text></paragraph><paragraph id="HE4B964C3C39A430FB17B726CC75EB77F"><enum>(2)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H3EA77EAAD85444D2915503CFA9B3A125"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H1C0E477E1D084F97943FAA3F87182F68" style="USC"><subparagraph id="H0E3016AAB2C443A5B74BD6DC3B3F0053" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">to medication that is or is part of a preventive health service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HEFD3442AA5544AEBABEECF9B37D4223D"><enum>(b)</enum><header>Elimination of hospital care and medical services copayments</header><text>Section 1710 of such title is amended—</text><paragraph id="H29D4FD0379A5462F859F1B0AAD3A63E2"><enum>(1)</enum><text>in subsection (f)—</text><subparagraph id="H544C7DE17B3842129088807598FDBD04"><enum>(A)</enum><text>by redesignating paragraph (5) as paragraph (6); and</text></subparagraph><subparagraph id="H349B3DC0C6184CD5A6058310012D1541"><enum>(B)</enum><text>by inserting after paragraph (4) the following new paragraph (5):</text><quoted-block id="H6FD4A565A4B645FFBDE30CEAAD12B4B4" style="OLC"><paragraph id="H89AB8FEA5600470FA06791586EAD458C" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">A veteran shall not be liable to the United States under this subsection for any amounts for preventive health services.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD2C2F76ED5EF495DA780116ADF90C0DF"><enum>(2)</enum><text>in subsection (g)(3), by adding at the end the following new subparagraph:</text><quoted-block id="H72CBBD1A163B446EB23575FD2A1F4DF3" style="OLC"><subparagraph id="H8A8178449B0240318053BFB450AA776E" indent="up1"><enum>(C)</enum><text>Preventive health services.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9A1A81BF78974D7196136CF203D55C8B"><enum>(c)</enum><header>Definition</header><text>Section 1701(9) of such title is amended—</text><paragraph id="H4D882E28E1204FB9A7393A79A3AD0906"><enum>(1)</enum><text>in subparagraph (K), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="H213E939BC0AB48C5B06C2DCDBBACC1AE"><enum>(2)</enum><text>by redesignating subparagraph (L) as subparagraph (O); and</text></paragraph><paragraph id="HF63DC4F245664C4D85E6B30C267FC6E6"><enum>(3)</enum><text>by inserting after subparagraph (K) the following new subparagraphs:</text><quoted-block display-inline="no-display-inline" id="HCAD7491B2D254E52BCC77F2C249DFBC5" style="USC"><subparagraph display-inline="no-display-inline" id="H5227FA81B918497CA022042B6DABD13C" indent="up1"><enum>(L)</enum><text display-inline="yes-display-inline">evidence-based items or services that have in effect a rating of <quote>A</quote> or <quote>B</quote> in the current recommendations of the United States Preventive Services Task Force;</text></subparagraph><subparagraph id="H22101E804CE94B41B8EBF6F0D143C8DF" indent="up1"><enum>(M)</enum><text display-inline="yes-display-inline">immunizations that have in effect a recommendation from the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention with respect to the individual involved;</text></subparagraph><subparagraph id="H1ACED46D6626461ABC82A3B8E77E95D8" indent="up1"><enum>(N)</enum><text display-inline="yes-display-inline">with respect to services for women, the preventive care and screenings provided for in the Health Resources and Services Administration Preventive Services Guidelines in effect as of January 1, 2017; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
