<section id="HFA9966F36CB54BAB9214842CD9D48505"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline"> This title may be cited as the <quote><short-title>North America Butterfly Conservation Fund Act of 2021</short-title></quote>.</text></section> <section id="H40CED58258444D13A126BB03135AE2A3"><enum>102.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this title are—</text>
<paragraph id="H84D83F7DD84946E78C39DC4E065EA072"><enum>(1)</enum><text>to perpetuate healthy populations of butterflies in North America;</text></paragraph> <paragraph id="H37144B7B1FBB4998A6132CF341F01EDF"><enum>(2)</enum><text>to assist in the conservation of threatened and endangered butterflies by supporting conservation initiatives in North America; and</text></paragraph>
<paragraph id="H185A82D3CB76486FBB7F7D90ED4D8F1C"><enum>(3)</enum><text>to provide financial resources and to foster international cooperation for those initiatives.</text></paragraph></section> <section id="HF7B9E6AB68C04584B41DCFA6245A9421"><enum>103.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="H1C7D9E777A5E4497B4CCC97E7C3281D3"><enum>(1)</enum><header>Conservation</header><text>The term <quote>conservation</quote> means the use of all methods and procedures necessary to protect habitats of butterflies in North America and of butterflies in those habitats, including—</text> <subparagraph id="H646EA4A81DBE4E0EAFB4F0E7C84813EE"><enum>(A)</enum><text>protection, restoration, and management of habitats;</text></subparagraph>
<subparagraph id="HF53ADA86D9734397B5C0253A1B207986"><enum>(B)</enum><text>onsite research and monitoring of populations, habitats, annual reproduction, and butterfly species population trends;</text></subparagraph> <subparagraph id="H2E9D9216EC9C4D27908558BB8205CFB1"><enum>(C)</enum><text>assistance in the development, implementation, and improvement of national and regional management plans;</text></subparagraph>
<subparagraph id="H6E8FBB3553104C3C9816A58A6F471C8D"><enum>(D)</enum><text>enforcement and implementation of applicable conservation laws; and</text></subparagraph> <subparagraph id="HBDBD20568ED24A5B8FDBD7CDABCC9A01"><enum>(E)</enum><text>community outreach and education.</text></subparagraph></paragraph>
<paragraph id="HDDD2A8C76F9947F18D6854C905D689D0"><enum>(2)</enum><header>Fund</header><text>The term <quote>Fund</quote> means the North America Butterfly Conservation Fund established by section 105.</text></paragraph> <paragraph id="H38E5F5872051478BA621E58CC795DB80"><enum>(3)</enum><header>Butterfly</header><text>The terms <quote>butterfly</quote> and <quote>butterflies</quote> mean any member of the order Lepidoptera.</text></paragraph>
<paragraph id="HF86FB9EB9694400EB779EC40E26B0DBD"><enum>(4)</enum><header>North america</header><text>The term <quote>North America</quote> means the United States, Canada, Mexico, Antigua and Barbuda, Bahamas, Barbados, Belize, Costa Rica, Cuba, Dominica, Dominican Republic, El Salvador, Grenada, Guatemala, Haiti, Honduras, Jamaica, Nicaragua, Panama, Saint Kitts and Nevis, Saint Lucia, Saint Vincent and the Grenadines, and Trinidad and Tobago.</text></paragraph> <paragraph id="HCFA5D1EE3BAC4010B2C96131AA2CB632"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph></section>
<section id="HB2BAC8C9B810462C9A1083A5619E24BF"><enum>104.</enum><header>North America butterfly conservation assistance</header>
<subsection id="H0FA69BCF62D6421C9724381319D69F06"><enum>(a)</enum><header>Assistance</header>
<paragraph id="H3B1902325DAB4423B8F03F77CDC2FFEF"><enum>(1)</enum><header>In general</header><text>Subject to the availability of funds and in consultation with other Federal officials, the Secretary shall use amounts in the Fund to provide financial assistance for projects for the conservation of butterflies for which project proposals are approved by the Secretary in accordance with this section.</text></paragraph> <paragraph id="H9EA947135A4E4C9A8212DA4ACEA38348"><enum>(2)</enum><header>Use of existing authorities</header><text>Assistance provided under this section shall be carried out in a manner consistent with authorities available to the Secretary under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph></subsection>
<subsection id="H17CF496A20B74CED943DD0D50A92B6BC"><enum>(b)</enum><header>Project proposals</header>
<paragraph id="HA3B334FB3DF941419D0537D4BDAC94B9"><enum>(1)</enum><header>Eligible applicants</header><text>A proposal for a project for the conservation of butterflies may be submitted to the Secretary by—</text> <subparagraph id="HA0A0CDE5177E46558CA0D6C013F41703"><enum>(A)</enum><text>a relevant State or Tribal agency, research institution, nonprofit organization, or wildlife management authority in North America that—</text>
<clause id="H9A0C25B9220B4B1DA40420A6301EA80B"><enum>(i)</enum><text>has within its boundaries butterfly habitat; and</text></clause> <clause id="H54D62CE981054693873CD90B6300D071"><enum>(ii)</enum><text>directly or indirectly affects butterfly conservation; or</text></clause></subparagraph>
<subparagraph id="H7E193978162B49E3B2E92444774720D2"><enum>(B)</enum><text>any other individual or entity, as determined appropriate by the Secretary, with the demonstrated expertise required for the conservation of butterflies in North America.</text></subparagraph></paragraph> <paragraph id="HF0AA3ECBE68D4A53A5E68DA66E050516"><enum>(2)</enum><header>Federal partnership opportunities</header><text>A Federal agency may not be a lead entity or receive funding for a project under this section, but may be included as a partner or collaborator on a project that receives such funding.</text></paragraph>
<paragraph id="HB90056EB10CD428FBFCA8D52FFEC6B1D"><enum>(3)</enum><header>Required elements</header><text>A project proposal shall include—</text> <subparagraph id="HF0BF849354CD413780B44508CF99659E"><enum>(A)</enum><text>a statement of the purposes of the project;</text></subparagraph>
<subparagraph id="HB9D55ED90E4D4948B719724B2496B98D"><enum>(B)</enum><text>the name of the entity or individual with overall responsibility for the project;</text></subparagraph> <subparagraph id="HDC802CE43FE2440E8434994C53BAB1E7"><enum>(C)</enum><text>a description of—</text>
<clause id="H0648F76C75FF48C28EF1DE95AB190A4F"><enum>(i)</enum><text>the qualifications of the entity or individuals that will conduct the project;</text></clause> <clause id="H5E7543BA28934110A24CBE2478A06E20"><enum>(ii)</enum><text>methods for project implementation and outcome assessment;</text></clause>
<clause id="H285EBB18218B45759748CC55E9D03C88"><enum>(iii)</enum><text>staffing and stakeholder engagement for the project;</text></clause> <clause id="HF8D63E6375B34AEB87C645C109F0E781"><enum>(iv)</enum><text>the logistics of the project, including cost estimates and timelines;</text></clause>
<clause id="HD8FFC30AF5C64D66B86B810B19CFE561"><enum>(v)</enum><text>anticipated outcomes; and</text></clause> <clause id="H3B52696784EC4E53AD944187531FB7BE"><enum>(vi)</enum><text>mechanisms to encourage adequate local public participation in project development and implementation;</text></clause></subparagraph>
<subparagraph id="HB1C857D7727A4EE997DCAA1FEBAD03C2"><enum>(D)</enum><text>assurances that the project will be implemented in consultation with relevant wildlife management authorities, Tribes, and other appropriate government officials;</text></subparagraph> <subparagraph id="H1FF07B7D46234C29A6250AFFAC9A1692"><enum>(E)</enum><text>evidence of free, informed, and prior consent by indigenous communities in the areas the project will be conducted, if the Secretary determines that such consent is required for the success of the project; </text></subparagraph>
<subparagraph id="HD7713DF82C3F4895A2EB1035AE53D784"><enum>(F)</enum><text>demonstrated sensitivity to local historic and cultural resources and compliance with applicable laws;</text></subparagraph> <subparagraph id="H95B2BE2418B74844A4B9BAD2BCE6DC3E"><enum>(G)</enum><text>information that demonstrates the potential of the project to contribute to the conservation of butterfly populations in North America;</text></subparagraph>
<subparagraph id="HF26B73FF684B4145B2C3A743DDA96BCE"><enum>(H)</enum><text>evidence of support for the project by appropriate governmental entities of the countries, Tribes, and indigenous communities in which the project will be conducted, if the Secretary determines that such support is required for the success of the project;</text></subparagraph> <subparagraph id="H6CCA8AD018424551BBBF41037305FEE5"><enum>(I)</enum><text>information regarding the source and amount of matching funding available for the project; and</text></subparagraph>
<subparagraph id="H254A806B907B4B99A42F853F91D54E09"><enum>(J)</enum><text>such other information as the Secretary may require.</text></subparagraph></paragraph></subsection> <subsection id="H15BC532B43C44DE48B1D043A7DBDDD63"><enum>(c)</enum><header>Project review and approval</header> <paragraph id="HCD929C40153440B2A2AA8392293C63AA"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text>
<subparagraph id="H0581A989EC444863B734E9B846D70499"><enum>(A)</enum><text>not later than 30 days after receiving a project proposal, provide a copy of the proposal to other Federal officials, as appropriate; and</text></subparagraph> <subparagraph id="H28623282659A4AF083A6FAD631FD6A99"><enum>(B)</enum><text>review each project proposal in a timely manner to determine whether the proposal meets the criteria specified in subsection (d).</text></subparagraph></paragraph>
<paragraph id="H2F2EF69321BD4F73BBBE0C2E29681C3E"><enum>(2)</enum><header>Consultation; approval or disapproval</header><text>Not later than 180 days after receiving a project proposal, and subject to the availability of funds, the Secretary, after consulting with other Federal officials, as appropriate, shall—</text> <subparagraph id="HBCA312FFFD544E00B312232BC159B7F0"><enum>(A)</enum><text>consult on the proposal with the government of each country in which the project is to be conducted;</text></subparagraph>
<subparagraph id="HB712FBE96B8D46318EBF61AAD8F5FE38"><enum>(B)</enum><text>after taking into consideration any comments resulting from the consultation, approve or disapprove the project proposal; and</text></subparagraph> <subparagraph id="HFCE36ACCAED8497D862CC3810195F12C"><enum>(C)</enum><text>provide written notification of the approval or disapproval to the person that submitted the project proposal, such other Federal officials, and each country described in subparagraph (A).</text></subparagraph></paragraph></subsection>
<subsection id="HF9783EDB6C1240A6B97281B48AE7CBB6"><enum>(d)</enum><header>Criteria for approval</header>
<paragraph id="HF134236BEBC7499EBB12E9DE9701608A"><enum>(1)</enum><header>In general</header><text>The Secretary may approve a project proposal under this section if the project will help recover and sustain viable populations of butterflies in the wild by assisting efforts in North America to implement butterfly conservation programs.</text></paragraph> <paragraph id="H61DC9C9AB19B4D7A807A982DCB1DF93B"><enum>(2)</enum><header>Priority</header><text>In selecting projects for assistance, the Secretary shall give preference to projects that conserve threatened and endangered species protected by the Endangered Species Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph>
<paragraph id="HD69F589388C24A9D888D567A369D7DF2"><enum>(3)</enum><header>Project sustainability</header><text>To the maximum extent practicable, in determining whether to approve project proposals under this section, the Secretary shall give preference to conservation projects that are designed to ensure effective, long-term conservation of butterflies and their habitats.</text></paragraph> <paragraph id="H2F0D7A495A764E83B49EA3BB5FC0C59F"><enum>(4)</enum><header>Matching funds</header><text>In determining whether to approve project proposals under this section, the Secretary shall give preference to projects for which matching funds are available.</text></paragraph>
<paragraph id="HAC871141D4DF4D2CABF04805FFC7816D"><enum>(5)</enum><header>Waiver</header><text>The Secretary may waive the application of paragraphs (2), (3), and (4) if the Secretary finds that such waiver is necessary to support a conservation project that the Secretary has identified as of high priority.</text></paragraph></subsection> <subsection id="H832ABCFEF6D64D23A8415CB3EAA0AC55"><enum>(e)</enum><header>Project reporting</header> <paragraph id="HC7A815D89A044A6FB3E9F654603E5009"><enum>(1)</enum><header>In general</header><text>Each person that receives assistance under this section for a project shall submit to the Secretary periodic reports (at such intervals as the Secretary may require) that include all information that the Secretary, after consultation with other government officials, determines is necessary to evaluate the progress and success of such project for the purposes of ensuring positive results, assessing problems, and fostering improvements.</text></paragraph>
<paragraph id="H0DFD63B8675F46529CB10F7549845F84"><enum>(2)</enum><header>Availability to the public</header><text>Reports under paragraph (1), and any other documents relating to projects for which financial assistance is provided under this title, shall be made available to the public.</text></paragraph></subsection></section> <section id="H78780B7960E94B829C3EE7F8A8788789"><enum>105.</enum><header>North America Butterfly Conservation Fund</header> <subsection id="HED427C9970404D7A9BD1AEADE5895531"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury a separate account, to be known as the <quote>North America Butterfly Conservation Fund</quote>, consisting of—</text>
<paragraph id="HAF43521B0F274AAE8C128C32A2DEF4C6"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into the Fund under subsection (e);</text></paragraph> <paragraph id="H1D46849C57DD4DEBB306F0E462AA6522"><enum>(2)</enum><text>amounts appropriated to the Fund under section 106; and</text></paragraph>
<paragraph id="H8B2796E555384423B5ABF9AAC18BCE92"><enum>(3)</enum><text>any interest earned on investment of amounts in the Fund under subsection (c).</text></paragraph></subsection> <subsection id="HB5F9EABFB1FD4FC4905C9878C1E442D5"><enum>(b)</enum><header>Expenditures from fund</header> <paragraph id="H4C0EA4C7CB61446383E29C6C6F6E25AB"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), at the request of the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to carry out section 104.</text></paragraph>
<paragraph id="H0C5D691F405E49DD998D32F96356EDE5"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amounts in the account available for each fiscal year, the Secretary may expend not more than 3 percent, or up to $80,000, whichever is greater, to pay the administrative expenses necessary to carry out this title.</text></paragraph></subsection> <subsection id="H3EB05647A4D04B7DAA88561926F7C28E"><enum>(c)</enum><header>Investment of amounts</header> <paragraph id="HDE3A7777DD4E45BA9AB4C07DAD010EF4"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall invest such portion of the Fund as is not, in the judgment of the Secretary of the Treasury, required to meet current withdrawals. Investments may be made only in interest-bearing obligations of the United States.</text></paragraph>
<paragraph id="H2120DBF4B1AA4E95BB38691C2F24789D"><enum>(2)</enum><header>Acquisition of obligations</header><text>For the purpose of investments under paragraph (1), obligations may be acquired—</text> <subparagraph id="HDEA0AD876B1E433C8B07C43476D9019D"><enum>(A)</enum><text>on original issue at the issue price; or</text></subparagraph>
<subparagraph id="HD307F05DBCE4441F943DE33327603F40"><enum>(B)</enum><text>by purchase of outstanding obligations at market price.</text></subparagraph></paragraph> <paragraph id="H648606E0F2BF44E48236D167E0A1F9F6"><enum>(3)</enum><header>Sale of obligations</header><text>Any obligation acquired by the Fund may be sold by the Secretary of the Treasury at market price.</text></paragraph>
<paragraph id="HE7C78880E1F54068800B6CB016858C0D"><enum>(4)</enum><header>Credits to fund</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund.</text></paragraph></subsection> <subsection id="H34174F0669C54763BE46568C8EC5BB07"><enum>(d)</enum><header>Transfers of amounts</header> <paragraph id="HAA063BAFDC9549B09635D4664FC7D3D3"><enum>(1)</enum><header>In general</header><text>The amounts required to be transferred to the Fund under this section shall be transferred at least monthly from the general fund of the Treasury to the Fund on the basis of estimates made by the Secretary of the Treasury.</text></paragraph>
<paragraph id="HEA94A931E9214379A96AADEF608F4D58"><enum>(2)</enum><header>Adjustments</header><text>Proper adjustment shall be made in amounts subsequently transferred to the extent prior estimates were in excess of or less than the amounts required to be transferred.</text></paragraph></subsection> <subsection id="H39812020E42F47D893351A28C5725A15"><enum>(e)</enum><header>Acceptance and use of donations</header> <paragraph id="H56511D3AC1844E1B956E60AF1A9E3D5A"><enum>(1)</enum><header>In general</header><text>The Secretary may accept for the Government a gift of any of the following to provide assistance under section 104:</text>
<subparagraph id="H2D124A38729E40B1999E4EC5C00FB426"><enum>(A)</enum><text>money;</text></subparagraph> <subparagraph id="H6474321699CB4FC7BCF16503C3556BF4"><enum>(B)</enum><text>an obligation of the Government included in the public debt made only on the condition that the obligation be canceled and retired and not reissued; and</text></subparagraph>
<subparagraph id="H682E160F1B524454AC6E27C0FFCFEA7E"><enum>(C)</enum><text>other intangible personal property made only on the condition that the property is sold on the best terms available and the proceeds are deposited in the Fund.</text></subparagraph></paragraph> <paragraph id="HD88DA342805E45A9AF7BE65C2ED8FA27"><enum>(2)</enum><header>Discretion to reject a gift</header><text>The Secretary may reject a gift under this section when the rejection is in the interest of the Government.</text></paragraph>
<paragraph id="HECF728F819884F24A131A2059804388E"><enum>(3)</enum><header>Taxes</header><text>If a gift received under this subsection is subject to a gift or inheritance tax, the Secretary may pay the tax out of the proceeds of the gift or the proceeds of the redemption or sale of the gift.</text></paragraph></subsection></section> <section id="HCA8AB5EABA104F9BAFC233E14E406B6F"><enum>106.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Secretary $5,000,000 for each of fiscal years 2022 through 2027 to carry out this title.</text></section>
<section id="HD6721B2435F04598994BC2A396F13245"><enum>107.</enum><header>Report to congress</header><text display-inline="no-display-inline">The Secretary shall submit an annual report to Congress not later than January 31 of each year regarding the Fund and the status of butterflies in North America. Each such report shall include with respect to the year for which such report is submitted a description of—</text> <paragraph id="HE480EDE0A26B4E6E802BF531644F12C2"><enum>(1)</enum><text>the total amounts deposited into and expended from the Fund;</text></paragraph>
<paragraph id="H4BE85A2B209B4C6595FD0CD0E44CE2B4"><enum>(2)</enum><text>the costs associated with the administration of the Fund;</text></paragraph> <paragraph id="HD4B2741A3DBC4BF7845EF6F1E1820F64"><enum>(3)</enum><text>a summary of the projects for which the Secretary has provided assistance under section 104 and an evaluation of those projects; and</text></paragraph>
<paragraph id="H6F532503E1004FD6AEC05B6003A3CD43"><enum>(4)</enum><text>an evaluation of the status of threatened and endangered butterfly populations in North America.</text></paragraph></section></title> <title id="H3C840349FA66456DB0199D0923773E79"><enum>II</enum><header>Pacific Islands Plant Conservation Fund Act of 2021</header> <section id="H1BB2EE87EF234D3D94D1654DE8EE55A4"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Pacific Islands Plant Conservation Fund Act of 2021</short-title></quote>.</text></section>
<section id="H14C51E8F2B8C4B9DB209F7E391B0F044"><enum>202.</enum><header>Purposes</header><text display-inline="no-display-inline">The purpose of this title is to assist in the conservation of threatened and endangered plant species in the Hawaiian Islands and the Pacific Island Territories of the United States by supporting and providing financial resources for projects to conserve plant species, their ecosystems, and address other threats to the survival of those plant species.</text></section> <section id="H48B3D1D4641B4F2DA8A36F69BE2C958B"><enum>203.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="H7F82586602D94916B3DFB79903AD201F"><enum>(1)</enum><header>Conservation</header><text>The term <quote>conservation</quote> means the use of all methods and procedures necessary to protect plants in the Pacific Islands including—</text> <subparagraph id="H8F847C3ED8C347C69408EDC6BD9DE159"><enum>(A)</enum><text>protection, restoration, and management of ecosystems;</text></subparagraph>
<subparagraph id="HBFB2590059D8478E8EEC4D748DE14A98"><enum>(B)</enum><text>onsite research and monitoring of populations, ecosystems, annual reproduction, and plant population trends;</text></subparagraph> <subparagraph id="H8D23FDDD10F54447B695F78614F17449"><enum>(C)</enum><text>assistance in the development, implementation, and improvement of management plans;</text></subparagraph>
<subparagraph id="H6D1FE87042E9467D8A13E26FB5BD7E19"><enum>(D)</enum><text>enforcement and implementation of applicable conservation laws; and</text></subparagraph> <subparagraph id="H06E37CD76020443289B012ED1B221210"><enum>(E)</enum><text>community outreach and education.</text></subparagraph></paragraph>
<paragraph id="H64A73FF1D25A40D3B2661ABA67AA4E21"><enum>(2)</enum><header>Fund</header><text>The term <quote>Fund</quote> means the Pacific Islands Plant Conservation Fund established by section 205.</text></paragraph> <paragraph id="H3CAC1206062A458FB39EF3C4BBD8752D"><enum>(3)</enum><header>Pacific islands</header><text>The term <quote>Pacific Islands</quote> means the Hawaiian islands and the United States territories of Guam, American Samoa, and the Northern Mariana Islands.</text></paragraph>
<paragraph id="HB8E3A9712FD541C19DB92AA56A9E1A65"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph></section> <section id="HE82FD73A3077407F8BE10D01D38BA071"><enum>204.</enum><header>Pacific islands plant conservation assistance</header> <subsection id="H80E3136D1C2F4DBA8E5EDD03064A530A"><enum>(a)</enum><header>Assistance</header> <paragraph id="HB578871C151B45F08A3367BA8EE7F01B"><enum>(1)</enum><header>In general</header><text>Subject to the availability of funds and in consultation with other Federal officials, the Secretary of Interior shall provide competitive financial assistance, including multiyear grants, for projects for the conservation of plant species on the Pacific Islands for which project proposals are approved by the Secretary in accordance with this section.</text></paragraph>
<paragraph id="H40366E5F576547F480F566407875FA32"><enum>(2)</enum><header>Use of existing authorities</header><text>Assistance provided under this section shall be carried out in a manner consistent with authorities available to the Secretary under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph></subsection> <subsection id="HA9DA73BBC7EC4B1EB10FC86A1A931CE0"><enum>(b)</enum><header>Project proposals</header> <paragraph id="H98A0B18E75D045C183C2B6EE5E06F5F6"><enum>(1)</enum><header>Eligible applicants</header><text>A project proposal may be submitted to the Secretary under this section by—</text>
<subparagraph id="H2B454A91AEC44DA9B9828A8ECFC384D6"><enum>(A)</enum><text>a relevant State, territory, or Tribal agency with the research expertise required for the conservation of plant species on the Pacific Islands; and</text></subparagraph> <subparagraph id="HBCE3E0885174409BAEB29D32AA7BC8DD"><enum>(B)</enum><text>any other individual or entity, as determined appropriate by the Secretary, with the expertise required for the conservation of plant species on the Pacific Islands.</text></subparagraph></paragraph>
<paragraph id="HE0855D06C7BE4D33BA0C54BE82477C06"><enum>(2)</enum><header>Federal partnership opportunities</header><text>A Federal agency may not be a lead entity or receive funding for a project under this section, but may be included as a partner or collaborator on a project that receives such funding.</text></paragraph> <paragraph id="HC9E0AD47A6EE48C88627EF28266C767E"><enum>(3)</enum><header>Required elements</header><text>A project proposal shall include—</text>
<subparagraph id="H59E637ED93E7407281D4E91D8FF10832"><enum>(A)</enum><text>a statement of the purposes of the project;</text></subparagraph> <subparagraph id="H6892D4D994814C67B90D1C5F2083143A"><enum>(B)</enum><text>the name of the entity or individual with overall responsibility for the project;</text></subparagraph>
<subparagraph id="HA34A6189BBCC472D96D5B660D95CFA60"><enum>(C)</enum><text>a description of—</text> <clause id="H499E839C01A845A19600C12C63694903"><enum>(i)</enum><text>the qualifications of the entity or individuals that will conduct the project;</text></clause>
<clause id="H0246CCC9C91B4B5FA416592B7A875319"><enum>(ii)</enum><text>methods for project implementation and outcome assessment;</text></clause> <clause id="H09FA9BF05281476CB9894ACB8507B66F"><enum>(iii)</enum><text>staffing and stakeholder engagement for the project;</text></clause>
<clause id="H3FF7EDE11F7643E695E02EDDD5D81462"><enum>(iv)</enum><text>the logistics of the project, including cost estimates and timelines;</text></clause> <clause id="H9A5BBF86C68145D8A8277CF44DEAC97E"><enum>(v)</enum><text>anticipated outcomes;</text></clause>
<clause id="H2CEB334DA0FA422EA71F8BEE1F2DA8EA"><enum>(vi)</enum><text>mechanisms to ensure adequate local public participation in project development and implementation; and</text></clause> <clause id="H8123B9BA81724BB8A75A0BFBEB6B784A"><enum>(vii)</enum><text>how the project will promote sustainable, effective, long-term programs to conserve plant populations on the Pacific Islands;</text></clause></subparagraph>
<subparagraph id="H8FFF07276EAD4E7FB213D9EC5C29F401"><enum>(D)</enum><text>demonstrated sensitivity to local historic and cultural resources and compliance with applicable laws;</text></subparagraph> <subparagraph id="HA60A8DEFD7E7413A823B39FB1EC40238"><enum>(E)</enum><text>assurances that the project will be implemented in consultation with relevant wildlife management authorities, Tribes, and other appropriate government officials;</text></subparagraph>
<subparagraph id="HA64DDCA4318845BEA75970B6EC4E44E8"><enum>(F)</enum><text>information that demonstrates the clear potential of the project to contribute to the conservation of threatened and endangered plant species on the Pacific Islands;</text></subparagraph> <subparagraph id="H0C40398C4E514375AA9DA2C023D455BF"><enum>(G)</enum><text>information regarding the source and amount of matching funding available for the project; and</text></subparagraph>
<subparagraph id="H562AAB50BDF6403098BB531999FEF4BD"><enum>(H)</enum><text>such other information as the Secretary may require.</text></subparagraph></paragraph></subsection> <subsection id="HB6483AEC87FB41EA9E0D687F7417E931"><enum>(c)</enum><header>Project review and approval</header> <paragraph id="H63B0CB76133845A2A2CD055D8FDC522B"><enum>(1)</enum><header>In general</header><text>The Secretary shall annually—</text>
<subparagraph id="HA9F0352B8CB64BA5A119022DCD9373F7"><enum>(A)</enum><text>not later than 30 days after receiving a project proposal, provide a copy of the proposal to other Federal officials, as appropriate; and</text></subparagraph> <subparagraph id="H81E17BD62AE74A9384F9487886526118"><enum>(B)</enum><text>review each project proposal in a timely manner to determine whether the proposal meets the criteria specified in subsection (d).</text></subparagraph></paragraph>
<paragraph id="H096BB5050E9C4EC384C9411AC5ABE01D"><enum>(2)</enum><header>Consultation; approval or disapproval</header><text>Subject to the availability of funds, the Secretary shall, with respect to each project proposal submitted under this section, and after consulting with other Federal officials, as appropriate—</text> <subparagraph id="H188D6D9B0BD544EFACDF3FA568C61887"><enum>(A)</enum><text>consult with respect to the proposal with the government of the State or territory in which such project is to be conducted; and</text></subparagraph>
<subparagraph id="H7D08F7E34BF54CABA5D0F4AD1FEEAD54"><enum>(B)</enum><text>provide written notification of the approval or disapproval to the individual or entity that submitted the proposal, such other Federal officials, and each State described in subparagraph (A).</text></subparagraph></paragraph></subsection> <subsection id="HA846637AE2D44622B57E9EF87FAFB404"><enum>(d)</enum><header>Criteria for approval</header> <paragraph id="H2BF0B2F2D45E44F3ADF9592539AD2F3A"><enum>(1)</enum><header>In general</header><text>The Secretary may approve a project proposal under this section if the project will help recover and sustain viable populations of threatened and endangered plants by assisting efforts on the Pacific Islands to implement plant conservation programs.</text></paragraph>
<paragraph id="H802F0899E8AE4BD695B77BA8E56286B8"><enum>(2)</enum><header>Priority</header><text>In selecting projects for assistance, the Secretary shall give preference to projects that conserve threatened and endangered species protected by the Endangered Species Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph> <paragraph id="H3D287746A15845699C26E46E29689A90"><enum>(3)</enum><header>Project sustainability</header><text>To the maximum extent practicable, in determining whether to approve project proposals under this section, the Secretary shall give preference to conservation projects that are designed to ensure effective, long-term conservation of plants and their ecosystems.</text></paragraph>
<paragraph id="H1C2F6F2016DF4BDA8CAB9357D425B327"><enum>(4)</enum><header>Matching funds</header><text>In determining whether to approve project proposals under this section, the Secretary shall give preference to projects for which matching funds are available.</text></paragraph> <paragraph id="H2D23162F4D7643CF954E3C67516A7CCF"><enum>(5)</enum><header>Waiver</header><text>The Secretary may waive the application of paragraphs (2), (3), and (4) if the Secretary finds that such waiver is necessary to support a conservation project that the Secretary has identified as of high priority.</text></paragraph></subsection>
<subsection id="HC4D7E4356D58463B8E4422DD7D98268E"><enum>(e)</enum><header>Project reporting</header>
<paragraph id="HB5B0996F5C884694B5F081D5BEAFCFDE"><enum>(1)</enum><header>In general</header><text>Each individual or entity that receives assistance under this section for a project shall submit to the Secretary periodic reports (at such intervals as the Secretary may require) that include all information that the Secretary, after consultation with other government officials, determines is necessary to evaluate the progress and success of such project for the purposes of ensuring positive results, assessing problems, and fostering improvements.</text></paragraph> <paragraph id="H275F6609D8E84FE885106D65DDC82D17"><enum>(2)</enum><header>Availability to the public</header><text>Reports under paragraph (1), and any other documents relating to projects for which financial assistance is provided under this title, shall be made available to the public in a timely manner.</text></paragraph></subsection></section>
<section id="HD907FFA545DA4B8594800E82F4F9A475"><enum>205.</enum><header>Pacific islands plant conservation fund</header>
<subsection id="H52007D55506A4300A90F13A67A458C96"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury a separate account, to be known as the <quote>Pacific Islands Plant Conservation Fund</quote>, consisting of—</text> <paragraph id="H45818C01D1264D86A6BF3D9FC5D967C0"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into the Fund under subsection (e);</text></paragraph>
<paragraph id="H1B40FFC3E4FB4901888430379EAE8E22"><enum>(2)</enum><text>amounts appropriated to the Fund under section 206; and</text></paragraph> <paragraph id="H72266EEA40384AA88048E16AE292EDCC"><enum>(3)</enum><text>any interest earned on investment of amounts in the Fund under subsection (c).</text></paragraph></subsection>
<subsection id="H49D94F916FCC4A929826349B62869DF3"><enum>(b)</enum><header>Expenditures from fund</header>
<paragraph id="H567EE35956044496A0ED06FD03E47AB5"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), at the request of the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to carry out section 204.</text></paragraph> <paragraph id="H4E8848C3633044119E0FC7C766D0F29A"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amounts in the account available for each fiscal year, the Secretary may expend not more than 3 percent, or up to $80,000, whichever is greater, to pay the administrative expenses necessary to carry out this title.</text></paragraph></subsection>
<subsection id="H4880BC602EFD4760B0EA1167C6348A6C"><enum>(c)</enum><header>Investment of amounts</header>
<paragraph id="H3F87C84D3C954419A3B6047E7B444C6E"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall invest such portion of the Fund as is not, in the judgment of the Secretary of the Treasury, required to meet current withdrawals. Investments may be made only in interest-bearing obligations of the United States.</text></paragraph> <paragraph id="HB8676A1613BD4FFB9F6E08B5E92597A0"><enum>(2)</enum><header>Acquisition of obligations</header><text>For the purpose of investments under paragraph (1), obligations may be acquired—</text>
<subparagraph id="HA5DE4B01D6A0477A8B8534F9BFEF0DD7"><enum>(A)</enum><text>on original issue at the issue price; or</text></subparagraph> <subparagraph id="H95EDA61E4E5040479A39B4FD91422F23"><enum>(B)</enum><text>by purchase of outstanding obligations at market price.</text></subparagraph></paragraph>

<section id="HA12720AB07F34F6F8F05CD8592E3FA4E"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Freshwater Mussel Conservation Fund Act of 2021</short-title></quote>.</text></section> <section id="H91F4DCC9AC1D4EC6AAA1F9DB3E575CD7"><enum>302.</enum><header>Purposes</header><text display-inline="no-display-inline">The purpose of this title is to assist in the conservation of threatened and endangered freshwater mussels species and their habitats in the United States by supporting and providing financial resources for projects to conserve freshwater mussel species, their habitats, and address other threats to the survival of those species.</text></section>
<section id="H6A95DB89F5C548158FFECEA84451412E"><enum>303.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="HF1640C40F07B43D1A7B508B3152284CC"><enum>(1)</enum><header>Conservation</header><text>The term <quote>conservation</quote> means the use of all methods and procedures necessary to protect habitats of freshwater mussel species in the United States and of the freshwater mussel species in those habitats including—</text>

<subparagraph id="HD4F0F4F1191E4B4FB101E3A978F6B2C3"><enum>(C)</enum><text>assistance in the development, implementation, and improvement of national and regional management plans;</text></subparagraph> <subparagraph id="H2756F0F115F3488994FA3C161725775E"><enum>(D)</enum><text>enforcement and implementation of applicable conservation laws; and</text></subparagraph>
<subparagraph id="H5CD71C4D13D443BAA60EC2DEB86CBD07"><enum>(E)</enum><text>community outreach and education.</text></subparagraph></paragraph> <paragraph id="HE8A070669D4D4D289E16FBD24CAE0A8A"><enum>(2)</enum><header>Fund</header><text>The term <quote>Fund</quote> means the Freshwater Mussel Conservation Fund established by section 305.</text></paragraph>
<paragraph id="H920F93CE5F314496A19E926067CC5048"><enum>(3)</enum><header>Freshwater mussels</header><text>The terms <quote>freshwater mussel</quote> and <quote>freshwater mussels</quote> mean any member of the order Unioinida.</text></paragraph> <paragraph id="H1E9A9CCB9D724B02ADE694F440F41797"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph></section>
<section id="H60A1210B4D9D4FCCB1D96035DE613F69"><enum>304.</enum><header>Freshwater mussel conservation assistance</header>
<subsection id="H633D88BB94AB4E24ABC1BE7BC9D7E9E1"><enum>(a)</enum><header>In general</header><text>Subject to the availability of funds and in consultation with other Federal officials, the Secretary of Interior shall provide competitive financial assistance, including multiyear grants, for projects for the conservation of freshwater mussels in the United States for which project proposals are approved by the Secretary in accordance with this section.</text></subsection> <subsection id="H2B0067EBDD09498AA24636937E846B2C"><enum>(b)</enum><header>Use of existing authorities</header><text>Assistance provided under this section shall be carried out in a manner consistent with authorities available to the Secretary under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></subsection>
<subsection id="HCBAF7B73B945443FA1CBE8361FE43B81"><enum>(c)</enum><header>Project proposals</header>
<paragraph id="H15E80E2F2785488EA367A00E5191352B"><enum>(1)</enum><header>Eligible applicants</header><text>A project proposal may be submitted to the Secretary under this section by—</text> <subparagraph id="H90A68A74B54D4B6F914C7D5F2E751912"><enum>(A)</enum><text>a relevant State and Tribal agency, research institution, or nonprofit organization with the expertise required for the conservation of freshwater mussels in the United States; and</text></subparagraph>
<subparagraph id="HCC63AB91157A4A63883282DD5FF1B0A4"><enum>(B)</enum><text>any other individual or entity, as determined appropriate by the Secretary, with the expertise required for the conservation of freshwater mussels in the United States.</text></subparagraph></paragraph> <paragraph id="HAD31BA9FD6F543F2AE0A2D0D0DC1C689"><enum>(2)</enum><header>Federal partnership opportunities</header><text>A Federal agency may not be a lead entity or receive funding for a project under this section, but may be included as a partner or collaborator on a project that receives such funding.</text></paragraph>
<paragraph id="HCCA55B08BD94499B9015A285DCDD5864"><enum>(3)</enum><header>Required elements</header><text>A project proposal shall include—</text> <subparagraph id="HEB28CEB066F14ADA80616B0EBEC68DED"><enum>(A)</enum><text>a statement of the purposes of the project;</text></subparagraph>
<subparagraph id="H4BEA74A5888847139BFEE726337A48B8"><enum>(B)</enum><text>the name of the entity or individual with overall responsibility for the project;</text></subparagraph> <subparagraph id="H03363CC9E3C3426A856B4E7692D04153"><enum>(C)</enum><text>a description of—</text>
<clause id="H27B4666BC47245599E7CB4D75FBC9A8B"><enum>(i)</enum><text>the qualifications of the entity or individuals that will conduct the project;</text></clause> <clause id="H974CC202FCA64CCABA1F6224B991EE43"><enum>(ii)</enum><text>methods for project implementation and outcome assessment;</text></clause>
<clause id="H826874DEF3F441BCA907C308461E9D9C"><enum>(iii)</enum><text>staffing and stakeholder engagement for the project;</text></clause> <clause id="H998CEE336D6A4CF49E2C8EFA75F8ABE8"><enum>(iv)</enum><text>the logistics of the project, including cost estimates and timelines;</text></clause>
<clause id="HE7A43F832E1F42AF975421304CE84CD5"><enum>(v)</enum><text>anticipated outcomes;</text></clause> <clause id="HFB258254D93249EB8E671BDE53A4C22E"><enum>(vi)</enum><text>mechanisms to ensure adequate local public participation in project development and implementation; and</text></clause>
<clause id="H2BB77C9714E643848AA481580796C71B"><enum>(vii)</enum><text>how the project will promote sustainable, effective, long-term programs to conserve plant populations on the Pacific Islands;</text></clause></subparagraph> <subparagraph id="HE72C484CBCB841829FB589D478B990C3"><enum>(D)</enum><text>demonstrated sensitivity to local historic and cultural resources and compliance with applicable laws;</text></subparagraph>
<subparagraph id="H2EDFE5778FE540559A511F388513F265"><enum>(E)</enum><text>assurances that the project will be implemented in consultation with relevant wildlife management authorities, Tribes, and other appropriate government officials;</text></subparagraph> <subparagraph id="H9CCFCC3D6B684FEBBA00BDB7F14155AB"><enum>(F)</enum><text>information that demonstrates the clear potential of the project to contribute to the conservation of freshwater mussels in the United States;</text></subparagraph>
<subparagraph id="H3D962E4355E941EA9E6A32F70D50D8A4"><enum>(G)</enum><text>information regarding the source and amount of matching funding available for the project; and</text></subparagraph> <subparagraph id="HFDFB6AB4DBA84EE1B554F26B6261AE21"><enum>(H)</enum><text>such other information as the Secretary may require.</text></subparagraph></paragraph></subsection>
<subsection id="H88C9911940DA4D989944B309324C4502"><enum>(d)</enum><header>Project review and approval</header>
<paragraph id="H0098A1E914BA43E7907632BBE3DFF729"><enum>(1)</enum><header>In general</header><text>The Secretary shall annually—</text> <subparagraph id="HBCC2E373467744FE9911DCB0B2EF74A4"><enum>(A)</enum><text>solicit project proposals for grants under this section;</text></subparagraph>
<subparagraph id="H2D0841DC06DD4FA3930538A8EBE66FE4"><enum>(B)</enum><text>provide to other Federal officials, as appropriate, copies of each proposal submitted in response to the solicitation; and</text></subparagraph> <subparagraph id="H54BEC294382E4BDA8512AE82DA1E95B3"><enum>(C)</enum><text>review each such proposal on a timeline that recognizes the urgency of the declining number of freshwater mussel species in the United States to determine whether the proposal meets the criteria specified in subsection (d).</text></subparagraph></paragraph>
<paragraph id="H1971DF9E490F423683E8BE109C75B3F9"><enum>(2)</enum><header>Consultation; approval or disapproval</header><text>Subject to the availability of funds, the Secretary shall, with respect to each project proposal submitted under this section, and after consulting with other Federal officials, as appropriate—</text> <subparagraph id="H9A840C92FE78408CA8DC53ADD432C304"><enum>(A)</enum><text>consult with respect to the proposal with the government of each State and foreign country in which the project is to be conducted; and</text></subparagraph>
<subparagraph id="H4B22435D02B040DB80A905E43DB8C166"><enum>(B)</enum><text>provide written notification of the approval or disapproval to the individual or entity that submitted the proposal, such other Federal officials, and each State and foreign country described in subparagraph (A).</text></subparagraph></paragraph></subsection> <subsection id="H831EA37EAFB64344B863771C432FB6EF"><enum>(e)</enum><header>Criteria for approval</header> <paragraph id="H81A321D7E36147A5931C0769CF1EC0AC"><enum>(1)</enum><header>In general</header><text>The Secretary may approve a project proposal under this section if the project shows promise for contributing to recovering and sustaining freshwater mussel populations in the United States in the wild.</text></paragraph>
<paragraph id="H220E4966A97C4C83A3A665E95409B7CA"><enum>(2)</enum><header>Priority</header><text>In selecting projects for assistance, the Secretary shall give preference to projects that conserve threatened and endangered species protected by the Endangered Species Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph> <paragraph id="H95025F7FDD22463CA5F9D347712B8A50"><enum>(3)</enum><header>Project sustainability</header><text>To the maximum extent practicable, in determining whether to approve project proposals under this section, the Secretary shall give preference to conservation projects that are designed to ensure effective, long-term conservation of freshwater mussels and their habitats.</text></paragraph>
<paragraph id="H5DE6754BE09A4AC4A52091FB4AD8C115"><enum>(4)</enum><header>Matching funds</header><text>In determining whether to approve project proposals under this section, the Secretary shall give preference to projects for which matching funds are available.</text></paragraph> <paragraph id="HC96724BAAA864802BEFAB228BFD5AFDF"><enum>(5)</enum><header>Waiver</header><text>The Secretary may waive the application of paragraphs (2), (3), and (4) with respect to a conservation project if the Secretary finds that such waiver is necessary to support a conservation project that the Secretary has identified as of high priority.</text></paragraph></subsection>
<subsection id="H2B725D07F9814836A4E28F3AD8322DC0"><enum>(f)</enum><header>Project reporting</header>
<paragraph id="HC69DA7D9D6464D988436A9516E6435A1"><enum>(1)</enum><header>In general</header><text>Each individual or entity that receives assistance under this section for a project shall submit to the Secretary periodic reports (at such intervals as the Secretary may require) that include all information that the Secretary, after consultation with other government officials, determines is necessary to evaluate the progress and success of such project for the purposes of ensuring positive results, assessing problems, and fostering improvements.</text></paragraph> <paragraph id="HA4F87352CB404F71B3BD7D1B21AC4532"><enum>(2)</enum><header>Availability to the public</header><text>Reports under paragraph (1), and any other documents relating to projects for which financial assistance is provided under this title, shall be made available to the public in a timely manner.</text></paragraph></subsection></section>
<section id="H693201E2434345D89381D9B97A63FAB7"><enum>305.</enum><header>Freshwater Mussels Conservation Fund</header>
<subsection id="HE8F8992CFD5A493FA35C95430EAD27CE"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury a separate account, to be known as the <quote>Freshwater Mussels Conservation Fund</quote>, consisting of—</text> <paragraph id="H49C8F307AE3443879CA4B760D3038469"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into the Fund under subsection (e);</text></paragraph>
<paragraph id="H289236163C5A4C6A8172C6F3562A0179"><enum>(2)</enum><text>amounts appropriated to the Fund under section 306; and</text></paragraph> <paragraph id="H6213F220AF0F421796A0EED82613D577"><enum>(3)</enum><text>any interest earned on investment of amounts in the Fund under subsection (c).</text></paragraph></subsection>
<subsection id="H789A5F902D5E4105ADB869B447E9F13C"><enum>(b)</enum><header>Expenditures from fund</header>
<paragraph id="HEC386DA435634CDE84AA5E87D07DFD00"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), at the request of the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to carry out section 304.</text></paragraph> <paragraph id="H626CA230112A48F885688654C9716652"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amounts in the account available for each fiscal year, the Secretary may expend not more than 3 percent, or up to $80,000, whichever is greater, to pay the administrative expenses necessary to carry out this title.</text></paragraph></subsection>
<subsection id="H315276326BAF4DA79C25E17AC7DC78E5"><enum>(c)</enum><header>Investment of amounts</header>
<paragraph id="HA6DFC4936BDC4585B522A5F1E0E5DF6C"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall invest such portion of the Fund as is not, in the judgment of the Secretary of the Treasury, required to meet current withdrawals. Investments may be made only in interest-bearing obligations of the United States.</text></paragraph> <paragraph id="H3E3DFDFC856945BF93C7ECCB1A063797"><enum>(2)</enum><header>Acquisition of obligations</header><text>For the purpose of investments under paragraph (1), obligations may be acquired—</text>
<subparagraph id="HE0127B229E634F3EB06FB90D4605CC26"><enum>(A)</enum><text>on original issue at the issue price; or</text></subparagraph> <subparagraph id="H335B7594E6B646E8B2D7205099B69A38"><enum>(B)</enum><text>by purchase of outstanding obligations at market price.</text></subparagraph></paragraph>
<paragraph id="HF7581331EE854BE885604AE049DD5A9E"><enum>(3)</enum><header>Sale of obligations</header><text>Any obligation acquired by the Fund may be sold by the Secretary of the Treasury at market price.</text></paragraph> <paragraph id="H5AE7B953E04D4F89AEA7890D826B3D23"><enum>(4)</enum><header>Credits to fund</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund.</text></paragraph></subsection>
<subsection id="H783A578B65A842129F1811CEEF3C8B22"><enum>(d)</enum><header>Transfers of amounts</header>
<paragraph id="H3F24BE81274942C79125FA239AE148ED"><enum>(1)</enum><header>In general</header><text>The amounts required to be transferred to the Fund under this section shall be transferred at least monthly from the general fund of the Treasury to the Fund on the basis of estimates made by the Secretary of the Treasury.</text></paragraph> <paragraph id="H0989710372A949D59637AF29440F68B7"><enum>(2)</enum><header>Adjustments</header><text>Proper adjustment shall be made in amounts subsequently transferred to the extent prior estimates were in excess of or less than the amounts required to be transferred.</text></paragraph></subsection>
<subsection id="HB83ADE2BFE674256B1D78EB2C80AB053"><enum>(e)</enum><header>Acceptance and use of donations</header>
<paragraph id="H4E408C437B794280880DE990A3E718FC"><enum>(1)</enum><header>In general</header><text>The Secretary may accept for the Government a gift of any of the following to provide assistance under section 304:</text> <subparagraph id="H2D3A7B28AEC0408FBD4CB6FE95F1DC88"><enum>(A)</enum><text>Money.</text></subparagraph>
<subparagraph id="H95F6D869BC1F4A14B12AF21884A6AEA9"><enum>(B)</enum><text>An obligation of the Government included in the public debt made only on the condition that the obligation be canceled and retired and not reissued.</text></subparagraph> <subparagraph id="HEE08C0105FAC41C4964C19A014C88A10"><enum>(C)</enum><text>Other intangible personal property made only on the condition that the property is sold on the best terms available and the proceeds are deposited in the Fund.</text></subparagraph></paragraph>
<paragraph id="HF310FE08754C44FA8E4DC127324BA19E"><enum>(2)</enum><header>Discretion to reject a gift</header><text>The Secretary may reject a gift under this section when the rejection is in the interest of the Government.</text></paragraph> <paragraph id="HD47B363C40494D98979DA24D319367F3"><enum>(3)</enum><header>Taxes</header><text>If a gift received under this subsection is subject to a gift or inheritance tax, the Secretary may pay the tax out of the proceeds of the gift or the proceeds of the redemption or sale of the gift.</text></paragraph></subsection></section>
<section id="HB84D42FA4C184A7FA20C0B25EE6FAE5C"><enum>306.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Secretary $5,000,000 for each of fiscal years 2022 through 2027 to carry out this title.</text></section> <section id="H3831CBACE9484B84B0024FC8E6228D42"><enum>307.</enum><header>Report to Congress</header><text display-inline="no-display-inline">The Secretary shall submit an annual report to Congress not later than January 31 of each year regarding the Fund and the status of freshwater mussels in the United States. Each such report shall include with respect to the year for which the report is submitted a description of—</text>
<paragraph id="HEC54DFDF7B8A4B17A4A9022906F5D8CF"><enum>(1)</enum><text>the total amounts deposited into and expended from the Fund;</text></paragraph> <paragraph id="HED69102CA67A47E6B437187CA5730E69"><enum>(2)</enum><text>the costs associated with the administration of the Fund;</text></paragraph>
<paragraph id="H36937195F5E64BB7ABFB53996E81D62C"><enum>(3)</enum><text>a summary of the projects for which the Secretary has provided assistance under section 304 and an evaluation of those projects; and</text></paragraph> <paragraph id="HA729F40BED314DE78DE56657B6EDB6F0"><enum>(4)</enum><text>an evaluation of the status of threatened and endangered freshwater mussel populations in the United States.</text></paragraph></section></title>
<title id="HA505E8B8A9A945A3B782822FA7F9ECBE"><enum>IV</enum><header>Southwest Desert Fish Conservation Fund Act of 2021</header>
<section id="HB63ACC5DBB524D54A40EEC4DE3658B6F"><enum>401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Southwest Desert Fish Conservation Fund Act of 2021</short-title></quote>.</text></section> <section id="HA191FA56429F4F859A1E779DD739A1DE"><enum>402.</enum><header>Purposes</header><text display-inline="no-display-inline">The purpose of this title is to assist in the conservation of threatened and endangered desert fish species and their habitats in the Southwest United States by supporting and providing financial resources for projects to conserve desert fish species, their habitats, and address other threats to the survival of desert fish species.</text></section>
<section id="H6A8D2848C9BD4B46A075EE4C7A344130"><enum>403.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H08626D0C27A24231921610FD81C1AABC"><enum>(1)</enum><header>Conservation</header><text>The term <quote>conservation</quote> means the use of all methods and procedures necessary to protect habitats of desert fish species in the Southwest and of the fish species in those habitats including—</text>
<subparagraph id="H4CA3F08CE6F4487B9810401A817894CA"><enum>(A)</enum><text>protection, restoration, and management of habitats;</text></subparagraph> <subparagraph id="H5A435006FCA4407FA410613F3BDEDD47"><enum>(B)</enum><text>onsite research and monitoring of populations, habitats, annual reproduction, and desert fish species population trends;</text></subparagraph>
<subparagraph id="H3105198A7CAF47A6B395A015BA8D7BA5"><enum>(C)</enum><text>assistance in the development, implementation, and improvement of national and regional management plans;</text></subparagraph> <subparagraph id="H6595DE7285CB4C049328C31C64694B99"><enum>(D)</enum><text>enforcement and implementation of applicable conservation laws; and</text></subparagraph>
<subparagraph id="H7D9020DDFC4B4373A64A476CDD44CCBB"><enum>(E)</enum><text>community outreach and education.</text></subparagraph></paragraph> <paragraph id="H9D4B20636B5B4BED87C877ABD6BDB56F"><enum>(2)</enum><header>Fund</header><text>The term <quote>Fund</quote> means the Southwest Desert Fish Conservation Fund established by section 405.</text></paragraph>
<paragraph id="HA8022B97837544CF951EA4704D9313FD"><enum>(3)</enum><header>Desert fish</header><text>The term <quote>desert fish</quote> means any member of the class Osteichthyes living in a desert ecosystem.</text></paragraph> <paragraph id="H282A41CA999F49D08E51E3CFE099A1E2"><enum>(4)</enum><header>Southwest</header><text>The term <quote>Southwest</quote> means the States of Arizona, California, Colorado, Nevada, New Mexico, and Utah.</text></paragraph>
<paragraph id="H3A43E26C480343C88F6FFBAC84D2C719"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph></section> <section id="HFB3F6AA94F5B4B2195042269FAD9C6CD"><enum>404.</enum><header>Southwest desert fish conservation assistance</header> <subsection id="H1A896D68280C43698D9AC724AA203FC4"><enum>(a)</enum><header>Assistance</header> <paragraph id="H8638ABFB3AF54FA388744C60B96C73EC"><enum>(1)</enum><header>In general</header><text>Subject to the availability of funds and in consultation with other Federal officials, the Secretary of Interior (in this title referred to as the <quote>Secretary</quote>) shall provide competitive financial assistance, including multiyear grants, for projects for the conservation of desert fish species in Southwest for which project proposals are approved by the Secretary in accordance with this section.</text></paragraph>

<subparagraph id="H66ED68709A5E40DF8FE1E187FECCE96B"><enum>(D)</enum><text>demonstrated sensitivity to local historic and cultural resources and compliance with applicable laws;</text></subparagraph> <subparagraph id="H4CFB996170DA4969942BC4D6597DDA1A"><enum>(E)</enum><text>assurances that the project will be implemented in consultation with relevant wildlife management authorities, Tribes, and other appropriate government officials;</text></subparagraph>
<subparagraph id="H60A37BA6A1EF4E4787F499A07476766D"><enum>(F)</enum><text>information that demonstrates the clear potential of the project to contribute to the conservation of desert fish populations in the Southwest;</text></subparagraph> <subparagraph id="H754DC97A2A0D47488C7296DA6DD8DE22"><enum>(G)</enum><text>information regarding the source and amount of matching funding available for the project; and</text></subparagraph>
<subparagraph id="H5F5C64FF00B14E6EBA4E481F8EC9A2FE"><enum>(H)</enum><text>such other information as the Secretary may require.</text></subparagraph></paragraph></subsection> <subsection id="HA6663AB0EFB14FCDB564E8EAFB4219D4"><enum>(c)</enum><header>Project review and approval</header> <paragraph id="HE824B1F788574FE18A119C918603FCF8"><enum>(1)</enum><header>In general</header><text>The Secretary shall annually—</text>
<subparagraph id="H52D3A1A6B42847B7932FDCE12E0F3B54"><enum>(A)</enum><text>solicit project proposals for grants under this section;</text></subparagraph> <subparagraph id="H6784384734074C99B19B1A948007E79D"><enum>(B)</enum><text>provide to other Federal officials, as appropriate, copies of each proposal submitted in response to the solicitation; and</text></subparagraph>
<subparagraph id="HB808C49081F9460C81C16FAE734B9645"><enum>(C)</enum><text>review each such proposal on a timeline that recognizes the urgency of the declining number of desert fish species in the Southwest to determine whether the proposal meets the criteria specified in subsection (d).</text></subparagraph></paragraph> <paragraph id="H5BFE874F8DBC470AB6DA0DA287A341F1"><enum>(2)</enum><header>Consultation; approval or disapproval</header><text>Subject to the availability of funds, the Secretary shall, with respect to each project proposal submitted under this section, and after consulting with other Federal officials, as appropriate—</text>
<subparagraph id="H8E968EDC15BA466084DF2585E570807E"><enum>(A)</enum><text>consult with respect to the proposal with the government of each State and foreign country in which the project is to be conducted; and</text></subparagraph> <subparagraph id="HF92254309EFD4877AB60783A49699E37"><enum>(B)</enum><text>provide written notification of the approval or disapproval to the individual or entity that submitted the proposal, such other Federal officials, and each State and foreign country described in subparagraph (A).</text></subparagraph></paragraph></subsection>
<subsection id="HCCC2DFBCF8A146C98121298826982E0B"><enum>(d)</enum><header>Criteria for approval</header><text>The Secretary may approve a project proposal under this section if the project shows promise for contributing to recovering and sustaining desert fish populations in the Southwest in the wild.</text> <paragraph id="H685968710E7642C09E17EB1B0A3412FA"><enum>(1)</enum><header>Priority</header><text>In selecting projects for assistance, the Secretary shall give preference to projects that conserve threatened and endangered species protected by the Endangered Species Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph>
<paragraph id="H674199A6BA644781BD77F17661F4DE1A"><enum>(2)</enum><header>Project sustainability</header><text>To the maximum extent practicable, in determining whether to approve project proposals under this section, the Secretary shall give preference to conservation projects that are designed to ensure effective, long-term conservation of desert fish and their habitats.</text></paragraph> <paragraph id="H0AC58DB116444BAFA730C0C025A8FC97"><enum>(3)</enum><header>Matching funds</header><text>In determining whether to approve project proposals under this section, the Secretary shall give preference to projects for which matching funds are available.</text></paragraph>
<paragraph id="H2335642D704140B1A09F8FA0A388236A"><enum>(4)</enum><header>Waiver</header><text>The Secretary may waive the application of paragraph (2), (3), and (4) if the Secretary finds that such waiver is necessary to support a conservation project that the Secretary has identified as of high priority.</text></paragraph></subsection> <subsection id="HF4B223832F6745D994DDDCC8A540E316"><enum>(e)</enum><header>Project reporting</header> <paragraph id="H5299B04E5B8749908FF4F1FF2C501792"><enum>(1)</enum><header>In general</header><text>Each individual or entity that receives assistance under this section for a project shall submit to the Secretary periodic reports (at such intervals as the Secretary may require) that include all information that the Secretary, after consultation with other government officials, determines is necessary to evaluate the progress and success of such project for the purposes of ensuring positive results, assessing problems, and fostering improvements.</text></paragraph>
<paragraph id="H2A1A486A32724E039C10522D9CEA1CD1"><enum>(2)</enum><header>Availability to the public</header><text>Reports under paragraph (1), and any other documents relating to projects for which financial assistance is provided under this title, shall be made available to the public in a timely manner.</text></paragraph></subsection></section> <section id="HCCE40FF7423C465F9632EC7D6533D82B"><enum>405.</enum><header>Southwest Desert Fish Conservation Fund</header> <subsection id="H911A1BCDEF264BF482FE619862F71055"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury a separate account, to be known as the <quote>Southwest Desert Fish Conservation Fund</quote>, consisting of—</text>
<paragraph id="H6B0314079E2442F3A36520FA55857B15"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into the Fund under subsection (e);</text></paragraph> <paragraph id="H80AEF489041D4CDB99C49616A8A68B10"><enum>(2)</enum><text>amounts appropriated to the Fund under section 406; and</text></paragraph>
<paragraph id="HF85CA594D2314719A139CBD1B17F95B7"><enum>(3)</enum><text>any interest earned on investment of amounts in the Fund under subsection (c).</text></paragraph></subsection> <subsection id="H8C0B3C63FE6D4CA8BEB48939A9CEECC1"><enum>(b)</enum><header>Expenditures from fund</header> <paragraph id="H7E5DF07E797A48128107A735B2488FC0"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), at the request of the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to carry out section 404.</text></paragraph>
<paragraph id="H3164FE3805BE4D8BB38BE57534EB09CF"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amounts in the account available for each fiscal year, the Secretary may expend not more than 3 percent, or up to $80,000, whichever is greater, to pay the administrative expenses necessary to carry out this title.</text></paragraph></subsection> <subsection id="H343D671AA140415C95A2B7217F6C28AE"><enum>(c)</enum><header>Investment of amounts</header> <paragraph id="H70F5AD6B38564BE3B8C8AB7D0A99D5D3"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall invest such portion of the Fund as is not, in the judgment of the Secretary of the Treasury, required to meet current withdrawals. Investments may be made only in interest-bearing obligations of the United States.</text></paragraph>
<paragraph id="HD9C58EEAF05C4AD3B0C8443A2EA38B7C"><enum>(2)</enum><header>Acquisition of obligations</header><text>For the purpose of investments under paragraph (1), obligations may be acquired—</text> <subparagraph id="H0F4AFD4FBD6E4D4F925F8AD291075D8A"><enum>(A)</enum><text>on original issue at the issue price; or</text></subparagraph>
<subparagraph id="H40BE39ABA642432F8096D1657ADCD66F"><enum>(B)</enum><text>by purchase of outstanding obligations at market price.</text></subparagraph></paragraph> <paragraph id="HC4378D186F524965B1830B8FC5F7BDE0"><enum>(3)</enum><header>Sale of obligations</header><text>Any obligation acquired by the Fund may be sold by the Secretary of the Treasury at market price.</text></paragraph>
<paragraph id="HB8F3B50B74184EE0B1C9F1F07C351CBC"><enum>(4)</enum><header>Credits to fund</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund.</text></paragraph></subsection> <subsection id="H0B79E039A74A44B7987AE12435EE06E9"><enum>(d)</enum><header>Transfers of amounts</header> <paragraph id="H6B2D5CF1235C49148D08AF527AC4E6AA"><enum>(1)</enum><header>In general</header><text>The amounts required to be transferred to the Fund under this section shall be transferred at least monthly from the general fund of the Treasury to the Fund on the basis of estimates made by the Secretary of the Treasury.</text></paragraph>
<paragraph id="H3E95F39C85844E28A4CF263B90E313B6"><enum>(2)</enum><header>Adjustments</header><text>Proper adjustment shall be made in amounts subsequently transferred to the extent prior estimates were in excess of or less than the amounts required to be transferred.</text></paragraph></subsection> <subsection id="HD079E1BFDBE348FDBCA8C994AF78D9D9"><enum>(e)</enum><header>Acceptance and use of donations</header> <paragraph id="H6147689A5BA64C0D880985491113CE80"><enum>(1)</enum><header>In general</header><text>The Secretary may accept for the Government a gift of any of the following to provide assistance under section 404:</text>
<subparagraph id="HA20566D331114935BD2AF997457C56BD"><enum>(A)</enum><text>Money.</text></subparagraph> <subparagraph id="H4A3102E0CF214A2A9676314F59E182BC"><enum>(B)</enum><text>An obligation of the Government included in the public debt made only on the condition that the obligation be canceled and retired and not reissued.</text></subparagraph>
<subparagraph id="H5933069AA44F41549274CDBBB3266155"><enum>(C)</enum><text>Other intangible personal property made only on the condition that the property is sold on the best terms available and the proceeds are deposited in the Fund.</text></subparagraph></paragraph> <paragraph id="H5A711167ABD341F48F3F8A93DC438A9C"><enum>(2)</enum><header>Discretion to reject a gift</header><text>The Secretary may reject a gift under this section when the rejection is in the interest of the Government.</text></paragraph>
<paragraph id="HB4A720A0A76B4105841D435930E0269A"><enum>(3)</enum><header>Taxes</header><text>If a gift received under this subsection is subject to a gift or inheritance tax, the Secretary may pay the tax out of the proceeds of the gift or the proceeds of the redemption or sale of the gift.</text></paragraph></subsection></section> <section id="HD90EF21A187C4DBBAB7172B8E5054770"><enum>406.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Secretary $5,000,000 for each of fiscal years 2022 through 2027 to carry out this title.</text></section>
<section id="HEB094AC48C4F41D3814839C0EFB9AE38"><enum>407.</enum><header>Report to Congress</header><text display-inline="no-display-inline">The Secretary shall submit an annual report to Congress not later than January 31 of each year regarding the Fund and the status of desert fish in the Southwest. Each such report shall include with respect to the year for which the report is submitted a description of—</text> <paragraph id="HA6B6DDE535154FF3AE08879CD72DD113"><enum>(1)</enum><text>the total amounts deposited into and expended from the Fund;</text></paragraph>
<paragraph id="H71FFAE871FE84BA6B5CB52DD2F45A13F"><enum>(2)</enum><text>the costs associated with the administration of the Fund;</text></paragraph> <paragraph id="H8D46E18063AC40EDA0403215D92FB3B3"><enum>(3)</enum><text>a summary of the projects for which the Secretary has provided assistance under section 404 and an evaluation of those projects; and</text></paragraph>
<paragraph id="H54B273C89A9A47BEA59B4682AC0A6271"><enum>(4)</enum><text>an evaluation of the status of threatened and endangered desert fish populations in the Southwest.</text></paragraph></section></title> </legis-body> </bill>
