Judiciary</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To waive the requirement to undergo a medical exam for aliens who are otherwise eligible for special immigrant status under the Afghan Allies Protection Act of 2009, and for other purposes.</official-title></form><legis-body id="HD0C7A62EFADC4E26AD8CC82C6CC0A0DE" style="OLC"><section id="HEAC38976CCC9479D9C9B60AF759BDDFA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Honoring Our Promises through Expedition for Afghan SIVs Act of 2021</short-title></quote> or the <quote><short-title>HOPE for Afghan SIVs Act of 2021</short-title></quote>.</text></section><section id="HF0951F3BA2154A85967264B0CCA655F4"><enum>2.</enum><header>Waiver of medical examination for afghan allies</header><subsection id="H9A1A4D94A5EE4A85BF05F355EF3012CA"><enum>(a)</enum><header>Authorization</header><text>The Secretary of State and the Secretary of Homeland Security may jointly issue a blanket waiver of the requirement that aliens described in section 602(b)(2) of the Afghan Allies Protection Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note) undergo a medical examination under section 221(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(d)</external-xref>), or any other applicable provision of law, prior to issuance of an immigrant visa or admission to the United States.</text></subsection><subsection id="HAD5440D958924056B5EDC6841DB11F1B"><enum>(b)</enum><header>Duration</header><text>A waiver issued under subsection (a) shall remain in effect for a period not to exceed 1 year, and, subject to subsection (g), may be extended by the Secretary of State and Secretary of Homeland Security for additional periods, each of which shall not exceed 1 year.</text></subsection><subsection id="HEF4C322760134393861CE88B137637D2"><enum>(c)</enum><header>Notification</header><text>Upon exercising the waiver authority under subsection (a), or the authority to extend a waiver under subsection (b), the Secretary of State and the Secretary of Homeland Security shall notify the appropriate congressional committees.</text></subsection><subsection id="HC032119766954223997DFAAC8156E4C3"><enum>(d)</enum><header>Requirement for medical examination after admission</header><paragraph id="H4CDD8B36EAC84567818CCD5E5A416DDE"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security, in consultation with the Secretary of Health and Human Services, shall establish procedures to ensure, to the greatest extent practicable, that any alien who receives a waiver of the medical examination requirement under this section, completes such an examination not later than 30 days after the date on which such alien is admitted to the United States.</text></paragraph><paragraph id="H07BC87B9282A48A499E8B978A4CDF6E3"><enum>(2)</enum><header>Conditional basis for status</header><subparagraph id="H92E314FAE28C4EBD8F21660C3D08BAE3"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, an alien who receives a waiver of the medical examination requirement under this section shall be considered, at the time of admission to the United States, as an alien lawfully admitted for permanent residence on a conditional basis.</text></subparagraph><subparagraph id="H9CEC42A8F1034B5B87CD1A488704ABAF"><enum>(B)</enum><header>Removal of conditions</header><text>The Secretary of Homeland Security shall remove the conditional basis of the alien’s status upon the Secretary’s confirmation that such alien has completed the medical examination and is not inadmissible under section 212(a)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(1)(A)</external-xref>).</text></subparagraph></paragraph><paragraph id="H38D77E8C05BA4FAB8148B62D3998CB74"><enum>(3)</enum><header>Report</header><text>Not later than one year after the date on which waiver authority under subsection (a) is exercised or such waiver is extended under subsection (b), as applicable, the Secretary of Homeland Security, in consultation with the Secretary of Health and Human Services, shall submit to the appropriate congressional committees a report on the status of medical examinations required under paragraph (1), including—</text><subparagraph id="H78F359515E154BF9AA7781F7E2C128A9"><enum>(A)</enum><text>the number of pending and completed examinations; and</text></subparagraph><subparagraph id="H5B80B051AB5E4D44AD4982EFFFA97719"><enum>(B)</enum><text display-inline="yes-display-inline">the number of aliens who have failed to complete the medical examination within the 30-day period after the date of such aliens’ admission.</text></subparagraph></paragraph></subsection><subsection id="H052B3FEA2F6E4C018D8BCDC0D3AACFF4"><enum>(e)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><paragraph id="H7A010217B1344E8D94D6ABD6B2A9F01E"><enum>(1)</enum><text>the Committees on Armed Services of the House of Representatives and of the Senate;</text></paragraph><paragraph id="HF74723E228D44A6FA05B7BD4CC5AB891"><enum>(2)</enum><text>the Committees on the Judiciary of the House of Representatives and of the Senate;</text></paragraph><paragraph id="HD360ECA6E82040FD89118DBF8920A56A"><enum>(3)</enum><text>the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate; and</text></paragraph><paragraph id="H09CE3AE420424B5EAF38156C95FBDE43"><enum>(4)</enum><text>the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text></paragraph></subsection><subsection id="HFA50EA8C1557432A8B21105407FB4026"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this Act may be construed to prevent the Secretary of State, the Secretary of Homeland Security, the Secretary of Defense, or the Secretary of Health and Human Services from adopting appropriate measures to prevent the spread of communicable diseases, including COVID–19, to the United States.</text></subsection><subsection id="H1433D88365BA47BCAB2710C85AC02D45"><enum>(g)</enum><header>Sunset</header><text>The authority under subsections (a) and (b) expires on the date that is 3 years after the date of enactment of this Act.</text></subsection></section><section id="H2FBE751D858044E69B486EB659CC326D"><enum>3.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body><attestation><attestation-group><attestation-date date="20210629" chamber="House">Passed the House of Representatives June 29,
