committee-id="HIG00">Intelligence</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Central Intelligence Agency Act of 1949 to authorize the provision of payment to personnel of the Central Intelligence Agency who incur qualifying injuries to the brain, to authorize the provision of payment to personnel of the Department of State who incur similar injuries, and for other purposes.</official-title></form><legis-body id="H3166347FDBDC41C6B04DC02ADCF53CD5" style="OLC"><section id="HFED1D11BE39F4D06A96822AC07351B33" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping American Victims Afflicted by Neurological Attacks Act of 2021</short-title></quote> or the <quote><short-title>HAVANA Act of 2021</short-title></quote>.</text></section><section id="H0FC8F67714C64A6080373DB3173FC22B" section-type="subsequent-section"><enum>2.</enum><header>Authority to pay personnel of Central Intelligence Agency for certain injuries to the brain</header><subsection id="HD3A085B4B9A5491DB70063214D7014B4"><enum>(a)</enum><header>Payment authorized</header><text>Section 19A of the Central Intelligence Agency Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/50/3519b">50 U.S.C. 3519b</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7B9E07393F3F4AC9B58222C7631A912C"><subsection id="H861EC7C3C4424B4AAE2ACAE32C7E45B5"><enum>(d)</enum><header>Authority To make payments for qualifying injuries to the brain</header><paragraph id="HA47863A73E7640849B948D0CAC08D354"><enum>(1)</enum><header>Authority</header><text>Notwithstanding any other provision of law, but subject to paragraph (2), the Director may provide payment to a covered dependent, a covered employee, and a covered individual for a qualifying injury to the brain.</text></paragraph><paragraph id="HA3322A47F4B9408987A189974F6A702E" commented="no"><enum>(2)</enum><header>Limitations</header><subparagraph id="H740DF50569A348AE91FD72973B8839D3" commented="no"><enum>(A)</enum><header>Appropriations required</header><text>Payment under paragraph (1) in a fiscal year may only be made using amounts appropriated in advance specifically for payments under such paragraph in such fiscal year.</text></subparagraph><subparagraph id="H27AE03297A554E7DA5D1872CC781AFF7" commented="no"><enum>(B)</enum><header>Matter of payments</header><text>Payments under paragraph (1) using amounts appropriated for such purpose shall be made either in the order in which claims for such payments are filed or on a pro-rata basis.</text></subparagraph><subparagraph id="HAD231321BC4B4B9295CE8558D962E93B" commented="no"><enum>(C)</enum><header>Amounts of payments</header><text>The total amount of funding obligated for payments under paragraph (1) may not exceed the amount specifically appropriated for providing payments under such paragraph during its period of availability.</text></subparagraph><subparagraph id="H2F63F6E84FD74830B1460C11EC5EE49D"><enum>(D)</enum><header>Frequency of payments</header><text>The Director may make payments under paragraph (1) in a lump sum payment or through multiple payments, including, subject to subparagraph (A), payments occurring in more than one year.</text></subparagraph></paragraph><paragraph id="H10F3D862FAC647BFB687D85791502673"><enum>(3)</enum><header>Regulations</header><subparagraph id="HFB7D6BEC8639478A876329778319AA18"><enum>(A)</enum><header>In general</header><text>The Director shall prescribe regulations to carry out this subsection.</text></subparagraph><subparagraph id="HE5121BB0ABC04A749847C264EB34D406"><enum>(B)</enum><header>Elements</header><text display-inline="yes-display-inline">The regulations prescribed under subparagraph (A) shall be consistent with this subsection and section 2 of the HAVANA Act of 2021, and include regulations detailing fair and equitable criteria for payment under paragraph (1).</text></subparagraph></paragraph><paragraph id="HF7C4C21844F748E491105AB5071D8EFA"><enum>(4)</enum><header>No effect on other benefits</header><text display-inline="yes-display-inline">Payments made under paragraph (1) are supplemental to any other benefit furnished by the United States Government for which a covered dependent, covered employee, or covered individual is entitled, and the receipt of such payments may not affect the eligibility of such a person to any other benefit furnished by the United States Government.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H83AB2EE2FE1E4254AD2A5590C4655EC1"><enum>(b)</enum><header>Applicability</header><text>Payment under subsection (d) of such section, as added by subsection (a) of this section, may be made available for a qualifying injury to the brain that occurs before, on, or after the date of the enactment of this Act, as the Director of the Central Intelligence Agency considers appropriate.</text></subsection><subsection id="H52642D3F7E994D9F828374C3B666B850"><enum>(c)</enum><header>Clarifying amendment</header><text>Section 19A(b) of the Central Intelligence Agency Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/50/3519b">50 U.S.C. 3519b(b)</external-xref>) is amended, in the subsection heading, by inserting <quote><header-in-text style="OLC" level="subsection">total disability resulting from</header-in-text></quote> before <quote><header-in-text style="OLC" level="subsection">certain injuries</header-in-text></quote>.</text></subsection><subsection id="H60446088825549A7B68B9E98210D9788"><enum>(d)</enum><header>Reports</header><paragraph id="HA28011EE249B447ABB3162EC42C18B4F"><enum>(1)</enum><header>Report on use of authority</header><subparagraph id="H5B4999367EF0405692D8CA0E48F78BE7"><enum>(A)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the Director of the Central Intelligence Agency shall submit to the appropriate congressional committees a report on the use of the authority provided by section 19A(d) of such Act, as added by subsection (a) of this section.</text></subparagraph><subparagraph id="H355316A23B8541739A790181933A8BDB"><enum>(B)</enum><header>Contents</header><text>The report submitted under subparagraph (A) shall include the following:</text><clause id="H0859EB2547424963A8992C4ED2073776"><enum>(i)</enum><text>A budget or spend plan for the use of the authority described in subparagraph (A) for the subsequent fiscal year.</text></clause><clause id="HF19DC2F2388C484395B0E9FC0869DEC9"><enum>(ii)</enum><text>Information relating to the use of the authority described in subparagraph (A) for the preceding year, including the following:</text><subclause id="HDD8AA7E642574739AC2E76CCCB7CCC6F"><enum>(I)</enum><text>The total amount expended.</text></subclause><subclause id="H555F433AEAA24BD8847F8E57721FCC18"><enum>(II)</enum><text>The number of covered dependents, covered employees, and covered individuals for whom payments were made.</text></subclause><subclause id="HF446C73C18554162B83A25CFCFD9FA89"><enum>(III)</enum><text>The amounts that were provided to each person described in subclause (II).</text></subclause></clause><clause id="H8F4F0D7D5F9A42CDB9570222F7F5A55C"><enum>(iii)</enum><text> An assessment of whether additional authorities are required to ensure that covered dependents, covered employees, and covered individuals can receive payments for qualifying injuries, such as a qualifying injury to the back or heart.</text></clause></subparagraph><subparagraph id="HDF7C4BEDAC074107BF12FBFCE93A3ACA"><enum>(C)</enum><header>Form</header><text>The report submitted under subparagraph (A) shall be submitted in classified form.</text></subparagraph></paragraph><paragraph id="H794CBD47B6164D1E987ECD1308074685"><enum>(2)</enum><header>Report on estimated costs for fiscal year 2023</header><text>Not later than March 1, 2022, the Director shall submit to the appropriate congressional committees a report detailing an estimate of the obligation that the Director expects to incur in providing payment under section 19A(d) of such Act, as added by subsection (a) of this section, in fiscal year 2023.</text></paragraph><paragraph id="H88C53D9C1EED4DF688E0EDEE2CF1E3EF"><enum>(3)</enum><header>Report on feasibility of modifications to program</header><text display-inline="yes-display-inline">Not later than 270 days after the date of the enactment of this Act, the Director shall submit to the appropriate congressional committees a report on the feasibility of the Central Intelligence Agency adopting a disability benefits program similar to the disability benefits program of the Department of Defense.</text></paragraph></subsection><subsection id="H52D0BBA96AD14E2391DD159685B945F5"><enum>(e)</enum><header>Regulations</header><paragraph id="H6E298CED90A74957BE655375D0D7F412"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Director shall prescribe regulations required under section 19A(d)(3)(A) of such Act, as added by subsection (a) of this section.</text></paragraph><paragraph id="H21A1792929A744F29EA3C997F50C9A42"><enum>(2)</enum><header>Notice to Congress</header><text>Not later than 210 days after the date of the enactment of this Act, the Director shall submit to the appropriate congressional committees the regulations prescribed in accordance with paragraph (1).</text></paragraph></subsection><subsection id="H9EBDC962D4D647569E57F0764A381F50"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3DF0E47A1A9C45FAAA09CAA75528F946"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> mean—</text><subparagraph id="H26C6B78241424BF69C6A4DA00A8529D7"><enum>(A)</enum><text>the congressional intelligence committees (as that term is defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)); and</text></subparagraph><subparagraph id="HE1B04D24BF2740B6AB01F0DFD1AF401F"><enum>(B)</enum><text>the Committees on Appropriations of the Senate and the House of Representatives.</text></subparagraph></paragraph><paragraph id="H5922D9D7823F4922A2DA6CC5BF715A09" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Covered dependent, covered employee, covered individual, and qualifying injury</header><text>The terms <term>covered dependent</term>, <term>covered employee</term>, <term>covered individual</term>, and <term>qualifying injury</term> have the meanings given such terms in section 19A(a) of the Central Intelligence Agency Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/50/3519b">50 U.S.C. 3519b(a)</external-xref>).</text></paragraph></subsection></section><section id="H8D160BC6B8924A56AB5915572B9905CA" section-type="subsequent-section"><enum>3.</enum><header>Authority to pay personnel of Department of State for certain injuries to the brain</header><subsection id="H41F9BA383A7745C6A112D68909095EB0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 901 of title IX of division J of the Further Consolidated Appropriations Act, 2020 (<external-xref legal-doc="usc" parsable-cite="usc/22/2680b">22 U.S.C. 2680b</external-xref>) is amended—</text><paragraph id="HEE9502EB636B4CC78F3F402EC083A432"><enum>(1)</enum><text>in subsection (f), by striking <quote>subsection (a) or (b)</quote> both places it appears and inserting <quote>subsection (a), (b), or (i)</quote>; and</text></paragraph><paragraph id="HB53CB2F0EB674C368F9C9EF732E01C9D"><enum>(2)</enum><text>in subsection (h)—</text><subparagraph id="H9A770CB43EA44CE69C4965CE66E41382"><enum>(A)</enum><text>in paragraph (1), by striking <quote><header-in-text style="OLC" level="paragraph">In general</header-in-text>.—This section</quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Adjustment of compensation provision</header-in-text>.—Subsections (a) and (b)</quote>; </text></subparagraph><subparagraph id="HB0FE1AF68CB04AFDB7A60EDBEED4F393"><enum>(B)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></subparagraph><subparagraph id="H868111F470964233AEBBB7F34055F2D2"><enum>(C)</enum><text>by inserting after paragraph (1) the following new paragraph:</text><quoted-block id="HBD522D09F9DE4829B398F566ADE50A73" style="OLC" act-name=""><paragraph id="HC8277EB3E7FD477EB9502E1590325342"><enum>(2)</enum><header>Other payment provision</header><text>Payment under subsection (i) may be made available for a qualifying injury that occurs before, on, or after the date of the enactment of the HAVANA Act of 2021.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB8FC541230484F2A90E5FB164AF00FAB"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block id="H18A9C3D3DC6742BAAD798C34F2C3C4F2" display-inline="no-display-inline" style="OLC" act-name=""><subsection id="HB24EFBA43C3C4AE198F434EF51BB749F"><enum>(i)</enum><header>Other injuries</header><paragraph id="H3A41A60D336D470E9FF0D256F7CB9DD1"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, but subject to paragraph (2), the Secretary of State or other agency head with an employee abroad may provide payment to a covered dependent, a dependent of a former employee, a covered employee, a former employee, and a covered individual for a qualifying injury to the brain.</text></paragraph><paragraph id="H6D7D3CD6C226412E9C391C852319D56F" commented="no"><enum>(2)</enum><header>Limitations</header><subparagraph id="H158C1FAB1EA94A9EAFB9E12800DC1260" commented="no"><enum>(A)</enum><header>Appropriations required</header><text>Payment under paragraph (1) in a fiscal year may only be made using amounts appropriated in advance specifically for payments under such paragraph in such fiscal year.</text></subparagraph><subparagraph id="H414D816281EC46248F489CEAE3E7F69A" commented="no"><enum>(B)</enum><header>Matter of payments</header><text display-inline="yes-display-inline">Payments under paragraph (1) using amounts appropriated for such purpose shall be made either in the order in which claims for such payments are filed or on a pro-rata basis.</text></subparagraph><subparagraph or other agency head described in paragraph (1) that provides payment under such paragraph shall prescribe regulations to carry out this subsection.</text></subparagraph><subparagraph authority</header><subparagraph id="HD6E66BE7B1AD483089DF95366A62154F"><enum>(A)</enum><header>In general</header><text>Not later than 365 days after the date of the enactment of this Act, the Secretary of State and each other agency head that makes a payment under subsection (i) of section 901 of title IX of division J of the Further Consolidated Appropriations Act, 2020 (<external-xref legal-doc="usc" parsable-cite="usc/22/2680b">22 U.S.C. 2680b</external-xref>), as added by subsection (a) of this section, shall submit to the appropriate congressional committees a report on the use of the authority provided by such subsection (i).</text></subparagraph><subparagraph id="HAA3D5BAFFAEE4644895B11648DAE5657"><enum>(B)</enum><header>Contents</header><text>Each report submitted under subparagraph (A) shall include the following:</text><clause id="H3E9E99F953164130B249EB55C86CC17D"><enum>(i)</enum><text>A budget or spend plan for the use of the authority described in subparagraph (A) for the subsequent fiscal year.</text></clause><clause id="H0A4BED5184D34D60927A32F6ED61F6A5"><enum>(ii)</enum><text>Information relating to the use of the authority described in subparagraph (A) days after the date of the enactment of this Act, the Secretary of State and each other agency head that makes a payment under subsection (i)(1) of section 901 of title IX of division J of the Further Consolidated Appropriations Act, 2020 (<external-xref legal-doc="usc" parsable-cite="usc/22/2680b">22 U.S.C. 2680b</external-xref>), as added by subsection (a) of this section, shall prescribe regulations required under subsection (i)(3)(A) of such Act.</text></paragraph><paragraph id="H54B95E673249408ABB462C094827E55B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Notice to Congress</header><text>Not later than 210 days after the date of the enactment of this Act, the Secretary of State and the agency heads described in paragraph (1) shall submit to the appropriate congressional committees the regulations prescribed in accordance with paragraph (1).</text></paragraph></subsection><subsection id="HF0AC85E7864F4AE1B7DD87500BDEC18B"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H1CC28F325E5F4A7CB92BA7CF73B465F6"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="HB05C8E4958EE4D9D82114436C4B69437"><enum>(A)</enum><text>the Committee on Foreign Relations and the Committee on Appropriations of the Senate; and</text></subparagraph><subparagraph id="HFB7B8833EA784F48A608B7B615437C45" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the Committee on Foreign Affairs and the Committee on Appropriations of the House of Representatives.</text></subparagraph></paragraph><paragraph id="HB84D01496BB44E81A6D2BDFA9337C787" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Covered dependent, covered employee, covered individual, and qualifying injury</header><text>The terms <term>covered dependent</term>, <term>covered employee</term>, <term>covered individual</term>, and <term>qualifying injury</term> have the meanings given such terms in section 901(e) of title IX of division J of the Further Consolidated Appropriations Act, 2020 (<external-xref legal-doc="usc"
