which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Horse Protection Act to prohibit the shipping, transporting, moving, delivering, receiving, possessing, purchasing, selling, or donation of horses and other equines to be slaughtered for human consumption, and for other purposes.</official-title></form><legis-body id="H33238B63DF70404DA9BE99F5CF992407" style="OLC"><section id="H954A5C3AAD854BD19E03615335DC117E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Save America’s Forgotten Equines Act of 2021</short-title></quote> or the <quote><short-title>SAFE Act of 2021</short-title></quote>. </text></section><section id="HC2D08BF77988417792EBC478460CB119"><enum>2.</enum><header>Prohibition on shipping, transporting, moving, delivering, receiving, possessing, purchasing, selling, or donation of horses and other equines for slaughter for human consumption</header><subsection id="H45DEEE54A1414523882187AC366AB5C6"><enum>(a)</enum><header>Definitions</header><text>Section 2 of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1821">15 U.S.C. 1821</external-xref>) is amended—</text><paragraph id="HE5561FDB926C49D3AF9D70E45D4DCB35"><enum>(1)</enum><text>by redesignating paragraphs (1) and (4) as paragraphs (2), and (5), respectively;</text></paragraph><paragraph id="H12950D5CA7D740CBAE4EF86437E2A305"><enum>(2)</enum><text>by inserting before paragraph (2), as so redesignated, the following new paragraph:</text><quoted-block id="HB0AC8170A1A54B4D9FAE58E8958972F8" style="OLC"><paragraph id="H98646EFA5F054A53BC0B3C9EBAC87C3D" indent="up1"><enum>(1)</enum><text>The term <quote>human consumption</quote> means ingestion by people as a source of food.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8629B494351242ACADD667EFDB9B615D"><enum>(3)</enum><text>by inserting after paragraph (3), as so redesignated, the following new paragraph:</text><quoted-block id="HB7E0FB47D8C44869ACD027634DEB91DA" style="OLC"><paragraph id="H473879E902A24973BE98EDA5B83F936A" indent="up1"><enum>(4)</enum><text>The term <quote>slaughter</quote> means the killing of one or more horses or other equines with the intent to sell or trade the flesh of such horses or equines for human consumption.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3669515AEA6A4C25809E6C0FB5DA9CE8"><enum>(b)</enum><header>Findings</header><text>Section 3 of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1822">15 U.S.C. 1822</external-xref>) is amended—</text><paragraph id="H358EFA88D218405E84F9EAFD276F6EC9"><enum>(1)</enum><text>by redesignating paragraphs (1) through (5) as paragraphs (6) through (10), respectively;</text></paragraph><paragraph id="H68F51203A96D4153BE3113118531F69F"><enum>(2)</enum><text>by inserting before paragraph (6), as so redesignated, the following new paragraphs:</text><quoted-block id="H33C60B7D6579417B80608D831B3B2BD7" style="OLC"><paragraph id="H1E697C7627604294812A1276F46A567F"><enum>(1)</enum><text>horses and other equines play a vital role in the collective experience of the United States and deserve protection and compassion;</text></paragraph><paragraph id="H58010D3E14234C249F4DE8476FB555FD"><enum>(2)</enum><text>horses and other equines are domestic animals that are used primarily for recreation, pleasure, work, and sport;</text></paragraph><paragraph id="HE0F707BE9BBF45D79EEC52D65D1B7B4A"><enum>(3)</enum><text>unlike cows, pigs, and many other animals, horses and other equines are not raised for the purpose of being slaughtered for human consumption;</text></paragraph><paragraph id="H933C9388A5C24D62A8F8BFBBC732F038"><enum>(4)</enum><text>individuals selling horses or other equines at auctions are seldom aware that the animals may be bought for the purpose of being slaughtered for human consumption;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HC85C4817FAD14DE6B85179AF4FB268BE"><enum>(3)</enum><text>by striking paragraph (8), as so redesignated, and inserting the following new paragraph:</text><quoted-block id="H77F2DC7F4B254B5FACB03968C8AC36FE" style="OLC"><paragraph id="H462FC9243DF94A37A7B63312018FF80F"><enum>(8)</enum><text>the shipping, transporting, moving, delivering, receiving, possessing, purchasing, selling, or donation in intrastate commerce of horses and other equines to be slaughtered for human consumption, adversely affects and burdens interstate and foreign commerce;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8FF7B9AEB7EE4CA4A6EF014F91DC5DA3"><enum>(c)</enum><header>Prohibition</header><text>Section 5 of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1824">15 U.S.C. 1824</external-xref>) is amended—</text><paragraph id="H983043D302F546B08C3D982B731F34A3"><enum>(1)</enum><text>by redesignating paragraphs (8) through (11) as paragraphs (9) through (12), respectively; and</text></paragraph><paragraph id="HA3753BE591864CDBB02F340BEE9236D5"><enum>(2)</enum><text>by inserting after paragraph (7) the following new paragraph:</text><quoted-block id="H1D25F19F4A6442CE8215EE63D124D8B9" style="OLC"><paragraph id="HD156FFDFF5AA4E0FBF26A1A98ED8BF4C"><enum>(8)</enum><text>The shipping, transporting, moving, delivering, receiving, possessing, purchasing, selling, or donation by a person of any horse or other equine that the person has reason to believe will be slaughtered for human consumption.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
